00:00:48.020 America is much less safe right now. I think that this has always been shaped in the context
00:00:52.860 of a political story. What's going to happen if he wins? This is a national security story right now.
00:00:57.940 He is a threat right now. He is threatening people in America. He is validating our enemies. And he
00:01:03.640 is the leader of what I've called the American insurgency. It's a social movement that seeks
00:01:07.320 to reverse the election, overthrow the government and install him as the leader. That is happening right
00:01:12.560 now. Every day he's out in the streets. He's posting social media. He is disrupting our civilization.
00:01:18.700 He is an immediate national security threat that the national security apparatus is thinking about.
00:01:22.800 I think we look at this. What happens if he wins? What happens if he's out and doing this for the
00:01:26.800 next 11 months? I think that is the more immediate threat. We've got to move that bar closer back
00:01:31.660 because he's got, at the end of the day, millions of people who are angry with guns who will do what
00:01:36.100 he says. And I think we have to approach it in that kind of framework first and most of all.
00:01:40.620 And I think also if you if he does win and you think about what that means for sort of the
00:01:45.240 geopolitical order, Amy referenced the greatest generation, right? And in the greatest generation,
00:01:49.960 America was part of the allied powers that were for liberal democracy and freedom against the
00:01:55.280 axis powers that were for authoritarianism and dictatorship. There is a rising axis of
00:02:01.600 authoritarians out there in the world right now. It includes Russia. It includes China. It includes
00:02:06.380 countries like Turkey and Hungary who are trading ideas and working together. Whether there is a cold
00:02:13.000 war or God forbid, a hot war, the notion that America in the 21st century would be on the side of the
00:02:21.020 axis powers is a terrifying thought. We don't make America great again by putting us on the axis side
00:02:28.240 and not the allied side. Let me ask you, though, as someone who focuses a lot on elections, if every U.S.
00:02:34.180 election moving forward becomes this plea to voters, democracy is on the line. One, what does that do to the
00:02:40.580 nature of our elections and two, can you ever advance as a country as and as a society if democracy
00:02:47.560 itself always remains in peril? You can't. You can't have a sustainable democracy where one of the
00:02:53.780 two parties has been captured by an extremist authoritarian movement and is consistently
00:02:58.600 representing the potential end of free democracy. But I don't think that's where we necessarily need to
00:03:04.840 be. We have a significant anti-MAGA, anti-authoritarian majority in this country.
00:03:10.740 The challenge we have is some of our electoral system design choices actually make it so that a
00:03:16.160 plurality, not a majority, could end up the electoral college. And if you go back and look at the early
00:03:23.140 20th century, after the Great Depression, a loss of faith in institutions, you see a fracturing of
00:03:28.040 parties around the world in the United States, in Europe, a lot like we're seeing today where we're
00:03:32.260 seeing a fracturing of parties, third-party candidates rising. And the danger is when it
00:03:37.040 fractures like that, a plurality faction can sneak through and people who do not represent a majority
00:03:43.020 of views can take power. It's why some of these third-party candidates represent one of the greatest
00:03:47.680 threats right now, because they could create a situation in which a very unpopular authoritarian
00:03:52.880 leader could sneak through and take power again. And breaking in just the last hour, Speaker Mike
00:03:58.000 Johnson announcing that security footage of the January 6th attack will be made available to the
00:04:02.980 public. That includes footage that was given to then Fox News host Tucker Carlson by Speaker Kevin
00:04:08.340 McCarthy earlier this year. You poured through this footage. You took steps to make sure that the
00:04:13.160 footage didn't disclose sensitive security information. Your reaction to Speaker Johnson's move today?
