00:00:00.000 Hello, my friends. What an incredible 48 hours it's been.
00:00:03.320 We beat Justin Trudeau in federal court yesterday, and then we beat him again today.
00:00:08.020 I want to tell you all about it. It's on today's podcast.
00:00:11.220 I want to invite you to get the video version of the podcast, too.
00:00:13.880 We call it Rebel News Plus. Just go to rebelnewsplus.com.
00:00:16.940 It's eight bucks a month. Bob's your uncle.
00:00:18.860 We don't take any money from Justin Trudeau, and I think that's why he doesn't like us.
00:00:23.080 That's why he fights us in court.
00:00:24.700 If Trudeau had his way, there'd be only two kinds of journalists in Canada.
00:00:27.740 Those who are paid by the government and those who are banned by the government.
00:00:32.880 If I had to choose between those two, I know which side I'd be on.
00:00:37.320 All right. Just go to rebelnewsplus.com to subscribe.
00:00:41.700 Otherwise, here's today's podcast.
00:00:57.740 Tonight, we beat Trudeau in court today. I'll have all the details.
00:01:02.720 It's September 8th, and this is the Ezra LeVant Show.
00:01:06.920 Why should others go to jail when you're a biggest carbon consumer I know?
00:01:10.700 There's 8,500 customers here, and you won't give them an answer.
00:01:14.800 The only thing I have to say to the government about why I publish it is because it's my bloody right to do so.
00:01:20.640 Yesterday, we had a three-hour emergency trial, a hearing at the Federal Court of Canada.
00:01:32.780 It was our application to get the court to order Justin Trudeau's hand-picked debates commission to let in our Rebel News reporters.
00:01:41.840 Eleven of our reporters had applied to go.
00:01:44.420 You might recall that last year, Kian Bextie and David Menzies applied to go.
00:01:49.260 They were blocked.
00:01:50.700 We went to the federal court in 2019, and we won.
00:01:54.160 They were accredited.
00:01:54.800 They went and asked great questions.
00:01:56.660 I thought, well, let's do it again, but not just with two reporters.
00:01:59.560 Let's send a ton of them.
00:02:01.220 So we sent 11, which I think weighs about a ton.
00:02:05.960 And as you might guess, they were all rejected by Trudeau's debate commission.
00:02:10.800 But they did it different this time, because last time, the Federal Court of Canada said this was outrageous.
00:02:17.180 You gave them a one-line response.
00:02:19.240 You didn't publish the rules.
00:02:20.600 You had no systems.
00:02:22.620 You outsourced the decision.
00:02:24.080 This is atrocious in all ways.
00:02:25.800 Those lads are going in.
00:02:27.420 So in the last two years, this debates commission has obviously taken that to heart.
00:02:32.840 And they thought, well, we will be so rigorous, there's no way a judge will let us, force us to take in the rebels.
00:02:41.360 So instead of having a two-line email saying, sorry, guys, you can't come with really no explanation,
00:02:47.160 they sent us like 10-page, deeply researched lawyer's letters for every one of our applicants.
00:02:54.920 Instead of having secret rules, they published their outrageous rules right online.
00:03:01.660 They clearly have spent the last two years thinking, how can we stop rebel news?
00:03:07.680 In fact, we were the only media outlet referred to by name in the application process.
00:03:14.200 It was incredible.
00:03:15.880 You know, the Americans have a concept of bill of attainder.
00:03:18.640 It's a phrase, it's an archaic phrase.
00:03:20.280 You can see it in their constitution.
00:03:21.480 It's against the law in their constitution.
00:03:24.100 A bill of attainder is when you pass a law targeting one guy.
00:03:28.180 Like, let's say you wanted to target Bill Gates and take all his money.
00:03:32.160 That's against the law in America.
00:03:33.560 It's called a bill of attainder.
00:03:34.700 That's really what Trudeau's Debate Commission did to us.
00:03:37.760 They had this whole system designed just to stop us.
00:03:41.280 They were obsessed.
00:03:42.240 They did all sorts of opposition research, digging up old things that all our reporters
00:03:46.000 might have written about or tweeted about in the past.
00:03:48.320 It was a little bit creepy.
