02:39:24.000 Is anybody shocked that President Trump could not take away citizenship for tens of millions of people with an executive order, reinterpreting Supreme Court rulings, federal law, the U.S. Constitution?

02:39:42.000 It was a 6 3 slash 5 4 decision.
02:39:48.000 And I'll tell you why that is.
02:39:51.000 It was a 6 3 decision.
02:39:54.000 That the executive order removing birthright citizenship is struck down according to the Constitution.
02:40:02.000 But it was a 5 4 decision that the executive order struck down based on federal law.
02:40:08.000 So, in other words, six justices said the executive order goes against the Constitution.
02:40:14.000 Five out of four said it goes against federal law and could be changed by overturning federal law.

02:40:28.000 But it's another major defeat for the Trump administration from the Supreme Court.
02:40:33.000 And you look at this decision, and there is nobody to blame other than Republicans.

02:40:43.000 Three of the Supreme Court justices that currently sit on the bench were appointed by Trump in his first term.
02:40:51.000 And two of the justices that went against the executive order were appointed by Trump.

02:41:00.000 Simply had better judges that were appointed in Trump's first term, it is very possible that birthright citizenship would be over as of today, paving the way for tens of millions of people potentially to be deported.
02:41:19.000 We don't know if they would have been grandfathered in or how that would have been worked out from a practical point of view.
02:41:25.000 But simply put, birthright citizenship would have been overturned if Trump just had appointed three good judges.

02:56:47.000 But our big news for the night is all about the Supreme Court decision on birthright citizenship.
02:56:53.000 You might remember that in January 2025, the day that Trump was inaugurated, he signed an executive order overturning birthright citizenship.
02:57:04.000 And as you know, the way it works in this country is that anybody who is born on the soil of the United States of America.
02:57:11.000 Automatically becomes a citizen and they get all the rights enjoyed by anybody else that lives here.
02:57:18.000 Whether they're parents or citizens, no matter how many generations they've gone back, it doesn't even matter.
02:57:26.000 Literally, if you are born on the land, you have full voting rights, you are entitled to Social Security and all the other benefits conferred upon you by citizenship.
02:57:38.000 And this has given rise to a very toxic and bad incentive structure. 0.53
02:57:45.000 Particularly, birth tourism and illegal immigration. 0.76
02:57:49.000 If you are a foreign national, whether you're wealthy or whether you're poor, because of this perverse incentive structure that's been set up, it would behoove anybody, no matter what country you come from, again, whether rich or poor, to come here when you're pregnant so that your children will be born on the land and they'll enjoy all the benefits of U.S. citizenship. 0.69

02:59:18.000 They will have privileged access to American public schools, to the American health care system, and they'll be set up to live in America for the rest of their lives.