00:04:18.720 Yeah, it's dangerous. You know, the Capitol Police gave it to us, Alicia, with really strict conditions
00:04:25.240 that we needed to clear with them before we publicly showed any of that footage. That's relevant because
00:04:31.540 it demonstrates some events in and around the Capitol. There are security cameras posted all over
00:04:37.280 the complex, but the specific location of those cameras is closely held, law enforcement-sensitive
00:04:43.280 information. And if they're all disclosed, then a map can essentially be recreated as to where
00:04:48.640 they are. That will make it easier for future rioters who are intent on disrupting another joint
00:04:56.680 session of Congress or official proceeding to circumvent those cameras. So it's really risky to just throw
00:05:01.820 the doors open and make them together without any protection. There's also the fact that just this week
00:05:06.040 you had a Republican congressman peddling conspiracy theories about what actually happened on January 6th,
00:05:11.780 trying to argue that the FBI was involved in January 6th. You take this footage and you put it in the
00:05:18.020 hands of bad actors. Who knows where it goes? Well, and I think it's a bit weird that Mike Johnson is doing
00:05:23.580 this. He's recently become the Speaker of the House, right? He was a sort of consensus candidate when they
00:05:29.320 kind of panicked after three weeks of Republicans not having a speaker. And also, he recently endorsed Donald
00:05:35.700 Trump. So you have to wonder, is he doing this as like a campaign stunt or is he doing this in his job as
00:05:43.400 Speaker of the House? Break it down a little bit more for our viewers so they have a better
00:05:46.940 understanding because I, too, am saying this is a head-scratcher.
00:05:51.660 It really is, Katie. And you were talking before about Congress and the budgetary crisis with
00:05:56.920 Congress kicking the can down the road. This is an example of a judge kicking the can up the road.
00:06:03.220 She's made this baseline finding that Trump participated in insurrection. But to be removed from the ballot
00:06:09.920 under Section 3 of the 14th Amendment, you have to have taken an oath as an officer of the United
00:06:16.220 States. And she curiously found that the president is not an officer of the United States. There's some
00:06:22.440 technical legal jargoning going on here. Now this will go to the Colorado Supreme Court for a decision
00:06:29.240 as to whether they'll reverse and find that Trump. This is the primal scream of a dying regime.

00:08:10.720 start with Julie Kelly. In this J6 footage, Mike Davis is going to join us from Denver, so we're going
00:08:17.420 to cover everything today, including the southern border. So let's get to work. Julie Kelly, they're not
00:08:24.480 happy that the footage has finally been released. Folks, I want you to understand that after 11 months
00:08:31.060 and power, we finally, Mike Johnson finally gives us the footage. Julie, walk us through all of it,
00:08:36.160 ma'am. So let's take a little victory lap here. As I said on Twitter last night, we have to take the
00:08:42.060 small victories when we get them. And this certainly is a victory. You have been pressuring House
00:08:48.440 Republicans to do this. I certainly have my first article about releasing the tapes I wrote in May of
00:08:53.380 2021 when we found out that at least 14,000 hours of security footage had been put under protective
00:09:00.480 orders as court proceedings occurred for January 6th defendants. So this is a big win because to
00:09:08.120 your point, all the right people are melting down, not just the people that you see on MSNBC, but you
00:09:13.500 see Liz Cheney and Adam Kinzinger lashing out, Jamie Raskin lashing out. But look, this is just the start.
00:09:20.200 The American people have not seen this footage. We have seen some of it. I have access to some of
00:09:26.340 this footage. I've seen it. I've posted some of it, but the majority of the public has not seen this.
00:09:32.820 And that is why these people are freaking out. And this is just the beginning of the breaking of the
00:09:38.340 dam here, Steve. There's going to be more footage released that not just show police helping people
00:09:44.000 in, but the level of police brutality that day that prompted a lot of the clashes between protesters
00:09:51.340 and, uh, and police, there's going to be a lot more seen. And as I said, this is the beginning of
00:09:58.520 the breaking of the dam to the point that you have made. And I've made also, we need a January 6th select
00:10:05.360 committee run by Republicans, put these people like Tim Heafy, who was just interviewed. Why did
00:10:13.120 Tim Heafy cover up Heapy or whatever his name is? Why did the January 6th committee cover up parts of
00:10:19.820 their investigation related to the involvement of federal agencies and the FBI? Why didn't the
00:10:25.920 January 6th committee interview FBI director, Christopher Wray? How can you have an investigation
00:10:31.340 and not interview the head of the top law enforcement agency in the country? So there's a lot more
00:10:39.320 truth to be revealed about January 6th. And Steve, you could see the response on our side
00:10:45.300 on social media. This is a huge issue to the base and Republicans are getting to see that first and
00:10:53.000 foremost. This is a huge issue, not just the truth and the coverup, but of course the 1200 Americans and
00:11:00.600 counting who have been ensnared in this abusive retaliatory department of justice investigation.
