01:01:24.000 But tonight it's a really big story because the FBI announced I don't know if they made an announcement, but they confirmed that Hunter Biden has been under investigation for money laundering.

01:01:37.000 That's a really big deal.
01:01:39.000 Because what we had up until this point was suspicions, the laptop, things that were kind of unverified and unconfirmed.
01:01:47.000 We basically knew it was all true, but there wasn't so much confirmation about the evidence or some of these things.
01:01:55.000 We all knew it was there, but I don't think it was ever verified yet.
01:02:00.000 Now we have official confirmation from the FBI that Hunter Biden is under investigation.
01:02:05.000 They launched the investigation in 2019.
01:02:08.000 And the subject of the investigation was money laundering, which is what he's being accused of.
01:02:14.000 Money laundering with Ukraine, China, I think even countries like Kazakhstan and other countries are involved too.
01:02:22.000 But the main ones are Ukraine and China.
01:02:25.000 And the reason why this is relevant and very damning is because, of course, how does this all come to fruition?
01:02:31.000 Well, it's because Joe Biden was the vice president.
01:02:34.000 You know, all of this corruption is happening and being facilitated through.
01:02:40.000 Joe Biden holding the office of vice president.
01:02:43.000 Obviously, he's running for president.
01:02:45.000 So that's the relevance.
01:02:48.000 And we'll talk about that tonight some updates on that situation.

01:02:56.000 And it's amazing, just like every other story, you've got the story itself, and then you've got, I think, what is becoming this always happens.

01:03:32.000 But it really is mind blowing because you still have most of the population that doesn't even know what's going on.

01:03:41.000 They don't know about the media cover up.
01:03:44.000 People just don't even know.
01:03:45.000 Despite the media censorship and suppression being so blatant and overt, most of the population still doesn't even know what's going on.

01:03:56.000 But that'll be our main story.
01:03:58.000 We'll also be talking tonight about some decisions that have been made in various courts about the deadline for absentee ballots.
01:04:07.000 And this is a really important thing before the election.
01:04:10.000 I've been talking for a few months now about how the Democrats are going to try to steal the election.
01:04:16.000 And this is what it's all about.
01:04:19.000 Of course, in this election, you've got more early voting and more absentee voting than in any election ever 70 million people.
01:04:30.000 Have already voted in the election.
01:04:31.000 I think more at this point.
01:04:33.000 But more than 70 million people have already voted, which is probably more than half of all the votes already cast a week before the election, or roughly about a half week before the day of the election, which is unprecedented.
01:04:49.000 And what's really important now, as we move past the election, is the counting of these ballots.
01:04:57.000 The tricky thing, of course, with absentee ballots is they're sent through the mail.
01:05:01.000 The mail is not very reliable.
01:05:03.000 It's not very efficient.
01:05:05.000 And as we know, it's not instantaneous like it is when you're voting in person.
01:05:09.000 So there's a big debate now about how long after the election, if at all, a state can accept these absentee ballots.
01:05:19.000 In other words, let's say your ballot is postmarked November 2nd, it's sent in on November 2nd, but the state doesn't receive it until November 7th.
01:05:31.000 Well, that's four days after the election.
01:05:33.000 Is that counted?
01:05:34.000 Even though it was cast before the election, it's received after the election.
01:05:40.000 Do you count it?
01:05:41.000 At what point do you stop counting the ballots?
01:05:44.000 Is it a day?
01:05:45.000 Is it a week?
01:05:45.000 Is it two weeks?
01:05:47.000 And this is the debate that's happening across all the states, and the most important states it's happening in are the swing states.
01:05:54.000 And I want to go over tonight some of the key rulings that have been made in state courts and in the Supreme Court about how they're handling this.
01:06:02.000 And it's interesting that it's different in every state.
01:06:05.000 In some states, like Wisconsin, you have to have the ballot received by the day of the election.
01:06:12.000 And then in other states, like North Carolina, they extended the deadline to receive the ballots by nine days.
01:06:18.000 So you could have the ballot received nine days after the election and it's still counted.
01:06:25.000 And of course, you would expect this because you have different poll closing times and you have all kinds of different regulations for the elections in all the different states.
01:06:34.000 But what's more is that when the courts are ruling on this, They're ruling in inconsistent ways.
01:06:43.000 For example, in Wisconsin, the Supreme Court rules that the same day acceptance deadline is legal.
01:06:52.000 In North Carolina, the Supreme Court says that the extension to nine days after the election is acceptable.
01:07:00.000 So the court rules in Wisconsin they have to be in on the same day, and in North Carolina they can be extended.
01:07:09.000 Really, about what the state legislatures are deciding.
01:07:12.000 And if the state legislature chooses one way, then that's the way they have to do it.
01:07:16.000 And if they choose another way, they have to follow through.
01:07:19.000 The Supreme Court is against these arbitrary and last minute rule changes, which are being made under the pretext of coronavirus.
01:07:28.000 Well, the pandemic is going on, so now we're going to change all the rules and we'll take your ballots 10 years after the election.
01:07:34.000 It doesn't even matter anymore.
01:07:36.000 The reason why this matters is because the mail in voting is probably going to be favoring Joe Biden.
01:07:45.000 And so if we see a close election in the swing states, And maybe these decisions are revisited, it finds its way back in the courts, they will be invalidating or canceling out a lot of ballots potentially, which may favor Joe Biden, which may swing the election one way or the other in key swing states, and then therefore could swing the entire, the whole election.
01:08:07.000 So we'll talk about that, some pretty interesting stuff.
01:08:11.000 Before we get into our news, though, just want to remind you once again to vote.

