00:01:44.240 and the sentencing, well, it was downright disturbing.
00:01:47.140 First, there was the $23,000 in fines.
00:01:50.660 But even more unnerving was that Pastor Art was ordered by Justice Adam Germain
00:01:56.680 to give equal time to the government narrative whenever and wherever
00:02:01.840 Pastor Art voices his personal opinions about the pandemic.

00:02:44.320 who recently released the province's official rules for Halloween.
00:02:49.800 As expected, those guidelines are completely absurd.

00:02:57.240 The sanctions announced by Justice Adam Germain do not include imprisonment for Pastor Artur Pawlowski or his brother David.
00:03:10.960 They do include significant financial fines as well as an obligation to perform some community service work not associated with street church.
00:03:20.640 Additionally, and most problematically, both David and Artur will be under probation.
00:03:25.960 David for 12 months and Artur for 18 months.
00:03:29.180 And the contents of the probation, while some of it is fairly standard,
00:03:33.000 includes some problematic and apparently targeted attacks on their ministries and capacities as pastor.
00:03:39.500 First and foremost, Pastor Artur Pawlowski is forbidden from travel outside of Alberta.
00:03:44.380 This seeming response to the fact that he has been touring the United States
00:03:48.680 and bringing quite a bit of attention to his mistreatment at the hand of government authorities.
00:03:54.420 Furthermore, and again most troublingly certainly,
00:03:57.780 is the fact that Pastor Artur and David Pawlowski have been instructed to basically provide a verbal statement
00:04:04.360 that has been prescripted discussing masks, vaccines, and COVID-19
00:04:09.980 in a matter that is approved by the government following any public comments they make.
00:04:16.240 This has to be fleshed out and once we have the written ruling, we can explore this at length.
00:04:21.140 But this amounts to compelled speech.
00:04:23.920 Sanctions mandating that they follow up any statement with a pre-approved addendum
00:04:28.240 clarifying that their opinion is not necessarily that of the government's.
00:04:32.600 This is extremely problematic.
00:04:34.280 So, Pastor Artur, we have the ruling not going to jail,
00:04:39.120 but as you said, they've fundamentally attempted to undermine your capacity as a pastor.
00:04:44.940 Clearly, this is better than going to jail,
00:04:47.040 but how do you feel about the overall attack on your role as a pastor?
00:04:51.820 No, I'm going to jail.
00:04:53.120 I mean, there's no question about that.
00:04:55.080 They just did it in such a way to show that they are merciful.

00:05:37.400 And I know that what they're doing here in Canada is wrong.

00:05:44.260 And people expect their pastors, the clergymen, to speak the truth.
00:05:50.500 And this judge is effectively taking away my ability to tell the truth to the public.
00:05:59.500 I cannot and I will never obey that kind of ruling.
00:06:04.260 And we know we've seen charter rights violated from the get-go.
00:06:08.820 Compelled speech is the type of stuff we see in the Soviet Union,
00:06:12.340 forcing you to add an appendix from the government,
00:06:15.940 a footnote to every comment you make publicly as a pastor is ridiculous.
00:06:19.660 So we will be appealing that.
00:06:21.860 Do you have any words out there for people as we move forward with your legal battle
00:06:25.860 in light of this ruling and what your plan is moving forward?

00:07:19.060 whenever or wherever he chooses to speak about the pandemic.
00:07:23.900 This is the kind of court ruling you might have seen in the dark old days of the Soviet Union.
00:07:29.920 As for Canada, surely this is a deeply disturbing precedent
00:07:34.260 and one that is almost beyond belief.
00:07:38.340 And joining me now is the man who's been covering the Pastor Pawlowski saga from day one,
00:07:43.720 and that would be Adam Seuss.

