00:05:20.580 Sean Hannity on his program the other day was speaking with the lawyer Sidney Powell.
00:05:25.220 And Sean Hannity suggested that if Biden becomes president,
00:05:29.340 if Donald Trump is on his way out,
00:05:31.120 that he should issue a pardon for himself and for his family.
00:05:36.500 I watched Andrew Weissman come out and literally say,
00:05:39.440 oh, Biden's AG needs to go after Donald Trump.
00:05:42.460 And I'm like, the president out the door needs to pardon his whole family and himself
00:05:46.260 because they want this witch hunt to go on in perpetuity.
00:05:49.780 They're so full of rage and insanity against the president.
00:05:52.840 I mean, can the president, I assume that the power of the pardon is absolute
00:05:58.440 and that he should be able to pardon anybody that he wants to.
00:06:01.740 It is absolute.
00:06:03.120 It's in the Constitution.
00:06:04.260 I don't know about his authority to pardon himself, but it should not be necessary.
00:06:09.940 And aside from that, the president's going to get another four years in office to finish the job he started.
00:06:14.900 So Sidney Powell is still really holding out hope.

00:06:22.080 You'll recall that Sidney Powell is not working officially with the Trump legal campaign.
00:06:26.760 While the Trump campaign is focusing on specific matters of election fraud and unconstitutionality in Pennsylvania,
00:06:34.540 Sidney Powell is pursuing this idea that there was a national, very widespread hacking scheme to shift votes.
00:06:43.220 So she's still pursuing that.
00:06:45.140 But to Sean Hannity's point, it seems to me that's not the right attitude to have.
00:06:49.680 Do respect to Sean.
00:06:51.360 I get it.
00:06:52.180 It's true.
00:06:53.080 The Biden legal team is going to try to go after Trump.
00:06:57.220 They are going to have a lot of encouragement from the base to these frothing jackals of the Democratic base to go after Trump once he leaves office.
00:07:07.000 But I don't think Trump should pardon himself because Trump hasn't done anything illegal.
00:07:12.500 There would be nothing to pardon himself for.
00:07:16.200 And, you know, I think that's sort of Hannity's point.
00:07:18.160 He says whatever they go after Trump for, he should just pardon himself now.
00:07:20.500 I don't think that's how pardons work.
00:07:22.240 We certainly haven't seen that sort of thing in American history.
00:07:24.880 I think if Trump were to do anything of that sort, it would be giving in too much.
00:07:30.960 It would be giving in to despair and discouragement.
00:07:33.580 It would be giving in to fear, servile fear, by saying, I think they're going to come get me, so I exonerate myself.

00:07:40.420 But whatever they accuse me of, I didn't do it.
00:07:42.200 And it would be, in a way, an admission of guilt.

00:07:47.440 I'm not quite so sure.
00:07:48.640 In America, we do not have a political tradition of jailing our vanquished politicians, at least at the presidential level.
00:07:57.320 And we don't have a tradition of jailing our political opponents in this country, even though some of them probably do deserve jail.
00:08:04.180 For instance, some people who were the former, future first female president four years ago, you know, those sort of people, there is evidence that they've done things that are illegal.
00:08:13.900 We still don't put them in prison because that's what tinpot dictatorships do.
00:08:17.780 That's what banana republics do, and we don't want to do that.
00:08:19.760 If President Trump were to pardon himself, as Sean is describing here, it would be a sort of concession that we're now living in the world where we jail our political opponents once they leave the presidency.

00:08:34.920 I understand why people are reacting with such extremes to this legal process right now, either to saying the whole country is completely over or to saying that Trump's got to give up immediately or the country is over.

