01:10:12.000 Quote, after the king signed the Magna Carta and granted power back to the people, he woke up and said, I made a mistake, I need to get it back, Warren said.

01:10:21.000 And quote, the government's been trying to do that ever since.

01:10:24.000 He had a bright line rule that said no searches without an arrest warrant.

01:10:27.000 Now we have one that says sort of, maybe.

01:10:31.000 And again, some good news, the Arkansas Supreme Court, again that's a state court, came out and said you can't do Knock and talk.

01:10:39.000 They have in Dallas and all over the place.

01:10:41.000 It's right here in Texas where they admit whole neighborhoods, cops go out and, we'd like to talk to you about your guns, ma'am. 1.00

01:10:47.000 Mind if we come in and look at them?

01:10:48.000 I mean, that's one step to the gun confiscation.

01:10:52.000 And of course, this case had to do with guns and them going in and getting them.

01:10:55.000 In Louisiana.

01:10:58.000 Very, very scary.

01:10:59.000 Very, very serious.

01:11:00.000 And we're told that the newscast in Louisiana are showing SWAT teams going into houses and how great all this is.

01:11:06.000 Going to our guest, Joseph Scott, with Lee and Walsh Associates there in Louisiana.

01:11:17.000 I've been seeing this trend across the board.

01:11:19.000 The Patriot Act was written for the general public in Section 802.

01:11:23.000 Now they're saying we're going to go after your Fourth Amendment period.

01:11:27.000 Number one, what do you think of this ruling?

01:11:29.000 Number two, what's been the response of people in Louisiana?

01:11:34.000 I've read the ruling pretty closely.

01:11:36.000 I've worked cases using the earlier cases to try and support motions to suppress.

01:11:45.000 There are a couple of big problems here.

01:11:49.000 The first is that the Fifth Circuit has decided that the so-called knock and talk is an absolutely legitimate exercise of state authority, where they can just walk up to a house uninvited with no particular suspicion and say uh... do you have any drugs in here do you have any guns in here or uh... do you mind if we come in and talk to you about it or is your brother home that sort of thing and the the previous understanding was that if you let the police into your house and they said do you mind if we have a look around for drugs or guns and you say okay then

01:12:29.000 Everybody has agreed to it.

01:12:31.000 It's a consent search.

01:12:33.000 Now, if you said, well, you can look for my brother, but he's not here, they can go through the house and look in those places where your brother might be.

01:12:48.000 The problem with this new ruling is that, used to be, The police were allowed to make a protective sweep of the house to make sure no one was lying in an ambush.

01:13:00.000 And in order to make that... And that's if they already had probable cause for some type of crime or they were searching for somebody.

01:13:06.000 This is just random.

01:13:07.000 We're just going to go in houses if we feel like it.

01:13:11.000 This still says... Here's the two different scenarios.

01:13:17.000 The first is where you say, sure, you can come in and look for a person.

01:13:22.000 Well, then they're going to look in those places where people could be found.

01:13:25.000 But if you just say, uh, you can come in and talk to me for a minute, this ruling potentially says, well, the minute you allow them into your house, they're allowed to make a protective sweep to make sure that there's nobody laying in ambush.

01:13:39.000 Now, sir, I've read the 60 plus pages.

01:13:41.000 I scanned over it last night.

01:13:43.000 Right.

01:13:44.000 And I printed it off yesterday morning.

01:13:45.000 We only had a cursory look at it.

01:13:46.000 I spent about 30 minutes reading over it last night.

01:13:50.000 And the way this is written, and the loopholes that are in it, and that's what the media and the other lawyers have said here, you know, the headline here is, Court Opens Door to Surgeons Without Warrants, and it just says they're just going to go in houses and businesses if they feel like it, and that they're not going to be liable.

01:14:07.000 I don't know that it's that broad.

01:14:09.000 It is a dangerous expansion because it used to be that if you said, okay, I'll talk to you in my living room, Then the police could not go past your living room without your consent.

01:14:23.000 But under this ruling, I guarantee that the police will say, well, you know, when we came into the house, we decided that we felt nervous.

01:14:34.000 That's the thing, if they feel like they're in danger, then they're going to go ahead and do this.

01:14:38.000 It's the same thing, it says for their convenience, with the Supreme Court ruling, we've got to answer their questions, whatever happened to the Fifth Amendment?

01:14:48.000 That sounds, now I have not read that Supreme Court ruling yet, it does sound a lot like an expansion of the old Terry Stop and Frisk, but the Terry Stop and Frisk required that they had some reason to stop you and frisk you.

01:15:03.000 Not all that long ago the Supreme Court said that every citizen Upon meeting a police officer has the citizen's right to turn and walk away and not answer questions.

01:15:14.000 Well I have the Dallas Morning News where a year ago it said whole neighborhoods, I mean middle class areas, squads of police would go when the man was gone and literally bully their way in and quote find illegal guns.

