03:09:29.000 So that being the point, look, the Supreme Court, it's gonna come down to, it's not clearly spelled out in the Constitution that this is strictly prohibited.

03:09:39.000 Now, what is gonna have to happen?

03:09:40.000 And I would hope it would be a 9-0 decision by the United States Supreme Court.

03:09:45.000 That an offense against the United States has to be something that has been deemed as having happened by way of a judicial process, meaning someone is convicted.

03:09:56.000 Because you haven't committed an offense, you may have committed acts which comprise an offense, but you have not committed an offense until you're convicted of that as a crime.

03:10:05.000 So this would be the one way they could tackle it and probably be the best way they could tackle it without having to mangle up or in any way limit the president's You know, authority to pardon, which I think is a great thing.

03:10:17.000 And I think it should be unreviewable and irreversible.

03:10:20.000 In fact, a client I'm working for right now trying to get justice for on the civil side, Abraham Bolden.

03:10:25.000 The one good thing that Joe Biden did in his entire life probably, or presidency at least, was to pardon Abraham Bolden, the first black secret service agent who was set up in one of the first lawfare cases ever.

03:10:45.000 And they went after him and convicted him in Chicago.

03:11:47.000 That's right, because there are certain elements to crime.

03:11:49.000 An offense is specific elements that be proven beyond a reasonable doubt in a court of law for that to become a, it doesn't say any acts against the United States.

03:12:00.000 And that's, again, a very specific legal term.

03:12:05.000 And a defense is something that has been committed.

03:12:07.000 The elements have been met.

03:12:08.000 And just the idea, though, of a blanket pardon, I mean, it is just, it's offensive.

03:12:13.000 The founders of this country would never have countenanced this, not a one.

03:12:18.000 I can't think of a single one, because that's exactly what the crown would do.

03:12:21.000 That's exactly what they faced with the British crown, where- They would give them basically letters of mark to operate however they wanted.

03:12:29.000 And he would send, King George would send his minions into the colonies and they would operate with impunity, robbing, raping, doing whatever they want to the colonists.

03:12:40.000 And it's one of the reasons we threw off the crown.
