02:56:47.000But our big news for the night is all about the Supreme Court decision on birthright citizenship.
02:56:53.000You might remember that in January 2025, the day that Trump was inaugurated, he signed an executive order overturning birthright citizenship.
02:57:04.000And as you know, the way it works in this country is that anybody who is born on the soil of the United States of America.
02:57:11.000Automatically becomes a citizen and they get all the rights enjoyed by anybody else that lives here.
02:57:18.000Whether they're parents or citizens, no matter how many generations they've gone back, it doesn't even matter.
02:57:26.000Literally, if you are born on the land, you have full voting rights, you are entitled to Social Security and all the other benefits conferred upon you by citizenship.
02:57:38.000And this has given rise to a very toxic and bad incentive structure.0.53
02:57:45.000Particularly, birth tourism and illegal immigration.0.76
02:57:49.000If you are a foreign national, whether you're wealthy or whether you're poor, because of this perverse incentive structure that's been set up, it would behoove anybody, no matter what country you come from, again, whether rich or poor, to come here when you're pregnant so that your children will be born on the land and they'll enjoy all the benefits of U.S. citizenship.0.69
02:58:13.000And so it's become very common for Russian oligarchs and Chinese elites, rich people, to travel to the United States when they're pregnant to have their children here.0.82

02:58:32.000Because then it allows their children to visit the United States whenever they want, reside in the United States whenever they want, to gain access to American universities and other amenities.

02:59:18.000They will have privileged access to American public schools, to the American health care system, and they'll be set up to live in America for the rest of their lives.
02:59:41.000But the history of this amendment is very important to understand.
02:59:45.000It's not as though the states and the Congress and the representatives of this country got together and said, wouldn't it be a great idea if anybody that was born on the land could become a citizen?
02:59:57.000The 14th Amendment comes by way of the Civil War.
03:00:01.000It was part of a series of three amendments to the Constitution, which were ratified in the immediate aftermath of the Civil War, which were meant to address the particular circumstances of the freed slaves after the conclusion of the Civil War.
03:00:21.000The 14th Amendment, which is where birthright citizenship is enshrined, was ratified so that the people that were freed from slavery would be grandfathered in as citizens.
03:00:35.000And it said all these people that were in legal limbo, people that were slaves, now are freed.
03:00:42.000Question is, what are they legally to the government?
03:00:46.00014th Amendment says, well, it doesn't matter if they were born as slaves and are now free.
03:00:52.000Because as long as they were born on the land, they are now citizens.
03:00:57.000And so this was a sloppy way, a sloppy way in the US Constitution to figure out what we're going to do, what is to be done about all these people.
03:01:08.000It is part of a series of three amendments 13, 14, and 15.
03:01:14.000What do we do with all the freed slaves after the Civil War?
03:01:17.000And it said, well, as far as their legal status is concerned, we will consider that if they were born on the land, it doesn't matter if they were slaves at that time or free men.
03:01:28.000That was the point of that provision of the 14th Amendment.
03:01:33.000And of course, since then, the situation has changed.
03:01:37.000Since then, in the mid and late 19th century, you've had huge waves of immigration.
03:01:42.000And then there's the Ellis Islanders, and then there's Hart Seller and the 1990 Immigration Act.
03:01:48.000We've opened the floodgates to massive amounts of foreign nationals coming here for various reasons.0.90
03:01:55.000And this has incentivized people to come here illegally or for other reasons, and they're taking advantage of this provision.
03:02:02.000So, when Trump was elected, it was one of his promises that he would overturn birthright citizenship.
03:02:08.000But you have to understand that in order to do this, there's a few ways you could go about it.
03:02:13.000Since it is enshrined in the Constitution and was interpreted by the Supreme Court in the late 19th century, there are one of three ways that we can go about getting rid of this.
03:02:25.000You can pass a law in Congress which says people born on the land are no longer automatically citizens.
03:02:59.000And then the third way is you could catalyze a Supreme Court decision on that provision in the 14th Amendment.
03:03:07.000You can either have a federal law or you could have, in this case, an executive order, force the Supreme Court to consider.
03:03:14.000This issue, and then it would give the Supreme Court an opportunity to create a new interpretation of the 14th Amendment and maybe redefine it in a different way.
03:03:25.000Those are the three ways you might go about it.
03:03:27.000Obviously, amending the Constitution is the most rock solid, but also the most difficult.
03:03:33.000You're never going to get a constitutional convention.
03:03:35.000You're never going to get three fifths of the states to approve of something like that because the constituency just doesn't exist for that right now.
03:03:43.000Federal law would be equally as tricky because you need to go.