01:15:28.000 That is a consistent problem.

01:15:32.000 Oh really?

01:15:32.000 Tell us about that.

01:15:34.000 The knock and talks such as they are and There seems to be a lot of consent searches going on.

01:15:43.000 But most people don't know that.

01:15:45.000 I mean, look, I've had the police pull me over four or five times over the last ten years, and they'll say, about half the time when you get pulled over, because I tend to speed, and it's true, and they pull me over and they go, mind if I search?

01:15:55.000 And I go, well, no you can't.

01:15:57.000 Well, what have you got to hide?

01:15:58.000 Well, Fourth Amendment. 0.71

01:15:59.000 You know, buddy, go get a dog if you want to, you know, there's nothing in here.

01:16:03.000 So my point is that most people get bullied by them, and I've had them try to intimidate me into letting them into the car.

01:16:10.000 So it's really intimidation into it.

01:16:14.000 I agree, and I would say, remember that cars go under a different set of rules.

01:16:22.000 Houses are guaranteed a special place in the Constitution.

01:16:28.000 Cars are not.

01:16:29.000 But in terms of the houses, uh... you know they they do have a tendency to

01:16:36.000 bullion control their way in and the problem that most people have is that

01:16:40.000 when something gets found in their house even if it's not there's a bong school boyfriend a neighbor 0.98

01:16:46.000 somebody dropped it in the couch when they're sitting there

01:16:50.000 uh...

01:16:51.000 when you go to court and you say gee i'd like to suppress this evidence because

01:16:55.000 there was not a valid consent to search You know, in order to have a valid consent to search, you have to know what rights you're giving up.

01:17:02.000 But you say that it's not a consistent problem with what you've seen as a criminal defense lawyer.

01:17:08.000 So in Louisiana, they're doing these knock and talks and bullying in.

01:17:11.000 Describe that for us.

01:17:13.000 Well, I would say that the case that I'm thinking about, somebody The police showed up, claiming that they had gotten a complaint from a neighbor about suspicious activity at the house.

01:17:31.000 Lots of cars, short visits, looks like a dope dealer.

01:17:35.000 Should have gotten a warrant!

01:17:37.000 Should have gotten a warrant, but they said that we didn't have probable cause, and we knew we didn't have probable cause, so we went to do a knock and talk.

01:17:48.000 This is where the knock-and-talk comes into play.

01:17:51.000 They know they can't get a warrant, but they also know... And I would state that the cases you're going to talk about are going to be cases where they actually found something, because that's when you get in contact with them as a defense lawyer.

01:18:00.000 Because I talk to people all the time in Austin, 95% of the time nothing's in there.

01:18:05.000 They just let the search take place, and that's not America.

01:18:09.000 And, you know, people who think that there's nothing in their house, and then find out, oh, gee, well, I guess that a person who was staying here for a short period of time left something behind.

01:18:23.000 And I also arrest people for prescription pills that aren't in bottles even if they have the prescription.

01:18:29.000 There are a lot of ways to get in trouble and a lot of these... Go back to that case.

01:18:34.000 I'm sorry I keep interrupting.

01:18:35.000 Go back there.

01:18:35.000 That's okay.

01:18:37.000 They showed up at 930 on a Thursday night as, you know, this young lady was getting ready to go out.

01:18:47.000 And kept on telling her.

01:18:51.000 We just want to take a quick look around.

01:18:53.000 And her answer was, I really don't want you to do this.

01:18:57.000 Please go away.

01:18:57.000 I don't want my house torn up.

01:18:59.000 And they spent a good 15 minutes just standing in her kitchen telling her over and over again, we just need to take a quick look around and we'll leave you alone.

01:19:09.000 Well, something was found.

01:19:12.000 I argued that her will It wasn't a free exercise of will, and of course the judge ruled against me.

01:19:20.000 And that case is still pending, so I'm not going to say a whole lot more about it.

01:19:24.000 But this is not atypical.

01:19:28.000 This is something that happens because the police know that if they had to go get a warrant, they would need to come up with real testimony and real facts before they could get in the house.

01:19:41.000 The difference is, under the new U.S.

01:19:43.000 v. Gould decision, when they show up... One more segment.

01:26:04.000 What the 5th Circuit was trying to do is they're going along with the 6th Circuit and the D.C.

01:26:10.000 Circuit and saying that you can have a protective check of a house without an arrest.

01:26:17.000 And the protective sweep of the house has been the law for 10 years, but that's after you arrest somebody in their house.

01:26:27.000 Other lawyers see it as kind of an expansion of something that we were already opposed to, because these consent searches, we think, are not always consented to.

01:26:38.000 Well, yeah, they'll sit there dozens of times, going, let me search your car, let me search your car.
