00:08:19.100yesterday feeling sick and trying to still get some work done i was going over uh legal actions
00:08:25.360and i was considering uh the appeals and the positions we're in with the drag queen case
00:08:31.440and moving forward um or not what we're considering with the case uh coming up with here with rocco
00:08:38.080We're going to have a fulsome discussion tonight. I'm really glad that Ted had decided to join us.
00:08:43.160We sort of asked him last minute, but Ted has been a part of this from the very onset in 2020,
00:08:49.820when he and Rocco were already working together and they were fighting against the mandating immunization for children.
00:08:59.340And then they walked straight into this COVID fraud and from there on set off and put their cases forward.
00:09:06.660And then I met Ted and then Action for Canada had just the delight of meeting Rocco. It's going to be one of the highlights of my lifetime for the very reason of the season that we're walking through.
00:09:18.860And as we go through tonight and to genuinely learn what this man has done for Canadians against much opposition and criticism, I might add, but he had the shoulders to take it, as did Ted Kuntz and as did myself.
00:09:32.860But that all comes full circle back to me thanking everyone for donating to the cause, to donating to Vaccine Choice Canada, our legal actions and keeping us going, because this is a major battle and we can't do this without you.

00:10:34.500Now, as I was saying and thanking you for your donations, as you know, drag queen Frida Wells, Tyson Cook, had filed a vexatious, I call it, and frivolous notice of civil claim against us back in 2024, suing us for defamation because we were exposing this individual and some of his activities.
00:10:55.720The major reason was, of course, because he is an education assistant at a local school district in Kelowna, working with vulnerable children and for Autism BC, and his extracurricular activities are of public interest.
00:11:11.600He's made himself known as an activist, and when you're going to do that, then you are up to be questioned, and especially when there are children involved.
00:11:19.980So as of yesterday, you know, it takes a while to make these decisions, whether we appeal, whether we go straight to court, you know, what is going to be the best use of our money and what is of the best purpose.
00:11:32.920If we leave a decision stand, then you can't go back later and undo that decision.
00:11:38.220And so in this instance, we felt that we needed to appeal the judge's decision to dismiss our, oh, sorry, I got tied up there a little bit.
00:11:52.860Our, sorry, we're going to have to go back to that, Terenzio, and do a little clip there.
00:12:00.720Yeah, just coming across our slap, our anti-slap.
00:12:04.000he was the decision was to dismiss our anti-slap and we don't feel that that decision to stand
00:12:09.720based on the evidence that we brought forward um just in case you are new to understanding who
00:12:16.340this individual is this is mr tyson cook and on his facebook page this is um in 2019 april of 2019
00:12:25.200and he has uh stated that they do not perform in front of minors this is at an adult drag queen
00:12:33.060event. And this is what we happen to be looking at. And I think that it's important that if
00:12:40.960somebody is telling you that they are only entertaining adults, that it is worth looking
00:12:47.840into this. And that's what Action for Canada has done. Having a little bit of a problem sharing
00:12:53.240screen. This is evidence that he said he's actually hosting this event. These are the
00:12:58.900individuals backstage and we've tied everything together to show yes indeed Mr. Cook was at an
00:13:05.780adult drag queen event with a minor attending this event and this just doubles down on our concerns
00:13:13.020and why we feel it's important to continue this case. Now under legal action in our menu if you

00:13:39.240this has from the onset all of the information that if you want to look at the history of this
00:13:43.940case the original statement of claim I filed a 25 page affidavit against Bonnie Henry RCMP
00:13:52.500key correspondence, and every single opportunity that we've had to move this case forward,
00:13:59.200we have documented. And let me tell you, considering this has been going on since 2021,
00:14:04.400this is not a lot of updates to be providing you when you see the time length that they have
00:14:09.900dragged this case out. And this will become critical in our conversation when we discuss
00:14:15.740what happened in court on September 24th. And I look forward to getting to that. Now, they dismissed
00:14:23.120our claim in its entirety on Thursday. I am in the process of deciding what steps to take next.
00:14:33.840And again, we will be going into a conversation regarding the judge who made his decision that day.
00:14:41.480So Justice Gordon C. Weatherhill heard from the two, several of the lawyers, the defendants lawyers, there were four defendants counsel there, and three of them had spoken before lunch hour, so between 10 and noon.
00:14:57.840From noon to 2 o'clock, 12.30 to 2 o'clock, there was 12.30 to 2 o'clock, there was a break for lunch.
00:15:08.520And when we came back, the final lawyer spoke for a few minutes and then Rocco spoke for an hour.
00:15:15.260And he addressed the defendant's arguments and presented his submissions in case law in support of allowing our claim to proceed.
00:15:22.580After that, the judge requested a 15-minute break, at which time he came back and he announced that he was making his full decision.
00:15:34.480Without leaving, without taking a moment, he had made his decision.
00:15:40.700And it was 11 and a half minutes that he spoke in his decision.
00:15:44.820And so how could he possibly have taken into consideration Rocco's submissions and the case law? And also when we showed up, he didn't have three essential materials that we had delivered well in advance of the case beginning.
00:16:01.120So this is a complaint that I will be filing with the Canadian Judicial Council, asking them to review the information that I'm going to provide, but we'll talk about some of the vitriol that had taken place and the comments that the judge had made.
