00:08:49.000 travel, that is, travel of citizens or people between the states is prohibited.
00:08:54.000 That would be almost impossible to impose, especially in regions of the country like New England, where states are very close to one another.

00:09:04.000 It's easy for me to be back in and out of the city, or even out of New Jersey, or Massachusetts, or Rhode Island, from where I live.

00:09:16.000 We don't have tolls, there aren't border checkpoints, so it's really hard to know what that would mean as a matter of law.
00:09:23.000 When I heard you say in the run-up to this, Alex, that this was akin to martial law, At first I thought that was an overstatement, but as I thought about what you were saying, I guess it would take something like martial law to make that work.
00:09:35.000 Because if there are multiple points of ingress and egress between states, who's going to determine whether somebody is crossed unlawfully?
00:09:42.000 You have to monitor that to occur, and who can do that better than the military or police?

00:09:55.000 If you look at the right to travel, the United States Supreme Court has recognized it as fundamental, but it has never anchored that right in a particular clause of the Constitution.
00:10:06.000 The 14th Amendment, for example, has a clause that says the citizens of the various states enjoy the privileges and immunities of other states.
00:10:14.000 That's been taken to mean that when I travel to Texas, I enjoy the rights of a Texas citizen, even though I'm not a Texan.
00:10:21.000 From time to time, the states have tried to impose durational requirements on a person before that person can enjoy the benefits of social welfare, let's say.
00:10:30.000 So a Californian couldn't move to Texas and claim welfare straight away.
00:10:35.000 Those issues have been defeated as a violation of the Privilege and Immunities Clause.
00:10:40.000 In 1999, a case called Saenz, S-A-E-N-Z versus Roe, struck down an imposition on a right to travel without necessarily, and explicitly saying, for purposes of this case, we need not identify the source of the right to travel in the text of the Constitution.

00:24:18.000 I hear a lot the hospitals are terrified, medical professionals are bracing themselves for an inability to care for all the people that will become ill.
00:24:26.000 And the thinking appears to be that if we can slow down interaction between people, increase social distancing, the virus won't take root quite as deeply, quite as quickly, and we'll be able to deal with the most critically ill.
00:24:38.000 So I think this is a misplaced gesture on Mr. Trump's part.
00:24:41.000 I mean, I don't know.
00:24:42.000 If you lock the country down, the virus can't spread.
00:24:45.000 The problem is it's an overreaction.
00:24:48.000 I think everyone agrees that there's going to be social transmission of it.
00:24:51.000 And you begin to wonder about his secondary motive.
00:24:54.000 He appears not to have given the issue much thought.
00:24:57.000 He eviscerated the Department of Public, or the CDC, rather.
00:25:01.000 And now the CDC is playing catch up.
00:25:03.000 And I think rather than dealing in a narrowly tailored fashion with issues that are clearly
00:25:09.000 within the national government's authority, he's overreaching.
00:25:13.000 Now some say, and I've heard Alice say it, I don't know you, you may believe it, that
00:25:16.000 this is part of a larger conspiracy to destroy civil liberties in the country in the name
00:25:21.000 of an overarching set of powers.
00:25:23.000 I certainly hope not.
00:25:25.000 But I do think that big tech and the emergence of AI creates an unusual world.
00:25:31.000 In 1776, Adam Smith wrote The Wealth of Nations, and he talked about the power of markets, and he said there's an invisible hand, and that invisible hand allocates resources efficiently, and if we interfere with it, we create inefficiency.
00:25:47.000 But here's a question that I think AI raised, and that is, Can an algorithm sufficiently powerful, armed with a vision of human welfare, more efficiently than a market allocate resources?
00:26:00.000 My hunch is that there are plenty of people, call them globalists, who think that's so.
00:26:04.000 However, here's the issue.
00:26:06.000 Somebody has to create the algorithm.
00:26:09.000 And if it's the 1% or the people sitting in Silicon Valley or if it's Bill Gates and Mark Zuckerberg and people with enormous wealth who secretly control the algorithm deciding who has access and who doesn't, then it's not so much the AI determining what best promotes human happiness It's AI imposing a particular version of human happiness.
00:26:31.000 So I think the history of this country has always been that government is regarded with distrust and that we, the people, retain sovereignty.
00:26:39.000 That's what distinguishes us from China, which has an organic conception of the state, where individuals are subservient cogs in a larger wheel.
00:26:46.000 It's what distinguishes us from Europe, which really does not have a Bill of Rights with the teeth that ours does.
00:26:52.000 So I think we're at a constitutional turning point here.
00:26:55.000 I think that, you know, that talks about suicide by despair and the sense of disentitlement and flyover country that caught the elite by surprise in the 2016 election.
00:27:05.000 I think it's time for the people to roar back.
00:27:08.000 I don't know if you have the means to post the number of the White House switchboard, but in my fantasy life, the White House switchboard gets a million calls within the next hour saying, do not suspend interstate travel.
00:27:18.000 Because if you do that, I'm not going to be able to get materials from interstate travel or the alternative.
00:27:23.000 The federal government's going to have to license people at the border.
00:27:26.000 I may not be able to travel to my job across state lines.
00:27:30.000 I may not be able to visit my family across state lines without a permit.
00:27:34.000 If you're going to license travel, if you're going to have permits to travel, what do you need to enforce that?
00:27:39.000 You need an overwhelming show of force at each and every border.
00:27:42.000 What institution can do that?
00:27:44.000 You know, I don't know.
00:27:46.000 I'd like to think this is not a prelude to martial law, but if you're going to have a rule that needs to be enforced, you need an enforcement agency.
00:27:53.000 And I guess that would be the military.
00:27:55.000 So I think the president is panicking.
00:27:57.000 I think that there are forecasts of enormous numbers of deaths and the federal government's been caught unprepared.
00:28:03.000 But contrast this with the great flu influenza virus pandemic or epidemic in 1918.
00:28:10.000 We lost 650,000 Americans to influenza-related deaths in 1918.
00:28:15.000 That was 13 times more than the total number of American casualties in World War I. But yet we pressed on with dignity, yet we pressed on with state sovereignty, yet we pressed on with a commitment to individual liberties.
00:28:29.000 It wasn't perfect.
00:28:30.000 But it wasn't a wholesale abdication of individual responsibility and bowing in the direction of the state that we seem prepared to do.
00:28:38.000 And that Donald Trump would be the vehicle of this message to me is shocking.

