00:01:10.500 Tonight, the most bizarre court order I've seen in Canada. A judge orders Pastor Arthur to denounce
00:01:18.860 himself every time he speaks in public. It's October 13th, and this is The Ezra LeVant Show.

00:01:44.440 Today, the judge enforcing Alberta's pandemic lockdown laws sentenced Pastor Arthur Pawlowski.
00:01:51.320 His crime? No crime, actually. He simply opened his church during the lockdown.
00:01:56.540 In a bizarre 40-minute rant today, Justice Adam Germain ordered that for the next 18 months,
00:02:04.280 whenever Pastor Arthur talks about lockdowns, the pandemic, or vaccines, in tweets, in speeches,
00:02:11.620 in media interviews, he must immediately repudiate himself.
00:02:14.940 And give the official government view condemning himself after he gives his own views.
00:02:22.080 He must argue against himself. He must condemn himself or go back to jail.
00:02:26.720 It's compelled speech, like a Maoist struggle session in communist China.
00:02:31.780 You have to say what the government tells you to say.
00:02:35.120 This is unheard of in Canadian law.
00:02:37.100 Even convicted murderers cannot be ordered to apologize for their crimes.
00:02:40.600 In any way, such a forced apology would be meaningless.
00:02:44.460 But a convicted pastor must now violate his own conscience
00:02:47.460 and repeat an angry judge's talking points or face prison.
00:02:51.740 And that's the whole point of it.
00:02:52.960 This judge wants Pastor Arthur to submit,
00:02:56.820 to acknowledge the government as his master.
00:02:59.740 And if he can't convince Pastor Arthur of this voluntarily,
00:03:03.440 he'll just force him to say it with a court order.
00:03:05.300 It's like forcing him to kneel, which the police have already done.
00:03:11.840 The judge also hit Pastor Arthur with $42,000 in fines
00:03:16.400 and another $10,000 for his brother, David.
00:03:20.160 What a disgrace this judge is, especially to Alberta,
00:03:22.940 whose official motto is strong and free.
00:03:26.340 And that's not all.
00:03:27.240 In his 40-minute rant, the judge repeatedly criticized Pastor Arthur
00:03:30.600 for talking about civil liberties to the media.
00:03:32.740 He specifically mentioned Pastor Arthur's appearance on Fox News.
00:03:38.680 But what does that have to do with allegedly breaking a Canadian lockdown law?
00:03:42.960 Nothing.
00:03:43.940 But it has everything to do with politics.
00:03:45.940 So to stop more media appearances by Pastor Arthur,
00:03:49.520 the judge has ordered him to self-denounce after every public statement.
00:03:53.360 So an interview would be ridiculous.
00:03:54.620 The judge also raged at Pastor Arthur for going on a speaking tour
00:04:00.540 and warning other churches around North America about the threat to civil liberties.
00:04:05.380 So to stop that, the judge also banned Pastor Arthur
00:04:09.680 from leaving his home province of Alberta for the next 18 months.
00:04:13.160 He's banned.
00:04:14.840 There's no legal precedent for any of this.
00:04:17.540 It's completely unconnected to Pastor Arthur's alleged lockdown crimes.
00:04:21.560 It's simply a power-mad judge's revenge on Pastor Arthur,
00:04:26.660 a blatant attempt to stop him from speaking freely.
00:04:29.480 This truly is the most absurd, un-Canadian,
00:04:32.140 and clearly unconstitutional court ruling in recent memory.
00:04:36.340 In fact, to find anything like it,
00:04:38.380 you have to look back nearly 90 years
00:04:40.340 to William Eberhardt, the former Alberta premier.
00:04:43.780 Eberhardt passed a series of laws together called the Alberta Press Act,
00:04:47.500 which forced newspapers to print the government's rebuttal to their own editorials.
00:04:52.600 That laughably illegal law was taken all the way to the Supreme Court,
00:04:58.100 and in 1938 it was struck down.
00:05:01.060 And the Edmonton Journal, the newspaper that led the charge against the Press Act,
00:05:05.100 they won a special Pulitzer Prize for their efforts.
00:05:09.720 Justice Germain has brought back that illegal law,
00:05:11.920 but applied it just to one citizen.
00:05:15.060 Alas, today the mainstream media are cheering for the censors this time.
00:05:19.340 It'll probably not surprise you that Justice Adam Germain
00:05:22.280 is a failed liberal politician
00:05:24.580 who, after he lost his election,
00:05:26.600 was appointed to the courts by Jean Chrétien.
00:05:30.300 Obviously, Pastor Arthur intends to appeal,
00:05:32.520 and obviously we've got to help him.
00:05:34.260 I just got off the phone with Pastor Arthur's top gun lawyer, Sarah Miller.
00:05:37.420 We're relieved that Pastor Arthur was kept out of jail.
00:05:41.840 Jason Kenney's prosecutors has demanded a 21-day prison term.
00:05:46.700 But Justice Germain is smart enough to know that
00:05:48.700 actually throwing the pastor back in prison
00:05:51.340 would have made international headlines again,
00:05:53.620 and clearly that's been on the judge's mind.
00:05:56.660 But what he's done here,
00:05:58.020 issuing a political self-denunciation order,
00:06:00.560 is almost as bad.