00:07:50.600 Adam, I have to be honest, given the judge's rhetoric prior to sentencing,
00:07:55.800 I was truly expecting him to throw the book at Pastor Art.
00:07:59.660 I was expecting a multi-year jail sentence.
00:08:03.200 That didn't happen.
00:08:04.720 And while nobody wants to be jailed, I have to be honest,
00:08:08.340 these free speech restrictions might even be worse than a prison sentence
00:08:13.320 when it comes to someone like Arthur.
00:08:16.200 What do you say, my friend?
00:08:18.060 Well, you know, it's really interesting.
00:08:19.240 I don't know if you're watching the live stream of our coverage from the courthouse,
00:08:22.340 but I actually said a few times, because I had this sneaking suspicion
00:08:25.440 that he may be laying out this heavy case and stating that imprisonment was entirely justified.
00:08:33.120 In a similar fashion to the fact that before he determined that the Pawlowskis,
00:08:37.420 Chris Scott and everyone else, basically, who were under this umbrella ruling,
00:08:40.680 were guilty of contempt of court,
00:08:42.580 he seemed to be providing a lot of commentary on how there was reasonable grounds
00:08:47.420 to suggest that they shouldn't be found guilty in contempt of court.
00:08:50.880 After laying all that out and applauding Sarah Miller for exceptional work,
00:08:55.580 he basically came out with a guilty and all counts ruling.
00:08:58.520 Based on that experience last time, when he was laying it on so thick and saying prison is entirely justifiable,
00:09:05.200 I had this sort of sneaking suspicion in the back of my mind that he's saying this for political purposes,
00:09:10.700 to basically say that the government did no wrong, that AHS did no wrong.
00:09:15.280 But he knew from a legal precedent that throwing someone in jail for, again, he's already spent three days in jail,
00:09:22.060 but throwing someone in jail for an extended period of time, again, with one contempt case,
00:09:27.260 one instance, not repeated instances, would lose on appeal immediately.
00:09:31.100 So I think he tried to do the most punishment that he could without sending him to jail.
00:09:36.340 But on that one hand, it does seem like a victory in that there wasn't a jail sentence,
00:09:40.880 but it is good news, bad news.
00:09:42.580 And the bad news is exactly this.
00:09:45.300 It's the fact that they've basically undermined his capacity as a pastor,
00:09:48.900 and they've basically tagged on him this Twitter or Facebook-style warning
00:09:53.460 that everywhere Pastor Archer goes, he has to say COVID information
00:09:57.240 and provide a little disclaimer from the government.
00:09:59.680 You are entirely right in suggesting that is communist-era politics.
00:10:04.800 When I spoke with Sarah Miller, I asked her if there's any precedent of a court ruling
00:10:08.900 where a pastor or a person who speaks publicly was ordered to, after every public statement,
00:10:14.900 add a little addendum or footnote providing official government data to contradict their own positions.
00:10:20.720 You know, but Adam, even so, do you think Justice Germain has painted himself into a corner?
00:10:26.500 I mean, I'm not a lawyer, but by that I mean he has laid out the law to him,
00:10:32.180 i.e., when you speak publicly, whether it's in the public square or on social media,
00:10:37.280 you have to give a corresponding amount of time to the AHS or government narrative regarding the pandemic.
00:10:44.420 We know Archer is not going to do that.
00:10:46.960 So if he doesn't do that, and maybe he's already not done that,
00:10:52.660 that would be, I guess, what, contempt of court?
00:10:56.240 So now the justice is back in the position of either fining him or sentencing him to jail again.
00:11:05.120 So the big question to me is, will this justice double down when it comes to the actual enforcement of this mandate?
00:11:14.900 Because I would argue, Adam, it's only a matter of time.
00:11:18.100 Yeah. Well, the two potential outlets or the two potential thoughts on this are,
00:11:23.640 one, and this is optimistic and I don't necessarily believe it,
00:11:26.460 but it is the thought that perhaps he thought he could sort of silence him
00:11:31.120 and just kind of put him by the wayside, not throw him into jail.
00:11:35.620 He literally mentioned that he didn't want to allow Pastor Archer to become a martyr of sorts in prison.
00:11:40.460 So it's very much political, but maybe the thought was, well, maybe we waylay him and stick him to the outside.
00:11:46.060 I think that's naive, to be honest, because we know Pastor Archer Poplowski will not be silenced
00:11:51.300 and he will not be adding little footnotes or addendums.
00:11:53.680 I think what they are likely to do and what is probably what you're suggesting is be like,
00:11:59.760 see, this is yet another case of contempt and now we're justified with more severe punishments.
00:12:04.540 But what they don't realize they're doing by trying to thread this needle and have the best of both worlds,
00:12:09.320 what they're doing is continuing to provide a growing platform
00:12:12.960 and make international parties more and more aware that this is clearly political and that he's being targeted.
00:12:19.660 They've set up this ridiculous thing.
00:12:21.020 This compelled speech mandate is by every metric that I understand, and I'm not a lawyer, but it's illegal.
00:12:27.140 You can't force someone, it's against their fundamental rights as a Canadian,
00:12:30.500 to have to say something after every public statement.
00:12:33.200 It's ridiculous.
00:12:33.960 If there was ever any doubt whether or not this was political,
00:12:37.540 Justice Adam Jermaine's extended comments before he gave his ruling,
00:12:42.300 just basically stipulating nothing to do with the contempt of court case,
00:12:45.100 but restating government talking points on COVID, finalize that conclusively,
00:12:50.100 and then to cement it entirely, his ruling where Pastor Arthur isn't allowed to tour and speak,
00:12:55.620 he's not allowed to leave the province, and then worse still,
00:12:58.340 Pastor Arthur is subjected to these probation terms that are virtually unprecedented,
00:13:03.440 where he's fundamentally being stifled as a pastor.
00:13:05.920 It sets in stone that this was a political ruling, not a legal ruling.
00:13:11.960 Oh, 100%, Adam.
00:13:13.320 It was definitely a political ruling.
00:13:14.800 But by the same token, do you think that Justice Jermaine is experiencing some buyer's remorse?
00:13:22.660 Because he didn't want to put Pastor Arthur in jail to further continue on the martyr narrative.
00:13:31.060 But I would suggest what he did with this, you know, curbing of his free speech is even worse,
00:13:38.840 even more noteworthy, even more enraging to the world community that cares about freedom of speech.
00:13:45.260 I'm just wondering if we had Justice Jermaine's ear in a private conversation.
00:13:52.500 He's saying, yikes, I think I blew it with this ruling.
00:13:57.560 And it very much, it resembles, and this furthers the narrative that this is political,
00:14:01.520 it resembles Jason Kenney's management of the COVID-19 situation from the beginning.
00:14:06.700 He's attempting to play both sides of the conversation.
00:14:10.680 And instead of committing to one platform, whether that be opening or moving towards restrictions,
00:14:15.320 he's trying to keep everyone happy.
00:14:17.320 They're more concerned about public polls than a logical course of action moving forward.
00:14:22.320 This initiative by Justice Jermaine was, I think, a horribly failed attempt to thread that needle.
00:14:28.180 And I can tell you almost conclusively that there is an element of buyer's remorse,
00:14:31.520 or at least some second thought.
00:14:33.360 Because as court was wrapping up yesterday, Sarah Miller mentioned in court,
00:14:37.720 and we'll get the transcripts to make sure that we have this accurately.
00:14:40.040 We will share that with our viewers, of course.
00:14:41.700 But Sarah Miller basically said that all the cases of precedent that she cited are a large number of them.
00:14:47.540 Justice Jermaine didn't even mention in his final ruling.
00:14:51.120 And he said something to the effect of, well, I'm only human.
00:14:53.980 The written ruling was actually supposed to come out this morning.
00:14:57.540 And obviously, the written ruling would be virtually ready to go at the time it was read by Justice Jermaine,
00:15:02.380 maybe some minor tweaks.
00:15:03.540 They've delayed it until tomorrow.
00:15:05.220 So I suspect, I mean, I don't know if this is legal, I'm not a lawyer,
00:15:09.580 but a ruling that should be out in written form and presented this morning has been delayed by 24 hours.
00:15:16.000 I don't know if tweaks are being made or if there's amendments being made
00:15:19.380 because of all the criticism and backlash that has come his way.
00:15:22.740 But I would certainly love to get my hands on that original written ruling
00:15:26.060 as it stood when it was read by Justice Jermaine.