00:16:48.860in the comments section whether you feel that we should appeal this case once you've heard
00:16:54.480the facts of what transpired last Thursday. So with that, Heather, would you please introduce
00:17:00.020our guests? We have two guests joining us tonight. Rocco Galati is a prominent Canadian
00:17:08.920constitutional lawyer who is committed to challenging unconstitutional actions and
00:17:14.300omissions of the state. He's had a very successful career spanning over three decades,
00:17:20.340is the founder of the Constitutional Rights Centre, and has twice been named as one of
00:17:26.260Canada's top 25 influential lawyers by Canadian Lawyer magazine. He's the author of the newly
00:17:33.380released autobiography, Clowns in Gowns, My Life and the Law. Rocco believes it's his duty,
00:17:40.900not just as a lawyer but as a Canadian citizen to speak up and take action and we are so thankful
00:17:47.460for his impressive knowledge, integrity and strength of character. Our second guest is Ted
00:17:55.160Kuntz. Ted is the president of Vaccine Choice Canada, a not-for-profit society dedicated to
00:18:02.060protecting informed consent, vaccine education, parental rights in medical decision making and
00:18:07.980medical freedom for all Canadians. Will you all help me welcome Rocco Galati and Ted Koontz.
00:18:15.340Hello Rocco and Ted, welcome to the Empower Hour.
00:18:19.520Thank you. Thank you Heather and welcome Rocco and Ted. Ted, thanks for the last minute here
00:18:26.260joining us. Like I say, I wanted it to be a more fulsome conversation. You've been in this since
00:18:31.160the onset in 2020 actually prior to that in the vaccine battle but uh rocco i'm so grateful i think
00:18:38.580it's been since 2022 since i last had you on the show so we've got a lot of catching up to do on
00:18:43.360the show tonight absolutely so yeah well where do you want me to start i well i think i i thought
00:18:53.800maybe we could take a step back from uh action for canada's case because we're going to get back
00:18:59.740to the netty gritty, and I could update everyone on what generally has happened to COVID litigation,
00:19:08.300not just with our case or the cases I've carried, but other cases as well. And there are three
00:19:17.600disturbing phenomenon that have happened with COVID litigation. The first one, a lot of the
00:19:27.020lower courts have decided that they don't need to hear evidence on the measures or the efficacy
00:19:34.620and safety of the vaccines or anything. They simply take what we call judicial notice
00:19:42.080that what the government has done or is doing is fine. And judicial notice is recognizing a fact
00:19:51.960that's so notorious that you don't need evidence on.
00:19:56.600So, for instance, you know, that gravity exists on Earth
00:20:01.060and that there are four directions on the planet, north, south, east, west.
00:20:05.840Of course, even with such basic notions,
00:20:09.460if you're standing on the Arctic Circle, there's only one direction and that's south.
00:20:14.000And if you're standing on the Antarctic Circle, there's only one direction and that's north.
00:20:19.800But that only to highlight the fact that the courts, the Supreme Court of Canada said that judicial notice is a very, very rare and narrow avenue to bypass the need for evidence being filed and tested.
00:20:40.700The second thing that the courts have decided is that they're not a venue, they're not a forum for determining scientific facts, which is ridiculous because they do it every day in medical malpractice suits, in engineering catastrophes where buildings give way and structures give way.
00:21:06.320So they make scientific determinations every day in determining negligence suits.
00:21:13.880But while saying that the courts are not a venue to determine the science, let's say, of COVID,
00:21:22.740they'll tell you that's because we've taken judicial notice that the science, as the government touts it, is the right science.
00:21:32.100So there's a double contradiction there.
00:22:03.540damage to my vocal cords that resulted out of the intubation of my coma in 2021-2022.
00:22:11.280It fluctuates, but it's there for life. The third thing, as I was saying, is that the courts are
00:22:22.380saying is the COVID measures do not violate any charter rights. Now, that's what the lower courts
00:22:33.380both trial division courts and courts of appeal are doing, and they're swimming in their own cesspool.
00:22:41.120Because I say cesspool is because while they make these pronouncements, they're all directly contradicting very direct and sound Supreme Court of Canada jurisprudence.
00:22:55.600And so the starting point that I always take them through and everything that I'm about to tell you now, all the courts ignore.
00:23:07.580So the first one is the Carter case, which was the assisted suicide case, where the Supreme Court of Canada said as follows, quote,
00:23:21.300that the right of medical self-determination is not vitiated by the fact that serious risks
00:23:29.780or consequences, including death, may flow from a patient's decision. It is the same principle
00:23:39.960that is at work in cases dealing with the right to refuse consent to medical treatment or in demand
00:23:50.080that treatment be withdrawn or discontinued it is very clear case law from the supreme court in
00:23:55.920the ontario court of appeal in a case called reed versus fleming and this case from carter
00:24:01.800that you have an absolutely protected section 7 chartered light right to life liberty and security
00:24:09.120of the person to refuse any and all medical treatment or procedure that includes vaccines
00:24:14.840masking distancing closures you name it that's a constitutional right so if you take that as a
00:24:23.060premise and that that's to do with your physical well-being the supreme court has equally said
00:24:30.180that section seven protects your psychological well-being as well and we get that from the
00:24:36.440morgan toller case the o'connor case where a rape victim was under subpoena to testify about her own
00:24:43.720trauma at the behest of the criminally accused. And the Supreme Court said, well, no, even as a
00:24:50.560witness, she has Section 7 Charter Rights and the Shauli case, a health care case. Now, why
00:24:58.700psychological integrity being protected is important is because, you know, a lot of the
00:25:06.780a lot of people will say, well, they're not strapping you down and injecting you by force.
