00:01:46.000 I knew her a little bit when I was at Harvard Law School because she was a property professor.

00:01:51.000 The first time I met her, she, literally the first time I met her, she was recruiting for Harvard Law School and she ripped on Rush Limbaugh, so that was a pretty good opener for what Elizabeth Warren was politically.
00:02:01.000 Well, Elizabeth Warren today decided that she would engage in the most humiliating self-own I have ever seen in American politics.
00:02:09.000 I mean, this is like the best self own of all time.
00:02:12.000 This is the equivalent of that guy who owned gold during the World Cup and then got killed for it.
00:02:17.000 Hopefully nothing bad happens to Elizabeth Warren.
00:02:19.000 Nobody is calling for violence, but this is a really bad own goal.

00:02:23.000 So we have to travel back in time to a time when Elizabeth Warren claimed that she was, in fact, Native American.
00:02:29.000 She said that she had high Cherokee cheekbones.
00:02:31.000 She suggested in a in a recipe book called Pow Wow Chow, I kid you not, that she was a Native American.
00:02:38.000 And the recipe she submitted to Pow Wow Chow was a recipe, again I kid you not, for crab bisque.
00:02:45.000 Because, clearly, that was something the Cherokees made back in the day.
00:02:48.000 Crab bisque.
00:02:49.000 The noted crab herds of the Oklahoma plains that her ancestors used to hunt.
00:02:55.000 Elizabeth Warren told this story over and over about her Native American ancestry.
00:02:59.000 And what she said was that there were racist members of her family who couldn't accept her parents' romance because her mom was partially Native American.
00:03:07.000 Here's Elizabeth Warren telling the romantic story.
00:03:10.000 Actually, you have it wrong about what it is, I believe.

00:03:14.000 Tell us what it is.

00:03:15.000 My mom and dad were very much in love with each other and they wanted to get married.
00:03:21.000 And my father's parents said, absolutely not.
00:03:24.000 You can't marry her because she's part Cherokee and she's part Delaware.
00:03:28.000 And after fighting it as long as they could, my parents went off.
00:03:32.000 They eloped.
00:03:34.000 Okay, so her parents eloped because her mom was part Cherokee and part Delaware.
00:03:39.000 Which means, you would think, pretty hefty dose of Native American ancestry right there, right?
00:03:43.000 I mean, if her family is worried about it, then sounds like that would be some significant Native American ancestry.
00:03:49.000 So, President Trump didn't believe this because it's nonsense.
00:03:52.000 People actually checked into her background, they found there's no Native American ancestry anywhere in the time horizon of rationality.
00:03:59.000 So President Trump went out on the campaign trail, this is back in 2017 I believe, and he was holding a rally in Montana.
00:04:06.000 And he suggested that he would give her a million dollars if she could prove her Native American ancestry.
00:04:12.000 And we will say, I will give you a million dollars to your favorite charity, paid for by Trump, if you take the test and it shows you're an Indian.
00:04:24.000 So today, Elizabeth Warren came forward with the evidence that she was, in fact, Native American.
00:04:30.000 Now, I think that it is important to note, if you don't believe in media bias, you have to check out the headlines today, because the headlines today are truly astonishing.
00:04:37.000 The headline today from the Daily Beast suggests that there is strong evidence that she is Native American.
00:04:43.000 Okay, it says, this is the actual title.
00:04:45.000 Elizabeth Warren DNA Test Reveals Native American Ancestry.
00:04:50.000 Her claims to indigenous heritage had been ridiculed by Trump.
00:04:53.000 CNN had a headline about Elizabeth Warren.
00:04:56.000 Same thing.
00:04:56.000 It says, Trump offered $1 million.
00:04:58.000 Now he says, who cares?
00:05:01.000 And Elizabeth Warren releases test with strong evidence of ancestry.
00:05:06.000 And then analysis, why Elizabeth Warren is number one in our new 2020 rankings.
00:05:10.000 So CNN obviously has a pretty strong agenda here.
00:05:12.000 So what this would suggest, if you just read those headlines, is she took a DNA test and it found that a great-grandparent was Native American or something.
00:05:20.000 Well, well!
00:05:23.000 Not smuch.
00:05:25.000 So, she took a DNA test.
00:05:28.000 And here is what it showed.
00:05:29.000 This is according to the Boston Globe.
00:05:43.000 He concluded that the vast majority of Warren's ancestry is European, but he added that the results strongly support the existence of an unadmixed Native American ancestor.
00:05:52.000 So what exactly does that mean?
00:05:53.000 Here's what it means.
00:05:54.000 Bustamante calculated that Warren's pure Native American ancestor appears in her family tree in the range of six to ten generations ago.
00:06:04.000 Six to ten generations ago.
00:06:06.000 In other words, her actual Native American ancestor could be Pocahontas.
00:06:11.000 That takes you back like 200 years.
00:06:14.000 That's... Just to be straight about this.
00:06:17.000 Her claim that she has Native American ancestry was that her parent, her mom, was so Native American that she was discriminated against by her dad's family.
00:06:24.000 That is not the same thing as her great-great-great-great-great-grandparent minimum.
00:06:31.000 Was Native American.
00:06:32.000 Not the same thing at all.
00:06:33.000 And by the way, that is not the outer limit of the test.
00:06:35.000 The test shows that at best, at best, she was a 6th generation Native American.
00:06:41.000 At worst, at worst, it's 10th, which would mean that she had an ancestor, her great-great-great-great-great-great-great-great-great-grandparent, who was Native American.