00:15:29.460 Can't wait for that, Adam.
00:15:30.500 And Sarah Miller, who has been doing incredible work,
00:15:35.160 she described the judge's ruling as bizarre.
00:15:39.260 And make no mistake, that's quite harsh for a lawyer to call a judge's ruling bizarre, isn't it, Adam?
00:15:47.740 Oh, entirely.
00:15:48.420 And I mean, Sarah Miller is a well-respected lawyer, something of a legal prodigy.
00:15:53.520 Sheila and I often joke that she was born in a lab to fight in court for freedom.
00:16:00.940 But, I mean, she's in incredibly good standing and is well-respected.
00:16:04.500 And for something to be so outlandish and his comments to be so out there
00:16:09.160 that Sarah Miller is left kind of scratching her head saying,
00:16:12.760 this is bizarre, it says something significant.
00:16:16.560 This is not simply a matter of Pastor Arthur Pawlowski is our guy
00:16:20.060 and therefore we don't like this ruling.
00:16:21.680 There's certainly some extrajudicial considerations in what Justice Jermaine presented
00:16:27.880 that should be garnering the attention of civil liberties unions and organizations and groups,
00:16:34.720 lawyers across this country.
00:16:36.080 I certainly hope that the Alberta Court of Queen's Bench is looking at this
00:16:39.720 because this is, by every metric, bizarre.
00:16:43.060 And bizarre is not a word you want to hear when you're discussing court rulings.
00:16:46.740 And one last question before we wrap, Adam.
00:16:50.300 When it comes to, since you mentioned civil liberties unions,
00:16:54.940 has the Canadian Civil Liberties Association weighed in on this yet?
00:17:00.320 It has been, man's the word, shockingly.
00:17:03.460 And, I mean, it goes beyond that.
00:17:05.160 It seems that there's just a societal collaboration, willingness to cover this up.
00:17:10.040 Civil liberties unions have not said a thing.
00:17:12.080 Mark my words, if these were the exact same circumstances and the exact same words were being spoken
00:17:17.500 and it was any other religious group, civil liberties groups would be all over this.
00:17:21.780 They simply are not.
00:17:22.800 The other thing that we noticed that was so absolutely jarring is there was probably about
00:17:26.380 a hundred people outside of the court at 9 a.m. on a Wednesday on a very cool day.
00:17:31.900 City TV and numerous news outlets they're building is literally like you could throw a tennis ball and hit it.
00:17:38.620 It is at the end of the block.
00:17:41.380 They didn't say, oh, wait, there's a massive protest outside.
00:17:44.140 What's going on?
00:17:44.700 This is an international story.
00:17:46.500 And the groups that are supposed to be fighting for civil liberties, particularly religious civil liberties,
00:17:52.740 and the organizations that are supposed to be covering the news,
00:17:56.120 even a block away can't be bothered to come out and cover this international news.
00:18:00.740 It's truly troubling.
00:18:01.480 And, you know, I'm glad we'll end it on that, Adam, because that's what's perversely ironic about this case.
00:18:08.860 As you know, back in the 1930s, the premier Bible Bill Eberhardt, as he was called,
00:18:15.540 he was on a jihad against the media then, the newspapers, who would dare write criticism.
00:18:22.320 He was demanding that the government side be presented.
00:18:26.620 And the Edmonton Journal did such great work.
00:18:30.340 They actually won a well-deserved Pulitzer Prize.
00:18:33.740 Well, this judge is kind of doing what Bible Bill did back in the 1930s.
00:18:38.400 But the silence from the media watchdogs, which, of course, are more like lapdogs these days, it's deafening.
00:18:45.880 They're not interested in a Pulitzer Prize exposing an abuse of the state.
00:18:51.460 They are simpatico with shutting down free speech, aren't they?