01:08:23.000 Register to vote, check and make sure you register to vote, and of course, vote on Tuesday.

01:08:37.000 Then it's the weekend, and then it's Monday, and then it's the election.

01:08:46.000 We may not, but maybe we'll know on Tuesday who the next president will be, or potentially it could go on long after that.

01:08:58.000 So it's really getting down to the wire, but you got to go out and vote because we can win this.
01:09:02.000 I think, depending on what models you're looking at, we may have a really good chance.
01:09:08.000 Florida is looking really good.
01:09:11.000 I've heard that Michigan is looking really good in early voting.
01:09:14.000 More registered Republicans have returned early voting ballots than Democrats in Michigan.
01:09:19.000 That's a big deal.
01:09:21.000 It's looking good in Arizona.
01:09:23.000 It's looking good where it needs to, basically, but we can't win if we don't have.
01:09:28.000 Massive turnout on Tuesday.
01:09:30.000 We have to have massive turnout.

01:09:34.000 You should vote wherever you are, but especially if you're in a swing state, you got to vote on Tuesday.

01:09:46.000 I was a little bit late today because I was blasting off some epic tweets at Madison Cawthorn, and I wanted to show you the tweets because you have to go and like and retweet them right now because we have to ratio Madison Cawthorn.

01:10:10.000 But Madison Cawthorn is this young guy.

01:11:14.000 In any case, the reason why there's all this buzz is because there was a big upset.
01:11:19.000 Everybody expects that the person that the president backs is the person who's going to at least win the primary. 0.97

01:11:27.000 And initially, everybody thought that he might have been the Republican Party's answer to Alexandria Ocasio Cortez because he's young.

01:11:44.000 Oh, well, that means that he is relatable with.
01:11:47.000 The kids, and that also means that he's got his finger on the pulse of the future of the party.

01:11:54.000 I mean, the only thing that's comparable with him and AOC is that he is young.
01:11:58.000 He doesn't have a big social media following, he doesn't use it effectively, he's not very relatable, and he also is not the future of the party ideologically.

01:12:10.000 It would be like if Mitch McConnell was 70 years younger, whatever, 60 years younger.

01:12:21.000 Why this is so important is because if this guy gets in office, it's not the same as just any establishment Republican getting into office.

01:12:37.000 This is another one of these charismatic, fresh faced, compelling people with a compelling story that is in the party as a Trojan horse.

01:12:59.000 Mass immigration, this hyper capitalism, this fixation on small government and low taxes and freedom and the Constitution and all of that, instead of the things that matter, which is closing the borders, not just to illegals, but to legal immigrants, restoring the American family, being actually socially conservative, opposing the revolutionary left, not like meeting them halfway and giving them a handshake.
01:13:25.000 I mean, that is really problematic if somebody with those ideas in that vessel, in that vehicle, now is in Congress and now has that platform to metastasize into a major existential threat for the America First faction in the Republican Party.

