01:15:25.000 The Snowden revelations, all of it, confirm what you've been saying.

01:15:28.000 Well, yes, and we should express our appreciation of Edward Snowden.

01:15:34.000 So, three cheers for Edward Snowden.

01:15:41.000 We have to say that very often.

01:15:43.000 I say that in my speeches and ask people to cheer him, because the people who don't want us to know how they're mistreating us, Carl Snowden, a criminal, and they say he should be assassinated.

01:15:59.000 We have to not just think that he's a hero, but say he's a hero and invite others to say so, to counteract the movement to demonize him.

01:16:11.000 In any case, thanks to his heroism, we now know of many ways that the government collects data about people in general.

01:16:24.000 And then misrepresents, you know, using twisted bureaucratic language to make it seem that that's not what they're doing.

01:16:34.000 But that is what, thanks to the careful analysis done by journalists, we know that that's what the government is doing.

01:16:43.000 And we just found out that Many countries in Europe have made deals saying we'll give you access to snoop on people through our systems as long as you promise not to use them to snoop on our citizens.

01:17:02.000 Of course, they can't tell that that promise is being kept, but it doesn't even matter because if each country says you can use our digital systems to snoop on everybody except the people in our country, Then they can stoop on anybody through the systems of other countries.

01:17:22.000 So, what does this imply?

01:17:24.000 It puts democracy in danger.

01:17:28.000 You see, the idea of democracy is that the people control what the state does.

01:17:33.000 And that enables the people to have the state do the things that they want it to do, and not do the things they don't want it to do.

01:17:42.000 But in order to control what the state does, we need to know what the state is doing.

01:17:47.000 And that's difficult when states act secretly.

01:17:50.000 And in order to find out what they're really doing, we need heroes like Snowden, whistleblowers.

01:17:55.000 And we've got to defend him because if they can bring him down, they'll be able to sell the rollout of total surveillance publicly that was already there.

01:18:05.000 Exactly.

01:18:06.000 They also, they want to bring him down so as to scare anyone else from trying to tell us what the state is doing.

01:18:16.000 He was exposing criminal activity.

01:18:18.000 He is a hero.

01:18:19.000 And the criminals are saying they want to murder a U.S.

01:18:22.000 This is outrageous.

01:18:25.000 Yeah, although, of course, under the First Amendment you can say that you think certain kinds of people ought to be killed.

01:18:38.000 But, you know, freedom of speech is pretty broad, and the point... But when it's government officials doing it, I think it crosses the line.

01:18:52.000 But for me, the crucial point is we want to defend Snowden and get it clearly established that we regard him as a hero.

01:19:06.000 In any case, the point is, the government doesn't want other people to tell us what the government's doing, and therefore it tries to demonize whistleblowers, prosecute them, but in order to do that it has to figure out who they are.

01:19:26.000 How much general surveillance can permit the existence of democracy?

01:19:33.000 And the answer is If there's enough general surveillance to find the whistleblowers then we can't have democracy.

01:19:42.000 And we know the NSA on record is aimed at the media now and aimed at whistleblowers to suppress speech and people exposing crime.

01:25:47.000 They can see which officials or staff people talked with a journalist, and that means they can find out who blew the whistle, and they can punish those people, and that's what makes them scared to- people scared to do it.

01:26:01.000 So we must re- Redesign digital systems so that they don't collect enough data to let the government find the whistleblowers.

01:26:11.000 And that's a massive technological change that we need to make.

01:26:15.000 Now, you've brought up the point that a lot of the surveillance is directly done by companies, and they do it mostly for their commercial reasons.

01:26:24.000 They want to predict what sorts of things people will buy and so on.

01:26:30.000 Transforming advertising from a mere annoyance to something dangerous when you add the tracking of people to it.

01:26:39.000 But the point is, the business surveillance of people is dangerous because the data they collect is available to the state.

01:26:49.000 So they're like, it's like each business is like another tentacle of the state surveillance apparatus.

01:26:57.000 And they trade the baseball cards and they all share in the data mining.

01:27:01.000 Yeah, so the point is...

