00:11:31.000 They grab the wrong group of people, put the guy in handcuffs, take a gun out, shoot him right in the back. 0.96

00:11:45.000 And they go and grab everybody's cameras on tape.

00:11:49.000 Somebody's in a train hiding, and the train pulls out and gets it all on tape.

00:11:54.000 They filed a report saying he tried to take the gun from the officers.

00:11:56.000 They had to take him out.

00:11:59.000 And none of the cops got in trouble for lying.

00:12:02.000 The cop that did the killing ended up getting two years in jail and served less than a year.

00:12:08.000 For just absolutely cold-bloodedly executing that man.

00:12:12.000 And of course, in the case of the homeless man that they beat to death, the son of a police officer, then got caught lying about that, they've now been found not guilty because the police said he might have had a pre-existing heart condition.

00:12:25.000 Having his head and throat and legs and kidneys and everything stomped and beat in by eight police officers had nothing to do with it.

00:12:35.000 There are so many cases of that.

00:12:37.000 There are just so many, so many examples of this.

00:12:48.000 It truly and absolutely boggles the mind on every front that these type of things are unfolding.

00:12:58.000 And it shows the militarization of police that is getting more and more serious by the minute.

00:13:09.000 Now, here is the Washington Post speaking of this, and then I'm going to shift gears into other news, and then get back into this in the next hour with the lawyer who's going to be in studio with us.

00:14:20.000 Now obviously the drug culture is where criminals already gravitate to.

00:14:36.000 My issue here is that they have now arrested a whole bunch of people in a raid on the actor Hoffman's death from heroin, a particularly strong type known as the Ace of Spades.

00:14:56.000 And Hoffman reportedly was found dead, never even got the needle out of his arm.

00:15:01.000 Philip Seymour Hoffman, a very talented actor who struggled with substance abuse.

00:15:07.000 And so they've now raided the house, the apartment building, they believe, where they were selling the heroin.

00:15:13.000 Our Marines and Army, on record, grow and protect the majority of the poppy fields in

00:15:25.000 Afghanistan, and if you look at the BBC's own numbers, in the 11 years, it's now 12 years, but the first 11 years of the liberation from the Taliban, yeah right, totally staged war, they only arrested a few Taliban groups that had actually been pro-America and exposed Al Qaeda and tried to turn bin Laden over in the year before and were aware of what was happening.

00:16:29.000 It was 10-fold within five years, and 11-fold, then 12-fold, for a short period it went to 13-fold, and then now it's back down to 11-fold, the numbers we saw in 2012.

01:09:06.000 This senior at Cedar Creek High School asked us not to show his face.

01:09:10.000 And while the boy was resisting, that's when they, I guess, one put out a baton and the other one put out a taser and tased him.

01:09:17.000 According to the Bastrop County Sheriff's Office, a fight broke out in the hallway between two girls Wednesday afternoon, and two sheriff's deputies, Randy McMillan and Timothy Stalcup, acting as school resource officers, tried to break it up.

01:09:30.000 Investigators say 17-year-old Noe Nino de Rivera tried to interfere, and McMillan tasered the teen.

01:09:36.000 At first, I didn't really get it, because I thought people were playing.

01:09:39.000 But then, when I really heard it happened, I was like, wow, that's crazy.

01:09:44.000 No, Nino de Rivera's family tells us he fell, hit his head, and has undergone at least one surgery.

01:09:54.000 All right, and we're going to show you some exclusive photos here that the family has given us through their lawyer, attorney Adam Lowy, who is in studio with us, and he takes on a lot of these high-profile police shooting cases where they shoot people on the back, you name it, here in Central Texas.

01:17:23.000 Well, watching the video, I was about to say, the police officer's in a stance of almost enjoyment when he does it, spreading his legs out, you know, getting in a stance, so it doesn't look like it was an accident, and they've said it wasn't an accident, that he was basically being combative.

01:17:41.000 His hands were at his side, they push him over, and they just taser him for fun.

01:21:28.000 Less police are being killed statistically, but more people are dying at the hands of police because they're all training with instinctive shooting to just start shooting at the drop of a hat.

01:22:15.000 And I think that it's very important that we talk about these issues and try to make this thing right.

01:22:24.000 Break down more of the case, because I followed on the news, I followed you on the news, and them not wanting to release the video at first and saying that he basically resisted them or attacked them, and then of course now the video shows that they've lied.

01:22:39.000 Well, I think that that's a good point.

01:22:40.000 I think that what's interesting to me is right before the video came out, there was the head of a state police union named Kevin Lawrence that went on the local channel here and said, oh, I heard that Noe had some headaches the week before.

01:22:55.000 They started floating this out that he had a brain injury apparently a week before, as if a 17-year-old was wandering around with a brain bleed.

01:23:04.000 And just coincidentally, coincidentally, the day he got tased and was rushed to the hospital, that has nothing to do with the tasing.

01:23:11.000 It's a prior injury.

01:23:12.000 That is obviously completely false.

01:23:15.000 Watch the narrative in these cases.