00:25:12.580No, but the psychological coercion of either vaccinate or you lose your job or you vaccinate or you can't fly, on and on and on, is also protected by Section 7 of the Charter.
00:25:26.800Now, the other case that's important in this whole debate that speaks to judicial notice is a case called Regina v. Fine, that's F-I-N-D, which again I point out to these lower courts all the time, and when they put out their decision, they don't even address it.
00:25:51.920And what Regina v. Fine says is you cannot take judicial notice of scientific fact.
00:26:05.920And at paragraphs 48 and 49 of that decision, the court states at 48, in this case, the appellant relies heavily on proof by judicial notice.
00:26:21.920And it goes on, and then in paragraph 49, it tells the appellate why it can't rely on judicial notice.
00:26:30.420The Supreme Court says the scientific and statistical nature of much of the information relied upon by the appellate further complicates this case.
00:26:43.020This is why it must be proved through an expert whose qualifications are accepted by the court and who is available for cross-examination.
00:27:06.460This case has been relied upon and cited for a very clear statement that you cannot take judicial notice of scientific fact.
00:27:20.800It's too nuanced, it has too many variables, and so on.
00:27:26.300Yet, all these lower courts don't have a problem with ignoring this Supreme Court of Canada jurisprudence.
00:27:33.160And this is very distressing to me as a constitutional lawyer, because it's a serious erosion of the rule of law. One aspect of the rule of law, a crucial aspect of the rule of law, is the idea of stare decisis, that similar cases are similarly ruled upon, and the idea of an appellate hierarchy.
00:28:00.220Part of stare decisis says, thou shalt obey the Supreme Court.
00:28:06.240The reason we have an appellate structure, if it's lost on anyone, and it seems to be lost now on the judiciary itself,
00:28:15.600the reason we have an appellate structure is that we recognize that the lower courts sometimes or often get it wrong.
00:28:25.320Otherwise, why will we have a right to appeal if the lower courts were infallible, like the Vatican, you know?
00:28:34.540So, but they seem to ignore the Supreme Court of Canada.
00:28:40.500Now, excuse me, there's only been one case so far that's been decided by the Supreme Court of Canada on the COVID measures.
00:28:52.520And it came out February of this year, 2026. It's the Taylor versus Newfoundland and Labrador case. It dealt with the travel ban in Newfoundland, temporary travel ban. And the travel ban was imposed very early in the pandemic, as the government cited.
00:29:14.500Now, interesting to note what the Supreme Court decided vis-a-vis these other three landing bases of the lower and appellate courts of the provinces.
00:29:30.680Number one, the Supreme Court of Canada didn't decide that the travel ban did not violate the charter.
00:29:37.640It found that it viciously violated both Section 6.1 and 6.2 of the charter mobility rights
00:29:45.000and reminded the government that mobility rights are also tied to your Section 7 charter rights to liberty, life, and security of the person.
00:29:53.840Once it decided that it violated Sections 1 and 2, the Supreme Court went on to analyze, under Section 1, whether or not the ban was demonstrably justified in a free and democratic society, and whether the ban was saved by Section 1.
00:30:17.500Ultimately, the Supreme Court decided that the ban was saved by Section 1.
00:30:22.620But what's really critical is to see how they got there.
00:30:27.280Throughout the decision, the Supreme Court didn't take judicial notice of anything.
00:30:34.940It parsed, it analyzed the expert scientific evidence that had been filed in the case
00:30:42.800And the context of that evidence in the fact that the ban was imposed at the very early stages of the declared pandemic, and that there was no scientific certainty yet, one way or the other, and therefore they proceeded with caution.
00:31:09.980And so in that context, the Supreme Court said it was justified. They also cited that the other side didn't provide any scientific evidence on certain points.
00:31:22.280So my only point is that the Supreme Court of Canada went nowhere near judicial notice. They engaged in an analysis of the evidence before it, the scientific expert evidence.
00:31:37.660And they keep coming back to this point.
00:31:43.020And so what you have is the Supreme Court of Canada's decision on the COVID measures,
00:31:48.560the only one that is completely at odds with the orbiting conclusions of the lower courts
00:31:56.220of taking judicial notice as the scientific facts,
00:32:00.500of saying there's no charter violations by the COVID measures.
00:32:07.660of saying that the court cannot look at scientific evidence
00:32:11.520because it's not a laboratory or other such nonsense
00:33:01.940It's near, in my view, in my humble view,
00:33:05.540We're at a point where the rule of law is almost collapsed in Canada.
00:33:11.440And people will say, oh, you're exaggerating because it's only in the context of COVID.
00:33:16.400Well, no, it could collapse tomorrow on another political issue.
00:33:19.260What I see is a judiciary that's not applying the law, is not listening to the arguments on the contrary, but is almost following a Salem witch hunt of a frenzy, an emotional frenzy.
00:33:35.540You're either pro-vax or you're an anti-vaxxer.
00:34:00.160And it's so and anything that touches COVID and the other area of the law that touches COVID similarly gets eroded and flushed down the drainpipe.
00:34:12.220Like if you're engaged in a family law dispute where one parent wants their child vaccinated and the other doesn't, the family law principles go out the window because the judge, if they're pro-vaccination, is going to order the kid vaccinated.
