00:01:43.760 Years ago, after his first term, Nenshi was once known as the world's greatest mayor.
00:01:48.780 But boy, did he ever milk that one.
00:01:50.500 But time goes on, and the old shine has begun to rust.
00:01:55.080 Instead, Naheed Nenshi is now known by his spendthrift ways,
00:01:59.740 recklessly writing checks to international modernist artists to trash the cityscape with decidedly ugly art.
00:02:07.800 Millions of dollars wasted on two bobbing chickens outside of his extravagant library.
00:02:13.140 Half a million on the Beaufort Towers, which just looked like another unfinished Nenshi construction project.
00:02:19.080 And, of course, how could anyone forget the nearly half million on the iconically ugly Big Blue Ring?
00:02:27.300 Nenshi isn't just set on paying through the nose for abstract junk.
00:02:31.800 He wants to get rid of the few beautiful things that the city of Calgary has left.
00:02:36.040 Just this week, Nenshi and his fellow radicals on city council passed a motion to pay a Black Lives Matter surrogate
00:02:43.480 to pick four locations in the city and install Black Lives Matter propaganda on them.
00:02:49.520 The most controversial location is one that is right next to the oldest legion in Alberta.

00:03:16.720 On top of all Calgarians, it's also something that can be related to by the folks that are living specifically here in downtown on the East End.

00:03:32.020 This mural speaks to them. This whole project, the Cup Society, is for the unemployed, the folks experiencing homelessness and addiction.

00:06:23.420 Now, on July 31st, Jeremiah, a young farm boy in Alberta,
00:06:28.940 had an altercation with the Alberta sheriffs that he will never forget.
00:06:33.200 While driving a tractor to a hayfield, five sheriffs surrounded his tractor
00:06:37.620 and allegedly punched and body slammed the teenaged farmer onto the pavement
00:06:42.900 of a rural Alberta highway just near Olds, Alberta.
00:06:46.680 According to the police, the young man refused to comply with Trudeau's new draconian law
00:06:53.360 that forces without cause breathalyzer testing on anyone and everyone the police want to test.
00:06:59.960 It's a new law and it's so oppressive and seemingly illegal
00:07:03.400 that many folks don't even believe that the law exists, but it does.
00:07:07.840 After all, the police, don't they need probable cause or a reason to even so much as check your ID?
00:07:13.660 How are they able to forcibly make you take a breathalyzer test?
00:07:18.100 Well, it's Trudeau's rules, even if they do seem unconstitutional.
00:07:22.780 In young Jeremiah's case, his family says that it wasn't even the law that confused him.
00:07:27.700 He didn't even know what a breathalyzer was,
00:07:30.180 much less why the police were trying to shove it down his throat on the roadside.
00:07:35.080 At just 18 years old, Jeremiah has been homeschooled his whole life
00:07:39.480 alongside his dozen other siblings.
00:07:41.580 TVs just aren't a part of their household.
00:07:44.340 And the only time that they ever need to leave the farm is to go pick up parts.
00:07:49.440 These aren't city folks, but the police, well, they treated Jeremiah
00:07:53.400 like he was some sort of hardened criminal.
00:07:56.540 In fact, after beating the kid senseless,
00:07:59.500 they cuffed him and left him in the back of a squad car for hours
00:08:03.780 on a day where the heat almost reached 30 degrees Celsius.
00:08:08.480 It's almost unbelievable that law enforcement in Alberta is acting in this way.

00:08:16.220 She's the same Calgary lawyer that successfully defended Edward Maurice,
00:08:20.600 the rural Albertan icon of property rights and self-defense.