02:59:30.000 And this system comes to us by way of the 14th Amendment to the Constitution, which says that anybody born on the land is a citizen.
02:59:38.000 It is a constitutional issue.
02:59:41.000 But the history of this amendment is very important to understand.
02:59:45.000 It's not as though the states and the Congress and the representatives of this country got together and said, wouldn't it be a great idea if anybody that was born on the land could become a citizen?
02:59:57.000 The 14th Amendment comes by way of the Civil War.
03:00:01.000 It was part of a series of three amendments to the Constitution, which were ratified in the immediate aftermath of the Civil War, which were meant to address the particular circumstances of the freed slaves after the conclusion of the Civil War.
03:00:19.000 The 13th Amendment ended slavery.
03:00:21.000 The 14th Amendment, which is where birthright citizenship is enshrined, was ratified so that the people that were freed from slavery would be grandfathered in as citizens.
03:00:35.000 And it said all these people that were in legal limbo, people that were slaves, now are freed.
03:00:42.000 Question is, what are they legally to the government?
03:00:46.000 14th Amendment says, well, it doesn't matter if they were born as slaves and are now free.
03:00:52.000 Because as long as they were born on the land, they are now citizens.
03:00:57.000 And so this was a sloppy way, a sloppy way in the US Constitution to figure out what we're going to do, what is to be done about all these people.
03:01:08.000 It is part of a series of three amendments 13, 14, and 15.
03:01:14.000 What do we do with all the freed slaves after the Civil War?
03:01:17.000 And it said, well, as far as their legal status is concerned, we will consider that if they were born on the land, it doesn't matter if they were slaves at that time or free men.
03:01:26.000 They're now going to be citizens.
03:01:28.000 That was the point of that provision of the 14th Amendment.
03:01:33.000 And of course, since then, the situation has changed.
03:01:37.000 Since then, in the mid and late 19th century, you've had huge waves of immigration.
03:01:42.000 And then there's the Ellis Islanders, and then there's Hart Seller and the 1990 Immigration Act.
03:01:48.000 We've opened the floodgates to massive amounts of foreign nationals coming here for various reasons. 0.90
03:01:55.000 And this has incentivized people to come here illegally or for other reasons, and they're taking advantage of this provision.
03:02:02.000 So, when Trump was elected, it was one of his promises that he would overturn birthright citizenship.
03:02:08.000 But you have to understand that in order to do this, there's a few ways you could go about it.
03:02:13.000 Since it is enshrined in the Constitution and was interpreted by the Supreme Court in the late 19th century, there are one of three ways that we can go about getting rid of this.
03:02:25.000 You can pass a law in Congress which says people born on the land are no longer automatically citizens.
03:02:33.000 So there's a federal statute.
03:02:35.000 You can pass a law in Congress.
03:02:37.000 The obvious way to go about it is you can amend the Constitution.
03:02:41.000 You either have a convention of states or it's a supermajority in Congress.
03:02:46.000 There's two ways to ratify a new amendment in the Constitution.
03:02:49.000 You could address the language in the 14th Amendment and clarify it in a 29th or 28th or 29th Amendment.
03:02:57.000 That's another way.
03:02:59.000 And then the third way is you could catalyze a Supreme Court decision on that provision in the 14th Amendment.
03:03:07.000 You can either have a federal law or you could have, in this case, an executive order, force the Supreme Court to consider.
03:03:14.000 This issue, and then it would give the Supreme Court an opportunity to create a new interpretation of the 14th Amendment and maybe redefine it in a different way.
03:03:25.000 Those are the three ways you might go about it.
03:03:27.000 Obviously, amending the Constitution is the most rock solid, but also the most difficult.
03:03:33.000 You're never going to get a constitutional convention.
03:03:35.000 You're never going to get three fifths of the states to approve of something like that because the constituency just doesn't exist for that right now.
03:03:43.000 Federal law would be equally as tricky because you need to go.
03:03:47.000 To the Senate, and you would have to get a supermajority or 60 senators, three fifths of the Senate to vote on this.
03:03:54.000 And I don't even know if you'd get every Republican to vote for that, let alone seven Democrats on top of the Republican majority.
03:04:02.000 So that's probably out.
03:04:03.000 And even then, it might be challenged by the Supreme Court anyway.
03:04:07.000 And then the worst way that you could go about it is with an executive order.
03:04:12.000 And the reason that's the worst way is because when you consider the issue legally, you have the Constitution itself.
03:04:20.000 Which says, according to the 14th Amendment, if you're born on the land, you're a citizen.
03:04:26.000 So you have an executive order, and understand what an executive order really is.
03:04:31.000 It's really a memorandum.
03:04:33.000 All an executive order really is, it doesn't actually exist in the legal code.
03:04:38.000 What an executive order does is it directs the federal bureaucracy under the executive branch to carry out the existing federal statutes with new guidance.
03:04:52.000 So, what does this executive order specifically say?
03:04:55.000 It says stop giving citizenship to people that are born on the land, but their parents aren't citizens.
03:05:04.000 It's a guidance for the executive branch and how they're administering citizenship services.
03:05:11.000 It's really more like a memo.
03:05:13.000 People need to understand that's how the federal government works.
03:05:16.000 The Congress legislates.
03:05:18.000 And what is it to legislate?
03:05:20.000 Write the laws. 0.78