01:27:04.000 We have to redesign all of these systems so that they don't track what people are doing except for those people who are the subject of a court order because there was some reason to suspect a particular person and that authorizes investigation of someone.

01:27:24.000 Well, we always protected whistleblowers until just recently.

01:27:27.000 We've seen an incredible persecution of legitimate whistleblowers.

01:27:30.000 Well, actually, we didn't always protect them.

01:27:33.000 For instance, Daniel Ellsberg, Nixon tried to prosecute him, but the prosecutors made a mistake and they had to drop the case.

01:27:40.000 Sure, but the press used to come to the aid more of whistleblowers.

01:27:43.000 Yes, that's true.

01:27:44.000 And in addition, Obama has attacked whistleblowers with an energy unlike any previous president, or maybe even all, I think I read it was all previous presidents.

01:27:59.000 And we also see many practices meant to invite people into being surveilled.

01:36:20.000 Um, you're talking about DRM, Digital Restrictions Management, which is found in some malicious hardware, like those monitors and Blu-ray and DVD players, and also in software.

01:36:34.000 And in fact, often it's implemented by the firmware inside the product.

01:36:39.000 Now, that is a malicious functionality, and it ought to be illegal.

01:36:43.000 But why is it in there?

01:36:45.000 It's in there because the software is non-free.

01:36:48.000 Because the users don't control it.

01:36:51.000 If the users controlled it, they would fix the software so it didn't maliciously restrict them.

01:36:57.000 So, if their goal is to attack you by imposing restrictions, They have to first attack you by making the software non-free.

01:37:08.000 Now, I don't think there's anything virtuous about paying for an authorized copy of a non-free program.

01:37:15.000 You see, what's bad about the non-free program is that it's non-free.

01:37:21.000 An unauthorized copy of a non-free program is a nasty thing because it's proprietary, because it's non-free.

01:37:30.000 It's almost as bad as an authorized copy.

01:37:33.000 And so I won't use either one.

01:37:36.000 I reject them on principle.

01:37:37.000 No, no, I totally agree.

01:37:38.000 My point is, we play in their system.

01:37:42.000 And then they still come after us.

01:37:44.000 Yes, they do.

01:37:45.000 But please don't repeat their propaganda terms like stolen.

01:37:56.000 What's wrong is trying to stop people from sharing, which is what they're doing.

01:38:00.000 Quantify your view on that and explain the difference between hacking, which they've demonized as a term, versus criminal breaking into computers.

01:38:08.000 Oh, well, these are two different questions, and I can explain them both, but not at the same time.

01:38:13.000 So, the point is, software should respect your freedoms, and there are four freedoms you should have.

01:38:20.000 Freedom 0 is the freedom to run the program as you wish for whatever purpose.

01:38:25.000 Freedom 1 is the freedom to study the program's source code and change it to make it function for you the way you wish.

01:38:32.000 Now those two freedoms are enough to give each user separately control over the program, but this separate control was not enough.

01:38:40.000 Because most people are not programmers and don't know how to exercise Freedom1.

01:38:45.000 They don't know how to study and understand source code or change it.

01:38:48.000 So we need more than just this separate control.

01:38:51.000 We also need the freedom to work together and exercise collective control.

01:38:55.000 Which means any group of people or companies or both, whatever, any group of users should be free to work together to adapt the program to do what they want it to do.

01:39:07.000 And then offer copies of that to others if they wish.

01:39:11.000 And that requires two more freedoms.

01:39:13.000 Freedom 2 is the freedom to redistribute exact copies of the program.

01:39:18.000 You know, copy it and distribute the copies to others.

01:39:21.000 And Freedom 3 is the freedom to copy your modified versions and distribute those to others.

01:39:27.000 Those two freedoms allow the members of any group to work together and change the program to do what they want.

01:40:37.000 In the 1970s, when I joined the hacker community at MIT, sometimes it meant figuring out a clever way to do something on a computer.

01:40:49.000 And sometimes it meant a prank.

01:40:53.000 And sometimes it meant doing something that was surprising and funny.

01:40:57.000 And sometimes the thing that was clever or surprising and funny might be in the area of breaking security on a computer.