00:03:49.220 The trial yesterday was very exciting.
00:03:52.520 The judge was based in Newfoundland.
00:03:54.360 The lawyers for the commission were in Ottawa.
00:03:57.440 Another Justice Department lawyer was in Toronto.
00:03:59.720 There were seven lawyers on Trudeau's side.
00:04:01.780 We had one guy, Chad Williamson, in Calgary.
00:04:04.120 So it was truly a national Zoom hearing.
00:04:06.680 There were about 2,000 people watching the hearing on Zoom.
00:04:11.160 I don't know, but I think that's got to be one of the largest watched, most watched court
00:04:16.840 cases in Canadian history, other than the Supreme Court cases, which are televised.
00:04:22.520 It was incredible.
00:04:24.620 And I had a good feeling about it because the judge was asking skeptical questions of the
00:04:30.160 government.
00:04:31.280 And frankly, I think the government talked too long.
00:04:34.040 They were a little bit overdone.
00:04:35.300 Again, they had seven lawyers on their side.
00:04:37.100 I understand that they filed 2,000 pages of submissions to the judge the night before.
00:04:42.680 And I know that because the judge, the very first thing she said when the trial was on
00:04:46.520 was, why did you send me 2,000 pages to read last night?
00:04:49.420 There's no way I could have humanly accomplished that.
00:04:51.400 I think the judge was sort of upset with Trudeau's lawyers from the very beginning and it went
00:04:54.720 downhill from there.
00:04:55.380 Anyways, the trial went three hours and the judge said, I'll let you know the results tomorrow.
00:05:01.580 So I went to bed last night with a good feeling, but I didn't want to get my hopes too high.
00:05:06.040 You know how that is.
00:05:07.220 It's better to be a pessimist.
00:05:08.660 That way you're never let down.
00:05:10.100 In fact, I sort of drafted two emails, one if we won, one if we lost.
00:05:14.420 And I thought, oh, good luck to us.
00:05:16.640 But this morning we got the news and here it is.
00:05:20.160 See for yourself, the ruling from the federal court.
00:05:22.700 Now she didn't get into her deep reasons because she just wanted it quick.
00:05:25.520 She ordered them to accredit all 11 of our journalists in the manner that all other journalists
00:05:34.000 are.
00:05:34.280 Now, because of the COVID rules, some journalists are in person.
00:05:39.600 Some journalists are on a phone system.
00:05:41.840 But all 11 of our journalists are accredited.
00:05:44.360 Alexa LaVoie will be our journalist going in in person.
00:05:47.220 So that was yesterday.
00:05:48.280 It was great.
00:05:49.520 And what made it feel so great is knowing that Trudeau spent, what, a million and a half
00:05:54.860 dollars, seven lawyers, two years scheming for that day.
00:05:59.000 And they failed and freedom won.
00:06:01.340 And I love the fact that the judge was Newfoundland.
00:06:03.300 I know it shouldn't matter, but I really like that, that a judge who probably is considered
00:06:09.520 sort of an outsider, you know, Newfoundland, as opposed to being in the center of the country
00:06:13.440 in Toronto.
00:06:13.760 I love the fact that a Newfoundland judge struck down, you know, Ottawa Trudeau and his
00:06:20.140 Ottawa and Toronto lawyers.
00:06:21.480 I have to tell you, that made me feel pretty good.
00:06:23.000 Um, so that was great.
00:06:26.020 But, uh, my question is how come this keeps happening?
00:06:30.060 And by the way, the actual chief commissioner of the debates commission, his name is David
00:06:34.060 Johnson.
00:06:34.420 That should ring a bell.
00:06:35.120 He was our former governor general who had an illustrious career as a professor, a scholar,
00:06:39.780 a journalist, governor general.
00:06:41.360 And now he's running this ragtag operation as an errand boy for Trudeau.
00:06:46.680 And he's lost twice.
00:06:48.080 He's presided over Trudeau's little scheme twice.
00:06:51.280 And, and he's, why is he allowing his reputation of a dignified, successful, scholarly man to
00:06:58.860 be sullied like this in, in the sunset of his life?
00:07:01.360 I don't understand that.