00:28:47.000 And I would just add, in 1918, President Wilson actually got that flu.

00:28:53.000 He did not force Americans to do anything insane.

00:29:56.000 Those of us of a certain age recall friends just a little bit older than us who may have had polio.

00:30:02.000 We've eliminated cholera.
00:30:03.000 We've eliminated, you know, the mumps and measles for the most part, although they're on their way back.
00:30:08.000 We've become complacent and seem to think that we've won our battle against the microbe,
00:30:13.000 but evolution has a way of continuing to advance and new organisms appear.
00:30:18.000 I think we were caught with our public health pants down this time around, and there is
00:30:23.000 collective benefit and collective good in things like the CDC.
00:30:28.000 I wish the president paid a little more attention to hard science and a little less attention

00:30:34.000 My deepest fear is that if he announces something tonight, it'll be just as a means of preempting
00:30:39.000 Bernie Sanders and Joe Biden's debate.
00:30:42.000 Because if there's one place where Trump is comfortable, that's at the front of the media line.

00:30:50.000 And again, it's completely accurate.

00:30:53.000 I would add Fox News, which except for one commentator on that network, has been completely downplaying this to the point where they've now suspended a couple reporters who called coronavirus a Democrat scam.
00:31:05.000 And of course, the big part of the scam, I think, is this panic.
00:31:08.000 thing the reason why people are going out and buying entire stores worth of
00:31:12.000 toilet paper and putting them in the back of their truck so norm in the next

00:31:22.000 to possibly necessitate martial law because if you're keeping people I mean

00:32:25.000 Barring that, we'd make an emergency run at the United States Supreme Court.
00:32:28.000 So it would be about a week to 20 days of very intense legal fighting.

00:32:38.000 I want to dive deeper into this because a lot of Americans are going to be worried.

00:32:51.000 This is going to raise a lot of questions and has a lot of people on edge.