00:06:56.000 It's really, really spectacular.
00:06:58.000 So it says, the inherent imprecision of the six-page DNA analysis could provide fodder for Warren's critics.

00:07:05.000 If her great-great-great-grandmother was Native American, that puts her at 132nd American Indian.
00:07:10.000 But no one says she's 132nd.
00:07:11.000 The minimum, right?
00:07:13.000 The minimum is that she is 1... I think it was 1,512th or something?
00:07:19.000 She's not... Like, 132nd is not actually a 6th generation Native American.
00:07:25.000 That's like a 4th generation Native American.
00:07:28.000 In any case, the report includes the possibility that she is just one 1,024th Native American, if the ancestor is ten generations back.

00:07:41.000 So, here's the even better part.
00:07:43.000 To make up for the dearth of Native American ancestry,
00:07:47.000 DNA.
00:07:47.000 Bustamante used samples from Mexico, Peru, and Colombia to stand in for Native American.
00:07:53.000 So in order to use Cherokee DNA to match her up, he used Mexican, Peruvian, and Colombian DNA to match up.
00:08:01.000 So what it really shows is that she's 1,1024th Mexican, Peruvian, or Colombian.
00:08:07.000 So, awesome.

00:08:11.000 I love this.
00:08:12.000 It says, Warren has 12 times more Native American blood than a white person from Great Britain, and 10 times more than a white person from Utah, the report found.
00:08:20.000 Well, there's only one problem with that.
00:08:21.000 What the actual study shows is that the average American in the United States, of any race, the average American in the United States is 0.18% Native American.
00:08:32.000 And by the way, you're not accepted as a Native American in a Native American tribe unless you are at least 116th Native American, meaning that you had a great-grandparent who was Native American.
00:08:40.000 So, we are now going back 10 generations to try and claim that she's a Native American.
00:08:45.000 Because she claims, I guess, a University of Pennsylvania Native American heritage and all the rest.
00:08:51.000 She is .009% Native American.
00:08:54.000 And she's bragging about this.

00:08:56.000 This is her claim.
00:08:57.000 And the media are saying, well, this should put this thing to bed.

00:14:56.000 Elizabeth Warren is bitterly clinging on to this narrative and the media are bitterly clinging on along with her.
00:15:01.000 And then they are clinging on to a bunch of other false narratives that they are putting out.
00:15:04.000 Now, all they have to do, I've said this on CNN, all that the media have to do in order to undermine President Trump is just try to stick to the truth.

00:15:12.000 There's nothing that they can do that will force them to stick the truth.

00:15:18.000 So over the weekend, there were two separate, two separate major media stories that turned out to be basically false about President Trump.

00:15:27.000 Here is an NBC tweet about a rally that President Trump did, I believe, Friday night.

00:15:34.000 President Trump says Robert E. Lee was a great general during Ohio rally, calling the Confederate leader incredible.
00:15:40.000 Now you think, well, that's bad stuff.
00:15:42.000 You probably shouldn't call a Confederate leader incredible.
00:15:45.000 It is true, by the way, that Robert E. Lee was a good general.
00:15:48.000 I don't think he was a great general, but he was a good general.
00:15:50.000 That doesn't mean that he was a good person or that he believed good things, but that was the headline from NBC News.
00:15:57.000 The headline from NBC News is that Trump said that Robert E. Lee was a great general and called the Confederate leader incredible.
00:16:01.000 Now, here is what President Trump actually said about Robert E. Lee.

00:16:07.000 And one day, it was looking really bad.
00:16:12.000 And Lincoln just said, you hardly knew his name.
00:16:17.000 And they said, don't take him, he's got a drinking problem.

