00:00:29.000 And I think that our journey to Washington, D.C. this weekend may very well be or could be potentially the end to this breakneck schedule we've had on the show.

00:00:44.000 I don't see exactly what the end game would be going to state capitals from here on out.
00:00:49.000 And we'll talk about that more in a moment.
00:00:51.000 But what I mean to say is, I think we're back here on the show for a full week.
00:00:56.000 And this will be our first full week on the show since probably the week of the election over a month ago.
00:01:03.000 So I think this might be the first one that we've done Monday through Friday, first casual Friday show that we've seen in a long time.
00:01:10.000 Then again, I might get word from the campaign or from the White House or from wherever.
00:01:16.000 We might get called back into action next weekend.
00:01:19.000 You know, I don't really know what the game plan is at this point.
00:01:22.000 And that's because of our featured story tonight that has a lot to do with what we're talking about this evening, which I'm sure you know.
00:01:30.000 The Electoral College voted today.
00:01:33.000 And as many people have pointed out to me on Twitter and elsewhere, today, December 14th, is not on or in the Constitution.
00:01:41.000 But this is the day that formally the electors in all.
00:01:45.000 50 states officially vote in the Electoral College.
00:01:50.000 And that means, in some way, that the vote is final.
00:01:55.000 And we'll get into all the details.
00:01:57.000 Some dispute this.
00:01:58.000 There may be some other contingency still that we haven't exhausted yet.
00:02:03.000 But today was kind of a big deal.
00:02:05.000 The safe harbor deadline was last week.
00:02:08.000 Today, the Electoral College voted.
00:02:10.000 And now, the next big day for the election process is January 6th.
00:02:16.000 And that is when the vice president will read out all of the Electoral College votes and count them in front of a joint session of Congress.
00:02:24.000 And then the inauguration happens on January 20th.
00:02:28.000 So we'll get into all of that.
00:02:29.000 I know that's not a full summary, that doesn't explain everything that we might see in the next few weeks, but that's the gist of what happened today.
00:02:38.000 Pretty big day.
00:02:39.000 And that basically brings to an end our effort to get state legislatures to reclaim their constitutional authority to appoint electors because now the electors have voted.
00:02:50.000 You know, whether they voted for Biden, some voted in a contested way for Trump.
00:02:55.000 The electors have voted, and it seems that that chapter has closed.
00:02:58.000 So that's where we are today with the election, but I'll go into much more detail later tonight.
00:03:03.000 We'll talk all about that.
00:03:04.000 I'll also be talking tonight about the Texas lawsuit in the Supreme Court.
00:03:09.000 I didn't get to talk about that on the show yet.
00:03:12.000 The last time I talked about it was Thursday, and I had a pretty bleak take.
00:03:18.000 Apparently, a lot of people in the live chat didn't like my take on Thursday.
00:03:22.000 A lot of people on Twitter didn't like my take on Thursday.
00:03:25.000 And before the case was thrown out of the court, I said that I thought that this was a big scam by Republicans, Republican governors, Republican secretaries of state, and attorney generals, and even Republican congressmen who joined onto it with an amicus brief.
00:03:43.000 It was basically a big scam.
00:03:44.000 It was a big ass saving mechanism so that they could pretend that they were doing something to support the president, to keep him in office, while actually doing nothing substantive.
00:03:56.000 To win.
00:03:57.000 And the reason I said that is because of the timing of the lawsuit.
00:04:00.000 This lawsuit, launched by Texas to challenge the election results in four swing states, was launched last week.
00:04:08.000 They filed this suit, I think, a day after the safe harbor deadline, and that's the deadline after which all the elections must be certified, and they filed it less than a week before the Electoral College vote, meaning that they would have less than a week for this case to be taken up by the Supreme Court, decided by the Supreme Court, and then to change the outcome.
00:04:29.000 I don't think anybody expected that that would have happened in a one week period, and certainly it hadn't been decided by Thursday.
00:04:36.000 It was not going to happen over a weekend.
00:04:39.000 That's what I said on Thursday.
00:04:41.000 A lot of people disagreed.
00:04:43.000 And then within 24 hours, the case was thrown out in the Supreme Court on Friday.
00:04:47.000 That was the big news this weekend.
00:04:49.000 I did not get to cover that on the show because I was in Washington, D.C. for the rally this weekend.
00:04:54.000 But we'll talk a little bit about that tonight and fill you in on everything that's going on there.
00:04:59.000 So that's going to be our show.
00:05:02.000 Those are our two big stories.
00:05:04.000 Of course, before we get into that, we have a lot of other things to talk about.
00:05:08.000 I want to go over the rally in Washington, D.C. and what went on there.
00:05:13.000 And I also want to talk about a couple of other things.
00:05:15.000 Before I even get into the Washington, D.C. trip this weekend, I have a couple of big announcements pertaining to the show.
00:05:23.000 The first of which you probably already saw, but on Friday morning, I announced that AFPAC 2 will be taking place in February 2021 in Orlando, Florida.
00:05:36.000 So, in case you missed that on Twitter, I know there's been a lot happening this weekend between the Electoral College and the Supreme Court case and.
00:05:44.000 This million MAGA march in DC.
00:05:47.000 So, in case you missed it, I want to announce it formally on the show for the first time.
00:05:52.000 AFPAC 2, the America First Political Action Conference, is happening at the end of February in Orlando, Florida.
00:05:59.000 And that'll be happening the same weekend as CPAC.
00:06:03.000 About AFPAC, though, for this year, what's really exciting about this conference is that it's going to be open to the public for the first time.
00:06:11.000 Because I know that last year we had a couple of events.
00:06:14.000 We had the Miami Free Speech event.
00:06:17.000 We had the Groyper Leadership Summit in West Palm Beach, outside of the Turning Point SAS Conference.
00:06:25.000 And we had AFPAC One.
00:06:26.000 And for all of those events, attendance was limited.
00:06:29.000 It was invite only.
00:06:31.000 You had to get vetting and everything like that.
00:06:34.000 But this year, AFPAC Two, because it's held in Florida, they don't have any COVID lockdown restrictions there.
00:06:40.000 So there's no capacity limit on how many people we could have inside the event.
00:06:46.000 And also, I feel that the movement has been mainstream enough that we can just Open up the gates.
00:06:52.000 And obviously, we'll have security and there'll be precautions in place, but we are expecting to have hundreds and hundreds of people show up to this thing.
00:07:01.000 It's general admission.
00:07:02.000 So, very excited about that.
00:07:04.000 We'll be announcing a lot more details about that in the coming weeks and months.