00:08:54.540 But generally, we all don't like uncertainty, and so we want to resolve the uncertainty, even if it resolves in a way that is unpleasant, even if it resolves in a way that we're fearing, even if it resolves to the point that we're now saying we jail our political opponents once they leave the presidency.
00:09:10.600 But they just, because we don't like the apprehension, we just want some conclusion, so we don't need to be in suspense.
00:09:15.580 Life is lived in suspense.
00:09:17.720 You don't know what's going to happen.
00:09:19.320 Patience is a virtue.
00:09:20.900 And if you keep up that sort of attitude where you say, oh, okay, you're going to do your worst to me?

00:09:33.500 Now, you heard Sidney Powell on that clip mention that she is convinced that there is this nationwide election fraud, and not just that there's nationwide election fraud, but that they will prove this in court, and President Trump will get another four years in office, which she's describing a sort of confidence here that I think even President Trump is not necessarily displaying.
00:09:54.460 So what is her evidence?
00:09:56.180 The election fraud we are uncovering is massive, and there were foreign actors involved in our system.
00:10:04.800 People from Germany and Serbia and China were all in our election the night it happened.
00:10:11.940 So I have no doubt that foreign actors tried to interfere in the election.
00:10:18.020 I'm not sure exactly how they did it.
00:10:20.240 This was, by the way, our response in 2016.
00:10:23.200 The left said that the Russians tried to interfere in the presidential election.
00:10:27.720 And some conservatives, I guess, deny that.
00:10:29.260 But I don't deny that the Russians tried to interfere.
00:10:32.400 Foreign actors tried to interfere in every single election.
00:10:35.420 The question is how successful were they?
00:10:36.900 With the so-called Russiagate, they bought $100,000 worth of Facebook ads.
00:10:41.020 Media companies spend that in a week on Facebook ads.
00:10:44.380 That doesn't, that's nothing.
00:10:45.460 That's not going to affect it.
00:10:46.620 Now, Sidney Powell's claim is that these foreign actors were actually going and hacking the voting system, shifting the votes.
00:10:51.800 Again, I have no doubt that they would do it if they could.
00:10:54.740 I have no doubt that they are that corrupt and they want to mess up our system.
00:11:01.320 The question is can you prove it?
00:11:04.400 And time is ticking.
00:11:06.100 You know, we have, what, less than 10 days now until, no, I guess about 10 days until,
00:11:11.540 the electors vote.
00:11:12.800 So, how much longer before we, how much longer do we have to wait?
00:11:17.360 How much longer do we have to be in the suspense and apprehension to see this evidence of the hacking?
00:11:21.780 It's not enough to say, I have a hunch that this happened.

00:11:32.000 You have to prove it with certain, that's just a descriptive fact of our political and judicial system.

00:11:44.260 So, I hope that she brings the goods, but as of now, we haven't seen it.
00:11:48.080 Now, there is specific evidence of fraud in certain cases, not even just at the presidential level.
00:11:53.040 In one congressional race in New York, involving a congressional candidate that I actually know personally,
00:11:59.640 the two candidates, the Democratic incumbent and the Republican challenger, are separated by 12 votes.
00:12:07.580 I want to talk about your vote mattering.
00:12:09.100 I want to talk about going out there, even if it's a system that's vulnerable to fraud.
00:12:13.540 So, New York's 22nd congressional district, you've got the Republican Claudia Tenney,
00:12:18.080 has a 12-vote lead over the Democratic incumbent, Anthony Brindisi.
00:12:24.440 And that's good news, right?
00:12:26.560 Because that means Claudia's going to win, the Republican's going to win.
00:12:29.240 We're all good.
00:12:30.420 It's been almost a month now since the elections.
00:12:34.620 I think we should be able to count our ballots by now.
00:12:38.260 Talk about a tin pot dictatorship.
00:12:40.440 We can't even count our ballots within a month.
00:12:43.420 Well, no.
00:12:44.580 We have to keep counting the ballots until the Democrat wins.
00:12:47.500 Claudia has a 12-vote lead.

00:12:50.620 Conveniently, they just found a batch of 55 ballots.