00:34:29.160and if they're not they're going to apply the law but get overturned by the court of appeal
00:34:33.500because they take judicial notice of the fact that vaccines are all vaccines are safe and effective
00:34:39.920and so and so this is essentially what happened last week in our case where the government lawyers
00:34:50.020made their submissions we recessed for an hour and a half for lunch came back there was more
00:34:56.400submissions. I made mine. They came back for their reply. And right after 15 minutes, and after
00:35:03.620their brief reply, the judge within seconds said, I'm ready to give the decision. And what came out
00:35:11.720was a rant of venom that had nothing to do with the case. And Tanya will get into what he said
00:35:21.240as part of his decision and did not address any of my arguments at all no it was such a travesty
00:35:29.320of the the procedures of the court rocco that i know that we had a good group of people there
00:35:34.820attending and when the defendants council got up to spoke first it was uh the council representing
00:35:42.020the province bonnie henry eb and whoever else was named and then it was the council for the
00:35:48.720federal government for justin trudeau theresa tam and first of all no offense to them but they were
00:35:55.660probably straight out of law school they didn't feel it was necessary to send well-seasoned
00:36:00.960lawyers like yourself to even make an argument or debate with you or or do what the purpose of the
00:36:06.380courts is there for and so then after we had the hour and a half break and and the final lawyer
00:36:12.520came on to speak briefly you came on and all of us just sat there and we were thinking oh that's it
00:36:18.440were winning this motion to strike, because you were brilliant. You've got nearly 40 years
00:36:23.180of law behind you, your top constitutional lawyer, and there was literally no comparison
00:36:28.620listening to you and these other young lawyers speaking. They had the vitriol that they had
00:36:36.220nothing but to criticize the amended notice of civil claim. They wanted to use the former Judge
00:36:42.980ross's uh language as as well i think judge witherhill did that and so when it came to you
00:36:50.060and we just sat there and went bam you came with case law you came with everything apart from what
00:36:57.140it looked like my distress came from the fact that he did not address our arguments at all
00:37:04.520a hundred percent and there's no way no way that lengthy decision of his could have been written
00:37:11.940on the spot in his head it had to be pre-prepared either before he came in that morning
00:37:18.300or he might have prepared it during lunch but if he prepared it during lunch it was just as
00:37:26.200offensive because i hadn't yet gotten up to make my submissions until after lunch so there was no
00:37:32.160very little time there was no time between me making my submissions and him coming up with
00:37:38.100this decision that he arranged this organized uh uh decision and maybe you can tell people
00:37:48.300you can quote from the decision the kinds of things he was saying had nothing to do with the
00:37:53.420case yeah i'll do that right now and i will be making this this letter of complaint public um
00:37:59.440But as, you know, Rocco and I are saying, there wasn't even a breath before he came back.
00:38:05.300He had his notes there and he started reading them.
00:38:07.740And there was vitriol and there was definitely discrimination in those words.
00:38:13.060And so I'm going to just go straight to those.
00:38:15.200And so in his reasons, Justice Witherhill described the amended claim as a hodgepodge of verbosity and said that inflammatory and conspiratorial language had been removed from an earlier version.
00:38:26.260He went on to describe the pleading as an incoherent, unintelligible, unintelligent diatribe.
00:38:34.280Then he went on, and I found this most troubling, was when he stated that the claim sought to take the court into conspiratorial and demon-haunted shadow of Christian nationalism's opposition to and defiance of the COVID-19 measures introduced by the federal and B.C. government in 2020.
00:38:51.920Let that sink in. I'm going to repeat it. Conspiratorial and demon-haunted shadow of Christian nationalism. Now, Canadian Anti-Hate Network has done smear campaigns on Action for Canada, calling us Christian nationalists, because society, as they are trying to destroy us and bring communism in or whatever, Christian nationalism, in order to destroy our Christian foundation, is the direction they're going.
00:39:14.300And so if the judge had knowledge of Action for Canada being called Christian nationalists, but he doesn't have knowledge of what's going on with Fauci down in the United States and the trials or the Allison inquiry inquiry recently, where people are giving their firsthand testimony.
