Daniel Penney, a Marine veteran, put a crazed homeless man in a headlock, and then that person died. Now, Daniel Penney is going to be charged with second-degree manslaughter. Well, apparently we no longer do individual justice in this country, the typical way we do justice is there is a big social media coverage of an event, and if that event has the right narrative, then we demand prosecution of the person and then prosecutors just do it. And this is why, presumably, Daniel Penny, who is the Marine veteran who helped train future Marines, is the one who is being charged with manslaughter in the death of a man who was put in a submission hold on a homeless man, and died in a choke hold. And now, New York City has decided that they will charge this Marine who is a hero. It happens on the subway, and now, a second person is being a hero? You re being charged for a hero, right? Well, okay, so you re a hero in the subway? Well guess what, you re not? . In this episode, we ll talk about that, and why it s a good thing. and why you should not be a hero and what s a bad thing in the first place. and why you need to get a lawyer or not a lawyer, not a judge Why you should be a lawyer. And why you don t need to be a criminal And what s going to happen not why he s a hero ? because he s not a criminal, right What s a criminal? And what s the point of this is to do you re just a criminal ? Why is he not a hero here? Why he s gonna get away with this? ? What does he s a criminal here ? and should he get a second chance? or should he be charged who s not even get a chance to go to jail if he s just a little more than a day in jail?

00:00:48.000 Jordan Neely, he had an arrest record as long as you're armed, 40 plus arrests.
00:00:53.000 There was an outstanding warrant on Jordan Neely for punching a 67-year-old woman in the face.
00:00:57.000 He went on a subway in New York City and he started harassing and threatening all the people on the subway.
00:01:02.000 And the typical left-wing response to this is this is just what you're expected to undergo.
00:01:06.000 If you're going to participate in public life, if you're going to be on public transportation, you're expected to subject yourself to crazed people who have mental illness and drug issues threatening you on the subway system.
00:01:17.000 And if occasionally it breaks out into violence and you get hurt, well, again, that's just the cost of doing business.
00:01:22.000 Well, Jordan Ely went on the subway and he started apparently screaming and yelling at people and threatening them, saying he was happy to go to jail.
00:01:28.000 And then Daniel Penny, Who is a person who has been trained in protecting himself and others and has actually trained others because this is what he did with the Marines.
00:01:36.000 He actually was in the Marine training program.
00:01:38.000 He would help train future Marines as well.
00:01:41.000 He came up in the subway behind Jordan Neely and he put him in a submission hold.
00:01:44.000 Now the reason I use the term submission hold as opposed to choke hold is because, well, they can be used interchangeably.
00:01:50.000 The fact is that a submission hold is designed to cause somebody to submit.
00:01:53.000 It is what you would typically call a blood choke as opposed to an air choke.
00:01:56.000 An air choke is designed to cut off somebody's airways.
00:01:59.000 A blood choke is designed to put pressure on the arteries and therefore deprive oxygen to the brain long enough to make somebody, essentially, it's a sleeper hole that puts somebody into a state of unconsciousness.
00:02:11.000 And if you watch the tape, that's clearly what this marine is attempting to do.
00:02:15.000 He puts this guy, he puts Jordan Ailey in a submission hold.
00:02:18.000 There's a black man and a Hispanic man who are standing right there trying to also help subdue this crazed homeless person who should not have been on the streets.
00:02:27.000 The only reason he was on the streets is because the system in New York is garbage and it is absolutely incoherently foolish.
00:02:34.000 The way the system would work is that they would arrest Giordanili, he'd go to jail for five minutes, they'd let him back out on the street.
00:02:38.000 They'd arrest Giordanili, they'd let him back out on the street.
00:02:40.000 They would take Giordanili and they would sentence him to go to some sort of clean-out facility to get him off drugs.
00:02:46.000 And then he would just walk away.
00:02:47.000 They would send him to a mental health facility and he would just walk away.
00:02:50.000 And that's why he ended up on the street harassing people.

00:02:57.000 And now, apparently, Daniel Penney, the Marine in this particular case, is going to be charged with second-degree manslaughter.

