00:02:07.580 but it's the politicians who seized the opportunity for power and authoritarianism

00:02:14.140 And one of the worst things they did was to attack people who couldn't fight back.
00:02:18.420 Small businesses, ordinary people who couldn't pay the fines
00:02:21.600 and couldn't hire a lawyer to fight the fines.
00:02:24.380 So about six months ago, we came up with the idea that we would crowdfund to fight the fines.

00:02:29.560 People say we do it too much.
00:02:30.920 No, I disagree because we've been able to help literally dozens.
00:02:34.240 In fact, well over 100, if you add it all up in the different jurisdictions,
00:02:38.740 the number of people we've taken a case for or are currently intaking,
00:02:43.360 you're not even going to believe me when I say it's more than 300 people.
00:02:47.340 A lot of them are in Australia, and we've handled that in one big bundle.
00:02:50.880 But in other jurisdictions, especially here in Canada,
00:02:54.060 we are fighting the fines for people that the politicians and the police have chosen to pick on.

00:03:01.420 Well, our lawyers are looking to fight back, and that's what our show today is.

00:03:09.540 I'm here in sunny Barrie in Wales to speak to Anthony Claypole
00:03:12.560 on another case I'm investigating for Fight the Fines UK.
00:03:16.260 This is yet another case of corrupt fines being issued totally unfairly
00:03:21.500 to people simply trying to go about their ordinary lives.
00:03:25.200 Anthony Claypole earlier on this year was playing football in the park
00:03:28.460 with a friend and with his kids.
00:03:30.200 Now, this sort of exercise was totally mandated by the government, totally allowed,
00:03:34.400 and yet the police still hounded him and harassed him
00:03:36.960 and hit him with a £60 fine, which has since gone up,
00:03:40.220 for no good reason, to almost £1,000.
00:03:43.260 This is what Anthony Claypole had to say about his case.
00:03:46.580 So I'm here with Anthony Claypole, who earlier on in the year got fined in this very field,
00:03:50.920 which is by no means a small field.
00:03:54.440 There's probably no better place in Wales to be socially distanced.
00:03:58.060 What exactly did you get fined for?
00:04:00.380 Well, apparently I'd broken the coronavirus laws,
00:04:03.040 and they accused us of having a picnic.
00:04:06.420 I was in a field with apparently more than two people.
00:04:09.500 So in this massive field with more than two people,
00:04:12.520 and that's apparently a huge threat to public health, as it were.
00:04:18.160 But they find you for having a picnic.
00:04:21.240 Well, they said we were having a picnic.
00:04:22.660 We actually wasn't.
00:04:23.700 Right, so you didn't have any food.
00:04:24.960 No.
00:04:25.200 But you were sitting down on a blanket.
00:04:27.400 No, my partner was on a blanket because our younger son, Archie, is autistic,
00:04:31.520 and he wouldn't venture far from her, so she set the blanket down.
00:04:34.320 And myself and my friend were lashing a football back and forth.
00:04:38.180 And we were at least probably 50 feet apart at the time doing this.

00:04:42.040 And as I say, meanwhile, the kids were riding around on their bikes.
00:04:44.820 My partner was on a blanket with Archie,
00:04:47.140 and my friend Darren's wife was on a blanket probably about three metres apart,
00:04:52.040 because the girls had that in mind.
00:04:54.040 Because their youngest is a baby, and he couldn't even crawl at the time.
00:04:56.980 So he was having tummy time.

00:04:58.800 And, yeah, that's basically what happened.
00:05:00.640 They came from that direction over there and walked straight towards us,
00:05:03.480 made a beeline for us.
00:05:04.780 What exactly did they say to you?
00:05:07.320 They came over to break up the party
00:05:10.020 and told us that we were breaking the coronavirus laws
00:05:13.760 and that we had to move on.

00:05:16.660 And then they threatened you, apparently, didn't they?
00:05:20.800 Well, she wanted my details.
00:05:22.680 The guy was actually quite approachable,
00:05:24.580 but the female PCSO was, yeah, she had an attitude from the get-go.
00:05:31.820 And then they told you that they were going to arrest you in front of your children?
00:05:34.980 They did, yeah.
00:05:35.600 So they were sort of intimidating you and threatening you.
00:05:40.400 So I believe they said verbatim, you don't want your children to see that.
00:05:44.460 Yeah, they tried to use my children against me as if I was creating the situation
00:05:49.140 when, in fact, they were the ones that were causing the lamb distress, I would argue,
00:05:53.880 to not only myself but my young kids as well.
00:05:56.600 So they came from that direction and then you moved over into that direction
00:06:00.180 and where the other police turned up.
00:06:02.680 Yeah, they confronted us around sort of this area
00:06:05.060 and I said to my partner, come on, we'll just go home.
00:06:07.400 I've got work in two hours.
00:06:08.900 And we packed up and we went across that direction.
00:06:12.440 And these two PCSOs, they followed us at close proximity.
00:06:15.720 All the while, two of my kids were turning around,
00:06:17.980 but Daddy, they're following us.
00:06:19.040 But Dad, they're following us.
00:06:19.820 It's like, relax, it's okay, just ignore them.
00:06:21.740 They're not there.
00:06:22.740 And when we exited the field onto a street down there,
00:06:24.820 a riot van came bombing around the corner,
00:06:26.680 mounted the pavement in front of us and out jumped two proper coppers, if you like.
00:06:29.780 So you were actually going home?
00:06:31.000 We were leaving the field, yeah.