00:39:34.020and so these these individuals between the lawyers and the judge are making a mockery
00:39:39.620of the court as far as i'm concerned um i think there was one more uh oh yeah this is
00:39:45.020rocco's one of rocco's favorites i'll get to it um he referred to the decision in which a claim
00:39:51.420was described as grandstanding political advocacy with um and that he said the sentiment applied
00:39:56.900with equal force in this case and then went on to say that he had no hesitation in accepting the
00:40:02.600defendant's submissions in their entirety. He characterized Mr. Gladi's submissions for the
00:40:07.380plaintiffs as general, vague, and superficial protests. Now, if you were there, once we get
00:40:13.180the transcripts and makes those public, and this judge refused to provide us an online link so that
00:40:20.380the public could participate and listen in on this case, and I'm wondering if it's because of
00:40:26.520this diatribe that he had prepared. And then so finally, he goes, alarmingly, I say, the judge
00:40:34.220summarized the amended pleadings as well as our counsel submissions as trying to put lipstick on
00:40:39.520a pig. So there is no doubt in my mind that the judge's decision was predetermined. I think this
00:40:49.140was extremely unprofessional in the letter just to finalize I do quote a number I went to because
00:40:59.460the Canadian Judicial Council has ethical principles for judges by which they're they're
00:41:04.680supposed to follow and if not they can be removed from the bench and I mean this guy he's in
00:41:09.420violation of nearly all of them and it was vitriol it was with venom that that he brought this
00:41:16.000statement forward so Rocco how would you respond to what you witnessed that day
00:41:20.660I was I was uh distressingly uh embarrassed and uh uh you know uh at hearing that I mean
00:41:33.380at one point he said this kind of claim has no place in a courtroom I'd say the venom in his
00:41:40.640reasons after having not addressed one of my arguments has no place in a courtroom and so
00:41:48.180that's i i i was not privy when i heard that comment about uh christian nationalist demon
00:42:00.000laced or whatever he said i i saying where's this coming from this is nowhere in the pleadings
00:42:06.500nowhere in the government submissions he's got this where off the internet he's reading this
00:42:12.660somewhere off the internet and he's putting into his decision out of i just out of the blue and as
00:42:19.680you say if he's going to go looking at the internet he should be looking at the fact that
00:42:24.180the entire uh covet agenda is under a microscope south of the border and fauci practically took
00:42:31.740the fifth amendment on his own name yeah and it's not only in america it's overseas everybody is
00:42:38.360talking about this and he's not supposed to deal with extraneous evidence that's not before him
00:42:44.980that's the other distressing thing about the judgment is that he is not applying the law
00:42:50.740on a motion to strike this is not submissions after a trial or reasons on a summary judgment
00:42:59.160motion where evidence has been tendered and tested and cross-examined like in the taylor
00:43:05.040case evidence was before the court this is at the the pleading stage and he's bringing extraneous
00:43:12.860insulting religiously inflammatory remarks that come out of nowhere except his own head
00:43:21.520and wherever he got them yeah i know that's what's distressing to me as a lawyer everyone
00:43:27.940Everyone that was sitting there was shocked.
00:43:31.140But my overarching distress is not just this particular judge, but all the judges who are disposing of these COVID cases.0.91
00:43:41.700What's happening to our system, our judicial process, and what's happened to our system, our administration of justice,
00:43:48.480to the point that people, level-headed people, intelligent people like Ted Kuntz and his
00:43:55.000organization felt compelled to withdraw from the process, not because they had any doubts about
00:44:01.860their charter rights or any doubts of my ability to present their case, but they lost confidence
00:44:08.460in the judicial system. Maybe Ted could speak to that. The Vaccine Choice Canada made that statement
00:44:17.300public as to why they were pulling out of the courts. Yeah, Tanya, as you know, we had a very
00:44:24.020similar case to what you brought forward with Rocco, except ours was in Ontario. And I worked
00:44:32.120with Rocco on our statement of claim and reviewed it word by word. And I thought Rocco had provided
00:44:38.820a compelling declaration of this global tyranny that we're facing. And what I saw was different
00:44:47.100from what Rocco was doing and what we wanted Rocco to do and all others is that we wanted to
00:44:52.660talk about this was bigger than Bonnie Henry this was bigger than Dina Henshaw this was bigger than
00:44:58.200you know Teresa Tam this was a global agenda to take away both our individual and our national
00:45:05.660sovereignty but as we worked through the process with Rocco we got to a place of saying our courts
00:45:12.280are so corrupt. We were loathe to continue that process because what Rocco advised us is that
00:45:20.920there are different rules for if you lose a case and you have to pay court cause. I mean, Rocco,
00:45:26.800I think you estimated we could have been assessed in the neighborhood of $200,000 because of how
00:45:33.280Ontario makes those decisions. And one is we weren't in a position to take that risk, but two
00:45:42.000is I was afraid that we were going to add to bad case law. And so I was thrilled when you persisted
00:45:50.300in British Columbia. The rules are a little different in British Columbia. You also had
00:45:54.200more evidence than we had when we initially filed. And the evidence was so compelling of the harm of
00:46:02.080our government mandates and the violations of fundamental rights and freedoms. You know, I spoke
00:46:09.200with Rocco after the court of the case last week and I said Rocco this must be incredibly disturbing
00:46:15.060for a man who's dedicated his life to the rule of law in Canada to our charter of rights and
00:46:21.000freedoms and to witness such pitiful uh disrespect uh not only of the charter but of every Canadian
00:46:29.120in this country um it's it's you want to weep um because of this yeah and you know when we're
00:46:38.380When I think about Rocco and the depth of the travesty here is that it isn't like the opposition has only come from the other side, who are behind this scandalous, murderous objective in getting the vax out and taking control over everything we say and do.
00:46:58.180It is the fact that people within, even other lawyers, would criticize the work that Rocco was doing.
00:47:04.740And, you know, I just say from the inside, Rocco and I are telling you that when we say he is a top constitutional lawyer, there's a reason for that. And Rocco, I know that you were telling me about the, was it the Bar Association at the 150 year anniversary, they had highlighted the 12 top cases that had had an impact in Canada.
00:47:28.260And I believe three of your cases, I'm talking in 150 years, 12 top cases, three of your cases were on that list.
00:47:37.880What they did, the editor-in-chief of the CBA magazine, The National, surveyed retired Supreme Court of Canada judges to ask them what they thought the most important, impactful cases in the court's 150-year history were, and they named 12 cases.
00:47:58.480Of those 12 cases, I was central to three of them.
00:48:02.460And I want our listeners to really let that sink in.
