00:01:35.160 And in the name of COVID-19 protocols, he's watching you a little too closely for my liking.

00:04:16.820 So, Sheila, I have to say, I love, love, love that sign outside Jenny's Diner.

00:04:25.480 not forcing you, just taking away everything until you consent, end quote.
00:04:31.540 Translation, the state is indeed forcing you to play ball
00:04:36.300 if the end result of noncompliance regarding the COVID mandates
00:04:41.160 means that your business is going to be shut down
00:04:44.440 or you're going to be terminated out of a job
00:04:47.560 should an individual refuse to get double vaccinated.
00:04:52.280 Sheila, this is nothing more than coercion at its worst.
00:04:57.900 It is not capital punishment, but it is certainly an economic death sentence.
00:05:03.980 Yeah, that sign outside of her store, I think it's the most popular thing I've ever tweeted.
00:05:12.120 And it's turning up on large conservative Instagram pages because it is the truth.
00:05:18.760 And the sign itself calls out the Orwellian nature of what's being done to people.
00:05:23.820 They're saying, oh, we're not forcing you.
00:05:26.600 It's not mandatory.
00:05:27.400 We'll just crush you using the full force of the state until you do it
00:05:32.200 or segregate you into a hole until such time as you comply.
00:05:37.440 It's just like Jason Kenney's restriction exemptions program.

00:06:53.800 And it couldn't have been that dangerous since they stayed and finished their meal.

00:07:12.380 If you truly believed that that was a dangerous event to the public health, you would not have
00:07:20.080 stayed and enjoyed your delicious meal courtesy of Jenny's Diner.
00:07:23.680 But they did stay, which means in theory, they don't believe the things that they're enforcing.
00:07:29.620 They're just more than happy to do it and ruin somebody's entrepreneurial dream, which is

00:07:35.360 She's got to revamp everything about how she does business there because she just won't
00:07:42.400 do this thing the government wants from her.
00:07:44.940 She says she's not going to be invading the privacy of our customers.
00:07:48.900 Now, she does have customers who do confide in her because that's the kind of person she
00:07:53.240 is and that's how beloved she is in the community.
00:07:55.360 But she's not going to pry it out of people who want to come and have a milkshake.

00:08:00.640 And those people who are terrified, just stay at home or go to curbside pickup or the

00:08:08.520 But you know, Sheila, I want to point out something.
00:08:10.360 I know a bylaw enforcement officer, that is an easy target for people to aim for.

00:08:19.120 I'm not anti-bylaw.
00:08:20.860 I mean, for example, if there was somebody in the neighborhood taking dirty motor oil
00:08:26.240 and pouring it down the sewer, that's bad.

00:08:31.340 I would want bylaw to say, hey, you've got to clean up your rack.
00:08:34.500 You can't do that for all sorts of environmental reasons.
00:08:38.120 But the idea that, you know, they're going around trying to shut down a business offering

00:08:49.640 So it's kind of like, I look at it, Sheila, like ticket scalping.
00:08:53.520 For the most part, law enforcement turns a blind eye to that.
00:08:56.780 If I want to buy a ticket for the Toronto Maple Leafs at 400% over face value and someone's
00:09:02.640 willing to sell it to me for that, well, what's the crime?
00:09:06.280 And yet here they are targeting a business to shut it down, going undercover.

00:09:11.960 You know, I was thinking about this the other day.
00:09:16.300 This is the same side of the political spectrum that says legalize drugs, people will take
00:09:23.440 on the risk, legalize sex work, because we can't call it prostitution anymore, but legalize
00:09:28.080 sex work, because, you know, that's two consenting adults engaging in a business transaction and
00:09:34.360 they're taking on the risk.
00:09:36.080 What is it?
00:09:36.540 Our business, that's their argument.
00:09:38.120 But two consenting adults cannot exchange money for a milkshake without the state getting
00:09:45.840 involved and destroying the business.
00:09:48.000 That's the times that we live in now.
00:09:51.240 And people don't even see how ridiculous it is that we have undercover secret shoppers going
00:09:56.780 after mom and pop restaurants who serve burgers and fries and cake pops to a willing community.
00:10:04.180 Nobody is in Jenny's Diner that doesn't want to be there.
00:10:06.540 It's not like somebody is abducting people off the streets, sitting them up at the diner
00:10:11.140 and saying, drink this milkshake or, you know, it gets the hose again.