00:07:44.000 And I'm really glad that we're able to open it up because it was unfortunate last year that it had to be invite only for a variety of reasons.
00:07:52.000 I know a lot of people, I think thousands of people, at least 1,000, maybe 2,000 people, applied to go to AFPAC last year.
00:08:00.000 And we only ended up having about 150 or 200 people because we were trying to be really careful about privacy and security and things like that.
00:08:10.000 And I felt bad because there were hundreds, if not thousands, of people that wanted to show up that couldn't show up.
00:08:17.000 And this year we'll have an opportunity to bring everybody into one place.
00:08:22.000 It'll be kind of cool.
00:08:23.000 You know, hopefully, everybody from Stop the Steal from the Groyper Ward will be like a big family reunion.
00:08:28.000 So, that's coming up.
00:08:29.000 That'll be in February.
00:08:31.000 The other big announcement that I have about this show is that I have opened up an application on my website.
00:08:37.000 I don't know if people have discovered this yet, but I opened up an application on my website last week.

00:08:50.000 And I think I've told you this on various streams in the past few weeks.
00:08:54.000 During the Stop the Steel protests, but we are looking to rapidly scale up our operation here with America First.

00:09:06.000 The goal is to be competitive in the next election.
00:09:10.000 We are trying to create a lot of infrastructure in 2021.
00:09:14.000 And this is largely because of Stop the Steel, not just the rallies, but because of the screw job with the election.
00:09:22.000 I think that that has galvanized a lot of people.
00:09:24.000 I think the America First message is going to take off in a huge way next year.
00:09:29.000 And I think the time is right to really strike with the real grassroots movement.
00:09:34.000 And in order to take advantage of that, we need lots of help, lots of infrastructure.
00:09:39.000 So I opened up an application on the website.
00:09:41.000 We're looking to recruit interns, people to do nothing spectacular, nothing crazy.
00:09:47.000 But in the application, we just asked you where we could reach you like an email address, your skill set, your qualifications, things of that nature.
00:09:57.000 I and a few others will be reviewing all of that information.
00:10:00.000 And hopefully, we can bring some people aboard and get some help.
00:10:05.000 Because I got to tell you, we have a lot of people working for America first, but it seems like the growth of the movement is almost outpacing all the things that we're doing behind the scenes to build up the infrastructure.
00:10:16.000 So it's actually kind of like growing pains.
00:10:19.000 It's a good problem to have.
00:10:20.000 And also, I want to clarify in case people are wondering or asking I do not want your personal information on the application.
00:10:29.000 I don't want your names.
00:10:30.000 I don't want your addresses.
00:10:31.000 I don't want your phone numbers.
00:10:32.000 And I'm actually asking you not to put that information on the application.
00:10:37.000 It's a tricky thing.
00:10:38.000 Because, on the one hand, we want people to help us.
00:10:41.000 We want people to join the movement. 1.00
00:10:42.000 We want to get people involved and delegate some responsibilities out to the Groypers. 1.00
00:10:48.000 But at the same time, I know that every time you put out a contact form, you get accused of harvesting information or trying to dox people. 0.61
00:10:56.000 And I certainly have been a big proponent of not doing that, not collecting information, not putting it on a spreadsheet somewhere.

00:11:05.000 I'm telling you straight up before anybody even checks out the application, make sure that you're not putting anything that is, you know, that you don't want out there.

