00:02:21.000 Also, Congressman Ron Paul showed up number 5th in the Iowa straw poll, always a key poll, just as important in the early days as New Hampshire is gauging.

00:02:35.000 And MSNBC, Fox News, all of them spun this that, oh, well, they didn't even compete.

00:02:50.000 And that's with, as was predicted, Diebold Optical Scan System fails in Iowa, GOP Straw Poll.

00:02:57.000 Now, I even heard Fox News last night on the station I'm broadcasting out of, that I broadcast from, it's a syndicated show, but then I am, the mothership as I call it, the Kelby J590, was listening last night, driving back into work, And I heard Fox News admit, well, they said there would be problems with the Bible machines, and there were.

00:15:53.000 Congress, because it has a greater separation of powers, and has more members that represent the people, is really superior to the Executive, and then Judicial is beneath that.

00:16:01.000 Executive, though, really since the Civil War, has become preeminent, but that's illegitimate.

00:16:07.000 I mean, they can argue, well, we've got new powers because Lincoln got them, but that's like saying, uh, courts once said that black people weren't human beings and we're two-thirds human.

00:16:15.000 I reject that argument, and I have the organic law of a free human being to say no to the tyrant.

00:16:21.000 Now, there have been hundreds of civilizations, and there have been thousands of empires, because there have been many hundreds of empires per region of the world over the years.

00:16:29.000 Sometimes there would be an empire of a few months.

00:16:30.000 Think Mexico, it had many incarnations of kings and emperors and Austrian kings running it, just in its history.

00:16:38.000 But there have been, I could say, hundreds, if not thousands, of different empires and elites throughout History Review added them all up together.

00:16:50.000 That usually happens when some political leader like Julius Caesar comes in and takes his troops into Rome, takes his troops into Italy, crosses the Rubicon in the north, brings the men out of Austria, brings the men out of Germania, brings the men out of Gaul, and just says, hey man, I got the troops, shut up, I'm taking over, it's for your security.

01:09:32.000 In fact, you've written up something entitled, Terrorism, Law Cases, Materials, and Comments.

01:09:37.000 And so really, you're there churning it out, this whole new, brave new world, because things changed on 9-11, so things are changing in the military and domestically.

01:09:49.000 Well, it's the fourth edition of a textbook, and it's pretty unique in the country.

01:10:14.000 We've got the military commission, the Bush administration expanding the Bush doctrine.

01:10:19.000 I mean, you can't hardly keep up with it.

01:10:24.000 How our country has literally got a thousand wounds, bleeding to death, in a ditch right now.

01:10:37.000 We're using the laws of war in a way that was never envisioned when the laws of war were last codified significantly.

01:10:44.000 Well, domestically, they're certainly codifying it.

01:10:46.000 Let me just ask you a couple questions, because we were debating this morning about this Presidential Decision Directive 51.

01:10:53.000 And in there, it's new powers.

01:10:56.000 That's what Bush says.

01:10:56.000 I grant myself, kind of like Napoleon putting the crown of emperor on his own head, he says I grant myself the new powers that the executive is going to oversee the continued government operations of the three branches.

01:11:09.000 And law scholars have been a bunch of mainstream news articles written about it say it is a huge power grab.

01:11:14.000 Members of Congress have said that.

01:11:16.000 And regardless of what your spin or my spin is on what it does, today on CBS television in San Antonio, I brought up the fact, or it may have been the reporter that countered, was it you were the reporter that said, why does members of Congress or the Homeland Security Board, why should they be able to see the continuity why does members of Congress or the Homeland Security Board, why should

01:11:35.000 Because first Congressman DeFazio and then others on the committee, on Homeland Security Board, wanted to be able to see the secret plan, which they could always see before because they're co-equal, right?

01:11:49.000 However, you know, you have executive privilege, and all presidents, Democrats and Republicans, have exercised that when they come into conflict with Congress.

01:12:01.000 Lincoln actually had members of Congress arrested and did destroy much of the Tenth Amendment.

01:12:48.000 Well, again, you know, we have a variety of these conflicts, and ultimately he can do it until the Supreme Court says, no, you can't.

01:13:00.000 I mean, with the War Powers Act passed with Nixon's veto.
