00:01:54.720 But then one of his tenants, well, took him to the Human Rights Tribunal.
00:01:58.440 You see, John is Christian, and one of his tenants was a Muslim family that objected to John not taking his shoes off in the apartment.
00:02:09.460 They said it was anti-Muslim discrimination, and in a shocking decision, well, not shocking to those of us who know the Human Rights Tribunals,
00:02:17.720 they won a multi-thousand-dollar penalty against John.
00:02:21.700 Well, when we heard that, we said, John, we've got to fight this.
00:02:25.180 And we crowdfunded the legal appeal, which happened in Toronto.

00:03:07.060 First, Leeser, thank you for having us on, and thank you for having me.
00:03:10.060 So we heard the appeal at the divisional court for a panel of three judges,
00:03:15.120 and the decision that came down was from a procedural standpoint specifically.
00:03:19.700 The Human Rights Tribunal did not err in the way that they arrived to their decision.
00:03:24.920 Well, we gave it the good old college try.
00:03:27.920 Actually, we did far more than that.
00:03:30.180 We tried to get justice in a real courtroom for John Nalabi, the Christian Nigerian landlord
00:03:36.320 who was taken to the Ontario Human Rights Tribunal for supposedly being disrespectful to Muslim tenants.
00:03:45.160 But as anyone who follows the human rights racket in Canada already knows, there is a hierarchy.
00:03:52.320 And even though John himself is a visible minority, he learned that when it comes to the kangaroo court,
00:03:57.700 that is the Ontario Human Rights Commission, Islam trumps all.

00:04:15.360 I'll tell you, this story is so irksome.
00:04:18.880 John Nalabi is a very mild-mannered, soft-spoken immigrant from Nigeria.
00:04:23.620 Nigeria is about half-and-half Muslim and Christian.
00:04:26.580 So John's a Christian man, and he came to Canada.
00:04:30.760 I don't think he had 10 bucks in his wallet when he came.
00:04:34.400 And now he's worked hard, he's worked his way up, and he's a very small landlord.
00:04:38.180 Like, good for him, right?
00:04:39.180 Get a place, rent it out, live the dream.
00:04:41.840 Follow the rules, pay your taxes.
00:04:43.440 Well, his tenants were Muslim, that's fine.
00:04:48.240 And he came in to his apartment, his place, and he didn't take his shoes off at the door.
00:04:54.740 Now, maybe he should, I don't know.
00:04:57.000 But whether or not he did is a matter of, let's say, courtesy or custom, I don't know.
00:05:02.060 But it's not a religious matter.
00:05:03.480 And it is his property.

00:05:06.920 So they took him to the Human Rights Tribunal.
00:05:09.040 There is no such thing as a human right to have your landlord take his shoes off.
00:05:12.860 It might be a courtesy or a custom.
00:05:14.380 But they claimed it was discrimination based on religion.

00:05:20.980 He obviously didn't discriminate against them because he rented the place to them.
00:05:24.340 He obviously, when a landlord does or doesn't take your shoes off, that's not racism.

00:05:33.740 And he's happy to rent to Muslims.
00:05:35.880 And I know he has other Muslim connections that I won't get into now.

00:05:43.400 And wearing shoes in his own property is not an anti-Muslim act.

00:06:07.240 And there was so much stress and so many bad things, the family broke up.

00:06:13.180 And yet the Human Rights Tribunal insisted, no delays, we're proceeding with this important case.

00:06:19.560 Well, you can imagine the man's mind was elsewhere.