00:11:06.300 I was just in Washington this week. I sat in jury selection for another January 6th defendant,
00:11:13.020 478 days between his arrest and his trial and watching this DC jury pool come through the comments
00:11:21.940 that they make about January 6th and their, and the protesters speaks to not just the unfair trials
00:11:28.300 that are going on. But how in the hell is Donald Trump going to get a fair jury seated for his March
00:11:34.980 4th trial in the nation's Capitol? There's so much happening with this, which is why House Republicans
00:11:40.500 now need to take the next step and create their own committee because the videos are just only one part
00:11:46.020 of this. I want to repeat this. It's imperative for Johnson to, when he gets back, I think on Tuesdays,
00:11:55.780 the first day back a week, he must reinstate the joint committee on, on, on J six, let them have a
00:12:02.780 ranking member, let them have minority council. Let's set it up the right way. Not, not the way
00:12:06.880 that was set up. It's one of the reasons, one of the, one of the key arguments I've made in my case,
00:12:12.380 which I don't talk much about, but this is, you can't do it the way Nancy Pelosi did it. You have
00:12:17.460 to do it by the rules, but Johnson must set this up. We must have the house go through and do a formal
00:12:24.620 event. This must be adjudicated with Democrats throwing in two things. We must adjudicate now
00:12:29.440 must be done is number one. We have to get to the bottom of J six and this footage is part of it.
00:12:34.800 We have to get to the bottom of it. Wherever it leads has to get to the bottom of it. All of it,
00:12:38.980 all of it. And you also have to investigate Nancy Pelosi's committee. Doesn't this committee,
00:12:44.860 this committee, I think, I think there's, I think there's brazen criminality and what they did.

00:12:59.980 evidence. We are still waiting for the production of records from the secret service that have now
00:13:05.620 been buried at the department of justice, department of Homeland security and the Biden white
00:13:11.300 house. So there are still records that, uh, Barry Loudermilk, who is the head of the house
00:13:16.060 administrative committee who has been looking into this. He has sent letters to the Biden white
00:13:20.240 house and DHS and other authorities seeking these missing records. Get this, Steve, all of the video
00:13:26.780 interviews, you know, they, they offered the J six committee would offer clips of that during their
00:13:32.220 televised performances. None of those video, um, none of that footage has been archived or given over
00:13:40.360 to house Republicans. Why not? Because we know we're going to be able to compare what was really
00:13:46.140 said, or at least the context of some of these clips. Also, I want all of those, those four celebrity
00:13:53.180 January six committee, uh, January six cops, Mike Fanone, Dan Hodges, Ecclina Gunnell, and Harry Dunn.
00:13:59.960 They not only lied under oath to Congress in that hearing, they have lied under oath in court testimony
00:14:06.600 and victim impact statements that have prompted longer prison sentences because they've all lied

00:21:40.140 with its mission to chase Republicans out of office. The government, the Democrat governor named
00:21:45.200 Sarah Wallace as a judge in August, effective January 2023. Between when the governor named her
00:21:53.260 and when she took the bet, she made this donation to this anti-Trump January 6th PAC. So at the
00:21:59.220 beginning of the trial, Trump filed a motion to recuse and she said, oh, I don't remember making this
00:22:04.980 donation. Regardless, I can still be fair. Well, that's not the legal standard and it's not believable
00:22:09.900 that she doesn't remember making this donation. You would think that it was just a year ago. You
00:22:14.480 would remember the donations you made, particularly after you're a judge designee by the governor and
00:22:20.240 you're waiting to take the bench. So it's just not credible that she doesn't remember making this
00:22:24.740 anti-Trump January 6th donation in October of 2022, right before the midterm elections. And it
00:22:31.200 doesn't matter. Under the legal standard, she is objectively biased. It doesn't matter whether she
00:22:36.780 thinks subjectively she could be fair, objectively she's biased. And she delivered for the Democrats
00:22:42.680 despite the headlines, right? And here's how she delivered. She had this trial and during this trial
00:22:47.800 she let in this January 6th report, which is clearly inadmissible hearsay evidence. And her rationale
00:22:55.420 for doing this is, oh, well, this was a bipartisan commission. And I know that there was some trouble