00:03:05.000 Again, you can see, Jordan Ely is on the ground because he's being put in a submission hold by Daniel Penney.
00:03:12.000 There's another man, a black man there, who's trying to hold Jordan Ely's arms there to get him to submit.
00:03:17.000 There's another man, a Hispanic man, who's also trying to get... There are three men there who are trying to hold him down because he was obviously about to get violent with the passengers.
00:03:27.000 Not only that, but as this goes on, you'll see Jordan Neely goes unconscious, and then Daniel Penney immediately releases him.
00:03:34.000 He waits for medical care to come.
00:03:35.000 They put him in a position that is designed to prevent him from choking on his own vomit, for example.
00:03:43.000 It is a resuscitation position.
00:03:46.000 They move him.
00:03:48.000 Hey, that is what is being shown on the tape.
00:03:50.000 And now, New York City has decided that they will charge this Marine, who's a hero, okay?
00:03:56.000 You're on the subway for a second.
00:03:58.000 It's you on the subway.
00:03:59.000 And you are being harassed, as so often happens on the New York City subway system, by a person with a violent arrest record.
00:04:07.000 And the person just keeps getting closer and yelling at you.
00:04:09.000 And then, a Marine comes and puts the person in a submission hold.
00:04:13.000 Is that person a villain who ought to go to jail?
00:04:15.000 Now, you might say, well, why are these vigilantes on the streets?
00:04:18.000 Why?
00:04:19.000 Because defense of self and defense of others is actually good activity.
00:04:24.000 The fact that this ended tragically does not mean that the Marine in this case meant for it to end with the death of Giordanelli.
00:04:30.000 He clearly didn't.
00:04:31.000 If he wanted to kill Giordanelli, he clearly could have.
00:04:34.000 I'm not talking about accidentally.
00:04:36.000 He's a Marine.
00:04:36.000 He knows how to kill people.
00:04:38.000 He didn't mean to do that, which is why presumably they are charging him with manslaughter.
00:04:41.000 We'll get to what the elements of manslaughter are in just a second.
00:04:44.000 The reason this went viral is because Jordan Neely is a black man and Daniel Penney is a white man.
00:04:48.000 It is that simple.
00:04:49.000 If Daniel Penney were a black man, not only would Daniel Penney not be put on trial right now, Daniel Penney would be given the keys to the city.
00:04:57.000 If Jordan Neely were a white man, you never would have heard about any of this.
00:05:00.000 It never would have made the headlines at all.
00:05:03.000 There have been dozens of people who have died on the New York City subway system over the course of the last couple of years.
00:05:08.000 You don't know the names of any of them.
00:05:10.000 The reason this became an issue is because the media narrative is simple.
00:05:13.000 Daniel Penney is a stand-in for white America.
00:05:14.000 Jordan Neely is a stand-in for black America.
00:05:16.000 Now, it doesn't matter that none of this fits.
00:05:18.000 It doesn't matter, again, that the video shows a black man helping to hold Jordan Neely down.
00:05:23.000 It doesn't matter that Jordan Neely had a really, really long arrest record and had victimized lots and lots of people.
00:05:29.000 And that Daniel Penney is actually a person who serves the country as a Marine.
00:05:33.000 None of that matters.
00:05:34.000 It fit the basic elements that the media are looking for in order to propagate the lie that America is a systemically racist country.
00:05:40.000 Daniel Penney white, Jordan Neely black, Daniel Penney alive, Jordan Neely dead.
00:05:43.000 That's all it takes.
00:05:44.000 And now, the idea is going to be that Daniel Penney will be prosecuted.
00:05:47.000 Which means, by the way, you ever want to ride the New York City subway system again?
00:05:51.000 They've been having a real problem getting people to ride that subway because it turns out that very often people go down to the subway system and some crazed homeless person tries to push them in front of a train.
00:05:59.000 Or hit them with a samurai sword or something.
00:06:01.000 And they won't staff up the police in New York City.
00:06:04.000 They won't allow the police to actually do their jobs because they're afraid that that will create suspicions of systemic racism.
00:06:09.000 And so what that causes is civilians to actually have to do the job that the police are not allowed to do.
00:06:13.000 And then when bad things happen, then civilians are prosecuted.
00:06:16.000 So what that means is no one will use the subway system anymore.
00:06:19.000 This is a great way to clean out a major American city.
00:06:21.000 In fact, the largest American city.