00:48:06.340so if you something i was considering these last days as i've like i say no but it's this this is
00:48:13.620where i get the stress i mean it's not that i'm i'm i'm trying to sell my resume i'm not applying
00:48:20.320for a job here but if i if if a lawyer can have that kind of track track record and then all of
00:48:29.160a sudden all it takes is the as i said the covid environment to say you're a witch you're a warlock
00:48:36.500and that what all of a sudden i i i overnight convert into uh an incompetent or i'm verbose0.84
00:48:45.320or i you know my pleadings are the worst pleadings on the face of the earth well no there's a you
00:48:51.580know courts you remember when we put in the first claim it was too long it was prolix okay so
00:48:58.880So rather than arguing about it, we said, OK, well, we'll trim it down.
00:50:16.000And none of these cases honestly do that, you know, on COVID cases.
00:50:21.540There seems to be something about COVID that's created a cult.
00:50:25.540Well, it's you ran circles around them, Rocco. And I'm not just saying that, you know, because I'm I'm not defending Rocco. I'm an advocate here. I'm a supporter of Rocco because I've seen the work and the sacrifice and what he's done for us. And it really was a travesty of justice. There was no justice that took place on Thursday. I think what's obviously.
00:50:50.420It's against the plaintiffs and other Canadians who rely on their judicial system to have integrity.
00:50:58.480Well, and this is what I was just going to get to, Rocco, is I'm going to talk about Valerie-Anne because she was there in the court with us.
00:51:05.900And, you know, years ago in 2020, when you and I agreed, yes, you're going to take this case on, Ted will know this, you spend a lot of hours talking to different plaintiffs, hearing their stories.
00:51:15.480You guys have just now are hearing them on the Allison inquiries. We were hearing those in person in 2020. And in 2021, when this deadly vaccine and causing great injury came out. And so we put a lot of time and effort and investment into this emotionally. You know, we're compassionate towards these people, and we want justice for them.
00:51:35.340so valerie ann shows up and valerie ann is the plaintiff that was on was on sky train
00:51:42.880and the military mr quok for the uh transit police uh approaches her because she wasn't
00:51:50.640wearing a mask and she tells them that she has an exemption he refused to listen to her
00:51:55.300um she really was feisty and defended herself and she kept recording and now he's handcuffing her
00:52:01.240you know, to the railing, while this is going on, the TransLink speaker is instructing people to
00:52:08.560wear a mask unless you have an exception, while this is recording. So literally, they're saying,
00:52:14.960we didn't come forward with enough evidence, and what is our pleading all about? Oh, gee.
00:52:20.780And you've got a case like this with a gal sitting there in the court, undoubtedly, when the ruling1.00
00:52:25.960was was being read uh she left she couldn't even listen to the end and a couple of people broke
00:52:31.680down and and cried um you know because of the injustice of this and so there's real people
00:52:37.220involved in this you take the alice inquiry you put that into work that ted and rocco and i have
00:52:42.260done and that's what we're representing here and that's why i don't want to let this case go
00:52:46.560and if uh if that's the case i need people to let me know you guys email us you write in you
00:52:51.740start sending us money because um if we're going to move forward with this in an appeal it you know
00:52:57.740they've made the battle even greater now because you've got a i don't want to say a corrupt judge
00:53:02.340but you know everybody can come to their own conclusion on this who in their right mind
00:53:06.540would see what's going on either you're not reading the room if you have enough time to
00:53:10.460find out we're called a christian nationalist organization you have time to know what's going
00:53:14.100on with fochi you have time to know that bonnie henry's emails are are are live and public and
00:53:21.040that she knew back in January 2021, her colleagues and her staff were telling her vaccine injuries
00:53:26.480are taking place. And four months later, she's out there on the front lines proclaiming that
00:53:31.640vaccines are safe for pregnant women and for nursing babies. And yeah, the injuries just went
00:53:38.480from there and there. And hey, you're 12 years old, you can go get your vaccine now yourself,
00:53:42.600you don't need your parents permission. This is what came out of vaccine out of Bonnie Henry's
00:53:47.800mouth and then just in closing when i had john leak on the show we were talking about even
00:53:52.640statements that dr mccullough has said about this being murder at this point um when you continue
00:53:58.560on in something when you know serious injury including death is happening but anyways that's
00:54:03.480my little tirade for right now but of the injustice and the level of this so um ted do you have yeah
00:54:11.820My fear is that because the Supreme Court has issued its ruling in Taylor and provided a framework on how to approach these cases, that they'll feel they don't have to hear another one.
00:54:26.760And while that happens, the lower courts and appellate courts spin in their own world of ignoring the law.
00:54:33.960But that's where we break through. At least we're doing our part to take it to the greatest extent and exposing the depth of the corruption. And maybe by some miracle one day, if things are reversed, these judges themselves will be held accountable.
00:54:48.700I don't know where all of this is going, but I see that things are being undone around the world. I see that populist leaders are getting in in countries like it seemed like a miracle for people that were bound by tyranny are now being released and having leaders who are who are embracing the freedoms and I don't know morality. I don't know what to say.
00:55:13.880I think that's on a political level. My eye is strictly on the judicial forum.
00:55:21.660And, you know, as I said, five years ago, it was clear that the case law was on the side of maintaining medical informed consent and freedom.
00:57:50.640It doesn't necessarily have to be corruption.
00:57:53.380It's just the resistance of the courts to review the status quo.
