00:05:44.200 Ruling came in successful appeal decided last week in favor of Kate Scotto, feminist prosecutor

00:06:07.300 He was one of the judges presiding over one of Tommy Robinson's many trials that I attended,
00:06:13.740 and he was decidedly less free speechy last time.
00:06:17.620 He was one of the judges who sent Tommy Robinson back to prison a second time for contempt of
00:06:25.320 court simply for reporting outside a rape gang trial.
00:06:28.320 So yeah, I remember Justice Warby.
00:06:30.100 Maybe he's had a change of heart, or maybe he just hated Tommy Robinson.

00:06:34.300 But let me read a little bit more from the Daily Mail.
00:06:38.780 Judges have insisted that freedom of speech includes the right to offend in a landmark ruling,

00:09:32.940 But I think he sort of does act like a pig.

00:09:38.840 Let me read more from the Daily Mail and then I'll quote from the ruling itself.

00:09:48.620 And taken from her children and into custody after referring to trans woman Stephanie Hayden as a man,
00:09:55.840 a racist, and a pig in a wig.
00:09:59.600 Ms. Hayden, 47, reported the online remarks to police.
00:10:03.380 She, and I'm just quoting the Daily Mail here.
00:10:06.840 Okay, she, sorry, this is the mum of two.
00:10:08.860 The mum of two, she, had been arrested by three police officers in 2019 at her home in
00:10:14.220 Purton, near Hitchin, Hertfordshire, in front of her daughter, 10, and son, 20 months.
00:10:22.560 Boris Johnson later called it an abuse of power.
00:10:25.700 In February this year, radical feminist Ms. Scotto, 40, was handed a two-year conditional discharge
00:10:31.860 in order to pay a thousand pounds compensation with District Judge Margaret Dodds telling her,
00:10:37.000 your comments contributed nothing to a debate.
00:10:41.000 We teach children to be kind to each other and not to call each other names in the playground.
00:10:45.200 So this mum of two was literally arrested in front of her kids, taken into custody.
00:10:50.680 For some mean tweets that aren't that mean, I think I might have said worse in my day.
00:10:57.880 And look at the lower judge.
00:10:59.060 We teach children not to be mean.
00:11:03.100 That's true, we do.
00:11:05.380 Because they're children, so we can tell them what to do.
00:11:07.680 And we want them to be polite.
00:11:09.320 But it's not a crime to be rude.
00:11:12.300 And adults are not children.
00:11:13.980 And we don't arrest adults or children for calling people a pig in a wig.
00:11:19.300 In fact, that sounds like it could be a really fun kid's book.

00:11:24.640 That's what the lower court judge said was the test.
00:11:27.060 Is that really the test for freedom of speech now?
00:11:29.540 If your conversation meets the approval of some judge, only then can you have your conversation?

00:11:39.200 Now the Daily Mail does a pretty good job.

00:11:42.760 But there are a few errors in here that I detected because I read the ruling for myself.
00:11:47.560 I wanted to see what Justice Warby had to say because I saw him in action in Tommy Robinson's case.

00:11:57.600 The British courts are pretty good that way.

00:12:02.940 And I sort of wish I didn't.
00:12:04.540 It's 22 pages of he said, she said bickering on Twitter.
00:12:11.680 And this Stephanie Hayden isn't some little lamb who was being attacked by a big bully mum of two.
00:12:18.260 It's actually sort of the opposite.
00:12:20.520 This Hayden, I'm sorry, I'm not going to call him a girl.
00:12:24.360 He's a full-time bully and provocateur himself.
00:12:27.680 He's a Twitter warrior full of insults himself towards others.
00:12:32.120 Some of his tweets could even be called racist, which is why the mum said so.
00:12:37.340 But the first whiff of anyone resisting him, like he dishes it out.
00:12:42.400 But you speak back to him and deadname him and misgender him, he runs to court.
00:12:48.380 He runs to the police.
00:12:50.540 He runs to get injunctions and fines.
00:12:53.000 He really does remind me of Jonathan Yaniv that way, a bully, a cry bully.