00:11:16.000 It's totally secure and private, but I think it's just better if we deal with emails and things like that.
00:11:22.000 You can make a burner email and throw it on there because I don't want to put anybody in jeopardy or even have people perceive that they might be in jeopardy in that way with their information.
00:11:33.000 So those are our big developments on the America First front.
00:11:37.000 Obviously, a lot of things are happening.
00:11:39.000 Very exciting.
00:11:40.000 The movement is growing rapidly.
00:11:42.000 You've seen this happen over the past six weeks or so.
00:11:46.000 So that's where we are with that.
00:11:47.000 AFPAC 2 internship program.
00:11:51.000 It's good stuff.
00:11:52.000 I want to move on now and talk a little bit about the Washington, D.C. rally this weekend.
00:11:57.000 And I want to say before I get into all of that, thank you to everybody who joined us in Washington, D.C. on Saturday and Sunday.
00:12:05.000 It was a lot of fun.
00:12:06.000 It was a big rally.
00:12:07.000 This might have been the second biggest rally, I think, that has happened since the Million MAGA March.
00:12:14.000 It wasn't quite as big as the Million MAGA March, but there was a pretty sizable turnout.
00:12:18.000 And if you were there, I think you could see that.
00:12:20.000 One of the problems, though, with this weekend is that there were these competing rallies going on, and it was very confusing.
00:12:27.000 Very confusing even for me, because I'm talking to the organizers and I'm talking to the people involved, and I'm, in a sense, organizing my own somewhat autonomous event.
00:12:39.000 And even I didn't know all the details until the day of, because you had the MAGA March.
00:12:45.000 MAGA March is its own entity, they're this group.
00:12:49.000 They were having a rally on Freedom Plaza at noon.
00:12:52.000 And then after their rally, they were supposed to march to the Supreme Court.
00:12:56.000 Freedom Plaza is right around the White House, right around the Trump Hotel there, and they were going to march to the National Mall where the Supreme Court is.
00:13:06.000 That was at noon, and then the march was after the rally.
00:13:09.000 At the same time, you had a group called Jericho March, which was a number of Christian leaders and other people, and Alex Jones was involved with that, Ali Alexander was involved with that.
00:13:20.000 The Jericho March was starting at 9 30 a.m., and this was their plan, which was a little bit crazy.
00:13:27.000 They intended to have three simultaneous marches happening at the same time around three different buildings.
00:13:36.000 At 9 30 a.m., they were telling people they wanted a march around the Department of Justice, a march around the Capitol building, and a march around the Supreme Court.
00:13:46.000 And I'm looking at the website and I'm thinking, well, which is it?
00:13:49.000 Is it the DOJ?
00:13:50.000 Is it the Capitol?
00:13:50.000 Is it the Supreme Court?
00:13:51.000 Like, what's going on here?
00:13:53.000 And then they posted a map at some point later that week.
00:13:57.000 Showing, no, they wanted at the same time people marching around these three buildings, and these buildings are far apart from each other.
00:14:04.000 The DOJ is on the complete opposite side of the National Mall, maybe a mile away, and then you've got the Supreme Court and the Capitol relatively close to each other.
00:14:14.000 So you've got this march going on at 9 30, and then they were supposed to have a rally at the Supreme Court at 10, and then they were supposed to have another rally on a stage in the middle of the National Mall, I think by the Washington Monument at 11.
00:14:28.000 And these were two totally separate events.
00:14:30.000 So I saw a lot of different material being posted about the rallies this weekend.
00:14:36.000 And some said the White House, some said the Supreme Court, some said the Capitol, some said Freedom Plaza, marching around buildings, marching to and from the Supreme Court, all this craziness.
00:14:48.000 And I'm thinking, where is America First going to fit in?
00:14:50.000 We couldn't get a spot on the stage at the Jericho March or the MAGA March.
00:14:54.000 They wouldn't let us on, which is kind of interesting.
00:14:57.000 You know, they had a lot of speakers that haven't really been involved in Stop the Steal.
00:15:02.000 I know I've been flying to Phoenix, Harrisburg, Atlanta, Lansing, you know, just about every swing state capital.
00:15:08.000 I wasn't allowed on the stage.
00:15:10.000 At either event, we had to sort of carve out our own little area.
00:15:15.000 So I wasn't happy about that, but I got on the ground on Saturday.
00:15:18.000 I told people, let's go to the Supreme Court at 11 a.m.
00:15:22.000 I head out to the Supreme Court, and everybody's walking away.
00:15:27.000 I was supposed to do a speech on the steps of the Supreme Court, or at least that was the plan.
00:15:31.000 And by the time I get there, everybody is marching from the Supreme Court to Freedom Plaza, which I don't know if that was supposed to be the plan for anybody.
00:15:39.000 I don't know how that happened.
00:15:40.000 I don't think Jericho March or MAGA March planned on that happening.
00:15:44.000 But I arrived, and there was this caravan of Trump supporters marching.
00:15:49.000 So I said, okay, let's go with the crowd.
00:15:51.000 So we walked with them.
00:15:52.000 We showed up at Freedom Plaza and we carved out, like I said, a little space. 0.54
00:15:58.000 It was actually the same spot that we spoke at at the original Million Maga March on November 14th. 0.99
00:16:04.000 I got up on this sort of makeshift stage and we had all the Groypers gathered around. 0.63
00:16:09.000 And I want to say, I do apologize if you didn't make it to that crowd.
00:16:13.000 I know a lot of people are texting me and saying, where are you?
00:16:16.000 And some people just gave up and went home because there was so much confusion.
00:16:20.000 Like I said, there were like three or four simultaneous events, marches, rallies happening in a two or three hour period that morning.
00:16:29.000 And the details weren't really clear, I don't think, from anybody.
00:16:32.000 So I apologize if you didn't end up getting into that rally, getting into that crowd and seeing the speeches.
00:16:39.000 But it was actually, you know, we played it by ear.
00:16:43.000 It was one of these things where we just had to work with what we had.
00:16:46.000 We got on the ground, the situation was changing, we adapted.
00:16:50.000 And it turned out being a great rally.
00:16:51.000 We had our whole crew there, everybody spoke.
00:16:54.000 I gave a speech.
00:16:55.000 Jake Lloyd spoke.
00:16:57.000 Steve Franson spoke.
00:16:58.000 Scott Greer spoke.
00:16:59.000 Patrick spoke.
00:17:00.000 Jaden gave a speech.

00:17:05.000 So the whole gang got up there and gave a talk.

00:17:11.000 And I got to say, you know, I wasn't really feeling it.

00:17:15.000 And my first speech, I wasn't really into it.

00:17:19.000 I was pissed off because everything was so confusing and so chaotic.

00:17:27.000 We were kind of getting drowned out by this really loud speaker from one of the official events from the MAGA March.
00:17:34.000 And I just wasn't happy with what was going on.
00:17:36.000 So, my first speech, I wasn't really feeling it.
00:17:39.000 And, you know, so I gave a little talk on the megaphone, and then everybody went through their speeches.
00:17:45.000 And Jaden got up there, and he gave what I thought was probably the best speech I've ever seen him give.
00:17:52.000 And it was really something, actually, it was a very proud moment.
00:17:56.000 Because he gave, I think, a short speech at the Million Maga March on November 14th.
00:18:01.000 And I don't think he was expecting to give a speech, so he wasn't prepared.
00:18:05.000 And I don't think he has much experience public speaking.
00:18:07.000 He did well, but it wasn't the greatest.
00:18:12.000 And he turned it on this weekend like I don't think I've ever seen him before in such a short time.
00:18:17.000 He gave, I think, one of the better speeches at the rally.
00:18:21.000 It was high energy.
00:18:22.000 He was screaming.
00:18:23.000 He's going, the GOP spits on us and all this stuff.
00:18:27.000 And he really brought the energy back.
00:18:29.000 And he handed the megaphone off back to me.
00:18:31.000 And at that point, I was feeling it.
00:18:33.000 I was beaming with pride in the whole group, but Jaden in particular.
00:18:38.000 And the energy was turned up.
00:18:39.000 And I went out there.
00:18:40.000 And I think I went harder than I've ever gone on a speech at these Stop the Steal rallies or maybe ever.
00:18:47.000 I was talking about secession.
00:18:49.000 I said, You look at Black Lives Matter and Antifa, and they get taken seriously. 0.99

00:18:57.000 When I mentioned secession, I said, And there's a word people are saying.
00:19:02.000 I never thought I would hear this or support it, but people are talking about it.

00:19:10.000 And the whole place, if you were there, you remember.
00:19:13.000 I don't think it was even captured very well on video.
00:19:17.000 I watched the replay and it didn't really get, I think, the energy, but the whole place went insane.
00:19:23.000 The screaming, it was deafening.
00:19:26.000 That was the loudest cheer that I heard in maybe any Stop the Steal event I've been to so far.
00:19:32.000 Even some that might have been a little bit of a bigger crowd or the audio situation was better.

