00:07:19.460 has spoken out loudly against this declaration and today we have our own announcement we are taking
00:07:26.260 the government of canada to court we are here today because of the government's response to the
00:07:32.660 protests and blockades the government's emergency declaration is unprecedented and seriously infringes
00:07:39.940 the charter rights of canadians the government has brought in an extreme measure that should be
00:07:45.780 reserved for national emergencies a legal standard that has not been met emergency powers cannot and must
00:07:54.420 not be normalized for all the peaceful and disruptive protests in canada's history some involving unlawful acts
00:08:06.900 and protected standoffs with police never before has a government declared a national emergency under the
00:08:13.780 emergencies act and with that given itself the enormous powers to bypass the ordinary accountable democratic process
00:08:21.620 our commitment to equality and other rights is the reason that we strongly support the charter right to peaceful assembly
00:08:30.180 this is how marginalized people can stand up for their rights we plan to file a notice of application
00:08:36.580 for judicial review seeking a declaration that the emergency order and in the emergency order the measures and
00:08:44.260 the orders promulgated under it are not consistent with the emergencies act

00:08:56.580 law perspective for the courts to scrutinize these actions and ensure that they are consistent with

00:18:27.060 as long as as long as the requirements in the statute are met and if those requirements are not met
00:18:37.300 then nothing else works nothing else is valid in other words the government cannot act in this way
00:18:43.140 unless it has statutory authority right so that's the first point second point is this
00:18:49.540 the emergencies act provides for four different kinds of emergencies
00:18:57.860 public welfare public order international and war now on this occasion if you look at the proclamation
00:19:10.020 the declaration that the government has brought forward they have chosen
00:19:14.980 a public order emergency so the other three are now out we're talking about a public order emergency as
00:19:25.220 defined in the act so let's look at the definition and the words as is always the case when you're
00:19:34.180 dealing with law the words matter the words matter they define the line between lawful and unlawful so here's
00:19:43.140 the definition of a public order emergency it means an emergency that arises from threats to the security
00:19:56.180 of canada that is so serious as to be a national emergency
00:20:03.300 okay now as is so often the case in statutes you have definitions that have terms that are themselves defined
00:20:14.260 so one of the requirements of meeting this threshold for a public order emergency
00:20:20.660 is to have a national emergency what does national emergency mean in the statute it means this
00:20:28.500 it means an urgent and critical situation of a temporary nature that is either a or b and here's a and i'll tell you b a is this
00:20:39.380 a it seriously endangers the lives health or safety of canadians and is of such proportions
00:20:47.940 as to exceed the capacity or authority of a province to deal with that's a b is seriously threatens
00:21:00.820 the ability of the government to preserve the sovereignty security and territorial integrity now
00:21:07.620 let's do the two choices it's got to be a or b and in this case i'll get to in a minute the government
00:21:12.820 has chosen a so forget b and the final bit of that definition is and that cannot be effectively dealt

00:21:30.260 little bit so who was there at the press conference um what were they saying and uh why uh why is it
00:21:39.060 important to hear what they were saying so um the um it was a lot of illegal experts uh as well as a truck

00:26:08.500 complying to their demand um so this morning i was on the field at 6 00 a.m and uh since uh 5 00 a.m uh
00:26:17.540 the construction workers were are built up a fence all around the parliament but fun fact they have
00:26:25.780 already a fence around the parliament but he built one upper that the other one and when i asked the
00:26:33.300 police officer they say that is for the safety of the people i don't see why is the safety on that

00:26:49.380 yesterday they gave a notice of a warning to everybody who had a truck or protestor supporter
00:26:56.740 to move their car and their truck from the street and if they don't agree they are subject to be arrested
00:27:04.420 for taking part to illegal action but this morning they came back with another notice this time a red
00:27:12.020 paper to say um this is a final notice if you're not moving your car you're facing uh

00:27:26.660 you you're actually breaking the law and you will be arrested uh for stopping the truck traffic stopping the
00:27:33.780 uh blocking the road and uh stopping uh people to go and work in their shop and open the businesses

00:28:20.500 the street are open and it's only one street i can say that is almost completely blocked it's um it's a
00:28:30.820 kent street but most of the other street it's all clean you can pass you have no problem for that

00:28:46.500 police to pass and for the circulation so right now for the traffic you have no problem everybody can

00:29:41.620 national emergency that we need to suspend civil liberties is such a laugh and when you're telling

00:29:52.100 justin trudeau is well he's staging a kind of coup i think and that he's removing civil liberties away

00:31:55.140 tricky fancy investment move it wouldn't surprise me in fact it would surprise me if he didn't