00:07:02.420 I looked at the debates commission and my old friend, Deborah Gray is on it.
00:07:06.600 Remember the very first reform party MP from Alberta.
00:07:09.500 She sat by herself.
00:07:10.520 Stan Waters was in the Senate.
00:07:11.760 Deborah Gray was in the house.
00:07:13.100 They mocked her, they marginalized her, they taunted her, they called her an outsider.
00:07:18.060 And now she's part of Trudeau's debates commission doing the same thing to us.
00:07:21.220 I think Deborah Gray and David Johnston should resign and disavow the disgrace of the commission.
00:07:27.380 And if they don't, it's on them.
00:07:31.080 Boy, I hope Deborah Gray gets off that thing.
00:07:33.680 So we were feeling pretty good today.
00:07:36.560 And the judge said, let them in.
00:07:38.080 And yesterday, the lawyer for Trudeau said, we can accredit these people right up until
00:07:43.920 the starting time.
00:07:44.980 I heard her say that.
00:07:45.900 And so did the judge.
00:07:47.240 Well, today they suddenly sprung a new one on us.
00:07:50.360 They sent us an email just before noon Eastern time saying, oh, by the way, you have to either
00:07:55.280 be vaxxed or get a COVID test.
00:07:59.460 Oh, they just sort of made that up out of the blue.
00:08:01.320 Well, Alexa Lavoie, our in-person point person on this, got a rapid antigen test, shows negative.
00:08:08.720 She sent it in and they said, no, we don't accept that.
00:08:12.720 The debate starts in about six hours.
00:08:15.560 You need to take one of those fancy PCR tests that takes 24 to 48 hours to get back.
00:08:23.820 So the debate's in a few hours.
00:08:25.880 You have to take a test that will get the results after the debate is over.
00:08:29.420 Could you be more transparent about it?
00:08:33.180 Well, guess what?
00:08:34.800 Our lawyer called up the judge, gave notice to the other side, and they had a case management
00:08:39.500 meeting.
00:08:41.140 And believe it or not, Alexa managed to get a PCR test that was negative in like an hour.
00:08:45.080 I don't know how she managed to do it.
00:08:46.940 We sent that to the commission.
00:08:48.500 They still refused to accept it.
00:08:51.380 But only when we went back to the judge, disturbed the judge who had already issued her ruling.
00:08:56.060 Only then did Trudeau's lawyers accept Alexa's rapid PCR test.
00:09:02.540 Could you imagine these extreme lengths they went to?
00:09:05.920 I would call that tantamount to contempt of court.
00:09:09.540 You're ordered to accept rebel journalists and you keep coming up with new excuses and
00:09:13.320 we meet the excuses every time.
00:09:14.680 And you say, well, no, that's not good enough.
00:09:16.040 That's not good enough.
00:09:17.140 I think that that is in contempt of court.
00:09:19.440 And it was incredible.
00:09:21.480 And I give thanks to our lawyer, Chad Williamson, who was on the file.
00:09:25.280 Chad also asked if the debate commission would even call on our questioners.
00:09:29.560 And they said, oh, we'll treat them fairly.
00:09:31.520 I don't believe a Trudeau promise.
00:09:32.940 Anyways, that was their scheme today.
00:09:34.800 The debate is going to be a mess anyhow.
00:09:36.500 Look, Rosemary Barton, who is a Trudeau fangirl, it's just awful.
00:09:41.940 You know, here she is taking selfies with Trudeau.
00:09:44.840 I mean, come on, come on, get a room, you two.
00:09:46.900 And remember, she was the one who sued the Conservative Party of Canada in court.
00:09:52.680 Like, how is that even permitted?
00:09:54.900 I don't know.
00:09:55.760 All the themes of this debate today are lefty themes.
00:09:59.720 I know there's nothing in there about Trudeau's foreign policy disasters, whether it's China
00:10:05.800 and the two Michaels who are now in jail there over a thousand days or Afghanistan.
00:10:10.840 Trudeau called the election the day Kabul fell and he's abandoned Canadians over there.
00:10:16.900 Nothing on foreign policy allowed.
00:10:18.460 It's going to be a junk debate, which is why it's so important to our reporters and them.