00:08:37.700 Now, here's what Jeremiah's siblings had to say about the violent altercation.
00:08:42.560 So I started the GoFundMe Sunday afternoon.
00:08:47.240 One of my first purposes would be to help Dominic and Jeremiah out with lawyer fees
00:08:53.860 because they're obviously going to have a peer in court,
00:08:57.380 and they don't have a lot of money.
00:08:59.700 They're helping out with the family farm business,
00:09:02.140 and they don't get a wage like lots of other people do.
00:09:06.140 And I also started to bring awareness,
00:09:09.120 bring awareness that we're losing our freedom and rights in our country,
00:09:15.060 and also to bring awareness that what the sheriffs did
00:09:19.580 and how they handled the situation was very disrespectful to a good citizen,
00:09:25.980 a hard-working young farm boy, and very unprofessional.
00:09:32.580 So I wasn't on scene.
00:09:34.280 I was way working at another job, very busy time of year.
00:09:37.680 This is probably the worst year in over 18 years, or it is,
00:09:40.380 in Alberta farming history for farmers.
00:09:43.660 Very difficult time, very stressful.
00:09:45.680 When I heard about it, I came back to home immediately
00:09:49.120 to see what I could do and how I could help out,
00:09:52.180 and I was just shocked, and since then I've been just continually more and more shocked,
00:09:56.360 especially as footage rolls in from bystanders and people that filmed it
00:09:59.620 and are supporting and trying to help out and so on, and also in shock.
00:10:04.000 And that's just been escalating more and more.
00:10:07.780 Why did this happen?
00:10:09.140 And, you know, what can we do to prevent stuff like this happening in the future?
00:10:14.220 And just trying to come to grasp with the situation every time I look at my brother's face
00:10:18.340 and I see how shook up he is,
00:10:20.040 and you look at, you know, the blood and all the filming and footage and pictures and whatnot,
00:10:25.980 the same thing just happens over and over again.
00:10:28.340 Cannot believe that this actually happened here in Alberta.
00:10:30.600 Now, today, I got the chance to speak with Jeremiah's lawyer, Toni Rolston.
00:10:35.500 She's the attorney who represented the Albertan folk hero, Edward Maurice.
00:10:40.320 You probably know him.
00:10:41.480 He's the young family man who pulled out his gun to defend his family and property
00:10:45.860 when criminals broke onto his property.
00:10:47.980 Well, Toni Rolston successfully defended him in the case,
00:10:51.700 closely followed by many rural Albertans,
00:10:53.880 and I caught up with her outside the courthouse in Calgary
00:10:57.120 to talk about this case, which is sure to be the same.
00:11:12.500 Just to get started, could you give us an idea of the legal battle
00:11:16.260 that Dominic and Jeremiah are going to be facing in the next few months?
00:11:21.000 Well, both of them are subject to criminal charges.
00:11:25.220 They both have a court date coming up in Didsbury towards the end of October.
00:11:30.220 With respect to Jeremiah, his charges are refusal
00:11:33.180 and resisting or obstructing a police officer.
00:11:36.640 With respect to Dominic, he has two charges of obstructing a police officer
00:11:41.420 and causing a disturbance.
00:11:43.120 The concern that we have with respect to this, of course,
00:11:46.960 is the fact that if they are found guilty,
00:11:50.000 they will have a criminal record.
00:11:51.900 They will be subject to some sort of punitive aspect
00:11:56.360 in the sense of fines or probation and so forth.
00:11:59.840 And they're both very, very young.
00:12:02.580 And in my opinion, from what I've seen of the video
00:12:05.900 and upon speaking with my client,
00:12:08.060 the concern is that this whole incident
00:12:11.320 could have been handled so much differently.
00:12:15.780 And we wouldn't be here.
00:12:17.160 We wouldn't have two young boys,
00:12:19.280 and I say young or young adults,
00:12:21.200 that are actually subject now to the criminal justice system
00:12:24.440 when they've never, ever had an interaction.
00:12:26.580 What went wrong that day, in your opinion?
00:12:29.400 What did the sheriffs do wrong when they,
00:12:31.600 I mean, obviously punching them is the wrong thing to do,
00:12:34.040 but how did it escalate so quickly?
00:12:36.880 We don't have disclosure yet.
00:12:38.760 Disclosure is the evidence against Jeremiah
00:12:41.600 that we'll expect to get probably within a couple of weeks.
00:12:45.460 So I can't comment fully on that.
00:12:48.480 But from what I've seen from the video
00:12:50.220 and from my client's perspective, Jeremiah's perspective,
00:12:53.620 one of the concerns that we have is
00:12:55.700 you see these sheriffs chasing down this tractor in the video.
00:13:00.220 Someone gets into the other side of the tractor.
00:13:03.920 There's four or five sheriffs there,
00:13:05.700 and you see some movement in the tractor.
00:13:07.780 From what I understand,
00:13:08.560 that's when Jeremiah is being punched and hit
00:13:11.860 and pulled from both sides.
00:13:13.320 Then he's yanked down the tract, out of the tractor.
00:13:16.560 And the concern that we have clearly
00:13:18.740 in every citizen of Canada,
00:13:20.960 and especially in Alberta, as farmers,
00:13:22.920 what is happening where somebody
00:13:26.400 is actually being pulled out and punched?
00:13:29.800 And actually punched.
00:13:31.140 So what people need to really think about
00:13:33.060 is the fact that he's in a tractor.
00:13:36.000 He's going to go,