00:07:18.200 issued today by a liberal partisan

00:07:24.140 His name is Adam Germain,
00:07:26.420 and what's troubling to me
00:07:28.360 is that just a couple of hand-picked judges
00:07:31.360 in Alberta
00:07:32.660 have been given all the lockdown cases,
00:07:35.480 and I can't think it's a coincidence
00:07:37.560 that they chose
00:07:38.400 two of the most heavy-handed authoritarian judges
00:07:41.380 to do it.
00:07:42.720 And Adam Germain,
00:07:45.640 the fact that he was a liberal partisan
00:07:47.200 probably doesn't say as much
00:07:48.920 as just the fact that he is
00:07:51.520 clearly a total believer
00:07:54.860 in all lockdownism,
00:07:57.880 and he has a deep despise
00:08:00.260 for anyone who thinks differently,
00:08:02.760 who has a different opinion.
00:08:04.720 And I think the fact that Arthur Pavlovsky

00:08:29.760 salivating over the prospect.
00:08:31.040 They demanded he be jailed for 21 days.
00:08:34.340 Now, the judge didn't do that.
00:08:35.720 I think he knew that would create
00:08:37.200 an international shockwave.
00:08:39.260 And the media was very much
00:08:42.780 on the judge's mind.
00:08:43.640 He referred to Pastor Arthur's
00:08:46.260 media appearances,
00:08:47.440 including on Fox News,
00:08:48.640 that clearly bothered the judge.
00:08:50.920 So the judge didn't say,
00:08:52.600 I'm going to throw you in jail,
00:08:53.420 but he did something much worse.
00:08:55.760 He said,
00:08:56.320 anytime you say anything in public
00:08:57.800 about the lockdowns,

00:10:30.980 who violated the same order
00:10:32.880 that Art was arrested under
00:10:34.600 when he held his meeting
00:10:35.960 up on the Sky Palace,
00:10:37.540 that private dining club
00:10:39.540 that they have up on Sky Palace.
00:10:41.740 So, I mean, the judge,
00:10:44.020 he had a very specific list
00:10:49.160 of things that he referred to.
00:10:51.000 He said that
00:10:53.400 because of the ability
00:10:55.460 of Chris Scott,
00:10:56.820 who was also sentenced today,
00:10:58.240 and the Poloskis
00:10:59.380 to fundraise
00:11:00.360 that they would require
00:11:01.260 strict and steep fines.
00:11:04.200 And that's what they got today.
00:11:07.160 And AHS was awarded costs.
00:11:10.160 So, I mean,