00:10:23.300 So it's been an incredible 48 hours.
00:10:25.860 And we won and we won and we won.
00:10:27.680 And I thank you, our viewers, for sponsoring us through your crowdfunding.
00:10:31.440 We were seven to one and our lawyer beat him.
00:10:33.800 It was incredible.
00:10:34.720 But I want to ask you some questions.
00:10:36.100 Where was Aaron O'Toole in all this?
00:10:41.200 Not a word.
00:10:43.460 Where were some of the civil liberties groups, the Canadian Civil Liberties Association, the
00:10:47.940 Canadian Journalists for Free Expression, PEN Canada, Amnesty International?
00:10:52.380 Where are all the so-called journalists and civil liberties groups?
00:10:57.180 They were silent.
00:10:57.940 They weren't even in there.
00:11:00.260 They weren't in there helping.
00:11:01.540 They weren't even just chatting their support.
00:11:03.400 They were silent.
00:11:04.860 Well, how about just other working journalists?
00:11:07.720 No coverage of this until we won.
00:11:13.140 Are you telling me that if Stephen Harper had banned 11 journalists who were called liberals,
00:11:19.420 that that wouldn't have been the trial of the century if Harper had banned it?
00:11:23.440 Well, Trudeau banned it.
00:11:24.220 Well, Trudeau's paying all these other journalists.
00:11:25.880 I should tell you, the debate is incredible because all the party leaders who are involved
00:11:33.440 in the debate tonight, O'Toole, Jagmeet Singh, the Bloc leader, Blanchet, Annamie Paul of
00:11:38.240 the Greens, they didn't say a word about us being kept out.
00:11:42.020 They agree with it.
00:11:43.320 And why should that surprise you?
00:11:45.500 They're all fine.
00:11:46.460 They're excited about the fact that Maxime Bernier is kept out, even though Bernier has
00:11:50.860 higher support in the polls than Annamie Paul of the Greens or than the Bloc Québécois.
00:11:54.800 Yeah, don't for a minute think that Aaron O'Toole or the other major party leaders believe
00:12:00.180 in free speech.
00:12:00.960 They didn't in the case of Maxime Bernier and they didn't in the case of Rebel News.
00:12:03.940 I'm excited about tonight.
00:12:07.200 And instead of having a guest tonight, I'm going to invite you to tune in to our 11 reporters.
00:12:12.800 Alexa Lavoie will be inside.
00:12:14.900 Our other 10 reporters will be on the phone system for accredited journalists.
00:12:18.780 Now, you'll have to count with me and watch with me to see if our reporters are even allowed
00:12:23.400 to ask questions.
00:12:24.760 Trudeau's lawyer made us a promise, but a Trudeau promise and 35 cents will buy you a pay phone
00:12:29.240 call.
00:12:29.520 Am I right?
00:12:30.620 So I'm going to say goodbye to you now.
00:12:32.240 I want to thank you for helping us crowdfund this lawsuit.
00:12:35.660 You can see all the documents.
00:12:36.900 By the way, if you want to see the 2000 pages that Trudeau's lawyer dumped on the lap of
00:12:41.420 this judge the night before the trial, you can actually find them on our website, letusreport.com.
00:12:46.400 I don't propose that you read the 2000 pages.
00:12:48.560 The judge herself said she couldn't.
00:12:50.200 She didn't.
00:12:50.700 But the government, Trudeau certainly loved, I mean, imagine the cost of filing 2000 pages.
00:12:58.260 Like I say, Trudeau spent a million and a half dollars trying to censor us.
00:13:01.760 I would like to say thanks to Candace Malcolm of the Independent Press Gallery who stood up
00:13:06.220 for us.
00:13:06.600 She swore an affidavit in our defense.
00:13:09.280 But other than her, we were in court alone.
00:13:12.300 But I guess we weren't alone because we had you on our side.
00:13:16.080 All right.
00:13:16.280 That's the show for tonight.
00:13:17.300 I'm going to say goodbye now, but I'm going to invite you to tune in for our live stream
00:13:21.920 of the debate and hopefully of our journalists asking great questions.
00:13:26.680 Good night, everybody.