00:13:37.920 hey, that's what they're doing.
00:13:39.180 They're under a lot of time pressure to get this done.
00:13:41.840 He's not doing anything nefarious.
00:13:44.880 And what ends up happening is it just accelerates to this.
00:13:48.680 Where's the conversation?
00:13:50.520 Where's the explaining?
00:13:51.740 These people are law-abiding.
00:13:53.800 There's no need to think that this individual
00:13:57.320 is evading the police or trying to avoid.
00:14:00.960 Where is the conversation that needed to happen
00:14:03.560 before it resorts to physical violence?
00:14:07.000 So you've actually worked on a pretty high-profile case
00:14:10.040 just recently, and that concluded successfully
00:14:11.960 with Edward Maurice down in Okotoks.
00:14:16.260 What sort of parallels can you draw
00:14:19.740 between these two cases?
00:14:22.340 With respect to both of these cases,
00:14:24.460 my concern is with respect to how the police
00:14:26.400 conduct themselves initially.
00:14:28.520 That's where this all starts.
00:14:30.160 What steps are the police taking initially
00:14:33.580 when they're investigating?
00:14:35.880 Why jump straight to charges?
00:14:38.400 Why not have a discussion,
00:14:40.400 have an interaction with the individual
00:14:43.060 rather than jumping to charges
00:14:45.860 or jumping to physically grabbing somebody
00:14:48.820 and punching them and throwing them out of a vehicle?
00:14:52.080 In both cases, had everyone just slowed down,
00:14:55.840 had a discussion,
00:14:56.760 and maybe that's where some training comes in
00:14:58.920 with respect to this,
00:15:01.300 these both instances,
00:15:03.080 then in either case,
00:15:04.460 we may not have been here today.
00:15:06.400 We might not be clogging up the court system
00:15:08.860 with these types of cases.
00:15:10.980 So I want to talk about the tractor
00:15:13.940 that was actually seized.
00:15:15.560 A day or two later, it was returned.
00:15:19.340 They weren't sure,
00:15:20.340 the family wasn't sure who paid the tow charge
00:15:22.420 or who is going to be paying the cost
00:15:26.680 of repairing the transmission.
00:15:28.500 Do you know who sort of takes the blame on that
00:15:31.620 and who's going to be paying those bills?
00:15:33.220 I think it's going to be a civil matter.
00:15:36.920 Certainly, we're going to try to address it
00:15:38.980 on the criminal side within a charter notice
00:15:41.840 whereby we already foresee,
00:15:44.860 regardless of the disclosure,
00:15:46.040 that Jeremiah's rights have been violated.
00:15:48.700 We're going to try to address it,
00:15:50.560 but the criminal forum is not the proper forum for that.
00:15:55.140 So with respect to a civil lawyer,
00:15:57.480 I've been speaking to a civil lawyer regarding that
00:15:59.700 and hopefully the insurance companies
00:16:02.020 are going to step up
00:16:03.060 because they are insured
00:16:04.800 and that should be battled among the insurance.
00:16:07.980 But what's urgent right now
00:16:09.540 is they ought to have their tractor
00:16:11.840 put in the exact same position that it was
00:16:14.400 because now they have a loaner
00:16:16.380 and the problem with that is
00:16:18.180 it's a smaller tractor,
00:16:19.300 it's not as efficient.
00:16:21.040 This is a $300,000 piece of machinery
00:16:23.720 that some tow truck driver was directed
00:16:27.180 to just throw on some sort of a ramp
00:16:30.900 and take it away.
00:16:32.380 There's no thought process.
00:16:33.760 Again, there's no accountability.
00:16:36.360 Can somebody stop and think for a moment,
00:16:39.140 how are we going to do as little damage as possible
00:16:42.260 so that we're not here?
00:16:44.580 And it's the taxpayer
00:16:45.800 that's going to pay for both of these court cases.
00:16:48.560 Would you say that overall
00:16:51.980 that seizure of the tractor
00:16:53.200 was unlawful in your opinion?
00:16:55.600 I think we're going to have to look
00:16:57.120 at the disclosure with respect to that.
00:16:59.200 Police are permitted to seize a vehicle
00:17:03.120 capable of being put into motion
00:17:04.940 under these types of charges.
00:17:06.820 But at the same time,
00:17:08.860 that's not really where the live issue is.
00:17:11.240 The issue is if they're taking responsibility
00:17:13.960 for that piece of machinery,
00:17:16.280 then take responsibility
00:17:17.640 and have someone,
00:17:19.560 if you're going to tow it,
00:17:20.660 have someone who actually understands the machinery
00:17:22.780 tow it properly.
00:17:24.280 Because there was actually a sticker on it
00:17:25.560 that said don't tow it.

00:17:28.160 It actually wrecks the transmission.
00:17:29.540 So one of my final questions,

00:17:34.600 over the course of this criminal trial
00:17:36.500 and any civil litigation that happens afterwards,
00:17:40.480 are you going to be pursuing,

00:17:44.320 against the sheriffs
00:17:45.240 who actually ended up arresting them?
00:17:48.500 How is there the accountability
00:17:50.140 that you're talking about?
00:17:51.800 I mean, even if Jeremiah is found not guilty,
00:17:54.520 where's the accountability with the officers?
00:17:56.000 That's looking further down the road.
00:17:59.260 We do have some time to file a complaint regarding that.
00:18:02.100 Once we get the disclosure,
00:18:03.580 and hopefully we have the sheriffs
00:18:06.080 having some sort of body camera
00:18:07.680 or having a camera on the car
00:18:09.480 so we can also get another angle
00:18:11.100 as to what occurred.

00:18:13.440 Jeremiah sat in the back of a police car