01:23:17.000 When they start talking about these phantom prior injuries, or that he reached for a gun that he didn't have in other cases I've handled, that's when you know the police know they've done wrong.

01:23:27.000 Well, in the case of Kelly Thomas, I'm sure you followed that, just screaming for daddy, begging, and then being tortured to death.

01:23:34.000 It took him, what, four days to die in the hospital.

01:23:38.000 And when you look at the photograph, the mugshot of these police officers, I mean, talk about just absolute thug central types.

01:23:47.000 And then you look at the fact that the father of this guy was a retired police officer.

01:23:51.000 So they got away with murdering my son.

01:23:53.000 And the mother of police, you know, is also saying basically the same thing.

01:23:58.000 They claimed, oh, he might have had a heart condition before.

01:24:02.000 Because his heart was so bruised from the beating and all the rest of it, and his ribcage being rammed in on it.

01:24:07.000 And then they used that, and the jury cowardly, probably out of fear, of the gangsters, then found them not guilty.

01:24:15.000 I mean, that is such a disgraceful jury, and the culture of endorsing whatever the police do is absolutely going to empower our downfall.

01:24:25.000 And it's always ironic to me that our friends on the right wing are so anti-government.

01:24:31.000 They don't like the government, they're anti-government, limited government.

01:24:34.000 But yet, when the government kills someone, the reflexive reaction is, oh, they did the right thing there.

01:24:41.000 We need to support whatever the police do.

01:24:44.000 That's a paradox there.

01:24:45.000 If you're skeptical of the government, you should be even more skeptical when they kill someone, or in this case, when they seriously hurt someone.

01:24:52.000 And I think it's a real blind spot that most Americans have that must be addressed.

01:24:58.000 But what it comes down to, policing is a tough job.

01:25:01.000 And they get burnout, they get PTSD, and it's the culture of, hey, we're going to make mistakes, so stop trying to put us in jail for it, or we can't do this job.

01:25:12.000 And everybody gives the police more leeway, but it's now been abused, and they've now been federalized and globalized and militarized, and they're doing SWAT raids over You know, unreturned library books in Williamson County, literally.

01:25:33.000 What do you think, as a guy that gets a lot of these high-profile cases all over Texas, where do you think this is going?

01:25:39.000 Because clearly the public's turning against the police.

01:25:47.000 How do we reverse this militarization and bring them back to being more honorable peace officers?

01:26:06.000 When you're looking at Austin, This district attorney here, Rosemary Lindbergh, has never indicted a police officer for killing someone.

01:26:13.000 And I'm not even saying convict them, I'm saying indict them.

01:26:16.000 Let a jury decide if this was a criminal act.

01:26:19.000 When you look at these police shootings, and even in this case we'll see what happens, but district attorneys will not indict these police officers.

01:26:26.000 And what my point always is, let's put it in front of a criminal jury and let the jury decide.

01:26:31.000 And if they issue not guilty, they issue not guilty.

01:26:33.000 But it's the behind closed doors decisions that are very scary.

01:26:38.000 Well, there was a CIA section chief, I think his name was Carnival, it was about four years ago, I forget his name, it'll pop in my head in a minute, in Houston, and they pull him over, they get him out of the car, he's got his hands on his side, and the cops execute him.

01:36:27.000 So they have these connections in the police department, and in order to have connections, in order to have Chief Acevedo call you back, you cannot expose them for what they're doing.

01:36:43.000 He does actually come down here, even though I give him pretty hard interviews.

01:37:16.000 And I went back and looked at the video, our guys aren't cussing, it's the anti-gun people.

01:37:27.000 No, he's very slick, but I think the broader issue is, and people need to realize, when they hear stories from the media, the media is getting the stories from the police.

01:37:37.000 So when something like this... Well, exactly, I'll say instinctively mainstream media just grovels regardless.

01:37:42.000 And just takes whatever they say and then even dolls it up.

01:37:52.000 I mean, I sat through, I handled a trial last year where the way the media covered it, even when the evidence was clear in a courtroom, They just kept repeating the party line.

01:38:02.000 The issue in this case was whether a police officer got hit by a car and they opened fire to this car.

01:38:07.000 The evidence was clear that the officer was never hit by a car.

01:38:12.000 Clear as can be.

01:38:13.000 Even the defense lawyer admitted that.

01:38:14.000 But yet, the media, from day one, just repeated what the police said.

01:38:20.000 And it's just this reflexive, oh, if the police say it, it must be true.

01:41:15.000 And what immunity means is they can't be sued.

01:41:49.000 Now their grandson is a sheriff's deputy.

01:41:55.000 This is on record and getting caught the second time on tape.

01:42:02.000 No, it's 100 acres out of thousands.

01:42:04.000 Pointing guns at people saying, get off the property, it's mine.

01:42:08.000 Total racketeering, total official oppression, civil rights violation.

01:42:12.000 He's been told by a court before not to come on the property and lost in another court case, even though it's been 60 years or something.

01:42:20.000 Been adjudicated multiple times and then did it again and was caught on tape.

01:42:25.000 And the local sheriff's department will not do anything about their own deputy.

01:42:29.000 These people are literally God.