00:23:01.200 with the Republicans and they boycotted this thing, but you, you know, and Speaker Pelosi
00:23:05.540 appointed Liz Cheney and Adam Kinzinger to this commission, but they're good Republicans. So it,
00:23:11.180 you know, it's, it's, it's reliable evidence, which is just complete nonsense to every war room
00:23:15.540 listener. They laugh if you think that Liz Cheney and Adam Kinzinger are reliable Republicans,
00:23:20.700 right? We know they're not right there. They're Trump deranged and Trump fried their brain and
00:23:25.160 they're Democrats now effectively. But so the Sarah Wallace let this evidence in at this trial,
00:23:32.440 and then she used this evidence at trial to say that there was an insurrection,
00:23:37.960 right? Which is just nonsense as, as, as you saw from these videos that Speaker Mike Johnson
00:23:42.980 released, how the hell was that an insurrection? How many insurrectionists go into a nation's capital
00:23:49.640 unarmed, follow police direction, walk through velvet ropes, get to the Senate floor of the nation's
00:23:56.180 capital, take selfies, don't burn down the damn place, don't break every statue and they walk out,
00:24:02.020 right? January 6th was a lawful protest permitted by the national park service that got out of
00:24:08.400 control and turned into a riot. You know, we may find that it got out of control because federal
00:24:13.880 agents provoke people like you were talking about, Steve. And this, this video is so important because
00:24:18.760 it may prove that, but regardless, this is not an insurrection under any definition of insurrection.
00:24:24.140 It's just laughable to say that January 6th was an insurrection. It was a riot, right? And so,
00:24:30.040 but this, Sarah Wallace used this one-sided January 6th report. They brought in these performance
00:24:36.020 artists, Capitol police officers and others, and this goofball expert from Las Vegas who says when
00:24:43.620 Democrats say fight, they mean it in the political sense. But when Republicans like Trump say fight,
00:24:49.460 they mean go, go commit violence. It was just a head scratcher watching this thing. It was laughable,
00:24:54.180 right? And I sat through this trial. And so then Judge Wallace said, okay, there's an insurrection
00:24:59.100 and we're going to just ignore Supreme Court precedent for 50 years or 60 years, the Brandenburg
00:25:06.200 versus Ohio case, where it talks about the requirement for the incitement of violence.
00:25:11.600 We're just going to ignore that. And we're going to say that there's a different legal standard under
00:25:15.300 the 14th amendment that she just made up. And so Trump caused this insurrection, whether it's,
00:25:21.700 whether it's incited or whatever, he caused this insurrection somehow.

00:33:48.300 And what is, what is the path forward? So yeah, this Denver district court judge, Sarah Wallace,
00:33:54.020 just ignored the hearsay rules. She found that there was an insurrection, uh, which is laughable after
00:34:00.260 you watch these videos released by speaker Mike Johnson. And she held that Trump caused that
00:34:06.260 insurrection, which is laughable. If you look at Supreme court precedent precedent, like the
00:34:10.340 Brandenburg case. So now where we go, she, she got right to the edge. She pushed the ball as far as
00:34:15.820 she could, but I think she was starting to feel the heat and she blinked. And so there's a bit of a
00:34:20.500 tactical retreat. She's, she held, she ruled that, yeah, there was an insurrection. Trump caused it,
00:34:26.580 but under the 14th amendment, under section three of the 14th amendment, the disqualification clause,
00:34:31.820 she isn't sure whether the president is an officer under the 14th amendment. And so therefore she's
00:34:38.600 going to err on the side of caution. What this does is it allows these Democrat plaintiffs to take
00:34:43.920 this right to the Colorado Supreme court on that legal issue alone to, uh, to appeal directly to the
00:34:49.440 Supreme court under a, under the special election challenge out here. The Supreme court is stacked
00:34:54.400 by leftists because we stopped winning elections in Colorado when they legalized weed and went to all
00:34:59.900 mail ballots and all the New York and California dirt balls moved here. So the Supreme court's
00:35:04.600 probably going to reverse and hold that legally the president is, is included as an officer under
00:35:11.300 the 14th amendment. And therefore president Trump is disqualified. And then that puts the Supreme court
00:35:16.480 of the United States in a bad place from their perspective, because they're actually going to
00:35:20.580 have to put on their big boy pants, take a Trump case and do their jobs.
