02:25:20.000 He's got a valid asylum claim or he's protected under the TPS program.
02:25:25.000 He is not lawfully supposed to be here, but there is an order to immigration authorities that his removal is being deferred.
02:25:35.000 So he's supposed to be removed, but there's a legal hold on that.
02:25:40.000 Well, under the new Trump administration, he does in fact get deported.
02:25:46.000 He's supposed to be protected or shielded from deportation, even though he has no legal right to be here.
02:25:52.000 And not only is he removed from the United States, but he is rounded up with the criminals, and he is sent to El Salvador and put into a super prison for terrorists.
02:26:04.000 This is in spite of the fact that the guy is not a criminal, at least it's not confirmed that he is one, or a gang member, an affiliate of a gang, although there's rumors that he is.
02:26:15.000 In spite of this, he has been sent to El Salvador and imprisoned, The United States admits they made a mistake.
02:26:22.000 They said there was a clerical error which resulted in him being removed when he should have been protected.

02:26:51.000 And people are saying this is evidence of a cruel and inhumane immigration policy.

02:27:51.000 which means he was the subject of a deportation order But was allowed to stay in the United States because of the likelihood he might be harmed if he was returned to El Salvador Mr. Garcia was deported there and he is now being held in its sprawling It's called a mega prison.

02:28:17.000 Imagine one day you're here illegally in the United States.
02:28:20.000 The next day you wake up in a super prison for terrorists.

02:28:27.000 In the court filing, the Trump administration said there was nothing they could do to correct the error given that he was no longer in U.S.

02:28:42.000 Well, Garcia's case is separate from those of the Venezuelans.
02:28:45.000 Challenging the administration's use of the Alien Enemies Act, it raises some similar issues.
02:28:50.000 Lawyers for Venezuelans have persistently argued their clients have had no opportunity to challenge accusations they are gang members, and several have ended up in some Salvadoran prison without any way of protesting their plight or returning to the United States.