00:16:33.000 And Lincoln said, I don't care if he's an alcoholic, frankly, give me six or seven more just like him.

00:16:44.000 What he was saying is that Robert E. Lee was a great general who was overcome by Grant.
00:16:49.000 He was not saying that Robert E. Lee was a wonderful, wonderful person standing for wonderful things.

00:16:55.000 He says, you guys, you got this wrong.

00:17:20.000 An earlier tweet misidentified the general President Trump described as incredible at a rally in Ohio.

00:18:10.000 That is clearly not what Trump was saying.

00:23:46.000 Other good Trump, he said some interesting things on 60 Minutes.
00:23:50.000 And when he talked about the Democrats not wanting the country to heal, this obviously was correct.
00:23:54.000 Here's President Trump going after the Democrats.
00:23:57.000 He is not wrong about this, considering that Elizabeth Warren today is doing the, everybody hates you, Mr. Trump, and my Native American ancestry is real, and Hillary's saying no civility for Republicans, and all the rest.
00:24:07.000 Here is President Trump talking about Democrats wanting to divide the country.
00:24:11.000 We need to be healed.
00:24:13.000 I don't think they want to heal yet.
00:24:15.000 I'll be honest.
00:24:16.000 Well, you don't want to heal yet.
00:24:17.000 I saw Hillary Clinton made a really nasty statement.

00:24:27.000 I'm not sure that President Trump is the most healing president, but we will count this in the category of good Trump.
00:24:32.000 In the category of bad Trump, here is President Trump talking about Saudi Arabia.
00:24:37.000 He has made a couple of comments.
00:24:38.000 What he said on 60 Minutes was not bad.
00:24:40.000 But Saudi Arabia is enmeshed in a massive scandal right now because there's this guy named Jamal Khashoggi.
00:24:46.000 And Jamal Khashoggi was a person who wrote op-eds for The Washington Post.
00:24:52.000 He was a longtime retainer of the Saudi royal family and a critic of the regime.
00:24:56.000 He entered the Saudi consulate in Istanbul, Turkey on October 2nd, seeking documents relevant to a divorce.
00:25:01.000 The Turkish government claims that they have proof that a Saudi hit squad murdered him inside the consulate, chopped his body up, and then dispatched the remains in a black van to a private plane headed for Saudi Arabia.
00:25:11.000 There's not a lot of doubt that Khashoggi is dead at this point.
00:25:14.000 This has created worldwide consternation against the Saudi government, and in particular,
00:25:18.000 against Prince Mohammed bin Sultan, who's considered the new leader of Saudi Arabia, the new dictator of Saudi Arabia.
00:25:25.000 A few comments are necessary on this to understand what's going on exactly here.
00:25:30.000 Number one, Saudi Arabia is a tyrannical dictatorship led by people who are tyrannical dictators.
00:25:35.000 It's a monarchy.
00:25:36.000 They chop people's hands off regularly.
00:25:39.000 They imprison dissidents.
00:25:41.000 They are not a human rights friendly country.
00:25:44.000 Mohammed bin Sultan was supposed to be a reformer, but even as a reformer, he's still the dictator of Saudi Arabia.
00:25:49.000 This is not a supremely shocking story on any level other than we know the name of the guy who has disappeared as opposed to presumably many other people whose names we don't know who have been disappeared.
00:25:58.000 Second, the Turkish government has a pretty strong interest in trying to humiliate the Saudis because the Turkish government
00:26:04.000 has basically been anti-Saudi for years.
00:26:06.000 They're in bed with the Iranian government at this point, and to a certain extent in bed with the Syrian government as well.
00:26:13.000 All of that said, the Turkish government releasing evidence in an attempt to make it look like they are our friends.
00:26:19.000 Erdogan, who's the leader of Turkey, also an Islamist thug who has imprisoned dissidents and killed dissidents too.
00:26:24.000 So, there are no good guys in this part of the world, at least not in leadership positions.
00:26:30.000 In any case,
00:26:31.000 The call for the United States to distance itself from the Saudi Arabian government after all of this, I think is appropriate.
00:26:37.000 But I think it's also appropriate to note that the outsized consternation with regard to Khashoggi, which when I say outsized, I don't mean that it's inappropriate.
00:26:43.000 It's totally appropriate.
00:26:44.000 But when compared to the amount of consternation over Turkey imprisoning thousands of people, and until a minute ago, imprisoning a U.S.
00:26:52.000 pastor,
00:26:53.000 Or Syria murdering half a million people?
00:26:57.000 Or Iran pursuing terrorism across the region?
00:26:59.000 It is amazing how the human brain has the capacity to hone in on a single incident of evil in a way that it doesn't on literally hundreds of thousands of incidents of evil.
00:27:10.000 But with all of that said, the United States does have to do something if the Saudi Arabian government is calling dissidents back to consulates and then murdering them.
00:27:17.000 That is a bad thing.
00:27:19.000 Here's President Trump on 60 Minutes talking about it.
00:27:21.000 He changed his tune a little bit today.
00:27:24.000 They are ordering military equipment.
00:27:26.000 Everybody in the world wanted that order.
00:27:28.000 Russia wanted it.
00:27:30.000 China wanted it.
00:27:31.000 We wanted it.