00:35:26.500 Mike Hanger for one second, I'm bringing Jeff Clark, Jeff, you came on the show.
00:35:29.340 We had Mike and Dershowitz on the first day of this broke with the, uh, with the Leonard
00:35:34.040 Leo's federal society getting back in. You came in, I think on the next day and you laid out exactly
00:35:38.400 why she wouldn't be able to take him off the ballot, uh, walk through that. And do you think
00:35:43.620 that'll be, uh, you think that this will hold, will hold over time because it looks like they're
00:35:48.240 going to try to worm their way around it. Walk us through why you said at the beginning,
00:35:51.580 they would lose that she would have to blink at this level.
00:35:54.140 Sure. Let me, let me just make one point, a finer point on the January 6th stuff. So the way that she
00:36:02.100 let in the January 6th report, which I think is truly ludicrous is she said, I'll admit it
00:36:07.280 conditionally subject to cross-examination of Tim Heafy, who was the top, uh, lawyer,
00:36:13.920 the investigative lawyer for the January 6th committee for, uh, Nancy Pelosi really,
00:36:18.480 and Benny Thompson and, uh, Troy Nell is the Republican representative, right? I mean,
00:36:24.100 this is ridiculous. The idea that there's someone who is not a witness, right? In, in Heafy,
00:36:29.400 he's just a lawyer and he somehow can sanitize all of the hearsay evidence, uh, because you can ask
00:36:36.300 him questions about what the witnesses said. That's like truly, uh, ridiculous. And, you know,
00:36:41.800 the idea that you could admit the January 6th report, I think, uh, you know, is something that
00:36:45.980 would be laughed out of 90% of courts in America. On your question about, uh, you know, what is the
00:36:52.120 substance of her ruling here? So that, you know, you've gone through the two bad elements of her
00:36:57.200 decision, her finding that Trump engaged in an insurrection, uh, that he incited, uh, to it with,
00:37:03.380 uh, with violence, right? And that that was not protected by the first amendment because she found
00:37:08.340 it met the Brandenburg test for, uh, imminence intention and tendency, uh, which I think that's a very
00:37:15.480 vulnerable ruling in and of itself, but it's 102 page ruling, Steve. She doesn't get to the bottom
00:37:21.420 line, which she could have reached because it's really a threshold question until page 100 to 101.
00:37:27.820 And on that page, she says, while the court agrees that there are persuasive, uh, arguments on both
00:37:34.120 sides, the court holds that the absence of the president from the list of positions to which, uh,
00:37:39.660 the amendment applies. And that's the argument I laid out in my, uh, paper on the citizens for
00:37:44.200 Renewing America site, uh, combines with the fact that section three, uh, specifies that the
00:37:50.220 disqualifying oath is one to support the constitution, whereas the presidential oath is to
00:37:55.360 preserve, protect, and defend the constitution. It appears that the court, for whatever reason,
00:38:00.500 I'm sorry, that the, uh, to the court, that for whatever reason, the drafters of section three
00:38:05.400 did not intend to include a person who had only taken the presidential oath. So I think that is a very
00:38:12.260 solid argument, but it's an argument I've already seen Judge Ludig attacking as, uh, uh, you know,
00:38:19.060 technical. And actually during the same time you're running your show, I think Ali Velshi was having,
00:38:24.260 uh, tribe and, uh, Ludig on to, you know, attack the decision. So given the nature of the Colorado
00:38:31.320 Supreme court, I would not be surprised if they reversed, but you know, then it's going to go to
00:38:36.640 the U S Supreme court as we've all been predicting for a long time. But, but let's go back to the
00:38:44.060 threshold question. His point, I was going to make it, but he brought it in so brilliantly in 102 page
00:38:50.660 opinion. It's the last page. It's essentially before you get to the, you know, it's on page 100.
00:38:57.640 She actually gets to the punchline. She knew this at the beginning was not this entire trial just to
00:39:05.700 get the J six report in as some sort of thing to designate Trump as an insurrectionist. Was that
00:39:11.460 her whole purpose the entire time? As you can tell by the 99 pages she wrote on this because you,
00:39:17.040 she knew this, there's nothing in this trial, not one piece that came up that is relevant to
00:39:23.280 actually the threshold question of does the oath you know, does the oath of the president
00:39:28.880 fall under this type of provision? Correct. Am I wrong in that? I'm not a lawyer, but it just
00:39:34.260 seemed to me that this was kind of a, she kind of, she did this on for a purpose.