00:13:01.080 The Chenango County Attorney, Alan Gordon, said that election officials determined that
00:13:06.400 of these 55 ballots found, 44 of them are valid.
00:13:09.780 Now, the other way to read that is 11 of these votes were fraudulent, were ineligible.
00:13:17.160 How'd they end up there?
00:13:18.360 So, 44 are valid.
00:13:20.240 44 could swing an election easily if the election is right now hanging by 12 votes.
00:13:26.780 So, this county attorney has advised the Board of Elections to secure the ballots, leave
00:13:33.440 them unopened in their offices, and obviously throw out the ones that are illegitimate, but
00:13:38.980 now 44 ballots.
00:13:40.940 I hope they're unopened.
00:13:42.180 I hope that they're legitimate ballots.
00:13:44.140 I hope that they weren't just being held in case they were needed by the Democrats.
00:13:48.300 But when the votes trickle in and trickle in and trickle in until the Democrats win, that
00:13:53.920 does not give us confidence in the system.
00:13:57.320 It discourages us in some way because we feel like we can't win.

00:17:32.360 And Alabama Republican Representative Mo Brooks is telling his colleagues that he plans to
00:17:38.020 challenge the results of the Electoral College vote if the body votes to certify Democratic
00:17:44.120 presidential candidate Joe Biden as the next president.
00:17:46.800 Now, how does this work?
00:17:49.940 The Electoral College votes.
00:17:51.740 Then if a member of the House and a member of the Senate raise this objection and challenge
00:17:59.900 the Electoral College vote, this opens up the floor to debate.
00:18:05.540 The floor of the House and the Senate will have to deliberate on this matter.
00:18:09.540 Okay, fine.
00:18:10.240 That's a great last ditch effort.
00:18:11.280 But if it comes to that, then that last ditch effort and $1.50 will get you a cup of coffee.

00:18:45.920 So we mentioned yesterday that Bill Barr came out and said so far he hasn't seen evidence
00:18:49.620 of widespread hacking, sort of the fraud that Sidney Powell's talking about.
00:18:54.720 He since came out, by the way, and tempered that statement.
00:18:56.740 He said, I'm not saying there's no fraud that went on.
00:18:59.200 I'm not even saying there's not enough fraud to overturn the election.
00:19:02.660 I'm just saying we have not seen it yet.

00:19:08.860 But in the meantime, Bill Barr did something behind the scenes that I think is very important.
00:19:12.340 You've heard of the John Durham investigation.
00:19:14.900 This is a criminal investigation into the origins of the Russia hoax and into wrongdoing at the
00:19:21.080 FBI and the DOJ and the deep state, the blob, right?
00:19:24.460 And there's a big worry here that if Joe Biden becomes president, there goes John Durham.
00:19:30.380 There goes the investigation.
00:19:31.560 We're not going to find out how the Russia hoax started.
00:19:33.860 We're not going to find out if Joe Biden was involved in that because there's a lot of evidence
00:19:36.780 that he was or that Susan Rice was involved in that or that Barack Obama was involved in
00:19:41.260 that, that they had direct knowledge.
00:19:43.800 So what Bill Barr just did, and he did it surreptitiously, is he made John Durham a special counsel.
00:19:50.520 You remember special counsel.
00:19:52.000 It's the same procedure that created the Mueller investigation.
00:19:56.780 The special counsel has much more latitude to conduct an investigation.
00:20:02.380 What this means is that if Joe Biden does become president, he's not going to be able
00:20:06.700 to fire John Durham so easily.
00:20:08.940 So there's a greater chance that we'll get some results.
00:20:11.700 Again, I don't have a great deal of faith.
00:20:14.380 We're always told that these investigations are going to uncover corruption and all these
00:20:18.780 guys are getting holed off to jail, which probably is not even a great idea anyway, but you do
00:20:22.280 want them to face consequences.
00:20:23.520 You do want them to face justice, especially these lower level guys, John Brennan, Clapper.