00:27:33.000 So would you cut that off?
00:27:34.000 Well, I'll tell you what I don't want to do.
00:27:37.000 Boeing, Lockheed, Raytheon, all these companies.

00:27:45.000 There are other ways of punishing, to use a word that's a pretty harsh word, but it's true.
00:27:52.000 Okay, so, you know, when he says that he wants to maintain certain economic ties, that's not great Trump, right?
00:27:57.000 He needs to actually be exerting pressure on the Saudis for reform.
00:28:00.000 Now, he has to do that carefully because he also doesn't want to give a lot of leeway and leverage to the Iranians, who are enemies with the Saudi regime and have been fighting a proxy war in Yemen with the Saudis.
00:28:10.000 Again, there are no good guys in this particular area of the world.

00:28:48.000 I get along with him, okay?

00:35:15.000 A follower of whose shot up a bunch of Congress people last year came out and said that it's not that bad if people get mobbed in public places.
00:35:24.000 Like, it's amazing that Bernie doesn't feel any necessity to say anything here about this sort of action.
00:35:29.000 You know, listen again, I don't blame Bernie Sanders for that incident last year, because unless you're openly calling for violence, I don't blame you for somebody going and doing violence.
00:35:36.000 But when Bernie Sanders refuses to condemn mobbing in public spaces, he certainly is not making the country a better place.
00:35:45.000 I am very strongly in favor of mobilizing the American people to stand up and fight for economic justice and social justice and racial and environmental justice.
00:35:56.000 And I think we have to mobilize people.
00:35:59.000 I am not a great fan of being rude or disrupting activities.
00:36:03.000 But this is what I will say.
00:36:05.000 This entire 2000 election campaign is going to come down to two words, and that is voter turnout.
00:36:14.000 Okay, so he's not a big fan of people getting rude, but if people get rude, that's sort of the way that it is.
00:36:17.000 And voter turnout, I don't want to dampen the enthusiasm.
00:36:20.000 It just shows how the Democrats are willing to flirt with the mob politics they've been talking about for the last several months, really, since Maxine Waters broke out into the open with it.
00:36:29.000 And they're willing to do so on a regular basis.
00:36:31.000 They're even willing to validate mob violence on a regular basis.
00:36:35.000 Over the weekend, the Washington Times reported that Portland Mayor Ted Wheeler
00:36:38.000 came under fire over a viral video showing Antifa protesters blocking traffic and harassing drivers.
00:36:43.000 But he says he supports the decision by police to watch from a distance without getting involved.
00:36:48.000 He says, I was appalled by what I saw in the video, but I support the Portland Police Bureau's decision not to intervene.
00:36:54.000 The whole incident will be investigated.
00:36:55.000 The video was posted by journalist Andy Nago and it showed protesters, including members of Antifa and Black Lives Matter, blocking an intersection and attempting to direct traffic while officers on motorcycle watched from a block away.
00:37:07.000 At one point,
00:37:08.000 The activists chased down 74-year-old Kent Hauser after he made a right turn against their wishes, pounding on his silver Lexus and breaking a window.
00:37:15.000 The car sustained thousands of dollars in damage, he told The Oregonian.
00:37:18.000 But Mr. Wheeler insists the motorists should feel completely safe coming into downtown Portland.
00:37:23.000 Well, all of this, this lack of law enforcement, this lack of crackdowns on Antifa, it leads to
00:37:28.000 Greater heights of violence when other people who are ready for violence show up in places where Antifa is.
00:37:34.000 Now, here has been my recommendation for a very long time.
00:37:37.000 I speak at a lot of public events where protesters show up.
00:37:40.000 And in some of those events, protesters get violent.
00:37:44.000 I mean, that's happened at Cal State Los Angeles.
00:37:46.000 It happened at Penn State a little bit.
00:37:48.000 It happened, certainly, at Berkeley, where nine people were arrested.
00:37:51.000 My recommendation has always been, because there have been people who have said, well, should I come ready for self-defense?
00:37:56.000 What I've always said is, look,
00:37:58.000 If somebody hits you, then defending yourself is fine, but you should come ready to invoke the powers of the police.
00:38:04.000 You should be ready to go to the police and let law enforcement take care of the problem.
00:38:08.000 We live in a volatile climate enough that you don't have to go around spoiling for a fight.
00:38:12.000 Because if you spoil for a fight, the media is just going to play it as though you were the instigator of the fight in the first place.
00:38:17.000 The reason I bring this up is because over the weekend, there were a couple of violent incidents, one in New York and one in Portland, and it's just not good stuff.
00:38:24.000 It's not good stuff.
00:38:24.000 I'll explain.
00:38:25.000 So,
00:38:26.000 First, Portland.
00:38:27.000 So there was a march called the Patriot Pride, I believe, and it happened in Portland over the weekend.
00:38:37.000 And it got ugly because Antifa showed up and people basically started beating the crap out of each other.
00:38:43.000 Here's a little bit of the brawl.
00:38:57.000 So if you can't see this, you can see people fighting with each other, like really swinging on each other.
00:39:02.000 According to The Oregon Live, a demonstration billed as a march for law and order in the streets of Portland descended into chaos as rival political factions broke into bloody brawls downtown Saturday night.
00:39:11.000 Members of the right-wing group Patriot Player and their black-clad adversaries, known as Antifa, used bear spray, bear fists, and batons to thrash each other outside Kelly's Olympian, a popular bar on Southwest Washington Street.
00:39:23.000 The melee, which lasted more than a minute, ended when riot cops rushed in and fired pepper balls at the street fighters.
00:39:28.000 Now, as I say, what's happening here is that groups like Patriot Prayer, which are being cast as white nationalists, and I'm not seeing strong enough evidence to say that this is a white nationalist group.
00:39:40.000 In any case, and this is coming from a guy who's happy to say when I think people are white nationalists, right?
00:39:45.000 I did two episodes after Charlottesville talking about white nationalism and the evils of the alt-right.
00:39:50.000 Patriot Prayer was doing a march in Portland specifically because they wanted to show that Antifa was violent.
00:39:54.000 Antifa showed up, and it looked like Antifa instigated violence, and the folks at Patriot Prayer then got into it with them, including some of the Proud Boys from Gavin McInnes' group, and it got violent.

