00:04:13.720 I hope that this can put an end to a canard that I've been hearing from critics of Donald Trump for the past several weeks.

00:04:26.700 Namely, that Trump doesn't mind if Loeffler and Perdue lose in Georgia.

00:04:34.240 Trump, contrary to what some lawyers who are helping Donald Trump have been saying,
00:04:40.040 Trump has consistently told people to go vote in the Georgia races.

00:05:59.400 So he goes on and he's referring to President Trump and he's referring to former Vice President Joe Biden.
00:06:05.540 Chris Wallace cannot tolerate that Alex Azar will not concede the race on behalf of Trump.
00:06:11.680 If President Trump had worn a mask then and urged everyone to wear a mask then, back in April,
00:06:20.220 the way Joe Biden is right now, wouldn't we be in much better shape?

00:07:13.260 Chris Wallace should have a warning label when he posts this clip on Facebook or on Twitter,
00:07:19.220 saying that this claim is fake news, or at the very least, this claim is disputed.
00:07:23.900 Had the election come out and the media declared the election for Joe Biden and then Donald Trump
00:07:30.340 conceded, I guess it would be fair to call Joe Biden the president-elect, even though the electors
00:07:35.400 hadn't voted yet.
00:07:36.220 But that's not what happened.
00:07:37.500 This is a hotly contested presidential election.
00:07:40.220 There were lawsuits working their way through courts, very likely up to the Supreme Court.
00:07:43.800 And the electors have not voted, meaning that as a technical matter, we simply do not have
00:07:50.220 a president-elect.
00:07:51.100 But because no one's conceded this, because the election is disputed, there is no argument
00:07:55.180 whatsoever for calling Joe Biden the president-elect unless you are a partisan who is trying to
00:08:02.020 confuse the public about a debated and contested presidential election, which is obviously what
00:08:09.700 Chris Wallace is doing.
00:08:10.480 This is something that very few people pointed out on Twitter.
00:08:15.660 When Twitter had the line, it said, this claim is disputed.
00:08:20.860 They only put that on President Trump's tweets.
00:08:25.140 But a friend of mine, Jim O'Neill, pointed this out, that if a claim is disputed, then you
00:08:32.180 ought to put the disputed label on both sides of the claim.
00:08:36.240 So if Donald Trump comes out and says, we won this election, and Joe Biden comes out
00:08:40.840 and says, we won this election, if the claim that Trump won is disputed, then that means
00:08:44.400 that the claim that Biden won is disputed too.
00:08:46.200 So you're supposed to put the label on both.
00:08:47.880 But of course, the media don't want to do that, because when they say disputed, they mean
00:08:52.140 it's disputed by us.
00:08:53.420 When they say, sources have called this election differently, the sources they're referring to
00:08:57.000 are themselves.
00:08:58.180 And they want to make themselves the official authority for this, even though they are not.
00:09:03.440 But the courts have some authority here, the president has some authority if he were to
00:09:08.480 concede, and the electors, of course, who will be voting not many days from now, have
00:09:14.140 authority as well.
00:09:16.280 Also knocking down Chris Wallace's insistence that Joe Biden is the president-elect is the
00:09:21.740 Supreme Court.
00:09:22.560 So just yesterday, this is some big news on the Trump legal front.
00:09:26.220 Sam Alito, Supreme Court justice, asked officials in Pennsylvania to file briefs by tomorrow morning,
00:09:33.080 by Tuesday morning, in response to an emergency injunction petition filed by Republicans seeking
00:09:38.120 to invalidate or rescind the results of the November 3rd election in the Keystone State.
00:09:42.620 So I just did an episode with Senator Cruz on our show, Verdict, about this issue.
00:09:49.500 Of all of the claims of election fraud or illegality or unconstitutionality, the clearest example
00:09:55.780 of this is Pennsylvania.
00:09:56.840 The Pennsylvania state constitution prohibits the use of widespread unsolicited mail-in ballots,
00:10:03.820 the kind of ballots that we saw in this election.
00:10:05.680 It explicitly prohibits their use.
00:10:08.260 You got to vote in person.
00:10:09.760 There are some narrow carve-outs, but you have to vote in person there.
00:10:13.260 The legislature in Pennsylvania overrode this, and they said, no, you can vote by mail, widespread
00:10:20.360 mail-in.
00:10:20.880 But the legislature does not have the authority to override the constitution.
00:10:26.560 Now, the Pennsylvania Supreme Court came in, and in a highly partisan and indefensible
00:10:31.140 opinion, said, oh, never mind, forget about the constitution, have your mail-in ballots,
00:10:36.040 and enjoy however you're going to count them down there in Philly, guys.
00:10:40.060 There is now a petition going to the US Supreme Court to invalidate those results because they
00:10:48.720 were patently unconstitutional.
00:10:50.780 That is a very legitimate argument.
00:10:53.140 However, there is a deadline for these things because we need to know where the electors are
00:10:57.120 going before they go and vote.
00:10:58.800 So initially, this deadline was going, or initially, rather, the Supreme Court was maybe going to
00:11:03.500 hear this Thursday.
00:11:04.040 It would have been too late.
00:11:04.840 So they've reached this safe harbor deadline.
00:11:07.520 What this seems to suggest is that the Supreme Court is going to weigh in on the election in
00:11:11.580 Pennsylvania.
00:11:12.140 Now, that wouldn't be enough to flip the presidential election.
00:11:14.400 You'd also have to flip Georgia, and you'd have to flip Arizona.
00:11:17.900 Is that possible?
00:11:18.920 I suppose it is possible.
00:11:20.080 Is it likely?
00:11:20.860 It's not likely.
00:11:22.540 However, however, it's worth pointing out, it is not impossible.
00:11:26.000 The Trump team is still pursuing their legal options.

