01:39:46.000 They're posting a woe, Jack, and it's supposed to be like a middle-class dad.
01:39:50.000 He's got like a beard, and he's wearing like a button-down flannel, and he's got a goofy haircut.
01:39:57.000 And they're posting these memes of the middle class dad Wojak and like a plain Jane wife Wojak and kids.
01:40:07.000 And they're posting these memes that are portraying like a mediocre middle class life.
01:40:16.000 And if you've been watching my show, I've actually heavily criticized that.
01:40:20.000 There used to be a TikToker, I think he's still around, his name is called Hubslife.
01:40:25.000 And his whole meme, his brand, his, I guess it's his brand, his campaign was called Normalize the Norm.

01:40:40.000 And he's this TikToker, and he came up with this campaign in response to grindset culture.
01:40:47.000 You know, because for the past two years, you've really had Andrew Tate was the dominant factor.

01:40:57.000 You know, on your grind, chasing the bag, trying to make a lot of money, hustling, trying to get sports cars, negging women, you know, being red-pilled about dating culture and women.

01:41:17.000 What was at the center of Grindset culture, which was good, and I had my criticisms of it as well.

01:41:24.000 I think it overly emphasized sex, promiscuous sex.

01:41:32.000 But what was good about it is that it had a correct attitude towards women, which is that we should not be simping for them.

01:41:44.000 We should be primarily focused on self-development.
01:41:48.000 And we should put the development of men first before men become preoccupied with relationships or seeking external validation from women.
01:41:58.000 They should work hard and work out and improve themselves and really develop an independent sense of self as a man first.

01:42:08.000 And I also supported the idea of this restlessness.
01:42:13.000 I like the idea of promoting ambition and young men that wanted to make something of themselves, wanted to work hard, wanted to take the initiative and start businesses, and the whole idea was to escape the matrix.