00:40:10.000 And I think it's okay to defend yourself, too.
00:40:12.000 But there's a difference between being willing to defend yourself and spoiling for a fight to the point where you are looking to beat the living crap out of somebody because, number one, you shouldn't be looking to beat the living crap out of people in aggressive fashion.
00:40:23.000 Like, once the guy's down, the guy's down.
00:40:24.000 Now it's time for law enforcement to come in.
00:40:26.000 And number two, it is perfectly obvious that the media are going to play this as though it is right-wing groups instigating violence, as opposed to Antifa, which has been violent every single place it goes, instigating violence.
00:40:37.000 Here's a little bit more video from that brawl in Portland.
00:40:42.000 It's a little hard to see, but you can see folks are marching.
00:40:45.000 And then, it's about to break down into violence.
00:40:48.000 You can see in the front people hitting each other, swinging on each other.

00:40:53.000 Okay, and then there was also a separate brawl in New York.
00:40:56.000 So, in New York, there was an event at the New York Metropolitan Club.
00:41:00.000 That club had been defaced by, allegedly, Antifa, over the past couple of days.
00:41:06.000 And there was an event for Gavin McInnes, who's the leader of the Proud Boys.
00:41:08.000 Now, again, the media have labeled the Proud Boys a white nationalist group.
00:41:11.000 They're members of the Proud Boys who are white nationalists.
00:41:15.000 Gavin is not a white nationalist.
00:41:17.000 I know Gavin.
00:41:18.000 Gavin is not a white nationalist.
00:41:20.000 Gavin, I think, needs to be more strict about who he involves as his friends, but to suggest that Gavin is a white nationalist ignores any part of his rhetoric.