00:19:38.000 You could feel it like, you know, like adrenaline.
00:19:41.000 It was incredible.
00:19:42.000 I talked about secession.
00:19:44.000 I talked about the founding fathers, all this kind of stuff, really powerful finish, finishing strong with the rally.

00:19:54.000 And, you know, so I gave my speech.

00:19:57.000 I shook everybody's hand.
00:19:59.000 Very nice meeting everybody.
00:20:01.000 And I want to say thanks to everybody that found us at Freedom Plaza.
00:20:05.000 Thanks to everybody that showed up to DC.
00:20:07.000 But in particular, thanks to everybody that found the stage and was there in the crowd.

00:20:13.000 Got to shake a lot of hands and meet everybody.

00:20:17.000 It's always very exciting.
00:20:19.000 People, too, in Washington, D.C., who work very high level jobs.
00:20:23.000 There were a lot of people in the crowd in D.C. this weekend.
00:20:27.000 Some people were texting me, some people I met up with later.
00:20:30.000 I was like, You were in the crowd?

00:20:41.000 So it was a very exciting event, very exciting day.

00:20:56.000 I don't want to throw anybody under the bus, but it didn't really work out.

00:21:02.000 I was trying to get the details from the organizers the night before, the morning of.
00:21:07.000 I couldn't get any answers because we were supposed to have a stage and a sound system.

00:21:14.000 Is it still 3 o'clock National Mall?
00:21:17.000 They go, Well, it's either going to be the Supreme Court or the National Mall, and it's either going to be at 1 30 or 3 o'clock.
00:21:23.000 And I'm thinking, well, that's no good.
00:21:25.000 I'm more confused now than before I asked you where and when it was.
00:21:28.000 We're supposed to entertain four possible scenarios, two locations, two times.
00:21:34.000 I said, it's two o'clock.
00:21:36.000 I need to know when this thing is happening and where.
00:21:39.000 And they said, yeah, it's probably not going to happen.
00:21:40.000 It seems like InfoWars is going back to Austin.
00:21:44.000 They started packing up the stage.
00:21:46.000 And I felt terrible because, you know, people come out to these things and they pay for plane tickets and hotels, and even more than the money, they get all excited.
00:21:56.000 People think, oh, I'm going to go and meet Nick.
00:21:57.000 I'm going to meet Alex.
00:21:59.000 I'm going to go to a rally and everything.
00:22:01.000 And then they show up and they're taken down the stage before the event starts.

00:22:05.000 It's not happening.
00:22:08.000 I wound up going out to the National Mall anyway, and I met up with a small group of Groypers who stuck it out. 0.96

00:23:06.000 It was retweeted by Ilhan Omar.
00:23:09.000 It was retweeted by, I think, several congressmen, some major people.
00:23:14.000 And it was kind of amazing because a lot of liberals were retweeting it and they were saying, wow, this is good news to me.
00:23:21.000 They're going to destroy the GOP.
00:23:23.000 And then there were a lot of Republicans who were saying, oh, this guy's a Nazi. 0.93

00:23:54.000 What we're talking about and what the rest of that speech was about was basically about decapitating the GOP leadership.
00:24:00.000 Not in a literal sense, but primarying Mitch McConnell, giving a primary to Kevin McCarthy, going in and sending America first.

00:32:26.000 What I'm trying to say is that a couple of years ago, when the alt right would go viral, they would go viral with the media being complicit in that.

00:32:36.000 The media would put the alt right on television and their chants and their gaffes and whatever because they wanted people to see that because it helped them.
00:32:46.000 When we go viral, the media is opposing it, they're trying to suppress it.

00:32:52.000 And the messages that are getting out there are messages that truly challenge the system.
00:32:57.000 Nobody wants America First, Trump supporting Christian conservatives to start saying, we don't need the GOP.
00:33:04.000 We're going to destroy the GOP.
00:33:05.000 We're going to withhold our vote.
00:33:07.000 We're going to put America First conservatives in House races and Senate races and primary Republicans.

00:33:39.000 I think we've been presented in a lot of ways here with a great opportunity to do that.
00:33:44.000 In some ways, this might have been the best case scenario because this is a scenario, maybe more than any other scenario, that allows us to harness the power of 75 million Trump supporters and transfer that into electoral wins across the board with America First People and the GOP.