00:58:01.640COVID is different because they're turning upside down the status quo as it stood before COVID.
00:58:09.000So, for instance, in the Baker case, where we established, amongst other things, that you have a right to reasons, that came out of an immigration case in federal court.
00:58:18.600And in immigration cases, in federal court, you need to first get permission to bring an issue.
00:58:25.120I tried 27 times to get permission on the issue of the right to reasons, and they slammed me down every time.
00:58:32.580Then finally, we got permission in one case, and we went up and we won at the Supreme Court.
00:58:37.340So, yeah, a lot of cases where you're trying to establish rights that have not been specifically recognized, it could take a decade or two.
00:58:47.34010, 15 years, no problem. You have to keep knocking at the door. Here, you've got the reverse phenomenon. We have established charter rights to medical freedom and informed consent and all of that, but they're buried in the COVID measure context.
00:59:07.600That, to me, is worse. I don't mind knocking on the door for something new. But what gets me distressed as a constitutional lawyer is them slamming the door on something that's already been established.
00:59:26.400And it's not the Supreme Court slamming the door. It's the lower courts.
00:59:31.220Yeah, and there's got to be a workaround. Ted, go ahead, please.
00:59:34.440Well, I was just going to say, and they won't even let Rockwell make the arguments. I mean, what this whole case was about is trying to stop you from going and presenting your case in court.
00:59:44.920And the fact that you wouldn't even allow virtual viewing of this, of your case last week, tells me they don't want people to see what's going on here. They don't want to bring any attention to it. They don't want the arguments that you have to make on the record. They don't want it to be available to the public.
01:00:03.300Like I've said over and over again, Rocco, I believe that you're the only lawyer in Canada that they're afraid of.
01:00:39.680This is shutting down the rule of law in Canada.
01:00:43.160And, you know, I've mentioned that the National Citizens' Inquiry is going to conduct its 2027 hearings on do we have a rule of law in Canada?
01:00:51.040And I've suggested to Rocco we might need him to testify for the whole day.
01:01:00.340yeah so you you can tell the viewers that the if they're interested in reading my book it's

01:01:26.260that ted said he says i i had so much respect for rocco before reading this book and now i have so
01:01:32.640much more respect to see what rocco has done in battling through the canadian courts in the cases
01:01:38.960that he has chosen to take on um where so many cases you know they just didn't want to hear them
01:01:45.420and and we've known that they're trying everything the motion to strike is always the first knee-jerk
01:01:50.340reaction when you file a notice of civil claim for them in an effort to one delay the case and
01:01:56.000second to stop it. Oh, as I think about delay the case, the one lawyer, I believe it was the one
01:02:00.800for the federal government for Trudeau, she makes the most, it was the silliest comment to make and
01:02:06.120how much better it would have been if all of this was dealt with while we were actively involved
01:02:11.180in COVID. And I'm sitting there like, yeah, wouldn't that have been nice? We were trying
01:02:16.100for years. And if everybody will remember, this motion to strike should have been heard last
01:02:21.560October. So we filed the new notice of civil claim in December 2024. And they refused to
01:02:30.280provide us a date with the courts. And so finally, Rocco kept pressing in, we get it October 20th,
01:02:35.460then there's a strike, a BC strike, and the lawyers are on strike. And so they say we need
01:02:41.360to postpone it. And so we kept on them every single month. And they wouldn't give us a date.
01:02:47.540And so finally, all of a sudden, I think it was June, they say, yeah, you have a date, September 26. And so for anybody criticizing us is like, oh, you didn't work fast enough, and you weren't in the courts. I'm like, oh, my goodness, they don't want us in the courts, because of the evidence that we have to prove that what they did was criminal. And well, we're going for unconstitutional, but it takes a no brainer to realize the criminal aspect of this as well.
01:03:15.040And so anyways, we've got big decisions to make.
01:03:18.740Rocco, throughout your book as well, I love that you shared some of your family life.
01:03:23.120Your daughter as well performed and danced.
01:03:27.100Please remind me, she danced for, I've got a page right here.
01:08:15.240You know, Tanya, on that point, you know, when I was growing up,
01:08:18.740I was 12 of 13 children my mother had,
01:08:22.340and my parents were born in 1918 and 1919.
01:08:26.500And when I was growing up, my mother would say,
01:08:28.160I don't know what you kids are complaining about.

01:08:33.580and I was thinking I think to myself as a kid this is woman nuts of course we're not missing0.98
01:08:38.920any limbs she says you're all healthy and boy then when I became a parent and saw the potential for0.95
01:08:45.740injury permanent injury and disability I think back to my mother it was a marvel that she
01:08:51.580raised to adulthood 13 children without any missing limbs and yeah what have you you know
01:08:58.480Yeah. So like I say, it's a travesty. One thing I want to do before we break up, and it doesn't have to be the end of conversation, but I respect your time, is I want people to know that regardless of which way Action for Canada decides to go on this case, whether we appeal just for the fact of appealing and letting them know and sending a shot like we're not happy with this, we're going to expose you further to the corruption because this case should be heard.
01:09:21.700These plaintiffs have genuine complaints against what was happening. They have genuine injury, and they deserve their day in court. And so right away, when we filed in August of 2021, one of the defendants was at that time was BC Ferries. And by September, BC Ferries was like Nazi like, as far as people wearing their masks.
