00:09:50.240 so i think look there needs to be a firm hand to tell the career people that when they're given

00:11:10.320 a colleague who was a political appointee at the environmental protection agency and she supervised
00:11:17.040 several career employees several career managers one of them uh asked her to meet him on the weekend
00:11:24.560 in dupont circle and this is a woman who you know was either pregnant at the time i forget or had just
00:11:30.800 had her first child um you know very clearly uh you know a christian devout woman and uh he insisted on
00:11:39.840 taking her unbeknownst to her she just sort of showed up at the address uh where he was wearing
00:11:45.920 prominently a big shirt that said resistance uh you know he's meeting with his boss at a gay bar and he
00:11:54.080 clearly was trying to send a message that uh obviously he was going to resist and that uh you
00:12:00.480 know she wasn't really welcome and that uh he specifically said that look you're going to have
00:12:07.120 problems when you tell us what to do because we're really the ones who hold the the levers of power
00:12:12.640 and you know i've told that story before because i just think it's remarkable and brazen i mean
00:12:17.920 you know i had some problems with some people at the uh in the career ranks at the justice department

00:13:24.800 if i might get back to the justice department any particular person's case but i would say
00:13:29.360 what is the theory of having a civil service the theory is that they neutrally serve whatever president
00:13:36.160 sits in the chair okay and that means that that president sets the policy direction for officials
00:13:42.160 to announce that they are going to resist the policy direction of a new incoming president who is the
00:13:48.000 only official in the executive branch who is elected by the people albeit you know through the electoral
00:13:54.160 college mechanism they are not elected the president holds all of the legitimacy and a civil service
00:14:00.720 holds no legitimacy whatsoever and i believe it breaks the law if it says that it if it does disobey
00:14:07.360 uh the president and the political appointees that serve the president and carry out his agenda because
00:14:12.160 the government's so large the president can't possibly do it all and if they're not you know uh and if
00:14:18.480 they're saying that in advance that they're not going to obey that it's even worse would that be
00:14:23.120 grounds for an investigation if you were over at main justice absolutely i mean you can be dismissed for
00:14:28.320 insubordination right but if you say like across the board for entire categories of cases i intend to
00:14:34.160 be insubordinate i mean that to my mind is you know prima facie evidence sanitizing the president's
00:14:40.000 daily briefing is a fairly serious would you yes you're keeping information from the president that
00:14:46.320 he needs to have so that he can do his job effectively they're pretending as if they are the keepers
00:14:52.400 of the nation's intelligence and it's not the president and that's the reverse the president

00:16:25.920 tina peters is in prison so how are you trying to get her out i thought she was starting her nine
00:16:30.400 year sentence sir she uh requested bond or bail while her appeal is pending and the judge turned it down so
00:16:41.920 we have applied to the court of appeals in colorado for an independent decision on that bond issue

00:16:56.160 is she being treated rather harshly she's a gold star mother she's in her 70s i think jenna griswold
00:17:03.840 had these problems with these codes right where is it is it is she she got nine years in prison and
00:17:09.760 then they shackled her in the courtroom and dragged her off is tina peters being treated more harshly
00:17:16.640 than you would think for for what she's alleged to have done sir well let me just rattle off a few
00:17:23.600 things she's 69 years old she has no criminal record she was not convicted of any violent crime
00:17:31.680 she has no risk of flight um she had no brother the district court had no basis for denying her motion
00:17:44.480 he posited his decision on the fact that she spoke out about election integrity
00:17:50.480 and she was supported not only by three certified experts cyber experts who review the material that
00:17:57.600 she obtained from her own system she was the mesa county clerk and recorder and she was operating under a
00:18:06.320 federal duty a statutory duty a criminal statute that required her to preserve all election records
00:18:14.960 the secretary of state ordered that those records be deleted now she denies that but it's
00:18:20.000 that's a flimsy argument she ordered that they override override all of the election records after the
00:18:30.320 election knowing that was going to happen tina got a qualified expert to make forensic images
00:18:40.000 it's ironic that what they called a security breach is exactly what the secretary of state has been
00:18:45.600 guilty of guilty of just before the election passwords to the system which tina was never accused of releasing
00:18:54.880 but were released after she made those forensic images the secretary of state did the same thing and nothing of course happened
00:19:09.600 pat is it extraordinary that she's uh she's in jail given that she's not a flight risk
00:19:15.120 she's a gold star mother she's 69 years old uh and there's some dispute about the secretary of
00:19:21.120 state might have had the same problem that she's not out on appeal just as a normal course
00:19:26.160 of business here and the fact it was a non-violent crime i can't find a single criminal practitioner
00:19:33.840 who has ever faced anything like this before particularly because of her age
00:19:39.120 after 55 um there's a consensus among the corrections people and um physicians that people who are
00:19:48.480 incarcerated after age 55 see their age their aging accelerate so she is 69 and if she stays in for nine
00:19:58.640 years there's no question she will not attend her mother who's 96 her mother's demise won't even be able to
00:20:06.560 visit her mother this is outrageous where do you stand right now where do you stand right now with
00:20:16.240 going to the appeals court on uh for the uh the uh bail pending appeal when do you argue that
00:20:23.040 well there won't be a hearing on that they will rule on the papers on that it's my understanding
00:20:28.960 we have an emergency appeal that we'll file later this month on merits
00:20:38.960 we do it now but we have to have the transcript and that's not going to be available for another 20
00:20:43.680 some days so we'll have an argument on that in the court of appeals in colorado
00:20:50.080 in the meantime though unless the court of appeals grants her a motion to release her she's going to
00:20:57.520 still be in cars incarcerated

00:21:09.440 the tina peters situation has people throughout the country outraged the whole thing the the what
00:21:14.720 happened well how she tried to uh try to make sure the elections out there were fair and equitable uh
00:21:21.360 how she was rounded up like a common criminal how she's been treated the way she you know that they
00:21:26.640 came back gave her a nine-year sentence she was shackled in the courtroom and taken away
00:21:30.640 uh and she's done some uh i guess some um videos from prison people get more outraged on this every day