00:12:59.540 Let me read to you a few lines from the judgment about this.
00:13:02.360 So these two were having some Twitter quarrel, you know?
00:13:05.940 So both sides are dishing it out.
00:13:07.780 But then get this, I'm reading from the judgment.
00:13:09.240 The 2019 messages did not do any of the things Hayden identified in her evidence as unacceptable.
00:13:20.560 The record shows that she did not regard what was said as in any way offensive or objectionable
00:13:25.440 until she discovered that Ms. Scotto was the pseudonymous author.
00:13:30.420 At that point, Ms. Hayden was angered to the point of contacting the police again.
00:13:34.680 Okay, I'm sorry it's confusing because they're calling both people she.
00:13:39.240 Let me put it in normal language.
00:13:41.700 So the mum was writing a bunch of things on Twitter in 2019, all right?
00:13:46.600 But she was writing them under a pseudonym, like a made-up internet name.
00:13:52.400 So the mum was saying a bunch of things in 2019,
00:13:55.080 and this trans activist, Ms. Hayden, saw them,
00:13:59.440 but didn't find them upsetting at all.
00:14:02.620 Didn't find them unacceptable.
00:14:04.020 She said so.

00:14:08.680 Until he discovered they were written by the mum.
00:14:11.160 And then he was filled with a mighty rage and called the cops and had her arrest.

00:14:36.060 On the 1st of December 2018, at the instigation of the West Yorkshire Police,
00:14:41.720 Police Constable Kitchen of the Hertfordshire Police,
00:14:45.820 arrested Ms. Scotto on suspicion of harassment and malicious communication.
00:14:51.200 Ms. Scotto was interviewed.
00:14:52.360 She admitted the two Twitter accounts were hers and that she had posted the six tweets.
00:14:58.860 She did not accept posting message seven.
00:15:01.440 She denied committing any offense.
00:15:04.140 At the time of arrest, the officer seized Ms. Scotto's Samsung mobile phone and her Asus laptop.
00:15:12.300 The police, apparently expecting a guilty plea,
00:15:14.800 decided later on that downloading data from the phone or computer would be disproportionate and unnecessary.
00:15:20.900 Oh, so you were actually thinking of just literally downloading everything on her phone and her laptop
00:15:28.340 because she called someone a pig in a wig?
00:15:33.520 But if you think these cops are bad, look at this judge.
00:15:38.420 There's a lot of judges involved here.
00:15:39.680 Here's one of them.
00:15:40.220 In early December 2018, Ms. Hayden, that's the transgender man,
00:15:46.500 issued proceedings, that means sued,
00:15:48.980 against Ms. Scotto in the high court under action number QB, whatever.
00:15:53.840 On the 18th of December 2018, Ms. Hayden, that's the transgender man,
00:15:58.600 appeared before Jason Koppel, QC, sitting as a deputy judge,
00:16:02.680 and obtained an interim injunction prohibiting Ms. Scotto until trial or further order
00:16:10.320 from publishing, quote, any personal information relating to Ms. Hayden
00:16:15.060 on any social media platform,
00:16:17.820 as well as, more specifically, misgendering her on any social media platform,
00:16:23.040 publishing anything linking her to current,
00:16:25.560 her current female identity to her former male identity,
00:16:28.780 and anything stating or implying that she is a racist
00:16:32.980 or has published anything racist on any form of social media.
00:16:37.460 Ms. Scotto was neither present nor represented at the hearing when this order was made.
00:16:43.200 So literally banned by a judge on pain of prison, I guess, if Tommy's any precedent,
00:16:50.840 of calling a man a man, of referring to the fact that the man used to be a man
00:16:55.620 before calling himself a woman, of anything about the person,
00:17:00.720 of using the man's name his mother gave him,
00:17:03.180 of calling him a racist, even though she believes it were true.
00:17:05.520 And I saw some tweets in this judgment that suggested
00:17:09.040 maybe the transgender man is a bit of a racist,
00:17:12.600 but she's not even allowed to have that opinion.
00:17:16.340 Is this Iran or China or is this the UK?
00:17:19.100 And this pig in a wig, and I refer to his size,
00:17:21.900 but also his approach to dealing with his enemies,
00:17:25.660 which is a little bit piggish,
00:17:28.200 he took to Twitter himself to brag about this victory in court.

00:17:33.260 Later the same day, Ms. Hayden posted four tweets
00:17:35.860 containing news of the injunction,
00:17:37.800 giving a summary, and tweeted a photo of the order,
00:17:41.060 but with Ms. Scotto's name redacted,
00:17:43.080 asking others to retweet.
00:17:46.020 So this trans activist isn't just someone private,
00:17:48.860 looking for privacy.
00:17:51.760 He's doing a victory lap here.
00:17:54.400 He's suing and taunting and banning
00:17:56.400 anyone who disagrees with him or even insults him.
00:17:59.400 You know, I read this whole judgment,
00:18:01.500 and the whole time I was thinking,
00:18:02.980 Twitter has a block button, you know what I mean?