00:06:25.000 Alvin Bragg, who won't prosecute any crime in the city, has decided to prosecute this thing.
00:06:28.000 He'll prosecute Donald Trump for a seven-year-old payoff to Stormy Daniels, and he will prosecute Daniel Penney.

00:07:48.000 According to the Wall Street Journal, Daniel Penney, who is 24, will be arrested on a charge of second-degree manslaughter, according to a spokesman for the Manhattan District Attorney Alvin Bragg, who's an eminently political left-wing prosecutor.

00:08:01.000 Bragg's office had previously said it was conducting a criminal investigation into the death of Jordan Neely.
00:08:06.000 And then I love, I just love how the media treat Jordan Neely.
00:08:10.000 Okay, the proper descriptor of Jordan Neely, to give you the full context, would be, A decade-long homeless person with severe mental illness and drug abuse issues with 40 previous arrests.

00:08:21.000 Are those the facts that you hear?
00:08:23.000 So whenever I read a story from the Wall Street Journal, everybody assumes the Wall Street Journal is conservative.

00:08:27.000 The Wall Street Journal's editorial page is, in fact, conservative-leaning.
00:08:31.000 The news page for the Wall Street Journal is actually to the left of the New York Times.
00:08:35.000 The news gathering department of the Wall Street Journal is not a right-wing department.
00:08:38.000 In any case, here is how they describe Jordan Neely.
00:08:40.000 Again, the relevant facts would have been career criminal, threatens people, outstanding warrant for assault, mentally ill, drug addict, right?
00:08:47.000 These would be the relevant facts because all of those are going to play into the trial.
00:08:50.000 You know what's not going to play into the trial?
00:08:52.000 The fact that he sometimes impersonated Michael Jackson.
00:08:54.000 That's the only fact most Americans are going to know about this case.
00:08:57.000 In the same way, That most Americans only think of Michael Brown in the graduation outfit.
00:09:02.000 Because that's the photo that was plastered all over the news.
00:09:05.000 They don't think of Michael Brown as the guy who's robbing a convenience store minutes before he tried to take a gun off an officer and shoot him.
00:09:12.000 So here's how the Wall Street Journal describes it.
00:09:13.000 Mr. Bragg's office had previously said it was conducting a criminal investigation into the death of Jordan Neely,
00:09:18.000 a 30-year-old Michael Jackson impersonator who was killed in the May 1 altercation on a subway train traveling
00:09:23.000 through lower Manhattan.
00:09:24.000 The medical examiner's office ruled that Mr. Neely's death was a homicized cause by compression of the neck.
00:09:29.000 On Thursday, a law firm representing Mr. Penney said he would be absolved of wrongdoing once all the facts
00:09:33.000 surrounding the incident were brought to bear.
00:09:35.000 Now, again, it is very unclear exactly what the medical condition of Jordan Neely was before his death.
00:09:42.000 We've seen many of these cases of quote-unquote excited delirium, where somebody is put into a submission hold.
00:09:47.000 This is probably what happened with George Floyd, despite all of the nonsense about how there was literally no damage to his neck.
00:09:55.000 On George Floyd.
00:09:56.000 The notion that it was not an underlying drug and heart problem that caused the death of George Floyd.
00:10:00.000 Again, I have serious doubts about the verdict in the George Floyd case.
00:10:03.000 But in a statement last week, Penny's lawyer said Neely had been aggressively threatening Penny and other passengers and that Penny acted to protect himself and other passengers.
00:10:11.000 The May 5th statement said Daniel never intended to harm Mr. Neely and could not have foreseen his untimely death.
00:10:16.000 In the moments leading up to this, Neely took off his jacket, aggressively threw it to the floor, and was screaming that he was hungry and thirsty and ready to die.
00:10:23.000 Which, of course, is rather threatening.
00:10:26.000 People who knew Neely said he wasn't a violent person, but struggled with mental illness.
00:10:29.000 Well, if he wasn't a violent person, why did he punch a 67-year-old woman in the face?
00:10:33.000 There's an outstanding warrant on this.
00:10:36.000 Again, this is insane.
00:10:39.000 It's horrible public policy, by the way.
00:10:41.000 So you have about eight bad public policies stacked up on top of one another here.
00:10:45.000 One, you tell the police they're not allowed to do their jobs.
00:10:47.000 Two, you classify mental illness as a policing problem, and then you don't use involuntary commitment to put severely mentally ill people in hospitals where they get the treatment that they actually require, whether they like it or not.
00:10:59.000 Okay, so you make it a policing problem, then you tell the police they can't do their job, then civilians have to do the job, and then when civilians do do the job, then you prosecute them.
00:11:07.000 That is the pattern of behavior here.
00:11:09.000 Now, what exactly is manslaughter in the second degree?
00:11:12.000 Well, according to the Penal Code in New York, A person acts recklessly with respect to a death when that person engages in conduct which creates or contributes to a substantial and unjustifiable risk that another person's death will occur, and when he or she is aware of and consciously disregards that risk.
00:11:32.000 So there's no reason, by the way, for this Marine to think that Giordanili was going to die just because he was putting him in a submission hold.
00:11:38.000 Which again is the same hold that is used in MMA like on a routine basis.
00:11:42.000 The risk also has to be of such nature and degree that disregard of it constitutes a gross deviation from the standard of conduct a reasonable person would observe in the situation.
00:11:51.000 Now, we all know that this trial is immediately going to become political.
00:11:55.000 It's immediately going to become political.
00:11:57.000 If it happens in New York, There will be serious questions about the racial constituency of the jury, their political positions.
00:12:02.000 Is it going to be people who have flown Black Lives Matter flags?
00:12:06.000 Or is it not people who have flown Black Lives Matter flags?
00:12:08.000 Is it people who are white or people who are black?
00:12:10.000 I mean, this is going to be the calculus now, which says very poor things about our criminal justice system, particularly in our major cities.
00:12:18.000 It's absolutely horrifying.
00:12:19.000 And again, the way that the media treat all of this is as though You know, absolutely normal, homeless person, not threatening, just kind of mumbling to himself, suddenly was attacked and murdered by white marine.