00:10:40.260 You know, Sheila, in your video, what astonished me, and maybe it's because, you know, for seven
00:10:46.120 years of my life and another life, I covered the food service industry.
00:10:49.240 By the way, one of, if not the toughest industry to make money in, 80% of new restaurant startups
00:10:57.000 fail in the first three years.
00:10:58.680 That's how tough it is.
00:10:59.700 But what I noticed right off the bat, my God, that diner is immaculate.
00:11:06.300 It's like, to use the cliche, it's like you could eat off the floors.
00:11:09.680 And I challenge the government to say that this immaculate, pristine environment is somehow
00:11:16.780 a super spreader venue waiting to happen.
00:11:19.200 Whereas a big box store like a Costco or a Walmart that could never come near that level
00:11:26.320 of sanitation, that's okay.
00:11:28.380 How do you explain that, Sheila?
00:11:30.500 And that's the thing, David.
00:11:31.620 I've been in Jenny's Diner when they're full.
00:11:34.400 I've been there, you know, when they were open for customers full time.
00:11:38.400 It's always that clean.
00:11:40.100 She doesn't block off her dishwasher area, which can be the grossest part of a restaurant.
00:11:46.640 She doesn't block that off.
00:11:47.760 In fact, she's got a little mural back there because she's so proud of how clean and pretty
00:11:53.500 her restaurant is.
00:11:55.240 The benches just shine, like the booths shine.
00:12:01.420 And the thing is now, so that she is not forced to vax card her customers, she's going to rip
00:12:08.700 out all those booths.
00:12:10.780 She's taking them all out.
00:12:12.800 I don't know what's going to happen to them, but she said this beautiful little restaurant
00:12:16.720 that I built that's so cute and so quaint and so authentic, she has to take it all out
00:12:21.700 and she's going to fill up the space with retail items and, you know, other items that she can
00:12:28.800 sell that she makes, you know, like her cake balls and stuff, just to use up the spaces.
00:12:34.260 So she's not underwater on it, but she said, I can't use these booths and violate the privacy
00:12:40.280 of my customers.
00:12:41.000 So the booths got to go.
00:12:43.160 Unbelievable.
00:12:43.720 And somehow doing that makes Alberta a safer place, eh, Sheila?
00:12:48.880 Sheila, one last question, because we're going to wrap it up.

00:12:55.600 In your opinion, I mean, is there going to be a modicum of justice for Jenny?
00:13:00.420 Are, you know, bylaw and law enforcement and health officials still going to put the pedal
00:13:06.660 to the metal and making her life miserable?
00:13:09.020 Certainly there was so many in the community love her and love her diner.
00:13:13.140 How is this going to play out in the final analysis?

00:13:20.040 I did make sure that she did have a lawyer.
00:13:22.940 She does have her own lawyer because, you know, we would have gladly stepped in to help
00:13:28.340 her, but she's got one that she knows and she likes and she trusts.

00:13:33.740 But I think in the end, Jenny walks away.
00:13:38.720 That's what I think.
00:13:39.560 I think that this past 20 months of driving a wedge between Jenny and the customers she
00:13:47.620 so loves and who still love her, I think it's just demoralized her in such a way where I
00:13:56.960 don't know if her love of what she does will ever recover.
00:14:01.720 And I've never seen the sort of appreciation for what Jenny is doing.
00:14:07.820 I think maybe it was replicated with Chris Scott and Natalie Klein when they opened their
00:14:14.840 respective restaurant and barbershop in defiance of the lockdowns.
00:14:19.360 But people were out at the protest against the vaccine passport, marching with signs, not
00:14:26.920 ones that said, stop the vaccine passport, but signs that said, reopen Jenny's diner.
00:14:32.800 That's how the community loves her.
00:14:35.380 And for the health of the community, the Alberta government has said no.
00:14:40.400 And I think it's one of the most appalling things I've ever seen.

00:14:44.340 The only silver lining I can think of is at least Premier Kenney, unlike Mayor Tory, didn't
00:14:50.420 send all the king's horses and all the king's men, a la Adam Skelly of Adamson Barbecue, and
00:14:55.780 drag her away in handcuffs into a police cruiser.

00:18:26.040 So, Drea, before we get into the nuts and bolts of this story, what I found disturbing about this case is that Michaela actually went on a six-day hunger strike after the incident at the pharma safe occurred.
00:18:42.320 What was the reason for her doing that, Drea?
00:18:46.760 Well, equally disturbing is that she went to simply pick up her medication at the pharmacy in a small town, not a whole lot of options to do so.
00:18:56.080 Plus, it's where she always goes.
00:18:57.660 And she was denied the right to pick up her medication because she's unable to wear a mask.
00:19:03.000 And I call her Ella.
00:19:04.660 Ella is a fighter.
00:19:05.700 Apparently, I forget what, for what reason, but I think back in the 70s, she also did a hunger strike.
00:19:13.220 And so, I talked to her husband.
00:19:15.360 I said, are you worried about her?
00:19:16.400 He said, yes, but there's no stopping her.
00:19:18.460 I won't be able to stop her at all.
00:19:20.180 So, she's quite the rebel.
00:19:22.500 And she just said, no, that's ridiculous, which it is.
00:19:26.260 And, you know, Drea, that's the thing.
00:19:27.800 When it comes to hunger strikes, what I associate that kind of protest to is political protests.
00:19:33.620 And so, maybe that's where we are in Canada.
00:19:36.760 This is now a political issue.
00:19:39.700 You've got to wear a mask, even if medically you're unable to.
00:19:43.080 You've got to get the double jabs or you're going to lose your job.
00:19:47.680 Jeez, I just wonder if this is going to be a growing trend.
00:19:50.420 But it just shows how deeply passionate she was in saying no to this kind of overreach and coercion.