00:34:05.000 But we're going to move on.
00:34:07.000 I want to talk about the Texas suit because we have a lot to cover tonight.
00:34:12.000 So, we got to get a move on.
00:34:13.000 We got to get to talking about this stuff.
00:34:15.000 And our first story is the Texas lawsuit in the Supreme Court.
00:34:20.000 And I want to reiterate my position about this from Thursday and from Twitter because a lot of people didn't like my take on this.
00:34:26.000 And basically, I think I was right.
00:34:29.000 I said on Thursday, and I'll just summarize briefly the Texas suit in case you forgot or you don't know.
00:34:36.000 So last week, the state of Texas sued the states Michigan, Wisconsin, Pennsylvania, and Georgia.
00:34:45.000 And they were suing these states because Texas claimed that when these states improperly changed their election guidelines, they violated the Electors Clause of the Constitution.
00:34:58.000 Because in the Constitution, it says that the electors that voted in the Electoral College must be chosen by the state legislatures.
00:35:08.000 The state legislatures in all 50 states have delegated their authority to appoint the electors to the voters by having elections in every state.
00:35:20.000 If in each state state supreme courts and state election officials are changing the process for the election and how the electors are chosen, then that would mean that the Constitution was violated.
00:35:33.000 That would mean that state election officials and state supreme courts are, in their own way, Deciding how the electors are appointed rather than the state legislature.
00:35:43.000 The state legislature alone has the constitutional authority to appoint electors, and therefore, the state legislature alone has the authority to determine how elections are conducted in order to facilitate the appointment of those electors.
00:35:59.000 If state supreme courts and if election officials in the state without that constitutional authority change those guidelines, change how those elections are conducted, then that means they're violating the Constitution.
00:36:11.000 If they're violating the Constitution in a manner that puts a president in office illegitimately, a president that governs all 50 states, that means that Texas is involved.
00:36:23.000 That means that Texas constitutional rights have been violated.
00:36:28.000 That was the main thrust of the lawsuit.
00:36:30.000 And so last week, we went over this in great detail.
00:36:34.000 21 states filed amicus briefings alongside Texas, 126 House Republicans.
00:36:42.000 They filed their own amicus brief alongside Texas.
00:36:45.000 And then you had state senators and state representatives from all the swing states.
00:36:50.000 They signed letters and amicus briefs as well alongside Texas.
00:36:54.000 And it looked like this lawsuit was gaining a lot of momentum.
00:36:57.000 President Trump said this was the big one.
00:37:00.000 And a lot of people expected this to be the lawsuit that would overturn the results.
00:37:05.000 And they thought this because when Texas sues another state, when any state sues another state, the jurisdiction for that case.
00:37:15.000 Is the Supreme Court.
00:37:16.000 That falls within the exclusive jurisdiction of the Supreme Court.
00:37:20.000 When one state sues another state, that case must not only originate in the Supreme Court, but it is the exclusive jurisdiction of the Supreme Court.
00:37:29.000 In other words, that means that this lawsuit doesn't have to go through a district court, it doesn't have to go through a state Supreme Court, it starts at the Supreme Court and it's heard in the Supreme Court only.
00:37:41.000 And that's a huge advantage.
00:37:42.000 We probably should have done that from the beginning.
00:37:44.000 Because what you're seeing with all these other lawsuits filed by the campaign.
00:37:48.000 Is they're getting gummed up in the district courts and the appellate courts.
00:37:52.000 They're getting screwed at every level.
00:37:55.000 And basically, what's happening is that the system is just stalling. 0.85
00:37:58.000 We don't have time for a lawsuit to work its way up through the entire court system in six weeks.
00:38:04.000 We just don't have that kind of time.
00:38:06.000 So, what was critical about this lawsuit was the basis of the lawsuit itself.
00:38:12.000 Because it was the Constitution, because it was one state suing four other states, it had to begin in the Supreme Court and it could only be heard by the Supreme Court.
00:38:21.000 And for that reason, people thought that the Supreme Court would take this case.
00:38:25.000 They would look at the voter fraud and they would rule that yes, the Constitution was violated.
00:38:29.000 The constitutional rights of Texans and other voters were violated.
00:38:33.000 And therefore, they would order the swing states, state legislatures to appoint their electors rather than abide by the results of these fraudulent elections where state Supreme Courts and state election officials had interfered.
00:38:47.000 That was the expected outcome.
00:38:50.000 Now, what I said on Thursday and what I tweeted.
00:38:53.000 Thursday night was that this was all basically just a scam by state Republicans and House Republicans so that they could look like they were trying to overturn the Joe Biden victory without actually putting forth anything that would actually have a chance of overturning the Biden victory.
00:39:12.000 And the reason I said that is because of the timing of the lawsuit.
00:39:16.000 This lawsuit was filed a day after the safe harbor deadline.
00:39:20.000 And a lot of people have pointed out the safe harbor deadline is not in the Constitution, which I am well aware of that.
00:39:25.000 I've been talking about that for weeks.
00:39:25.000 Fact.
00:39:27.000 I said that three weeks ago.
00:39:29.000 The safe harbor deadline's coming up, but it basically doesn't mean anything.
00:39:33.000 You know, so it's not in the Constitution.
00:39:35.000 And also, the safe harbor deadline means that all that that means, that was on December 8th, is that by that deadline, states are expected to have certified the results of their elections and that those certified results would govern the allocation of Electoral College votes.
00:39:50.000 That's the safe harbor deadline.
00:39:52.000 So I said, well, the case started after the safe harbor deadline and a week before.
00:39:58.000 The Electoral College votes.
00:40:00.000 I understand that December 14th, today, the day that the Electoral College votes, is also not in the Constitution.
00:40:07.000 But the point is, this is happening in the middle of December.
00:40:11.000 The big one, the big case where all the states suddenly decide they want to do something, and all the House Republicans decide they suddenly want to do something, they decide to make their big play with a case that originates in the Supreme Court in the middle of December.
00:40:28.000 The middle of December when most of the process has already worked itself out.
00:40:32.000 And what I said on Thursday is the time to have done this would have been November 4th.
00:40:37.000 The time to have begun these proceedings, maybe it was impossible to do it on November 4th because we hadn't gathered all the intelligence and the votes hadn't been even finished in a lot of states.
00:40:47.000 But the time to have done this would have been earlier than it was filed, not a day after the safe harbor deadline.
00:40:54.000 What's more is if these governors and secretaries of state and attorney generals and House Republicans really wanted to overturn the results of the election, they would be more vocal.
00:41:05.000 They have been saying nothing about election integrity for weeks.
00:41:09.000 They've done nothing about election integrity for weeks.
00:41:13.000 Then Republicans in Georgia start to say, well, wait a second.
00:41:18.000 Republicans aren't doing anything to protect our president.
00:41:21.000 It's been months, it's been weeks.
00:41:23.000 Republicans haven't said anything, they haven't done anything.
00:41:27.000 And what's worse is now they're asking us to go out and vote in a Senate runoff.
00:41:32.000 They do nothing to defend our president.
00:41:33.000 They do nothing.
00:41:35.000 To protect our rightful, duly elected president, and now they expect us to go out and vote for them, we're not going to vote for you, or we're not going to vote for you until you start to fight for Trump.
00:41:47.000 And then it's only after that happens, it's only after there's this uprising in the Republican Party, or this perceived threat that Republicans won't turn out in Georgia to give Mitch McConnell control of the Senate for another two years, that all of a sudden, after six weeks of silence, six weeks of inaction, but after Republicans start to throw off the shackles, and I should also add, After it seems like it's almost impossible for any action to make a difference, finally Republicans decide they're going to do something.

00:42:19.000 We are going to go out and file this big suit in the Supreme Court and it's going to work.
00:42:25.000 We weren't able to overturn the election in the Supreme Court in one week, the week before the Electoral College votes.