00:41:32.000 Do the Proud Boys spoil for a fight?
00:41:35.000 Yeah, they do.
00:41:35.000 And you can see that in this particular video in New York.
00:41:38.000 Now, Antifa's claiming that the Proud Boys instigated the violence.
00:41:41.000 The Proud Boys are claiming that Antifa instigated the violence.
00:41:43.000 Apparently, after the event, they walked out, there were some Antifa members, somehow the violence gets instigated and you end up with basically 20 members of the Proud Boys kicking the living crap out of three members of Antifa.
00:42:04.000 And they won't get off these guys.
00:42:06.000 They're kicking them.
00:42:06.000 And then eventually, you'll see some members of sort of the surrounding crowd actually pulling people off of these guys because they don't want them, you know, getting arrested or killing somebody on the streets.

00:42:19.000 This is not civilization.
00:42:20.000 It's not civilization.
00:42:22.000 And if the police won't do their jobs, it's going to get worse and worse.
00:42:24.000 And if mayors aren't going to do their jobs, it's going to get worse and worse.
00:42:27.000 New York Governor Andrew Cuomo called on the FBI to investigate violent clashes connected to the Proud Boys, and he blamed President Trump for the hatred and violence he tied to the altercations.

00:42:36.000 This is not a federal issue.
00:42:38.000 Hey, the state and city should investigate every one of these incidents and the people who instigate violence should go to jail.
00:42:43.000 If the city was doing that in the first place, these brawls would not be breaking out.
00:42:47.000 We've seen them now in Sacramento.
00:42:48.000 We've seen them a couple of times in Portland.
00:42:50.000 We've seen them in Berkeley.
00:42:51.000 We've seen them now in New York City.
00:42:52.000 This is all ugly stuff.
00:42:54.000 Yes, be ready to defend yourself.
00:42:56.000 Don't go to events that are spoiling for a fight.
00:42:58.000 Be there in coordination with the police.
00:42:59.000 If you're on the side of law enforcement, you're doing something right.
00:43:02.000 And if the left refuses to allow law enforcement to do its job, this sort of stuff is going to become more and more prevalent.

00:43:20.000 So I went and visited Graceland and I realized I didn't know very much about Elvis.

00:43:26.000 So there's a really good book called Being Elvis, A Lonely Life by Ray Connolly.
00:43:30.000 And the book is fun and well-written and interesting.

00:44:11.000 So, Michael Savage, who's a radio talk show host, and I disagree with Michael on a lot of things.

00:44:22.000 They ought to check out Michael's books because Michael has been preaching a lot of the same sort of themes, some of which I agree with, some of which I disagree with, that Trump has been on for a long time.
00:44:32.000 There's a reason that Trump and Savage were close during the last election cycle.
00:44:35.000 He has a new book out called Stop Mass Hysteria, America's Insanity from the Salem Witch Trouse to the Trump Witch Hunt about the left targeting Trump.
00:44:42.000 The left acts like they don't have a window into the mind of Trump people, like the Trump people are all crazy and that they don't have anybody articulating their viewpoint.
00:44:49.000 Savage is a pretty good articulator of that viewpoint.
00:44:51.000 So if folks want to know what a lot of the Trump base is thinking, Michael has a good beat on it.