00:06:51.940 When we raise the funds to appeal this in a real court, and the decision comes back where
00:06:58.800 basically they say the tribunal did...
00:07:02.260 They said that it's not that the tribunal made the right decision, but they were following
00:07:07.040 their own proper protocol.
00:07:09.540 Now, Ezra, you're a lawyer by training.
00:07:12.260 This is beyond my pay grade to understand.
00:07:14.600 I mean, this is not a matter of justice to me.
00:07:18.060 One iota, what's your take on this?
00:07:20.500 Well, because the Human Rights Tribunal is called an expert tribunal, it's granted some
00:07:26.440 deference from the courts.
00:07:27.300 Now, of course, it's not an expert tribunal.
00:07:29.160 It's a bunch of BS.
00:07:30.460 It's partisan.
00:07:31.460 It's unfair.
00:07:32.080 It's biased.
00:07:32.880 It's not run by real judges.
00:07:35.520 But for example, let me give you a very obscure example.
00:07:38.620 Where I'm originally from in Alberta, there's something called the Surface Rights Appeal Board.
00:07:43.900 What is that?
00:07:45.840 Well, let's say you're a farmer who's got a blueberry farm.
00:07:50.540 Yeah.
00:07:51.020 And underneath is $100 million of coal.
00:07:54.620 Yeah.
00:07:54.800 So one guy owns the blueberry farm on top.
00:07:57.900 The other guy owns $100 million of coal underneath.
00:08:01.160 How do you compromise and how do you regulate how the coal miner gets his coal and the blueberry
00:08:10.580 farm?
00:08:10.860 And that's a real case.
00:08:11.880 I actually, when I was an article student, I worked on that case in Alberta before the Surface
00:08:15.960 Rights Appeal Board.
00:08:17.020 It's such an obscure area.
00:08:18.600 It's such a narrow field of law that everyone says, okay, well, we don't know anything about
00:08:24.200 surface rights except this expert.
00:08:26.320 We're going to grant them a lot of latitude.
00:08:29.460 And if you don't like what happened in that expert tribunal, we're just going to check to
00:08:33.620 make sure that it was, that they followed their own rules more enough.
00:08:37.700 We're not going to get into whether they were right or wrong.
00:08:39.900 We're just going to say, was it patently unreasonable?
00:08:43.700 It's crazy.
00:08:44.840 So you get it for surface rights because that's something so obscure.
00:08:49.280 You want to say, okay, I'm not going to mess with surface rights.
00:08:52.160 But human rights is a catch-all for any grievance thing.
00:08:56.140 It's not a real field of expertise.
00:08:58.360 Yeah.
00:08:58.500 It's not a real field.
00:08:59.200 Like surface rights is a real issue that is a really narrow area of law.
00:09:06.580 I believe that the Surface Rights Appeal Board should exist.
00:09:09.760 Okay.
00:09:10.200 And it should be granted deference.
00:09:12.340 The Human Rights Tribunal should not be granted that kind of deference because it's not a real
00:09:16.360 field of expertise.
00:09:18.360 And so here in this case, you had three real judges who didn't crack open the case and say,
00:09:23.880 yeah, that's a bad ruling.
00:09:25.360 They granted deference to the Human Rights Tribunal and said, well, they followed their
00:09:30.240 rules and there was, and yeah, maybe we don't like the outcome, but there's nothing that
00:09:36.000 would make us set it aside.
00:09:37.720 So they respected the Human Rights Tribunal.
00:09:42.340 Trouble is, it doesn't deserve respect because it's not even a real thing.
00:09:46.020 And I would argue, Ezra, it's about the interpretation.
00:09:49.640 To go back to what you said earlier, the idea of John being anti-Muslim, about him being
00:09:55.360 Islamophobic, it doesn't fly because he would never have rented the unit to people who are
00:10:01.320 obviously Muslims in the first place.
00:10:03.660 So that's one thing.
00:10:04.720 The second thing, Ezra, this is a speculative question.
00:10:08.380 Do you truly think these two people, these two tenants who painted themselves as devout
00:10:14.660 Muslims, they pray five times a day, et cetera, et cetera, were they really that offended by
00:10:21.420 somebody wearing shoes into their home?
00:10:24.380 Or was this an opportunity in their minds to game the system to come out with a nice
00:10:31.360 financial reward, which they had a pretty good chance of winning?
00:10:34.660 Yeah.
00:10:34.900 Well, I mean, I don't know them, so I don't know what they're like.
00:10:37.940 I only know what they've done.
00:10:39.280 And they've really destroyed John's life in a number of ways.
00:10:42.720 And they are so insistent that they get their payday.

00:10:48.800 But look, there's a lot of gross people in the world.
00:10:52.740 These gross people, these tenants, these abusive name-calling tenants, were aided, abetted,
00:11:01.880 assisted, and represented by the government for lawyers.

00:11:09.700 Why was this so important that you had two lawyers?
00:11:13.040 I'm talking about the court appeal last week, two weeks ago.
00:11:15.340 Why wasn't it so important that the Human Rights Tribunal sent two lawyers and some legal
00:11:19.680 aid clinic sent two lawyers?
00:11:21.300 You have four lawyers coming for John and Ladley.
00:11:25.960 I'll tell you why.
00:11:26.700 Because if anyone's allowed to resist, they must be crushed.