00:42:34.000 What a shocking turn of events.
00:42:35.000 We didn't expect that to happen.
00:42:37.000 Well, at least we tried.
00:42:39.000 I think that's what they think that we're all going to believe.
00:42:43.000 That was the intended outcome.
00:42:45.000 They can persuade Republicans that they did something without actually having tried to do anything meaningful.
00:42:53.000 They put up a lawsuit that was probably doomed to fail from the beginning, if not because of the grounds of the case, but because of the timing.
00:43:00.000 They put up a case that they knew would never be resolved in time before the Electoral College votes, or maybe they were dubious about the substance of it too.
00:43:10.000 But they knew that the lawsuit would fail.
00:43:12.000 They put it up in the hopes that Republicans would be tricked into thinking they were doing something.
00:43:17.000 And then, when it inevitably failed, they could throw their hands up and said, We did everything we could, but hey, vote for us because we tried.
00:43:24.000 I think that was the play.
00:43:26.000 And it was shot down in the Supreme Court.
00:43:28.000 If you can't blame the governors and the secretaries of state and the attorney generals, then you can blame the Supreme Court.
00:43:35.000 Because the Supreme Court, it's interesting, they threw this case out on Friday.
00:43:42.000 And they threw the case out because they said that there was no legal standing.
00:43:46.000 They said that the constitutional rights of Texans were not violated.
00:43:50.000 You know, there was nothing procedural that was wrong.
00:43:52.000 There was nothing, you know, anything like that.
00:43:54.000 But they just said that basically the case had no grounds.
00:43:57.000 That while Texas was claiming that these four states violated constitutional rights of people in Texas, the Supreme Court basically said, well, the elections in Pennsylvania have nothing to do with the people that live in Texas.
00:44:11.000 This was the ruling.
00:44:13.000 So they threw the case out.
00:44:15.000 But what was interesting about this is that all three of the Trump appointed Supreme Court judges.
00:44:21.000 Voted to throw the case out.
00:44:23.000 Gorsuch, Kavanaugh, and Amy Coney Barrett all voted to throw this case out of court.
00:44:29.000 It was only Justices Alito and Justice Thomas that voted to hear the case in front of the Supreme Court.
00:44:38.000 And, you know, to me, honestly, I think both of them are to blame. 0.99
00:44:43.000 I think the governors, the secretaries of state, the attorney generals, the House Republicans, Senate Republicans are to blame for waiting so long to put this lawsuit up and probably doing it to cover their ass. 0.97

00:45:08.000 We're being stonewalled by the media and by the district courts and the state legislatures.
00:45:13.000 If the Supreme Court cannot intervene to stop the biggest voter fraud in American history that is about to put in and install an illegitimate president in the White House, what are they really good for?
00:45:25.000 And they say, well, there's no standing in the Texas case.
00:45:28.000 Well, couldn't they find a reason to find standing?
00:45:30.000 Can't they find a case?
00:45:31.000 Can't they find some reason to adjudicate this?
00:45:35.000 I understand that maybe the Trump campaign hasn't dotted its I's and crossed its T's when it comes to every part of the procedure, putting a case before the Supreme Court.
00:45:45.000 But at what point do conservative Supreme Court justices, who are ostensibly constitutionalists or even people that have some loyalty to President Trump and conservative values, at what point do they say, It's time for us to intervene and to make a judgment about what's going on here.
00:46:02.000 They should have done that.
00:46:04.000 They have some discretionary role in involving themselves in an election like this.
00:46:10.000 Clearly, there was fraud.
00:46:11.000 Clearly, even if there isn't fraud, there's a question about fraud where 85% of voters think that Biden is illegitimate, where majorities in state legislatures are questioning the results.
00:46:23.000 There's major politicians that question the results.
00:46:25.000 The sitting president doesn't think this was conducted fairly.
00:46:29.000 And the Supreme Court can't find a reason for them to adjudicate this case?
00:46:34.000 And specifically, I think about Kavanaugh, who was thrown under the bus and accused of being a rapist by Kamala Harris. 0.89
00:46:41.000 I think about Amy Coney Barrett, who is almost stonewalled.
00:46:44.000 I think about Gorsuch, who's supposed to be a great constitutionalist.
00:46:48.000 These Supreme Court justices that were so important to put on the court, to put on the bench, because, you know, for whatever reason, Mitch McConnell said it was important.

00:52:41.000 Even when our party wins, we get the same policies as if we didn't win.
00:52:45.000 And it doesn't matter how total and how complete the victory is, how overwhelming it is, the result is always the same.
00:52:53.000 So we have to change tactics because if we keep pushing this same tactic that has a 0% chance of working, we will never win.
00:53:02.000 And that is, I think, the big leap that a lot of Republicans are going to have to make.
00:53:07.000 That's the big realization is that this is not working.

00:53:13.000 There is no scenario where just voting for Republicans and dutifully keeping Republican majorities is going to deliver results for us, the voters.

00:53:26.000 So if there is a 0% chance that we can win with this strategy, then that means that any other strategy now becomes viable.
00:53:34.000 We have to look at strategies that have a non zero chance of working.
00:53:37.000 What has a non zero chance of working is withholding our vote in the Senate runoff.

00:53:44.000 That has a non zero chance of working.
00:53:47.000 Because hypothetically, if both of the Republicans in Georgia lose their race, Mitch McConnell is no longer in control of the Senate.
00:53:55.000 Mitch McConnell cannot tell his donors that he has control of the Senate, that he has any kind of power.
00:53:59.000 He doesn't control the committees, he doesn't control the agenda.
00:54:02.000 That weakens Mitch McConnell, that weakens the party.
00:54:06.000 It also communicates to the GOP that the voters are willing to withhold their votes.
00:54:10.000 It communicates to the establishment that if they don't do what we elect them to do, they won't get elected anymore.
00:54:16.000 And the donor money stops coming in, and the committee positions aren't awarded to them, and they don't set the agenda anymore, and their clout and the gravy train come to a halt.

00:54:31.000 And even if it's just talk, maybe we'll get a little bit of follow through in 2022.
00:54:37.000 Maybe they'll start to do something to earn our vote back.

00:54:42.000 There's a non zero chance that if we run America First candidates to primary Republicans in 2022, that we get America First candidates in office and they start to change the agenda in the Republican Party.
00:54:54.000 Even if we're not able to get America First candidates in through the primary in 2022, We withhold our votes in 2022 and Republicans lose even more seats.
00:55:04.000 There's a non zero chance that then Republicans are going to turn around and they're going to try and win us back in the election after that.

00:57:22.000 That is probably the bigger deal.