00:11:39.660 And this could be the way, maybe the only way, to flip the votes in Georgia and Arizona, which
00:11:46.040 is they need to prove that there was something fishy about the vote counting machines.

00:13:41.920 The big news coming out of Antrim County, Michigan this morning, Pete, is that a judge actually
00:13:47.320 granted our team access to 22 of the Dominion voting machines for us to conduct a forensic
00:13:52.880 audit.
00:13:53.760 So if you remember, this is the county that had the switch of 6,000 votes from President
00:13:59.160 Trump to Joe Biden, and that was an unexplained and so-called glitch.
00:14:03.380 And so our team is going to be able to go in this morning at about 830, and we'll be there
00:14:07.980 for about eight hours to conduct that forensic examination, and we'll have the results in about
00:14:12.660 48 hours.
00:14:13.760 And that'll tell us a lot about these machines.
00:14:15.920 So we'll find out later this week if there is any substance to the claims that Dominion
00:14:22.040 and the other software have flipped the votes.
00:14:25.560 Now, this is happening because of a judge in Michigan.
00:14:28.460 Of course, if there is some sort of systemic issue with the software, then that's going to
00:14:33.100 affect the certification of the results in other states as well.
00:14:38.720 Some people passionately believe that these voting machines were rigged.
00:14:44.020 They see the glitches, such as thousands of ballots being flipped for somebody else.
00:14:48.620 They see spikes in the count, and they say, this looks pretty fishy.
00:14:52.280 They know that these electronic voting machines are vulnerable just by definition compared to
00:14:56.600 older methods of voting.
00:14:58.100 So they look at that and they say, absolutely, there was a rigged election going on through
00:15:04.320 the machines.
00:15:05.020 Then there are other people who say, this is crazy.
00:15:07.120 This is a conspiracy theory.
00:15:08.840 There's no chance that any of the machines were rigged.
00:15:11.580 Come on, get your tinfoil hat off.
00:15:14.020 Now, as always in this election fight, there is an option between these two extremes.
00:15:20.460 The option is, okay, if you're so convinced it's a conspiracy theory, let us go in and
00:15:25.280 take a look at the machines.
00:15:27.580 If you're so convinced this is, then don't wipe the machines.
00:15:30.880 There was a judge order in Georgia not to allow people to wipe the Dominion voting machines
00:15:34.440 and reset them.
00:15:35.440 Cool, there's no problem.
00:15:36.380 Then we're going to go in there and take a look at what's going on in those machines.
00:15:39.240 Likewise, for people who were convinced there was rigging, okay, if you're so convinced,
00:15:44.340 we'll go into the machines.