03:05:24.000 The executive branch executes the laws.
03:05:26.000 How do they execute the federal statutes?
03:05:29.000 With the departments and agencies in the federal bureaucracy.
03:05:33.000 And what the executive branch has is the discretion for how they're going to interpret and then execute the laws given to them by the legislature, according to the federal statute.
03:05:47.000 So, what is an executive order?
03:05:48.000 Trump is saying, well, we're going to take the existing federal statute and we're just going to sort of, we're going to, At our discretion, change how we're applying it. 0.99
03:05:57.000 So don't give citizenship to these people anymore.
03:06:00.000 That's really what it says.
03:06:02.000 So you've got a constitutional amendment, which is basically the expression of the sovereign people of the United States.
03:06:10.000 Constitution's the supreme law of the land.
03:06:14.000 It is from where the federal government derives all of its powers.
03:06:17.000 You've got an amendment versus this memo from the president to Homeland Security and Immigration Services.
03:06:26.000 Obviously, the constitutional amendment outweighs that.
03:06:29.000 But you also have a Supreme Court interpretation.
03:06:33.000 Of the 14th Amendment in the 1890s.
03:06:36.000 This was considered in the 1890s by the Supreme Court, and the Supreme Court said if you're born on the land, you're a citizen.
03:06:44.000 So you've got the Constitution itself, and you've got a Supreme Court ruling.
03:06:48.000 You also have at least two federal statutes that also say if you're born on the land, you're a citizen.
03:06:55.000 So you've got an executive order, which is again like a glorified memo going up against an amendment to the Constitution.
03:07:04.000 A Supreme Court decision and two federal statutes from Congress.
03:07:09.000 It was never going to stand a chance, and everybody knows that.
03:07:13.000 Now, that did not stop people last year from celebrating as though it was a done deal.
03:07:19.000 I remember because I've been doing this show for 10 years.
03:07:24.000 So I remember on January 20th or 21st, 2025, when Trump signed hundreds of executive orders on day one, one of them was overturning birthright citizenship.
03:07:37.000 And I remember that day very well.
03:07:39.000 I remember that entire week.
03:07:41.000 I remember all the Trump supporters were celebrating as though it had happened.
03:07:47.000 Trump signed the executive order, said, Birthright citizenship is over.
03:07:50.000 And everybody said, We won.
03:07:53.000 Birthright citizenship is over. 0.94
03:07:55.000 It's a done deal.
03:07:57.000 And I remember thinking at the time, obviously, this is going to be challenged by a federal court.
03:08:03.000 And it was.
03:08:04.000 It was challenged by, I think, 38 different states.
03:08:08.000 It was challenged by a significant number of states.
03:08:13.000 It was stopped with an injunction from a federal judge, and then obviously it worked its way up to the Supreme Court.
03:08:20.000 I said, What do you think is going to happen when the Supreme Court considers the issue?
03:08:25.000 Is the Supreme Court going to overturn the 14th Amendment and a decision from 1896 and two federal statutes because of a memo?
03:08:34.000 No, just on procedural grounds alone.
03:08:37.000 Forget about the merits of the argument.
03:08:39.000 Should we have it?
03:08:40.000 Should we not have it?
03:08:41.000 On procedural grounds alone, the Supreme Court will say, if you want to change this policy, amend the Constitution, pass a law through Congress.
03:08:52.000 An executive order isn't enough.
03:08:54.000 I said, that much is obvious.
03:08:56.000 And I said on my show, and the clip went a little bit viral today.
03:09:01.000 I said on my show on January 21st, 2025, I said, it's going to get challenged.
03:09:07.000 It's going to go to the Supreme Court.
03:09:09.000 I said, and then it's going to get struck down because of the composition of the court.
03:09:14.000 I said, do you really think that Chief Justice Roberts and Amy Coney Barrett are going to vote to overturn birthright citizenship?
03:09:22.000 Justice Roberts is a moderate.
03:09:25.000 He's barely even a conservative anymore.
03:09:27.000 And Amy Coney Barrett, she's got two adopted kids from Africa.
03:09:33.000 She is a woman.
03:09:35.000 She is a Catholic, which sadly increasingly means liberal.
03:09:40.000 And she's got two adopted kids from Africa. 1.00
03:09:45.000 You think this woman is going to overturn birthright citizenship? 1.00

03:09:51.000 And sure enough, that is exactly how the decision came down.
03:09:54.000 It was Justice Roberts and Amy Coney Barrett that said this is unconstitutional and it's against federal law.
03:10:04.000 Roberts and Barrett, and then Kavanaugh in a separate procedural decision, but it was those two plus Kavanaugh in two separate decisions that shut it down and said birthright citizenship is upheld.
03:10:17.000 There is no challenge to birthright citizenship, it stays.
03:10:23.000 And this is a story from the New York Times.
03:10:24.000 We'll work through it and talk a little bit about the specifics.
03:10:28.000 It says, quote, the Supreme Court on Tuesday struck down President Trump's executive order limiting birthright citizenship.
03:10:35.000 Chief Justice John Roberts, writing for the majority, explained that Mr. Trump's executive order violated the 14th Amendment, which says that children born in the United States to undocumented parents or to parents temporarily in the country, or rather, this is his decision, not the Constitution.
03:10:52.000 He wrote that children born in the U.S. to undocumented parents or to parents temporarily in the country are citizens at birth.
03:11:00.000 The Chief Justice was joined by the court's three liberal justices, along with two fellow conservatives, Amy Coney Barrett and Brett Kavanaugh.
03:11:08.000 Brett Kavanaugh wrote that he would strike down the executive order based on federal law, not the Constitution.
03:11:15.000 In a social media post after the ruling, the president called the Supreme Court's decision too bad for our country.
03:11:22.000 He said, Yeah, that's a shame.
03:11:25.000 Three of the court's conservatives, Justice Clarence Thomas, Justice Samuel Alito, and Neil Gorsuch, dissented.
03:11:31.000 In his 91 page dissent, joined by Justice Gorsuch, Thomas said that the 14th Amendment was intended to enshrine citizenship for formerly enslaved people and their descendants.
03:11:41.000 He wrote Blacks were entitled to citizenship because they were Americans.
03:11:46.000 They had no other homeland, owed no allegiance to any foreign power, and were subject to no other authority.
03:11:52.000 The same cannot be said for the children of foreign temporary visitors who were attached to their home country, lacked similar bonds to this country, and would not be called upon in time of war.
03:12:03.000 Justice Alito called the decision a serious mistake, writing that the court's view of the Constitution confers citizenship on virtually everyone who happens to be born in the country, including the children of birth tourists, people that he characterized as women who come here solely for the purpose of giving birth to a child and then promptly returning home.
03:12:23.000 So let's talk about the decision specifically.
03:12:27.000 It's a 6 3 and a 5 4 decision.
03:12:30.000 Six out of three justices said that the executive order is contrary to federal law.