01:55:33.000 So our big featured story is about the case of Daniel Penny in New York City.
01:55:37.000 And this is actually an old case, but it is being decided now.
01:55:44.000 Daniel Penny was the subway hero in New York City who apprehended a mentally ill black Michael Jackson impersonator on the New York City subway.
01:55:55.000 And the story goes something like this.
01:55:57.000 New York City has a lot of crime now.
01:56:00.000 This is the Ferguson effect on steroids.
01:56:03.000 Ever since George Floyd and the Summer of Love, BLM, every major city has had a massive surge in property crime, violent crime.
01:56:12.000 You see it in LA, New York, Chicago.
01:56:15.000 It's everywhere.
01:56:16.000 New York City is no different.
01:56:18.000 And so on the subway, there was a black, mentally ill, Michael Jackson impersonator.
01:56:27.000 He was well known for going on the subway and having a mental breakdown.
01:56:32.000 He had 40 prior arrests.
01:56:35.000 And he went on the subway one morning and started threatening to kill everybody on the train.
01:56:40.000 He said, I don't care.
01:56:42.000 I'm going to jail.
01:56:43.000 I don't care if the cops come for me.
01:56:45.000 I'm going to kill everybody.
01:56:48.000 And started acting erratically and aggressively towards the passengers.
01:56:53.000 Daniel Penny, who's a veteran, young white man in his 20s, gets up and apprehends this mentally ill person and puts him in a chokehold to subdue him.
01:57:07.000 Passengers call the cops.
01:57:09.000 Cops arrive.
01:57:10.000 When the cops arrive, Daniel Penny, or rather the victim, is still alive.
01:57:16.000 They refuse to do mouth-to-mouth resuscitation because they don't want to get sick.
01:57:20.000 He later dies.
01:57:22.000 Daniel Penny is charged with manslaughter.
01:57:26.000 He's charged with reckless endangerment and manslaughter for killing this guy.
01:57:33.000 Now, and the latest this week, on top of the criminal charges, which are being decided right now, he is being sued civilly by the family of the victim.
01:57:45.000 The good news is, and this is the big story from today, he was facing two major charges and the top charge was a manslaughter charge.
01:57:55.000 If convicted, he would have faced 15 years in prison, and thankfully he was acquitted of that charge today.
01:58:04.000 The charge was dismissed because of a hung jury, and now the jury will consider the lesser charge, which was reckless endangerment.
01:58:14.000 And that one, it's still not good.
01:58:17.000 He does face a sentence of up to four years in prison, but significantly less.
01:58:22.000 And so this is the story.
01:58:24.000 This is from the New York Times.
01:58:25.000 It says, quote, the Manhattan judge overseeing the case of a man accused in the choking death of a mentally ill subway passenger dismissed the most serious charge against him on Friday afternoon, leaving jurors to consider a lesser charge when they return to court next week.
01:58:42.000 The jurors on Friday deadlocked over whether the man, Daniel Penny, was guilty of manslaughter, leaving unresolved a case that has come to exemplify New York's post-pandemic struggles.
01:58:54.000 They will now consider whether he should be charged of, I'm sorry, not reckless endangerment, criminally negligent homicide, a charge that carries a lesser prison sentence.
01:59:04.000 After nearly three days of deliberations, the jurors sent two notes, one on Friday morning and a second during the afternoon, to the judge, Maxwell Wiley, saying they could not come to a unanimous decision about whether Penny was guilty of manslaughter in the second degree.
01:59:20.000 After the jurors sent the first note, the judge responded by reading them a so-called Allen charge, which are official instructions for the jurors to resume their deliberations with the goal of reaching an agreement through the reconsideration of differing opinions.
01:59:36.000 Following the instructions, the panel of seven women and five men returned to their sequestered room to discuss further the.
01:59:44.000 However, after about three hours, they sent another note saying, after further deliberations, we cannot come to a unanimous decision on count one, manslaughter in the second degree.
01:59:55.000 Mr. Penny's lawyers argued that the deadlock meant the trial should be ruled a mistrial.
02:00:01.000 While prosecutors with the Manhattan District Attorney's Office asked that the manslaughter charge be dismissed so that the jury could deliberate on the lesser charge.
02:00:10.000 Had the jury convicted Mr. Penny of second-degree manslaughter, he would have faced up to 15 years in prison.
02:00:17.000 By contrast, criminally negligent homicide in New York carries a maximum of four years.
02:00:23.000 Neither charge comes with a minimum sentence.
02:00:25.000 So jurors were deadlocked.
02:00:31.000 The judge pressed them and said, I want a verdict.
02:00:35.000 They came back and said, we don't have one.
02:00:37.000 In order to avoid a mistrial, the judge said, all right, then we'll throw it out.
02:00:43.000 And now that will allow the jurors to consider the second charge.
02:00:47.000 And maybe the judge or the prosecution are confident that the jurors will be more able to deliver a guilty verdict on that one.

02:01:50.000 If you've been arrested 40 times and you're on drugs, you're mentally insane.

02:02:03.000 You should be in jail or institutionalized, but you're not someone that's struggling with mental health.

02:02:12.000 Anyway, it says, Mr. Penny fatally choked Jordan Neely when he held Mr. Neely in a chokehold for about six minutes on the floor of an F train on May 1, 2023. Mr. Neely had boarded the train that day and begun yelling at passengers, according to witnesses.
02:02:32.000 As he strode through the subway car, he shouted about being hungry, saying he wanted to return to jail and did not care if he lived or died.
02:02:40.000 Mr. Penny approached Mr. Neely from behind and put him in a chokehold, taking him to the floor.
02:02:45.000 Prosecutors said Mr. Penny's actions were not accidental and that he had failed to recognize Mr. Neely's humanity, squeezing his neck ever tighter as he struggled to break free.
02:02:56.000 They argued that Mr. Penny's chokehold killed Mr. Neely, pointing to the testimony of a New York City medical examiner who ruled the death was caused by compression of the neck.
02:03:07.000 Mr. Penny's lawyers argued their clients' actions had not been the direct cause of the death, suggesting it was a combination of synthetic marijuana use, sickle cell, and mental illness.

02:06:36.000 Well, he didn't get choked out for dancing, and he didn't get choked out for wanting to live to be an old age.
02:06:43.000 He was choked out because he was threatening to kill everybody on public transportation, and it wasn't the first time.