00:15:50.060 We don't, this isn't going to drag on for eight or 10 years.
00:15:53.860 Frankly, even if there was fraud, if you can't prove it in the amount of time, it doesn't

00:16:05.360 And we figured it out around 1990 for sure that he stole it.

00:43:45.400 But Nick Kristof in the New York Times published an op-ed that I sort of enjoyed.

00:43:51.500 It's called the Children of Pornhub subheader.
00:43:54.260 Why does Canada allow this company, Pornhub, I guess the largest, I think the largest porn company in the world.
00:44:02.700 Why does, why does Canada allow this company to profit off videos of exploitation and assault?
00:44:09.080 And the article begins,
00:44:10.660 Pornhub prides itself on being the cheery, winking face of naughty,
00:44:13.880 the website that buys a billboard in Times Square and provides snow plows to clear Boston streets.
00:44:18.480 It donates to organizations fighting for racial equality and offers steamy content free to get
00:44:24.520 people through COVID-19 shutdowns. That supposedly wholesome Pornhub attracts 3.5 billion visits per
00:44:29.920 month. Oh my gosh. More than Netflix, Yahoo, or Amazon. Pornhub raises, or rakes in money from
00:44:36.780 almost 3 billion ad impressions a day. One ranking lists Pornhub as the 10th most visited website in
00:44:41.780 the world. Yet there's another side to this company. It's infested with rape videos.
00:44:45.760 It monetizes child rapes, revenge pornography, spy cam videos of women showering,
00:44:50.060 racist and misogynist content, and footage of women being asphyxiated in plastic bags.
00:44:54.620 A search for girls under 18, no space, or 14-year-old, or 14YO leads in each case to more
00:45:01.720 than 100,000 videos. Most aren't of children being assaulted, but too many are. You get the point.
00:45:06.660 This brings us back to a debate that actually started last December, and it kind of split the
00:45:12.100 right. What to do about the online porn problem. You had people who, in the name of a very degraded
00:45:19.680 and shallow understanding of libertarianism, said, nah, porn's great. George Washington and Thomas
00:45:24.460 Jefferson would love it. They basically wrote the Declaration of Independence and the Constitution so
00:45:29.440 that we could all watch videos of this trash, this wicked and debased stuff. And so we got to keep
00:45:37.680 porn, no regulations. And then you had another side saying, we need to ban porn. Just ban it.
00:45:42.520 This is obviously horrible stuff. Just ban the porn right now. And this debate ensued. And
00:45:47.940 I thought both sides sort of missed the point.
00:45:55.360 It gets to a lot of our public debates right now. Actually, right to the top of the show,
00:45:58.780 we were talking about, do you defend Trump or do you defend Georgia? How about both? How about you do
00:46:03.880 both? How about you allow Trump to pursue his legal options and encourage him to pursue his legal
00:46:08.320 options and don't encourage him to concede? And then how about you also try to hold the Senate by
00:46:13.380 voting for those two Georgia senators? Why can't you do both? I think on the porn debate,
00:46:19.360 we can acknowledge there is no constitutional right to pornography. Pornography has been
00:46:26.240 highly regulated, if not outright illegal, from the very beginning of the country. We still have laws
00:46:31.600 against obscenity. We jailed pornographers as recently as a dozen years ago. The founding
00:46:37.700 fathers made a very clear distinction between liberty and licentiousness. Okay. And they did not
00:46:43.400 support licentiousness. And they realized that licentiousness like Pornhub is the opposite of
00:46:48.280 true liberty, that it actually undermines liberty. Okay. That's, that's the one hand. On the other hand,
00:46:52.500 from the banned porn people, I think it's also worth remembering that conservatives are prudent.
00:46:57.880 We have a practical quality to ourselves. It is not possible to eliminate lust from the heart of man.
00:47:05.080 It's also not possible to eliminate the expressions of that lust. This is why the, the, some of the
00:47:10.520 greatest theologians and moral thinkers in history, St. Augustine and St. Thomas Aquinas actually defended