00:11:32.120 And, you know, and that's, here's the perversely ironic epilogue to this story, Ezra.
00:11:38.360 So these government lawyers and the tribunal are saying, we are going to fight for Muslim
00:11:44.040 rights.
00:11:44.620 You know, no one's going to stop us.
00:11:46.420 This is the top of the pyramid.
00:11:48.180 Well, they'll never say that, of course.
00:11:49.920 Here's the big picture.
00:11:51.360 This has received some considerable press.
00:11:54.580 Say I'm a landlord.
00:11:55.440 Say I look at potentially renting out a unit to a couple of developed Muslims.
00:12:01.420 Suddenly, this would never have crossed my mind before.
00:12:05.120 But now that I see that, wow, if I don't take off my shoes, if I don't give 25 hours notice
00:12:11.780 of a visit, you know, so that the female can properly veil herself, I am inviting myself
00:12:20.680 into a world of hurt.
00:12:22.000 So I think there might be landlords out there that they're not anti-Muslim or Islamophobic,
00:12:27.940 but this is now a third rail for them.
00:12:30.260 If I get the wrong type that know how to game the system based on the most trivial complaint,
00:12:35.340 I'm screwed and I want no part of it.
00:12:37.300 Yeah, I mean, it's like what we're seeing as a result of the over-the-top Me Too allegations
00:12:42.260 is that I was just reading a great story about this the other day.
00:12:46.800 A lot of corporate recruiters say, you know what?
00:12:50.580 It's just not worth going out for drinks after work with colleagues who are women
00:12:56.300 because the chances of a spurious accusation are too high.
00:13:01.520 Whereas they wouldn't think twice about going out for drinks with a colleague.
00:13:04.300 And it's not because they're sexist.
00:13:05.940 It's the opposite.
00:13:06.520 They don't want to be called sexist.
00:13:09.780 And so really, do you go on a business trip with a colleague who's female?
00:13:17.640 Well, it's so many risks there.
00:13:19.720 And I'm thinking that, I mean, I believe that we should be against,
00:13:24.940 I think we should treat people on the content of their character,
00:13:28.300 not the color of their skin or their gender or things like that.
00:13:30.780 But if a woman walking in is danger, danger, because they're bringing with them four lawyers.

00:18:22.400 It's so ridiculous that these are the insinuations being made against good, decent, hardworking

00:18:33.120 Yes, and something that he has never apologized for, if you see his interview in Chatelaine,
00:18:40.200 Canada's leading women's magazine, so-called, he answers that question with about three paragraphs
00:18:47.140 of baffle gab that I do not understand, even though English is my first language and I have
00:18:51.740 a degree in journalism, but he can't even take actions, he can't even take responsibility

00:18:57.620 But, Sheila, I think you were really on to something in your commentary, and that is bringing
00:19:02.540 up the psychological condition of projection, where you project your worst qualities on

00:19:11.460 And, you know, when you look at Justin Trudeau, as you mentioned, trust fund baby, has never
00:19:17.120 worked a tough job, a tough gig in his life.
00:19:21.100 So entitled, so, you know, born with a silver spoon in his mouth, compared to your husband
00:19:27.340 and so many other men out there putting in brutal shifts in all kinds of weather, bringing
00:19:34.740 home the bacon, if I'm still allowed to say that phrase.
00:19:37.780 I mean, he is the one who is a disgrace, not people like your husband.

00:19:44.440 Like, Justin Trudeau, we have to look at just his lifestyle.
00:19:46.960 At Harrington Lake, which is his, like, summer cottage, in the winter, the Canadian taxpayer
00:19:53.880 spends tens of thousands of dollars just to clear away the snow for him, because he can't

00:20:11.520 And he has the audacity to malign and, frankly, libel these decent men who are out there.

00:21:21.540 is because of these large quantities of men coming to rural Canada to build a pipeline and sleep in camp
00:21:31.000 and go on Kijiji and text their wives when they finally get back into cell phone service.
00:21:36.600 She's said that this is something the Liberal Party truly believes,
00:21:41.400 and it's something they think is a winning issue.