00:34:46.000 I mean, is this something that is going to, if God forbid this happens in the next few hours, and it's not immediately shot down by the first judge who sees it, is this going to go into effect?
00:35:01.000 Well, it may, although I'm told that since you... I got a tweet from somebody, or a tweet, a text message from somebody during the break, that there's a press conference going on right now and that the President may have walked it back.
00:35:12.000 And that we checked the President's Twitter feed, apparently he made some sort of crack about don't buy so many groceries, everybody calm down, and apparently Mike Pence is still speaking now, or so I'm told.
00:35:23.000 I'm on the phone with you.
00:35:25.000 So let's assume that there is a legal challenge to this.
00:35:28.000 The first question is, who's a plaintiff?
00:35:31.000 Who has standing?
00:35:32.000 It would be anybody that has the right to travel, so any citizen.
00:35:35.000 We'd have to find somebody to bring the action under.
00:35:38.000 I may bring it under my own name, because I have to travel down to Austin to work with Alex once a month.
00:35:43.000 I don't want to be banned from doing my job.
00:35:45.000 Then you file a complaint in court, a short complaint statement together with briefs about why you think this is an unconstitutional infringement on people's liberties, why it breaks the fundamental right of ours.
00:35:58.000 You have a quick hearing in front of the judge.
00:36:00.000 You ask for a first and ex parte hearing.
00:36:03.000 In other words, you say the government shouldn't even have a chance to be heard on this.
00:36:06.000 this is transparently outrageous.
00:36:08.000 If the government grants that, or if the court grants that,
00:36:11.000 then there could be a stay while the government had a chance to respond.
00:36:14.000 That's extraordinary.
00:36:16.000 If we didn't get that, then the government would have a very brief period
00:36:19.000 within which to respond, and there'd be argument before the district court judge.
00:36:23.000 That judge would then make a decision, most likely from the bench.
00:36:26.000 The loser would then have an opportunity to take an immediate appeal
00:36:29.000 to the Federal Circuit Court of Appeals, and I believe that court would hear it quickly.
00:36:35.000 The loser of that battle then would have an opportunity to take a writ of certiorari,
00:36:39.000 which is a request to the United States Supreme Court that they hear the matter promptly.
00:36:44.000 I think all of that could take, you know...
00:36:47.000 Up to 20 days to play that cycle out, which, from a lawyer's perspective, is the speed of light.
00:36:52.000 I chuckled when you talked about coffee and sleepless nights.
00:36:55.000 Those are just what goes with the turf in a law firm.
00:36:58.000 But this would be an extraordinarily stressful period.
00:37:02.000 And I think it would be one of those cases where the courts would drop everything to hear it, because such a move is unprecedented in The closest thing that comes to mind is Abraham Lincoln's suspension of the writ of habeas corpus during the Civil War.
00:37:18.000 But that was when there was a Civil War, when states had sought to succeed from the Union, and we were actually killing one another.
00:37:26.000 And I think Lincoln's calculus at that point was, when the very nature, when the very republic is at issue, extraordinary means are necessary to protect it and to save it.
00:37:37.000 I think President Trump may say something like, well, you know, suspending fundamental constitutional rights is the same thing.
00:37:45.000 I'm just not so sure I'm prepared to follow him there when what's assaulting us is nature.
00:37:51.000 You know, whether the coronavirus is man-made or not, that's beyond my pay grade.
00:37:55.000 All I know is that people are getting it state by state and a significant number of them are dying.
00:38:00.000 Me and my family are taking precautions.
00:38:02.000 I don't think we're being hysteric.
00:38:04.000 We just recognize the risk.
00:38:06.000 I'm not sure that we want the government trying to make life risk-free by the suspension of our civil liberties, but I fear that many Americans have come to that point.
00:38:15.000 And why do I say that?
00:38:16.000 Look at the debate about privacy with respect to Big Tech, with respect to Twitter, with respect to Facebook, with respect to Google.
00:38:23.000 People are saying such things as, I am prepared to give up some of my privacy so long as I get more security.
00:38:31.000 I guess the next step, as we habituate ourselves to the loss of these things, is I guess I'm now prepared to sacrifice my liberty for the sake of life.
00:38:41.000 There was a time when a rallying cry in this country was, give me liberty or give me death.
00:38:47.000 And I think we need to reconsider those words carefully.
00:38:50.000 This virus is not a political creature, as near as I can tell.
00:38:53.000 It's an equal opportunity killer.
00:38:56.000 And I think we need a collective public health response to deal with it.
00:38:59.000 I don't think that collective public health response should be politicized.
00:39:03.000 And I definitely don't think it should be politicized at the extent of our loss of liberty.

00:39:36.000 off a panic or a greater panic than what we're seeing right now. I mean it's it's

00:39:41.000 I've heard reports of fistfights in parking lots on the East Coast but it
00:39:45.000 seems as though the goal right now is to stave off the panic.
00:39:49.000 But what I had heard is essentially similar to what Alex had heard, which is that this was going to come in a week.
00:39:55.000 And what you just said, that Americans are getting more and more used to the idea of their civil liberties being erased.

00:50:10.000 As one would expect, right after President Nixon gave his speech, inflation began to rise and America's biggest export became debt.