00:06:50.780 And obviously, when we went in that direction,
00:06:53.140 she's obviously on the radio saying,
00:06:54.560 we're coming out on the pastures.
00:06:55.700 As though they're chasing someone who's just committed some kind of burglary or something, you know.
00:07:00.700 That's, it seems like an overreaction, doesn't it?
00:07:03.520 It does, yeah.
00:07:04.320 But obviously, for you, you've got five children.
00:07:05.840 You've got four at home.
00:07:06.520 Yeah.
00:07:07.000 Two of them are sort of vulnerable.
00:07:08.740 One's got autism, one's got aspergers.
00:07:11.340 You can't have them cooped up in a house all day.
00:07:13.160 No, it's not good for them.

00:07:15.460 It's not good for children in general, in my opinion.
00:07:17.840 Children are not supposed to be cooped up in a house.
00:07:19.920 And considering this field is on my doorstep,
00:07:22.780 it's less than 10 minutes walk from my house,
00:07:24.980 I felt like this was probably the best location to come
00:07:27.400 if they could ride around on their bikes.
00:07:29.460 And, you know, they were happy, they were laughing,
00:07:32.020 they were having fun like kids should be.
00:07:33.840 And that mood changed when the PCSOs come from that direction.
00:07:37.320 And they literally, there were other people in the field,
00:07:39.420 but they made a beeline for us.
00:07:41.520 And that's when the mood changed.
00:07:42.780 And why do you think that was, that they went for you?
00:07:45.920 Well, I don't know.
00:07:47.400 Maybe they just walked through the Snicket by chance
00:07:49.260 and saw us, or whether I was tagged
00:07:52.680 because of my post on Facebook, I don't know.
00:07:56.300 Right, so you've been quite vocal about this stuff in the past
00:07:59.860 and you think it's possible that maybe there are people out there
00:08:02.920 who are, you know, they've got a grudge, as it were.
00:08:06.920 Well, I think that they don't generally like people who speak out,
00:08:11.280 especially against the state and things like that.
00:08:13.520 But for sure, they made a beeline straight for us.
00:08:17.100 There were other people in the field, but they came for us.
00:08:19.340 And since then, you've received a lot of correspondence,
00:08:21.820 obviously from ACRO and, you know, all sorts of other organisations.
00:08:27.320 They sent you notices and fines.
00:08:30.560 And what was the fine originally?
00:08:32.500 So originally, it was what they call a fixed penalty notice.
00:08:36.280 And it was from a company called ACRO.
00:08:39.740 I was told to ignore that.
00:08:41.700 So I was told to not pay that because I hadn't done anything wrong.
00:08:45.440 It says here the charge is that you contravene the requirement
00:08:48.820 to not participate in a gathering in public of more than two people.
00:08:52.440 Quite a charge, yeah.
00:08:54.560 So basically, the charge is not being a loan.
00:08:57.900 Yeah.
00:08:58.540 And the amount of this was £60?
00:09:01.080 At the time, yeah, initially it was £60.
00:09:02.920 Right.
00:09:04.440 It's since gone up to £816 plus charges, plus fees, plus all the rest.
00:09:11.800 And then you got the other one, I think, from...
00:09:13.840 And then I received this, which is what they call a single justice procedure
00:09:16.840 from the South Wales Police.
00:09:18.280 Again, this on the second page goes into the charge, as it were.
00:09:21.760 Well, this one, the charge has changed to participating in public gathering.

00:09:25.940 That sounds a lot more like you're at a protest or a party.
00:09:30.260 Not in a group of a few people.
00:09:31.540 A small protest.

00:09:32.440 A lot of young members.
00:09:33.460 Yeah, a lot of young kids protesting against not being able to cycle around a field.

00:09:39.720 But, yeah, no, that's phrased in a lot more of a serious kind of term.
00:09:44.580 Yeah, it's probably more threatening.
00:09:46.240 It seemed that they up the ante with that one.
00:09:47.840 And they gave me the chance, though, to enter my plea, attend court, or plead guilty,
00:09:53.880 which I was never going to do.

00:09:55.440 Because I'm not guilty of anything.
00:09:57.340 So, again, I was advised not to create juncture with them, not to accept that,
00:10:01.020 because as soon as I sent that off, I was creating a contract with them
00:10:04.300 and accepting the fine, accepting the charge.
00:10:06.340 I can see here there's a section called Your Plea.

00:10:09.320 You've pled not guilty.