00:45:47.000 Okay, time for a couple of things that I hate.
00:45:53.000 So Israel has taken a policy that I think is very, very foolish.
00:45:56.000 There's a policy where basically Israel has barred unhinged people from traveling to study in Israel.
00:46:04.000 So there's this woman whose name is Lara Alkasam.
00:46:07.000 She's 22.
00:46:08.000 She's an American student of Palestinian descent.
00:46:11.000 She arrived in Israel with an Israeli-issued visa to study in a master's program at Hebrew U. She never made it out of the airport.
00:46:18.000 Israeli security officials detained her because of her past membership in Students for Justice in Palestine, which is indeed an anti-Semitic, anti-Israel group.
00:46:25.000 They support BDS, a boycott, divestment, and sanctions policy toward the Jewish state.
00:46:30.000 And now she's facing a deportation hearing.
00:46:33.000 This is bad politics, and it is anti-First Amendment principles.
00:46:36.000 Now, my view is this.
00:46:38.000 The State of Israel does not have to give citizenship to anybody who wants to undermine the State of Israel, just as the United States does not have to give citizenship to anybody who wants to undermine the United States of America.
00:46:49.000 As a general rule, bringing in people to study in your country, as long as they are paying their own way and it's not taking public dollars, I don't think we should be subsidizing that in the United States.
00:46:58.000 But if somebody comes here and they are a socialist, for example, and they want to study in an engineering program here and they want to pay their own way, I don't see a big problem with that.
00:47:06.000 And I think that it would be a mistake for the United States to bar people based on political viewpoint, except when it comes to actually becoming citizens and integrating into the society.
00:47:15.000 So Israel has no need to grant citizenship to this woman, al-Qassam.
00:47:19.000 They've been doing this for a few months and I don't think it's smart.
00:47:22.000 In April, Catherine Frank, this Barry Weiss and Brett Stevens reporting at the New York Times, a professor at Columbia, was interrogated and then deported from Israel on charges of being a leader of Jewish Voice for Peace, which is another organization that endorses BDS.
00:47:36.000 In August, Simone Zimmerman, an American Jewish activist who lives in Israel and is a founder, if not now, which is a group that is also pro-BDS,
00:47:44.000 was held at the Israeli border for more than three hours and quizzed on her political views.
00:47:47.000 Peter Beinart, who is an absolute schmuck of a human being, but he is a left-wing Zionist, supposedly.
00:47:53.000 He's also quasi-pro-BDS.
00:47:55.000 He was on his way to his niece's bat mitzvah in Israel, and he was detained and questioned.
00:47:59.000 This is foolish for people who are just visiting.
00:48:01.000 If you think they're an actual security threat, like a real security threat, like they're raising money against Israel, then you have every right to ban them.
00:48:09.000 But if they're just there and they're left-wing,
00:48:11.000 Let them in, have them leave when their visa expires, and that's that.
00:48:15.000 This is bad policy.
00:48:16.000 I feel the same way about Israel as I do about the United States.
00:48:18.000 On free speech basis, this seems counterproductive and foolish.
00:48:23.000 I agree with Brett and Barry when they say Israel, like all countries, has a right to protect its borders and to determine who is allowed in and out.
00:48:29.000 But Israel is also a state that prides itself on being a liberal democracy, a fact that goes far to explain the longstanding support for Israel among American Jews and non-Jews alike.
00:48:37.000 If liberalism is about anything, it's about deep tolerance for opinions we find foolish, dangerous, and antithetical to our own.
00:48:43.000 So detaining folks is not a worthwhile goal.
00:48:47.000 I think this is right, but you don't have to give citizenship to anybody, nor do you have to give public benefits to anybody.
00:48:51.000 And that's where I would draw the line, where I, Israel, I feel the exact same way about the United States.
00:48:56.000 Okay, other things that I hate.
00:48:57.000 So speaking of media bias, insane piece in the New York Times over the weekend talking about Jared Kushner and his taxes.