00:57:29.000 So today, the electors in the Electoral College formally voted, they cast their votes in the state legislatures.
00:57:37.000 And the outcome of that is that Joe Biden has unofficially won 306 electoral votes to President Trump's 232.
00:57:48.000 And if you are smart, you'll remember that that is actually the inverse of what President Trump got in 2016.
00:57:56.000 In 2016, President Trump won 306 and Hillary Clinton got 232.
00:58:01.000 With the faithless electors, I think it wound up being slightly different.
00:58:06.000 But as far as not counting faithless electors goes, that was the count in 2016, except this time Joe Biden has 306, Trump has 232.
00:58:17.000 And I'll read you a report about this from the New York Times.
00:58:20.000 It says, quote, a strong majority of Donald Trump supporters reject the legitimacy of Joe Biden as president elect.
00:58:26.000 With many, I'm sorry, this is the wrong story.
00:58:31.000 Okay, this is about the electors from the New York Times.
00:58:36.000 It says Joseph R. Biden was affirmed as the president elect on Monday as members of the Electoral College pushed him past the 270 threshold to win the White House, all but ending a disruptive chapter in American history in which President Trump sought to use legal challenges and political pressure to overturn the results.
00:58:55.000 Get this it says, of a free and fair election.
00:58:58.000 And you know what's amazing about every news story that I've seen about the events of today is that every single news report says something to this effect.
00:59:07.000 It says, free and fair election.
00:59:09.000 It went smoothly.
00:59:10.000 There were no problems.
00:59:12.000 It was totally, you know, so clear editorializing.
00:59:17.000 It says, the president elect passed the threshold after California cast its 55 votes for Mr. Biden on Monday afternoon, capping a day marked by heightened security in battleground states and an unusual level of scrutiny for what is normally a formal procedural affair.
00:59:33.000 I should also add, in this article, they say it was a day marked by heightened security in battleground states.
00:59:41.000 And you know what they're talking about when they say that?
00:59:44.000 They're talking about how, in the state capitals of Michigan and Wisconsin, they closed down the state capitals, citing the coronavirus pandemic.
00:59:54.000 In both Michigan and Wisconsin, they closed their state legislatures entirely, locked down the whole building for one day.
01:00:03.000 It wasn't closed yesterday and it won't be closed tomorrow, but they closed it down today, they said, because of the pandemic.
01:00:10.000 Now, in Michigan, this is an article from Big League Politics.
01:00:13.000 There were pro Trump electors who wanted to get inside the state capitol and informally cast electoral college votes for Trump.
01:00:22.000 I'll explain the significance of that in a moment, but they were barred from doing so because they locked down the capitol.