00:20:01.560 Maybe we have to switch up our tactics.
00:20:03.700 It's been, I think, 18 months of peaceful protests.
00:20:07.220 So, maybe silent protests.

00:20:09.780 I thought it would be interesting, since there's so many health care workers and frontline workers without jobs.
00:20:16.260 Maybe they could stand on the corner and beg for money, because that's the state they're being put into by these policies.
00:20:24.160 And I do think it's over-politicized.
00:20:26.060 So, maybe it's time to think outside of the box.

00:20:29.840 In the months ago, before there even was a vaccine, remember how we used to champion them as the frontline heroes?
00:20:35.240 And now that there is a vaccine, you're a frontline zero if you don't get the jab.
00:20:39.720 Just disgraceful.
00:20:40.860 But, you know, this pharmacy, they, especially being involved in the medical industry, if you want to call it that, Drea, they should know that there are exemptions based on age, based on medical status.
00:20:55.420 So, what was their reason for disobeying this bylaw?
00:21:01.260 I don't think they had a reason.
00:21:02.920 I think a lot of it comes down to people just hearing these public health lords say a statement.
00:21:10.640 And so, they assume that they can behave that way and it's legal.
00:21:14.260 And they don't do their due diligence to find out that, for example, in B.C., where Ella is from, where this took place, you have a duty to accommodate people if they're exempt.
00:21:25.100 And you're right.
00:21:25.600 As a pharmacy, people who are unable to wear a mask are more likely to have medical issues.
00:21:31.160 They're more likely to be in your business.
00:21:32.640 So, you have a duty to accommodate them.
00:21:35.180 Simply serve them, obviously, is what I would say.
00:21:37.400 But, I mean, there are other options.
00:21:39.840 They could have had a cordless way for her to pay and given her product outside or what have you.
00:21:46.080 But they didn't do any of that.
00:21:47.560 And I want to point out just, you know, the scary trend.
00:21:51.560 And this is why this fight was so important because here we are almost, I don't know, maybe just under a year ago, you have her taking this stand saying, no, this isn't right.

00:22:02.560 Flash forward to now.
00:22:04.440 We've let a lot slide.
00:22:05.580 And now you see there's parents who are unable to see their newborn babies because of these orders.
00:22:11.900 Or there's people being denied treatment in certain places.
00:22:16.080 People are just going rogue and doing their own thing, even if it's not lawful to do so.
00:22:21.580 So, that's why fights like this are so important.
00:22:24.640 You know, I think you're right.
00:22:25.600 I think it is about going rogue.
00:22:27.080 And I think the ostensible policy reason for them going rogue, Drea, is all based on virtue signaling, i.e.
00:22:35.600 We're going above and beyond what the government is requiring us to do.
00:22:41.400 I mean, I think back to in Hamilton, the Labor Day classic between the Tiger Cats and the Argonauts.
00:22:47.240 That was on Labor Day.
00:22:49.000 The VAX passport in Ontario didn't kick in until September 22nd, more than two weeks away.
00:22:55.620 And yet, for some reason, the Tiger Cats organization said, if you're not double jabbed, go home and watch the game on TV, even though they were not obligated to require a VAX passport on this day.
00:23:09.420 Do you think maybe that's what's driving some of these entities in terms of, you know, we're going to go over and above what we're actually required to do?
00:23:19.720 Yeah, I think that the groupthink mentality, or at least what people think it is because of what gets portrayed on mainstream media and the only thing you hear from the politicians is that everybody wants this.
00:23:31.400 But I don't really think that's true.
00:23:33.600 I think, and I don't even know if we can call it the silent majority, I think most people are saying this is going too far and I'm not really comfortable with where this is.
00:23:41.760 And when we're denying people basic needs like medication, we're in a dire situation.
00:23:48.820 And I think they are, you know, I think we've now learned that if people think everybody's jumping off of the bridge, they will too.
00:23:56.780 Yeah, and the other thing, Dre, of course, is that you are not above the law.
00:24:00.580 Well, I hearken back to several months ago, we went out to Imperial Home Hardware on Dufferin Street in Toronto, because if I hadn't seen this film from the customer, I never would have believed it.