01:41:07.000 Of course, at that time, it wasn't for robbing anything.

01:41:12.000 It was so that you could get access to the computer at night when it was sitting there going to waste, because nobody was using it.

01:41:20.000 And you had some school work or project you wanted to do, so you got around the security and you put the computer to use.

01:41:30.000 Of course, there's nothing to say My definition, which sort of summarizes all these things, is playful cleverness.

01:41:42.000 Hacking is playful cleverness.

01:41:44.000 And you're a hacker if you appreciate and enjoy playful cleverness.

01:41:49.000 Perhaps your own, perhaps other people's, perhaps both.

01:41:52.000 All I've ever experienced from people that call themselves hackers is helping us on so many fronts and then we've only had a few malicious things and again I wouldn't even call those people hackers.

01:42:06.000 They were connected to government groups trying to censor us.

01:42:10.000 So what do you call someone who's malicious against good people online?

01:42:15.000 When I speak of breaking computer security I call it cracking.

01:42:19.000 Now, that can be done for good or for evil.

01:42:23.000 There are lots of people who break computer security in order to steal from people.

01:42:29.000 Like, there's this ransomware.

01:42:31.000 It's a kind of malware that gets into people's computers and encrypts everything and says, we'll tell you how to decrypt it if you send us some money.

01:42:41.000 Now, that's very bad.

01:42:44.000 The people doing it, I would say, mostly are not thinking of playful cleverness.

01:42:50.000 They just want some money.

01:42:52.000 So I don't know if they're hackers, but they are crackers.

01:42:57.000 So there are various different aspects of things.

01:43:01.000 I wouldn't say that being a hacker intrinsically means what you're doing is ethical.

01:43:06.000 Any more than it intrinsically means what you're doing is unethical.

01:43:10.000 But what about this, Doctor?

01:43:11.000 It's an orthogonal question.

01:43:12.000 But lots of kinds of hacking are perfectly fine and don't hurt anybody.

01:43:18.000 Lady Gaga's clothing is hacking.

01:43:22.000 Now expanding on this, Dr. Stallman, I want to throw this out at you.

01:43:25.000 We now learn Stuxnet was put out by the US and Israel.

01:43:28.000 They didn't use Stuxnet to try to pass cybersecurity, their false flag.

01:43:31.000 We now learn the FBI and government infects millions and millions of computers to quote, look for one bad guy.

01:43:39.000 And so the old conspiracy theory that it was really government corporations and virus companies putting out the viruses is now being proven.

01:43:46.000 Yeah.

01:43:48.000 And that's a malicious conspiracy indeed.

01:43:54.000 I don't know, maybe a little of it is hacking.

01:43:57.000 A lot of it is cracking.

01:44:11.000 Occasionally I've found clever ways to Turn off security in the systems that I administered.

01:44:31.000 Back to the subject, because I don't think you had time to get to it.

01:44:34.000 The phenomenon of what Aaron Swartz was doing and what happened to him.

01:44:37.000 What is your overall thought on that tragedy?

01:44:41.000 Well, from what I've read about what happened, It looks like some people at MIT, when they saw that there was a laptop that was downloading lots of papers from JSTOR, I believe it was, they didn't know what was going on, so they thoughtlessly called the authorities.

01:45:06.000 And the authorities were looking for somebody to kick.

01:45:13.000 To set an example of how horrible it was to violate terms of service.

01:45:19.000 And they had this law, the CFAA, that they could stretch in that way.

01:45:26.000 And so the prosecutors picked on Swartz.

01:45:33.000 And the people at MIT, they didn't realize that that was going to happen.

01:45:37.000 They didn't even know that it was Aaron Swartz at the time when they brought the authorities into it.

01:45:44.000 And the lesson that people at MIT are learning is, You better not bring the authorities into it until you know what's going on and you can decide whether it warrants that response.

01:45:59.000 You call the FBI in or the government in, you better have a really good reason because they will destroy people.

01:45:59.000 That's right.

01:46:05.000 Look, he was getting married.

01:46:07.000 He said he was going to beat it in court.