00:49:03.000 Ever since Nikki Haley suggested that Jared Kushner is a smart guy, the media have decided that they are on the warpath for Kushner.
00:49:09.000 They have two separate lines of attack over the past several days.
00:49:12.000 Line of attack number one, Jared Kushner is close with the MBS Mohammed bin Sultan, the Saudi prince responsible allegedly for the murder of Jamal Khashoggi, who is that Saudi dissident.
00:49:23.000 So, Jared is close with the Saudi government, therefore it's Jared's fault the Saudi government did something bad.
00:49:27.000 I'd like to see that logic applied to every American president for the last 60 years.
00:49:32.000 I'd like to see that logic applied, because that logic simply does not hold.
00:49:35.000 If anybody has an alternative in Saudi Arabia we can get behind, I am happy to hear it.
00:49:39.000 Otherwise, Jared Kushner working with Mohammed bin Sultan, before he knew about a murder,
00:49:46.000 Seems to me not a terrible idea considering that Mohammed... It's worth noting here that Mohammed bin Sultan has been militantly opposed to the Muslim Brotherhood and also opposed to the Iranians, meaning we have global interests in the Saudi government.
00:49:59.000 We have actual interests in the Saudi government.
00:50:02.000 That doesn't mean that we can't smack them when they do something wrong, as we should.
00:50:05.000 But to blame Jared Kushner for this is just ridiculous and silly.
00:50:08.000 The other line of attack is that Jared didn't pay his taxes.
00:50:10.000 So according to the New York Times, over the past decade, Jared Kushner's family company has spent billions of dollars buying real estate.
00:50:16.000 His personal stock investments have soared.
00:50:18.000 His net worth has quintupled to almost $324 million.
00:50:21.000 And yet, for several years running, Mr. Kushner appears to have paid almost no federal income taxes, according to confidential financial documents reviewed by the New York Times.
00:50:29.000 His low tax bills are the result of a common tax-minimizing maneuver that, year after year, generated millions of dollars in losses for Mr. Kushner.
00:50:36.000 But the losses were only on paper, because his company didn't actually appear to lose money.
00:50:40.000 The losses were driven by depreciation, which is a tax benefit that lets real estate investors deduct a portion of the cost of their buildings from their taxable income every year.
00:50:49.000 In 2015, for example, Kushner took home $1.7 million in salary and investment gains, but those earnings were swamped by $8.3 million of losses, largely because of significant depreciation Kushner and his company took on their real estate.
00:51:02.000 So here's the question.
00:51:03.000 Did he break the law?
00:51:04.000 Here's the New York Times.
00:51:05.000 Nothing in the document suggests Mr. Kushner or his company broke the law.
00:51:09.000 So why is this an article?
00:51:11.000 So the article is, Jared Kushner paid his taxes, but he didn't actually owe taxes, so he didn't pay taxes.
00:51:18.000 How exactly is that an attack?
00:51:21.000 It's cynical.
00:51:22.000 I mean, really, that's cynical stuff.
00:51:23.000 If you don't like the tax code, argue against the tax code.
00:51:25.000 But don't blame people for abiding by the actual law of the land in the United States.
00:51:29.000 Okay, time for a quick Federalist paper and then we'll be out of here.
00:51:32.000 So, we're all the way up to Federalist 47 written by James Madison.
00:51:37.000 And this one is really fascinating because it talks about the original concept of separation of powers.
00:51:42.000 Madison says that tyranny is a failure of the separation of powers.
00:51:45.000 He says, quote,
00:51:46.000 The accumulation of all powers, legislative, executive, and judiciary in the same hand, whether of one, a few, or many, and whether hereditary, self-appointed, or elective, may justly be pronounced the very definition of tyranny.
00:51:57.000 In other words, if you have a branch that has irrigated to itself judicial power, executive power, and legislative power, that would be a tyranny.
00:52:04.000 He says that if the Constitution were really chargeable with the accumulation of that sort of power, that no further arguments would be necessary to inspire a universal reprobation of the system.
00:52:14.000 He does say, listen, there are parts where the executive does legislative stuff, and parts where the legislative does executive stuff, and parts where the judiciary does legislative stuff, but if they
00:52:25.000 Arrogate extensive and exclusive power of one of the other branches, that is tyranny.
00:52:29.000 So he quotes Montesquieu, the French philosopher Montesquieu, who was the progenitor of this idea of checks and balances.
00:52:35.000 He says,
00:52:43.000 We're good to go!
00:53:02.000 Montesquieu objected to the merger of the executive and the legislative.
00:53:05.000 So here is a quote from Montesquieu.
00:53:06.000 When the legislative and executive powers are united in the same person or body, there can be no liberty, because the apprehensions may arise, lest the same monarch or senate should enact tyrannical laws to execute them in a tyrannical manner.
00:53:18.000 He said, were the power of judging joined with the legislative, the life and liberty of the subject would be exposed to arbitrary control.
00:53:24.000 For the judge would then be the legislator.
00:53:26.000 Were it joined to the executive power, the judge might behave with all the violence of an oppressor.
00:53:31.000 So the argument right now in the United States is whether this is what's actually happened with the executive branch.
00:53:36.000 The executive branch basically legislates.
00:53:38.000 Not basically, they do.
00:53:39.000 The regulatory power of the executive branch is legislative power.
00:53:42.000 Now, you can argue that's not the whole legislative power, because Congress can trump that.
00:53:46.000 But Congress has failed to trump that.
00:53:48.000 If you actually would like to see a check and balance again, Congress has to take back some of that power.
00:53:53.000 Congress is doing some of that.
00:53:55.000 Under President Trump, they were involved in a legislative move where they basically were knocking down regulations at a pretty rapid rate.
00:54:01.000 That's good and necessary.
00:54:03.000 The executive power has also gained the judiciary power.
00:54:05.000 You have administrative agencies with their own hearings boards.
00:54:08.000 This is one of the reasons why there's been a lot of focus on a case called Chevron.
00:54:12.000 Chevron is a Supreme Court case in which the Supreme Court suggested the judiciary has to grant administrative deference to administrative agencies.
00:54:19.000 So you have a case in front of the EPA.
00:54:21.000 You go to the EPA board.
00:54:22.000 The EPA administrative board gives you a judicial decision.
00:54:25.000 The question is whether the judiciary can trump that decision.
00:54:28.000 Chevron says, in many cases, no.
00:54:30.000 That's why Chevron is wrong.
00:54:31.000 It's why Justice Gorsuch has opposed Chevron.
00:54:34.000 It's why Justice Kavanaugh opposes Chevron.
00:54:37.000 Chevron should be struck down just for these checks and balances to be restored.
00:54:41.000 Irrigation of too much power in one branch is the essence of tyranny that remains as true today as when the Constitution was written.