01:42:31.000 That's how a lot of them think.

01:42:33.000 I mean, a lot of them are very good people.

01:42:34.000 Well, they better hope I'm never there when they're pointing guns at people because I've had enough.

01:42:37.000 I think that these fears that people have, people like yourself that talk about it, I think they're very real.

01:42:42.000 I think that it's not just the exact opposite.

01:42:43.000 I will not take my children on our own property now to hunt because if this guy comes around and literally points guns at people and says leave, comes over fences, drove a police car.

01:42:55.000 Down gullies that I will not take a four-wheel drive in.

01:43:04.000 And the problem is, is that even though they can represent the minority of police officers, they are not held to be accountable for what they do.

01:43:20.000 Well, there's another entrance where he'd have to go like two miles away to get where he wanted to go, so he drove it through and took it down into a creek bottom.

01:43:29.000 I'm not exaggerating, but you can barely take a jeep through, and got the police car, the sheriff's car, this is in Freestone County, all the way through and up the gully, and got in no trouble, and then pulled guns on hunters.

01:43:46.000 With his family member who's not a cop.

01:43:48.000 With a gun.

01:43:49.000 I get calls from people that tell me similar stories and when you realize you don't have a case, not saying you don't, but when people I realize advise there's no case because of immunity.

01:43:58.000 Yeah, we've got a case.

01:43:59.000 What's interesting is that what you tell them or the people, the citizens will say, I'm gonna call Internal Affairs.

01:44:05.000 I mean, Internal Affairs is not going to do a single thing.

01:44:07.000 You have a problem with the Austin Police Department, you call Internal Affairs, it's going to go into a file, you'll never hear from them again.

01:44:14.000 I mean, that's how bad it's become that even when Internal Affairs does something, we've seen this in some cases I've handled in Austin.

01:44:21.000 The Chief doesn't follow what Internal Affairs wants.

01:44:23.000 The Chief's going to make his own decision.

01:44:24.000 And so I think that the problem is one of arrogance.

01:44:27.000 It's one of they feel they can do whatever they want.

01:44:30.000 They will not be held accountable.

01:44:32.000 And what happens is things like this.

01:44:34.000 Innocent young children get very seriously hurt for the rest of their life.

01:44:38.000 Well, I'm not a star lawyer like you, but what I've seen in the cases that win, you just show they were acting outside their capacity, that they've lied.

01:44:45.000 You go after the school for not rendering the aid for two hours.

01:44:48.000 I mean, you know what to do.

01:44:49.000 Fire torpedoes on every front.

01:44:51.000 You're going to sink them.

01:44:53.000 Well, it's going to be a tough case, but we're very confident we can prevail.

01:44:56.000 Are you going to later probably go after the fact they didn't render care?

01:44:59.000 Absolutely.

01:44:59.000 We've sued the school district as well.

01:45:01.000 Yeah, I knew that, but I mean, I mean, you got them right there.

01:45:03.000 Well, it's going to be, like I said, I am certain there were a lot of emails that were sent in the 24 hours after this, a lot of communication.

01:45:11.000 The cover-up is proof of the crime.

01:45:12.000 We will get all of that evidence and we will see what's there.

01:45:16.000 Now let me say this about the Austin Police.

01:45:19.000 I've been all over the country and overall they seem nice and professional, most of them I run into, compared to some of the other cities I've been in.

01:45:25.000 Uh, where the police are downright scary.

01:45:27.000 I totally agree with that.

01:45:28.000 I mean the Houston police are downright scary.

01:45:30.000 And I've handled cases in Chicago and that's just a different level of policing.

01:45:34.000 Oh yeah, I mean the cops there one time, I was filming on the street and they said don't do that.

01:45:38.000 And normally I'd argue and I could tell that these cops were not like wimps, like acting like they were going to hurt me.

01:45:43.000 They were looking at me like these detectives and they were going to really hurt me.

01:45:46.000 Right.

01:45:46.000 And they were looking at me and they go, listen, don't do it again.

01:45:49.000 And they didn't say anything else.

01:45:51.000 They were like, I could tell that they were criminals.

01:45:54.000 Right.

01:45:54.000 And I was like, wow.

01:45:56.000 And that's, I do feel that about the Austin police.

01:45:58.000 I think overall, compared to other departments, they're good.

01:46:00.000 But when things happen that are bad, they have an inability to admit they did wrong.

01:46:06.000 And they've got Mr. Slick.

01:46:08.000 I mean, he is unbelievable.

01:46:10.000 And that's what the city council wants.

01:46:12.000 They put it all on his hands to go talk to the media and schmooze the media and sell the public on a certain narrative.

01:46:32.000 Things are going to happen in the halls of a high school, such as a fight between two girls.

01:46:36.000 I mean, I got in fights with my coaches and stuff where they, you know, and then they were, they were so macho, you know, they wouldn't like press charges on me because they grabbed me and then I elbowed them so they punched me in the head and then I punched them.

01:46:48.000 My dad didn't go after them because I had a big black eye from the coach.

01:46:52.000 I mean, it's just disgusting. 0.98