00:19:44.320 Australian DC comic book writer for Superman has a new reimagining for Superman's son, Jonathan Kent, that is.

00:19:53.080 But is this just a marketing psyop?

00:19:56.660 Tom Taylor appeared on CNN this week to let everyone know that it would be a waste if Superman was just another straight white guy this time around.
00:20:04.000 Was what does Superman, what should Superman represent today?
00:20:08.280 A new Superman, if you're going to make a new Superman, what should that look like?
00:20:12.300 And it struck me as it would be a real opportunity lost if we had another, we had Clark Kent replaced by another straight white savior.
00:20:21.660 So here was an opportunity to create a Superman who could represent a whole new group of people.
00:20:29.680 Damn Superman, saving people and being white, you monster.
00:20:34.000 I'm kind of suspicious that Taylor is trolling, though, and just had the idea, well, what's the most ridiculous thing I can put into the comic to get people's attention and trigger people on the right wing?
00:20:43.780 Consider that the writer also discussed the new Superman is going to have to tackle tough issues, like refugees and climate change.
00:20:51.180 And I think that was one that we had to leave them.
00:20:54.800 And we'll be addressing modern day issues, like?
00:20:59.720 Like, like the climate crisis, like refugees.
00:21:05.720 John, in the last issue, has just been arrested attending a protest, trying to stop the refoundment of asylum seekers.
00:21:12.420 Not that I planned on buying a Superman comic book anytime soon, but this might be a genius marketing ploy by this writer.
00:21:19.380 A young Superman kissing a Japanese boy with pink hair just screams endless talk show segments about the impacts this could have on society.
00:21:27.800 This is ridiculous, you can't change Superman, the right wing will say.
00:21:31.400 Conservatives are so intolerant, how come they can't accept this, the left wing will say.
00:21:34.660 All the sources will be outraged and therefore everybody wins.
00:21:37.680 You have a writer in a rainbow Superman shirt, saying it's a waste to have a straight white Superman, and then puts him in protest for illegal immigrants.
00:21:46.220 This is like a boomer's worst nightmare come true.
00:21:49.240 But it all ends up in us talking about a comic book that probably 500 people would have bought otherwise.

00:22:54.000 And yet, when I was watching that writer during the CNN interview that you had as part of your report,

00:23:11.820 That's what I gather, David, is that he knows exactly what he's doing.
00:23:15.140 He's not dedicated to, you know, this social justice point of view in the comic.