02:07:20.000 We all know that public transportation in our country is unusable because of this kind of individual.
02:07:28.000 We all know that public trains, buses, we all know that even hubs of public transportation, like the train stops themselves, are ripe for violence.

02:07:44.000 You simply can't ride on public transportation.

02:07:49.000 I mean, what is public transportation?
02:07:51.000 Public transportation exists so that people don't need personal private transportation.
02:07:58.000 So that people don't need to use commercial transportation, like Uber or taxi cabs, or have their own private cars.
02:08:05.000 It is what makes living in the city economical and convenient.
02:08:10.000 It is a public service paid for by the taxpayers.
02:08:15.000 This is everything that is wrong with the country.
02:08:18.000 We have public transit so that we can have big, thriving cities, so that it is economical to live in them, so that it is safe and convenient and easy to travel through them.
02:08:30.000 And it is meant to create commerce and prosperity.
02:08:34.000 It is paid for out of our taxes.
02:08:38.000 And yet it has been made unusable, universally.
02:08:44.000 Nobody can take advantage of this.
02:08:47.000 Nobody can live, work, play, have leisure, recreation in the city because it has been taken advantage of and taken hostage by opportunists and predators.
02:08:59.000 They're doing drugs on the subway, urinating and defecating in the subway, committing crimes, burglaries, theft, in some cases, gang killing, shootings.
02:09:13.000 And there's all kinds of menace and intimidation that goes on there as well.

02:09:18.000 We've all seen it in every major metropolitan area this is going on.
02:09:23.000 And think of the downstream effect that this has on our society.
02:09:26.000 How many people are not living in the city because they can't take public transportation because of this?
02:09:31.000 How many people are commuting to work, which means getting a car, living in the suburbs, and then being a part of traffic congestion on the highway because they can't take public transportation?
02:09:43.000 How many people don't leave their block or their neighborhood on a Friday night or on a Saturday and go spend their money in the city, at a restaurant or at a club or wherever because they can't use public transportation?
02:09:56.000 There is an enormous unseen cost to all of this.

02:10:03.000 There's enormous social cost.
02:10:05.000 And of course, then there is the There is the opportunity cost of all this money that is coming out of the taxpayer that is going to public transportation that's totally unusable.
02:10:19.000 This is the kind of situation that politicians have created.
02:10:24.000 And again, you get back to this individual case.
02:10:27.000 You have one of these people who is a part of this problem antagonizing people on the subway.
02:10:33.000 We've all seen the story before.

02:10:38.000 Somebody gets up and does something about it because the cops won't do it.
02:10:44.000 The politicians won't do it.
02:10:45.000 When people jump over the turnstile and don't pay the fare, they just waive the fare.
02:10:50.000 And it makes it a loss to even operate the subway.
02:10:56.000 When people go on the subway and use it as a bathroom or use it as a place to do drugs or use it as a place to do gang hits, the cops aren't there.

02:11:06.000 10% of the violent crimes in the city of Chicago ever get solved, ever result in an arrest.
02:11:14.000 So, a citizen was forced to do the job that the police won't.
02:11:19.000 A citizen who was riding the subway like everybody else, people are just trying to get to work.
02:11:23.000 You know, law-abiding taxpayers are just trying to get to work to make the world go around.

02:11:36.000 Terrible people are taking advantage of the system, and a citizen steps up, really a vigilante, to protect the people, subdues the criminal, kills them in the process, and the system says that he's the criminal now.

02:11:54.000 And I would argue that the world would be a better place if people like this were killed all the time.

02:12:30.000 And the reason you do this is so that people know, I'm not going to go on the subway and commit crimes because I will face a consequence.

02:12:42.000 But it's gotten to the point where now it is so bad because there's been lax enforcement for so long, purely for political purposes.

02:12:57.000 And so now they feel comfortable being high, publicly defecating, living in the subway, and Mugging people, robbing people, assaulting people, killing people because they know they are not going to be arrested.

02:13:16.000 If they are, they'll be released eventually and they can start the cycle all over again.

02:13:48.000 Maybe if there was some sign that the political system is willing to stand by a vigilante or a police officer, maybe more people would take action.

02:13:59.000 But maybe we could start to reverse the trend and vigilantes and police would feel comfortable.