01:00:29.000 It says Pro Trump electors were blocked from entering the Michigan Capitol building this afternoon.
01:00:35.000 With GOP leadership working with reviled Governor Gretchen Whitmer to block them from the chamber.
01:00:41.000 Even though at least one Michigan lawmaker arrived to accompany the pro Trump electors, their civil rights were violated and they were kept out of the chamber by state police anyway.
01:00:50.000 Sources from inside the Michigan legislature have confirmed that it was, in fact, Republican leadership who deprived the pro Trump electors of their rights and colluded with Democrats to enforce the steal.
01:01:02.000 And I'll read you another article summarizing what they're trying to do here.
01:01:07.000 Because the play here is that the electors are all going to the state capitals, they're casting their votes in an official capacity as dictated by the results of the elections certified last week on the safe harbor deadline.
01:01:20.000 But Republican electors are still going to the state capitals to informally cast votes in the event that, in some way, shape, or form, the election is overturned.
01:01:32.000 If the election is overturned, these electoral votes exist procedurally.
01:01:38.000 To be counted on January 6th.
01:01:40.000 And I'll read this memo from the Republican Party that explains it in a little bit more detail.
01:01:46.000 It says Republican electors in four states said on December 14th that they would cast their procedural votes for President Donald Trump and Vice President Mike Pence.
01:01:56.000 Republican electors in Pennsylvania, Georgia, Nevada, and Arizona all said they voted for Trump.
01:02:03.000 It comes as their states formally appointed Democratic electors who voted for Democrat Joe Biden and Senator Kamala Harris.
01:02:10.000 The Pennsylvania GOP said in a news release that electors met in Harrisburg to cast a conditional vote for Trump and Pence at the request of the Trump campaign.
01:02:19.000 Their vote comes as Democratic electors voted in the Pennsylvania Electoral College for Biden and Harris.
01:02:25.000 The Pennsylvania GOP cited the 1960 presidential election between Richard Nixon and John F. Kennedy, who would become the eventual winner.
01:02:34.000 Pennsylvania Trump campaign chairman Bernie Comfort said, We took this procedural vote to preserve any legal claims that may be preserved going forward.
01:02:44.000 In Georgia, David Schaefer, the chairman of the Georgia Republican Party, said that electors made their move today because the president's lawsuit contested.
01:02:52.000 The Georgia election is still pending.
01:02:55.000 He said, The Republican nominees for presidential elector met today at noon at the state capitol today and cast their votes for president and vice president.
01:03:04.000 Had we not met today and cast our votes, the president's pending election contest would have been effectively mooted.
01:03:10.000 Our action today preserves his rights under Georgia law.
01:03:14.000 The same thing was done in Nevada and Arizona as well.
01:03:18.000 And so basically, the point of this is that all of the 538 formal official electors.
01:03:25.000 Go to their state legislatures and vote.
01:03:27.000 And these are the votes that will be counted on January 6th by the vice president in front of a joint session of Congress, tallied, and then a president elect is chosen.
01:03:38.000 The reason that Republican electors showed up to cast conditional votes anyway is in the event that the swing state elections are called into question by the Senate or overturned by the courts, then there would exist conditional electoral college votes that can be counted.
01:03:57.000 By the vice president on January 6th, in the event that the official Electoral College votes are thrown out.
01:04:03.000 It merely means that these Electoral College votes are in the system, so to speak.
01:04:08.000 These votes exist.
01:04:10.000 These votes have been entered in before the deadline.
01:04:12.000 And therefore, conditionally, they could potentially be counted when the votes are supposed to be counted in the House and in the Senate.
01:04:20.000 So that's why they did this.
01:04:21.000 My original point, though, was in the New York Times article, they say, well, this vote occurred amid heightened security.
01:04:30.000 And this was the excuse that was used.
01:04:31.000 In certain state capitals, they said, well, we're ratcheting up security and we're locking down the capitals because of COVID, because of potential violent threats from political extremists.
01:04:43.000 We're locking down the capitals either because of the pandemic or violence.
01:04:47.000 We're opening them up tomorrow.
01:04:50.000 In reality, what that was really about, what they're lying about in government, and what the media is helping them cover up is the reason they physically barred people from entering the capitol is to prevent Republican electors from casting votes for Trump.
01:05:04.000 In Michigan, they could not cast conditional electoral college votes for Trump.
01:05:10.000 They could not do what they did in Nevada, Georgia, Pennsylvania, and Arizona.
01:05:15.000 Nevada, Arizona, Georgia, and Pennsylvania.
01:05:18.000 They couldn't do what they did in those four states, in Michigan and in Wisconsin, because the Republican legislature, in combination with the Democratic governors in those states, shut down the Capitol buildings so that the Republican electors physically could not enter the chamber and cast their votes.
01:05:35.000 Now, thankfully, if all of the conditional electoral college votes are counted, there are enough of those that could put Trump over the edge.
01:05:44.000 If they're counted, and they may not be counted if a lawsuit isn't successful, if there's no objection to the official count by a senator, you know, then they won't be counted.
01:05:54.000 But if they are counted, then that means that there would be enough to put Trump over the top.
01:05:59.000 Although, there wouldn't be as many as there could have been because in Michigan and Wisconsin, they shut down the whole Capitol and would not.
01:06:07.000 Physically, they would not let them enter the building to cast their ballots.
01:06:10.000 And it's not like they wouldn't let them in because it was unconstitutional.
01:06:13.000 It's not like they wouldn't let them in because they don't have the authority to cast conditional ballots.
01:06:18.000 There's precedent for this.
01:06:20.000 They kept them out under the guise of pandemic awareness or under the guise of protecting the Capitol from security threats.
01:06:30.000 And like I said, what's more is the mainstream media is making up stories to cover it up.
01:06:34.000 Heightened security, they call it.
01:06:37.000 But that's where we are with the Electoral College.
01:06:39.000 As it stands right now, as I said, Joe Biden has 306, President Trump has 232.
01:06:46.000 And now the next big deadline that's coming up is January 6th.
01:06:50.000 And I've been saying this throughout the show, but on January 6th, there will be a joint session of Congress, the House and the Senate, presided over by the vice president.
01:06:59.000 The vice president, I believe it's under the 16th Amendment, counts the votes in front of the House and the Senate.
01:07:07.000 Now, there's some ambiguity in the law.
01:07:10.000 It merely says that he counts the votes.
01:07:12.000 Some have suggested that the vice president has the authority to choose which votes he counts.
01:07:17.000 Maybe he doesn't count all the Biden votes.
01:07:20.000 There's not a legal precedent.
01:07:22.000 To challenge this or to do this.
01:07:25.000 But some have speculated that because of the ambiguity in the Constitution, the vice president could count what he wants and not count what he doesn't want to count.
01:07:32.000 For example, if he thinks Pennsylvania was rigged, maybe he doesn't read Pennsylvania's Electoral College votes and doesn't count them.
01:07:39.000 And if he doesn't count enough votes, maybe Joe Biden doesn't get 270 Electoral College votes.
01:07:46.000 Maybe Mike Pence will count some of these conditional Electoral College votes cast by Republicans in these states, giving Trump 270.
01:07:57.000 That might be the case.
01:07:58.000 If, for whatever reason, maybe a lawsuit succeeds or an audit is conducted or there's a debate in the Senate and the Senate decides that they should throw out the results of one election, maybe Mike Pence will count enough votes to give Trump the victory or not count enough votes to give Joe Biden 270 Electoral College votes.
01:08:19.000 And if that's the case, then it would move to a contingent election held in the House of Representatives where the vote would be decided by the state delegations.
01:08:28.000 Meaning, each of the 50 states has one vote.
01:08:30.000 That one vote is decided by their delegation, all the representatives from that state.
01:08:35.000 Republicans control a majority of those delegations, and they could award Trump the victory in that way.
01:08:41.000 So, that is where we are today.
01:08:44.000 That is what will happen in the weeks ahead.
01:08:46.000 And I have to tell you, I'm not optimistic that we're going to pull this off.
01:08:50.000 And I know last week I said the lawsuit wasn't going to work, and people said, oh, you're blackpilling, you're blackpilling, no room for blackpills.
01:08:57.000 I'm just telling it like it is.
01:08:59.000 I'm going to fight until the inauguration.
01:09:02.000 And maybe even beyond that.
01:09:03.000 We're going to keep fighting until Joe Biden is sworn in.
01:09:06.000 When he's sworn in, he's the president.
01:09:08.000 I won't recognize him as legitimate, but when he's sworn in, there's really no legal recourse.
01:09:13.000 So I will fight through Inauguration Day on January 20th.
01:09:17.000 But I will tell you on December 14th that I don't think our chances are good.
01:09:22.000 I think we've got a very, very, very slim chance, if any chance, to overturn these results.
01:09:28.000 And that's simply because we don't have enough time.
01:09:31.000 We have three weeks.
01:09:33.000 And three weeks to overcome something that is really unprecedented.
01:09:37.000 There's no precedent for overturning an election at this point in time.
01:09:41.000 So we'll see what happens.
01:09:42.000 There have been new lawsuits filed in every swing state, as well as New Mexico.
01:09:46.000 So there's lawsuits in every state that can still be adjudicated.
01:09:50.000 In Georgia, it looks like they're maybe working on an audit for the votes.
01:09:56.000 And potentially there could be some business happening on January 6th.
01:10:01.000 A senator could object to the ballots being counted.
01:10:04.000 They'll hold the debate, and that could change the outcome too.
01:10:07.000 So, there's a few scenarios, but it seems to me that the most likely outcome is that these lawsuits will continue to be obstructed.
01:10:15.000 The votes will be counted in just the way that they always are on January 6th.
01:10:22.000 There will be no funny business.
01:10:23.000 There will be nothing unprecedented.
01:10:26.000 Mike Pence will simply count all the Electoral College votes that were cast today, and Joe Biden will be inaugurated on January 20th.

01:10:36.000 I've told you many times how frustrating it is because we won the election and we should have been able to stop the steal, but Republicans chose not to do anything.