00:10:11.400 It seems a bit serious, doesn't it, that you have to have a guilty or not guilty plea for...
00:10:15.120 For being in a field with your children.
00:10:16.280 Something like this, you know, yeah.
00:10:18.120 And was it at this point that the fine went up on this form?
00:10:22.360 No, I ignored...
00:10:23.300 Again, I ignored that on the basis that I was not to accept,
00:10:26.580 create contract with them and accept the fine and the charge.

00:10:29.780 And then the next thing you knew, just a couple of weeks ago,
00:10:33.500 I woke up to a message from a friend saying that I was apparently famous
00:10:36.260 on the Barriand District website.
00:10:38.780 Right.
00:10:39.200 Where they had posted a big header saying that Barriand was charged
00:10:44.380 breaching coronavirus laws, or regulations, whatever it was,
00:10:47.960 and then they had my full blurb, my name, my address, charged with the price.
00:10:53.700 It's very much like a criminal at large kind of thing.
00:10:57.000 Yeah, on the website of the Barriand District News.
00:10:58.740 So that's publicly humiliating, I mean, it's a small community, isn't it?
00:11:03.260 Yeah, kind of.
00:11:03.800 It's not that big a town.
00:11:05.300 Right.
00:11:06.200 But at that point, I still hadn't had any correspondence from the courts.
00:11:09.600 They hadn't informed me I'd been fine.
00:11:11.580 It seems that the Barriand District got all of this information
00:11:13.960 and they were allowed to just post that on the website.
00:11:15.960 They'd scare people, I guess.
00:11:16.960 So you've put here, under your information for the court,
00:11:20.080 I'm pleading not guilty because I had not broken any laws.
00:11:22.420 I was acting lawfully, committing no loss, harm or injury to anybody.

00:11:26.620 If I'm good enough to travel the country and my job,
00:11:28.540 then I'm good enough to take my children to a field to ride their bikes.

00:11:32.760 Also, the police statement contains zero context and is not a factual document
00:11:36.240 according to what happened.

00:11:39.280 So it sounds like you're fighting this.

00:11:51.060 So with all the costs, you're looking at about a grand.
00:11:53.260 Near enough, I'd say, yeah, because they didn't tell me
00:11:55.380 when I contacted Cardiff magistrates to confirm that this actually was a case.
00:11:59.720 I asked who's the victim surcharge for,
00:12:02.500 because in my opinion, I'm the victim.
00:12:05.360 But they reckon they add that to every case
00:12:07.560 every time someone's charged for something.
00:12:09.420 They add a surcharge.
00:12:10.660 So it's not a surcharge then.

00:12:12.960 Well, that's what they call it, surcharge.
00:12:14.880 So they're just bolting things on, you know, sort of arbitrarily.
00:12:18.840 At the time, though, wasn't the maximum fine that they could offer you,

00:12:22.680 I believe so, yeah, because if you bear in mind, this happened in me.
00:12:25.580 So we were in lockdown one, and at that time, to my knowledge anyway,
00:12:29.160 we were in what they call a tiered fine system, fine structure,
00:12:33.140 where if you were caught for the first offence, use that term loosely,
00:12:37.520 it was sort of £60 or £100,
00:12:39.380 and every time you got caught after that, if you did so...
00:12:42.220 Using the term offence very loosely,
00:12:43.940 when you're talking about kicking a football around in the field
00:12:45.620 and letting your children cycle around and exercise and get out of the house,
00:12:49.240 I mean, that's, you know, not exactly a hardened criminal.

00:12:54.760 But, no, I mean, so they've since brought in this higher fine system.

00:12:59.700 And they're kind of retroactively imposing that upon what you did back in May.
00:13:04.580 And then all of the fees and all the rest of it that go into that,
00:13:07.420 you're looking at almost £1,000.

00:13:11.760 That's quite a worrying amount,

00:13:16.880 And so close to Christmas.
00:13:18.480 You know, that's the kind of thing that could ruin Christmas.
00:13:21.120 Well, I can't afford it, to be quite honest with you,
00:13:22.900 because I'm the only one that works in my household,
00:13:24.780 because our children are young still,
00:13:26.780 so my partner can't go to work yet.
00:13:28.940 And obviously, as you say, just before Christmas,
00:13:30.700 to be lumped with this, it would be impossible for me.
00:13:34.220 And it's one of those situations where it's kind of catch-22.
00:13:36.840 You pay the fine, can't afford that.
00:13:38.420 But also, you've got to fight the fine,
00:13:39.800 you can't afford that either.

00:13:43.900 expecting you to shell out money
00:13:46.020 that you don't have before Christmas.

00:14:36.260 I spoke to Bridget last week over Skype,
00:14:38.280 and I was livid, mom to mom,
00:14:41.760 to hear what happened to her.
00:14:43.080 It was so upsetting
00:14:43.880 that we just had to find a way to help her out.

00:14:51.940 up to North Bay to talk to Bridget