03:03:47.000To the Senate, and you would have to get a supermajority or 60 senators, three fifths of the Senate to vote on this.
03:03:54.000And I don't even know if you'd get every Republican to vote for that, let alone seven Democrats on top of the Republican majority.
03:04:33.000All an executive order really is, it doesn't actually exist in the legal code.
03:04:38.000What an executive order does is it directs the federal bureaucracy under the executive branch to carry out the existing federal statutes with new guidance.
03:04:52.000So, what does this executive order specifically say?
03:04:55.000It says stop giving citizenship to people that are born on the land, but their parents aren't citizens.
03:05:04.000It's a guidance for the executive branch and how they're administering citizenship services.
03:05:24.000The executive branch executes the laws.
03:05:26.000How do they execute the federal statutes?
03:05:29.000With the departments and agencies in the federal bureaucracy.
03:05:33.000And what the executive branch has is the discretion for how they're going to interpret and then execute the laws given to them by the legislature, according to the federal statute.
03:05:48.000Trump is saying, well, we're going to take the existing federal statute and we're just going to sort of, we're going to, At our discretion, change how we're applying it.0.99
03:05:57.000So don't give citizenship to these people anymore.
03:06:36.000This was considered in the 1890s by the Supreme Court, and the Supreme Court said if you're born on the land, you're a citizen.
03:06:44.000So you've got the Constitution itself, and you've got a Supreme Court ruling.
03:06:48.000You also have at least two federal statutes that also say if you're born on the land, you're a citizen.
03:06:55.000So you've got an executive order, which is again like a glorified memo going up against an amendment to the Constitution.
03:07:04.000A Supreme Court decision and two federal statutes from Congress.
03:07:09.000It was never going to stand a chance, and everybody knows that.
03:07:13.000Now, that did not stop people last year from celebrating as though it was a done deal.
03:07:19.000I remember because I've been doing this show for 10 years.
03:07:24.000So I remember on January 20th or 21st, 2025, when Trump signed hundreds of executive orders on day one, one of them was overturning birthright citizenship.
03:08:41.000On procedural grounds alone, the Supreme Court will say, if you want to change this policy, amend the Constitution, pass a law through Congress.
03:09:51.000And sure enough, that is exactly how the decision came down.
03:09:54.000It was Justice Roberts and Amy Coney Barrett that said this is unconstitutional and it's against federal law.
03:10:04.000Roberts and Barrett, and then Kavanaugh in a separate procedural decision, but it was those two plus Kavanaugh in two separate decisions that shut it down and said birthright citizenship is upheld.
03:10:17.000There is no challenge to birthright citizenship, it stays.
03:10:23.000And this is a story from the New York Times.
03:10:24.000We'll work through it and talk a little bit about the specifics.
03:10:28.000It says, quote, the Supreme Court on Tuesday struck down President Trump's executive order limiting birthright citizenship.
03:10:35.000Chief Justice John Roberts, writing for the majority, explained that Mr. Trump's executive order violated the 14th Amendment, which says that children born in the United States to undocumented parents or to parents temporarily in the country, or rather, this is his decision, not the Constitution.
03:10:52.000He wrote that children born in the U.S. to undocumented parents or to parents temporarily in the country are citizens at birth.
03:11:00.000The Chief Justice was joined by the court's three liberal justices, along with two fellow conservatives, Amy Coney Barrett and Brett Kavanaugh.
03:11:08.000Brett Kavanaugh wrote that he would strike down the executive order based on federal law, not the Constitution.
03:11:15.000In a social media post after the ruling, the president called the Supreme Court's decision too bad for our country.
03:11:25.000Three of the court's conservatives, Justice Clarence Thomas, Justice Samuel Alito, and Neil Gorsuch, dissented.
03:11:31.000In his 91 page dissent, joined by Justice Gorsuch, Thomas said that the 14th Amendment was intended to enshrine citizenship for formerly enslaved people and their descendants.
03:11:41.000He wrote Blacks were entitled to citizenship because they were Americans.
03:11:46.000They had no other homeland, owed no allegiance to any foreign power, and were subject to no other authority.
03:11:52.000The same cannot be said for the children of foreign temporary visitors who were attached to their home country, lacked similar bonds to this country, and would not be called upon in time of war.
03:12:03.000Justice Alito called the decision a serious mistake, writing that the court's view of the Constitution confers citizenship on virtually everyone who happens to be born in the country, including the children of birth tourists, people that he characterized as women who come here solely for the purpose of giving birth to a child and then promptly returning home.
03:12:23.000So let's talk about the decision specifically.
03:12:30.000Six out of three justices said that the executive order is contrary to federal law.