00:39:39.940 It's a pure question of law. You don't need a trial to answer this question, right? You just need
00:39:44.060 to write briefs on both sides and then have the judge construe the provisions. So, you know,
00:39:48.360 what lawyers have this phrase, Latin, uh, obiter dicta, right? This is superfluous material things
00:39:54.820 you don't need to say things you don't say as a matter of judicial restraint. This entire opinion
00:40:00.360 is a dicta fest because it's a hundred pages of, you know, besmirching Trump and saying he loses this
00:40:06.960 argument. He loses that argument based on facts, but based on facts that come in from the January 6th
00:40:11.860 report, which is not, uh, evidence. It's just a report. It's an opinion of a bias set up by
00:40:18.040 Nancy Pelosi that excluded, uh, the, uh, Republicans who were selected by the Republican
00:40:23.460 conference. Um, and you know, that's just not the way you do analysis. Chief Justice Roberts has a
00:40:29.280 great quip where he said that if it's not necessary to decide, uh, more to a case, then in my view,
00:40:35.900 it is necessary not to decide more to a case. In other words, you only decide what you need to
00:40:41.520 decide and that's it. You could have just like written a five page opinion with this point up front.
00:40:46.240 And then it's, you know, then you don't need to reach anything. And you say, I don't need to reach
00:40:50.700 any of the other questions because, uh, you know, this answer is dispositive and it, you know, disposes
00:40:56.700 of this case. That's the way to judge what judicial restraint acts. So this judge was not doing that.
00:41:01.940 And we know that because she's biased, right? She's a Democrat. She, you know, Democratic, uh,
00:41:07.380 I'm sorry, donated to the Democrat organization that Mike Davis has really been dogging.
00:41:11.720 And so, you know, she's just trying to throw as much dirt as possible on Trump before she backs
00:41:17.320 away from the precipice. She did have a nice footnote. I will say Steve, where she says,
00:41:22.120 look, there are arguments on both sides, but if they're unclear, we have to quote air on the side
00:41:27.140 of democratic norms. In other words, let the people of the United States vote for who they want to have
00:41:32.920 as their president. And I think that's really the overarching point that many of us have been urging
00:41:38.000 for some time. Mike, does this now going to the color of Supreme court, is this really exposed as
00:41:45.160 kind of a psyop media war to basically put in the people's mind and local media as they cover these
00:41:51.400 different tribes, because they're going to go to every state again on this, uh, that Trump's an
00:41:55.440 insurrectionist and should be off the ballot in that the purpose of what the left is doing here.
00:42:00.380 Yeah. I mean, that's a, that's the political part of it, but I actually think the Democrats are
00:42:04.180 doing everything they can to disqualify president Trump from the ballot. And I think that this Denver
00:42:08.460 district court judge had every intention of doing this, but she felt the political pressure. And I
00:42:13.280 think she blinked at the last minute. So she got this case, got this opinion as far as she could,
00:42:19.340 she got as close to the edge of the cliff as she could. And then she backed off and then she's going
00:42:25.180 to wait for the Colorado Supreme court to reverse her on that narrow legal question of whether the 14th
00:42:30.940 amendment section three of the 14th amendment, the disqualification clause applies to president,
00:42:36.540 a president as an officer, or if it doesn't, and if it applies like the Colorado Supreme court will
00:42:41.180 likely hold that they disqualify Trump. And then they use that in other States right now,
00:42:46.140 they're in tactical retreat in key States like Minnesota, like Colorado, like New Hampshire,
00:42:52.440 uh, because they feel the political heat, right? They're, they're, they're not deciding this on,
00:42:57.300 on different grounds because it's a primary versus a general election on standing, whether
00:43:02.760 the president's an officer or not, they're going to come back at this. They're going to come back
00:43:06.340 at this again, especially when they see that president Trump is beating Biden, like a drum
00:43:11.560 on November 5th, 2024. They impeached him twice for nonsense. They indicted him four times for non-crimes.