00:47:15.920 legal prostitution, not because they thought legal prostitution was a good thing, but because they
00:47:20.240 acknowledged that it's the world's oldest profession. It actually predates politics just barely. I guess you
00:47:25.180 might say it's a form of politics. The two seem very similar. And Augustine and Thomas's point was that
00:47:32.320 if you eliminated prostitution entirely, the, the entire civilization would be convulsed with lust.
00:47:38.360 And so what you had to do is regulate it, you know, put, put it in one area, a red light district,
00:47:43.760 for instance, and treat it seriously as the danger that it is, but also recognize that it's
00:47:49.540 impractical, impractical, probably impossible to get rid of it entirely. Why can't we have that
00:47:54.980 conversation? I think once we eliminate the kind of stupid idea that we have a natural or
00:47:59.960 constitutional right to look at porn, and we also eliminate the imprudent and impractical idea that
00:48:05.740 you can utterly eliminate porn, we can have a real conversation, which is that this is obviously a
00:48:10.680 major problem confronting the country. You've got, well, especially in this generation, you've got
00:48:16.040 kids who have been exposed to this, young boys from very early age, they get hooked on it. It warps
00:48:22.000 their brain. It warps their lives. It creates an addiction that a lot of people want to get away
00:48:27.040 from. How about you can look at the number of people in this country. I think there was some
00:48:32.160 study that said 93 or 94% of men have looked at online pornography. And of course the typical rejoinder
00:48:39.580 to that is, and 6% of men are liars. You know, this is, it basically is a ubiquitous problem.
00:48:44.720 So how about you deal with that and say, yeah, this is, this is bad. This is, this is different
00:48:50.160 than having a Playboy under your bed in the 1970s. This is the, the ubiquity of it, the ease of use,
00:48:55.620 the, the stimulation of it is, is a, is a distinct problem. And then heavily regulate it. You know,
00:49:00.760 if I wanted to go buy a Playboy down the street, I would have to go and show an ID.
00:49:06.080 Why do we not have the same mechanism for online porn, like, like a website like Pornhub?
00:49:11.760 To say, we're not going to completely outlaw the thing, but you have to, you have to upload an ID
00:49:17.360 because in that case, it's not just saying only adults can get it. I actually don't think adults
00:49:21.940 should be able to easily access it either. It introduces an element of shame. You have to
00:49:26.280 show an ID and therefore you're saying, I am openly going to be looking at this kind of material,
00:49:31.820 which is very shameful. That would reduce the number of people who do it. Now you might have
00:49:36.340 people making fake IDs. You might have people getting around the rules. Sure. Okay. Right.
00:49:41.220 But as, as conservatives, especially, we should know better than anybody that you can't let the
00:49:47.260 perfect get in the way of the good. You can't let ideological purity get in the way of practical
00:49:52.500 results. You can't let these abstractions get in the way of prudence. If you could reduce this
00:49:59.540 problem, a problem that's so bad that even left-wingers in the freaking New York Times
00:50:04.420 are observing it now. It's not just the church ladies, you know, wagging their fingers. It's not
00:50:09.920 just Puritans and prudes wagging their fingers. Everybody is recognizing this is a problem.
00:50:16.160 Why not arrive at a sort of prudent solution? That, that is a central conservative insight is
00:50:22.480 prudence. And I think we ought to apply it to fraught public policy issues here.
00:50:26.700 This is why I often encourage people not to cling to ideology, you know, in the way that some people
00:50:32.880 just, they break their politics down into three bullet points and they say, no, liberty means
00:50:37.580 that I need to go look at porn all the time. No, it doesn't. Obviously it doesn't. And this applies
00:50:42.240 to the presidential race too. Go win in Georgia. Go, go win at the presidential level. At least try.
00:50:49.880 There's no reason not to try. And there's nothing admirable or virtuous about prioritizing that