01:46:09.000 I know they said they drove him to suicide, but I think they realized they were making him a cause celeb.

01:46:13.000 And I think they killed him physically.

01:46:15.000 I doubt it.

01:46:16.000 And the reason is just that, according to people close to him, he had a tendency to depression.

01:46:24.000 And so he'd thought about suicide before.

01:46:27.000 It's plausible that he would have killed himself, even if the day before he wasn't feeling so down.

01:46:35.000 I don't know.

01:46:36.000 I didn't know.

01:46:37.000 His father said the FBI, the Justice Department, killed my son.

01:46:41.000 But he said drove him to kill himself.

01:46:44.000 So regardless, they killed him.

01:46:45.000 Yeah, I mean they were responsible for his death, but that's not to say that they directly killed him.

01:46:53.000 Sure, I wonder what it feels like for a top internet... And it wasn't so much the FBI as far as I know, it was the prosecutors.

01:47:01.000 Sure, sure, the prosecutors would be technically right.

01:47:03.000 The FBI ran the case, but then the prosecutors administered it.

01:47:10.000 It's just a total tragedy that clearly this was an attempt at a chilling effect, but I don't think it worked.

01:47:16.000 And you know, I think the answer is what you've said.

01:47:19.000 Get outside the system, build new systems, try to promote the free software movement that you started, but also For whistleblowers, it's the same thing.

01:47:29.000 Stop complying.

01:47:30.000 More whistleblowers.

01:47:32.000 Overwhelm the system.

01:47:33.000 Don't comply with anything.

01:47:34.000 And that will bring it down.

01:47:39.000 There are many systems that we use that don't belong to us.

01:47:44.000 For instance, we're talking by a telephone call.

01:47:48.000 The phone companies collect the information of who you talk with.

01:47:54.000 And they make that data available to the government.

01:47:58.000 We can't prevent that by developing our own parallel systems.

01:48:04.000 ISPs.

01:48:05.000 If you have an ISP account, the ISP records all the connections that you make and makes that data available to the government.

01:48:15.000 So, it's almost impossible for us to avoid the government knowing who we're talking to.

01:48:24.000 And that's the crucial data.

01:48:25.000 Remember, to find the whistleblower, the government needs to know who talked with the journalist.

01:48:31.000 Even if they don't have any records of discussions, just identifying who talked with a journalist is enough to find the whistleblower, and then they can, of course, get that person's computers, study everything, and so on.

01:48:46.000 The point is that we need to insist that these systems, which we don't own, Be redesigned so that they do not keep dossiers about Orland Sundry.

01:49:01.000 That requires legislation.

01:49:03.000 We have to organize politically to demand that phone companies and ISPs not keep these long-term dossiers about us.

01:49:14.000 Exactly, as a culture.

01:49:16.000 The government can get about the past of a person who was not a suspect.

01:49:21.000 And that's why they always wanted to deny all this was going on, because they didn't want to have the debate, because they know morally they can't win the debate.

01:49:27.000 So all we have to do is, like the organic food movement, vote with our dollars, vote with our actions, and we can reverse this surveillance state?

01:49:34.000 No, it's not enough to vote with our actions, because we don't have an alternative.

01:49:39.000 There's nothing comparable to organic food for talking by phone.

01:49:44.000 There's just no communications system available to us.

01:49:50.000 Oh, which we could use and meeting in person may not do it because of license plate trackers that have been set up by the, well, by the cops in lots of cities and also by repo men.

01:50:09.000 And the point is, we need legislation to restrict license plate recognizers, so that if your car is, if your license plate is valid, and there is no surveillance order out on you, on your car in particular, then the license plate recorder shouldn't see your car.

01:50:29.000 It shouldn't notice your car.

01:50:30.000 It should only notice the license plates that are not valid, or the people for... Exactly!

01:50:39.000 Which, by the way, as you know, over a million people in California that work for the government, they are omitted because they work for the government.

01:50:48.000 So, basically, that means the only people who... Well, actually, that's interesting, because if they work for the government, that means they won't be seen, which means that they can blow the whistle.