00:12:33.000 Now, again, the underlying story here is that the system let Jordan Neely be put in this situation.
00:12:39.000 Jordan Neely was not capable of taking care of himself.
00:12:40.000 He was not capable of being safe on the streets.
00:12:43.000 Nobody, by the way, has the right to live on the streets.
00:12:45.000 The system failed Jordan Neely, and then Jordan Neely had a career criminal record.
00:12:50.000 And this is the fairly predictable result of all of that.
00:12:54.000 But that's the way it works in New York.
00:12:55.000 We don't prosecute minor crimes, they say.
00:12:57.000 We don't prosecute minor crimes.
00:12:58.000 And this is true across the nation.
00:13:00.000 Minor crimes will not be prosecuted because to prosecute minor crimes might result in more black people being arrested per capita than white people being arrested per capita.
00:13:07.000 But I have found the one crime for which a black homeless person will be arrested Not for punching a 67-year-old woman in the face.
00:13:15.000 Not for jumping turnstiles.
00:13:16.000 Not for abusing people on the subway.
00:13:17.000 You're not going to get arrested for any of that sort of stuff.
00:13:20.000 In fact, we will then call you, if something bad happens to you, a beloved Michael Jackson impersonator, and we will treat you as though you're not even homeless.

00:13:30.000 The new lingo has dropped.

00:13:32.000 Because it's our responsibility to house you, even if you don't wish to be housed.

00:13:40.000 But there is one crime, one crime that a black homeless person can commit in which the media will now describe them as a homeless person with mental illness who should go to jail.

00:28:11.000 Democrats hold a slim majority in the Senate, and the White House, of course, is issuing a veto threat this week.
00:28:16.000 In a joint statement after the bill passed, House GOP leaders said that Republicans are taking action to address the chaos at our nation's borders by delivering legislation that will support our border patrol agents, block the flow of fentanyl into our country, and put an end to the Biden border crisis.
00:28:29.000 The White House issued a statement this week saying that while they support productive efforts to reform the country's immigration system, it opposes the GOP-sponsored bill.
00:28:36.000 It says it would make elements of our immigration system worse.

00:28:40.000 Well, according to the White House, quote, the legislation does nothing to address the root causes of migration, reduces humanitarian protections, and restricts lawful pathways, which are critical alternatives to unlawful entry.
00:28:48.000 In other words, what we actually need to do is just release them on asylum.

00:28:53.000 So this White House is turning down actual money for more Border Patrol agents right now in the middle of Title 42 ending.