01:09:47.660And you've got to remember, if you take Highway 1 and all of a sudden it ends at a waterway at the Pacific Ocean and you need to get to your home on the island and the ferry is the only means of doing that, talk about being forced, talk about losing bodily autonomy.
01:10:02.800They were going to come out with VAX mandates and the ferries were willing to do that.
01:10:08.040Well, by mid-September and near the end of September, they lifted that mandate.
01:10:12.760They were no longer going to insist even that their employees got vaccinated.
01:10:19.040I believe that's thank goodness to the Action for Canada notice of civil claim that was filed.
01:10:24.660Also, Jennifer Whiteside was the education minister who was also named as a defendant.
01:10:29.640And she chose as the B.C. education minister not to make a mandate that all school staff and teachers needed to get vaccinated.
01:10:37.100I believe that was because she was named as a defendant, and very possibly that was too much for her to bear to carry that responsibility.
01:10:48.020She didn't sign up for that originally when she got elected, right?0.70
01:10:51.200And what happened with that is they instead, the government, Bonnie Henry, whoever was involved in that, Jennifer Whiteside,0.98
01:10:58.800she said that the school boards needed to make the decision to whether or not their school staff and teachers should be vaccinated.
01:11:06.440So Action for Canada put out a notice of liability immediately.
01:11:09.980We served it to all the superintendents,
01:11:11.840and then we served it to every single school board trustee in this province.
01:11:15.920We had a great team, and I'm so grateful for all of them.
01:11:18.960And then we sent it registered mail so that none of them could say they never received it
01:11:23.580to say, you don't have the authority, you don't have the medical experience to mandate this.
01:11:27.940Are you willing to hold yourself, be held liable, possibly for a vaccine injury?
01:11:33.440And so as each school board started to vote, they all started to vote no. And we continued that battle going nose to nose with Bonnie Henry for three or four months. And then finally, in the new year, they ended up lifting the order.
01:11:47.520And then I know there's another win as well that I can't think of right now.
01:11:53.620But the other one, Ted, that you and I were speaking about yesterday, and Rocco, you and I have spoken about this, is that vaccine, so-called vaccine hesitancy, has really skyrocketed from, was it, either of you, I'll say 10% now, vaccine hesitancy is at 30% or even higher.
01:15:17.280Not that I'm mine being, you know, I was born in Europe.
01:15:21.200But when he said that they need to increase
01:15:24.640they're very deep crucial ties i don't know if anybody noticed a list of the things he mentioned
01:15:31.800he said energy ai defense vaccines now why would one medical procedure of all them you know he
01:15:43.780could have said heart and stroke research you know or cancer no he only mentioned one medical
01:15:51.080procedure and that's vaccines why because it's three trillion dollars a year on just the covid
01:15:57.320vaccine floating around you know they're monsters when it comes to the money that's involved yeah
01:16:03.920you know well we've said you know we've said if we won the and when i had john leek on from the
01:16:09.980u.s we were saying that if they admit that these were causing injury you got to think then okay
01:16:14.620what are you going to what's the payout going to be for people that were injured and then it would
01:16:19.540bankrupt the US. But as you're saying, it's a trillion dollar industry. Who's getting that
01:16:24.660money? Who should be responsible for paying for those injuries? And of course, we know that they're
01:16:29.900immune from it, but that's got to be reversed. This is when you're talking about actual criminal
01:16:34.040behavior such as murder. I think it's time that we reassess this setup. And that goes for Canada
01:16:42.660as well. And I said to you earlier today, Rocco, that even with everybody with vaccine injured
01:16:47.880children rather than have these son of a guns get off scot-free and rather than receive payment0.89
01:16:55.400to see them go to jail for life or actually be hung would you know probably be satisfying enough
01:17:02.040to people that there was some accountability like this like during the Nuremberg trials that was
01:17:07.340that was the result in the end for mass murder in the Nuremberg trials and I just kind of figure
01:17:12.240that we shouldn't accept anything less right now. Well that's where all the prohibitions and the
01:17:17.800the helsinki accord came from was from the nazi experimentation uh in world war ii people forget
01:17:27.320that that's why we have all those rules you know it's it's it's insane the idea of forcing people
01:17:35.080to take a medical treatment they don't want is insane it's fascistic yeah it's it's i don't know
01:17:42.220about a hanging but you know i was just referring to the nuremberg trials it just happens to be
01:17:49.040what took place i was just referring i was just using a little historical example that's it
01:17:54.280um okay so uh ted as we as we wrap up here ted is there anything that we neglected to cover today
01:18:02.600that you would want to ask rocco or mention or make a statement i just think this is the most
01:18:09.180important issue probably in canadian history if we lose this battle it means that we are there is no
01:18:16.060uh individual rights and freedoms there is no bodily sovereignty there is no right of parents
01:18:21.300to make medical decisions for their children that we might as well just turn our lives over to the
01:18:26.840state and and allow the state to decide and and to me that's intolerable and so i i'm sorry ted
01:18:34.660And I think I'd like to parse what you just said to say we may lose the battle in court, but I think in terms of public awareness and the population, I don't think that battle is going to be lost.
01:18:50.260And so long as people hold to their rights and act accordingly, that will that will come out in the wash eventually, like everything else historically, you know.

01:19:04.660I would encourage people to read Rocco's book. I think they'll come away with a much deeper understanding about the contribution that this man has made to our rights and freedoms in this country.