01:25:44.000 It says In a pair of decisions welcomed by Democrats, the Supreme Court on Wednesday let election officials in two key battleground states, Pennsylvania and North Carolina, accept absentee ballots for several days after Election Day.
01:26:00.000 In the Pennsylvania case, the court refused a plea from Republicans in the state that it decide before Election Day whether election officials can continue receiving absentee ballots for three days after November 3rd.
01:26:13.000 So, in other words, the Supreme Court didn't make a decision on Pennsylvania.
01:26:18.000 They refused a Republican plea for the Supreme Court to intervene before the election.
01:26:25.000 They may still make a decision after the election, but for now, the Supreme Court won't intervene.
01:26:30.000 In the North Carolina case, the court let stand a lower court ruling that allowed the State Board of Elections to extend the deadline to nine days after Election Day, up from three days called for by the state legislature.
01:26:45.000 So, North Carolina, the laws on the books say that after the election, they can continue to accept ballots up to three days after Election Day.
01:26:56.000 The State Board of Elections revised that without the legislature, without the courts.
01:27:03.000 I think it's five people on the State Board of Elections.
01:27:06.000 They revised that and they said, well, we're going to extend it six days because of COVID, which is honestly BS.
01:27:13.000 They're doing it very shortly before the election.
01:27:16.000 It's not authorized by the legislature, it's not authorized by the courts.

01:27:22.000 And what's more, who's to say that they can't extend it by three weeks or four weeks or whatever?

01:27:48.000 You know, if you mailed it on Election Day, I think it would get there within nine days.

01:27:56.000 If you're that concerned about your ballot getting to the right place, just vote on Election Day or mail it weeks before.

01:28:09.000 The Pennsylvania order appeared to be unanimous, while the North Carolina one was issued over three noted dissents.
01:28:15.000 And those dissents came from Justice Thomas, Alito, and from Gorsuch.
01:28:22.000 All three of them said that it was no good for various reasons.
01:28:27.000 I think Justice Thomas didn't give a reason, and Gorsuch and Alito said in different terminology that the State Board of Elections didn't have the authority to do it.

01:31:01.000 But I'll tell you, as somebody that's been watching politics for like six or seven years, it is not what it's cracked up to be.
01:31:09.000 You know, I watched them with a conservative, supposedly majority, make the wrong decision on the individual mandate.

01:31:19.000 We saw them make how many bad decisions this summer after two appointments?

01:31:26.000 The federal judges, the Supreme Court, they will let you down.

01:31:35.000 It's like you've got Thomas, you've got Alito, Kavanaugh, and then you've got really everybody else.

01:31:43.000 It's certainly nothing that we should be sacrificing other priorities to get accomplished, especially within a short timeline before an election.
01:31:51.000 Anyway, the two cases involve broadly similar issues in Pennsylvania.
01:31:56.000 The question was whether the state's Supreme Court could override voting rules set by the state legislature.
01:32:02.000 In North Carolina, the question was whether state election officials had the power to alter such voting rules.
01:32:08.000 So in Pennsylvania, the state Supreme Court overrode the state's legislature on the deadline that they could accept the mail in ballots.
01:32:17.000 And the Supreme Court of the United States said, We're not going to make a decision.
01:32:22.000 We are just going to refuse the Republicans' plea to have us intervene before the election.
01:32:28.000 Because Initially, the Republicans brought it before the Supreme Court, and the Supreme Court came down 4 4 on the case of Pennsylvania.
01:32:38.000 Barrett got confirmed, and the Republicans brought it back to the Supreme Court, hoping that Barrett would participate, and then they get a 5 4 decision and cut down the deadline before the election.
01:32:49.000 Instead, the Supreme Court just refused to make a decision on Pennsylvania.
01:32:53.000 In North Carolina, the question was whether or not the State Board of Election Officials could change the deadline.
01:32:59.000 And the Supreme Court said that they could.
01:33:02.000 The Pennsylvania case left open the possibility of later action by the court.
01:33:06.000 Justice Alito wrote, I reluctantly conclude that there is simply not enough time at this late date to decide the question before the election.
01:33:16.000 Although the court denies the motion to expedite, says the petition he's writing, the petition remains before us, and if it is granted, the case can then be decided under a shortened schedule.
01:33:28.000 So, in other words, after the election, the Supreme Court may.
01:33:32.000 Look at the Republicans' petition again, and they may decide that the election deadline could not have been moved by the Pennsylvania Supreme Court, and therefore all the ballots received after the original deadline, but that were okay under the amended deadline, would then be scrapped.
01:33:51.000 They would be voided.
01:33:52.000 They wouldn't count.
01:33:55.000 And I don't know if this is clear.
01:33:57.000 Maybe this is confusing, but I just want to summarize for you.
01:34:01.000 So in Pennsylvania, there is a deadline on when you could submit your.
01:34:06.000 When the ballots can be received and still count.
01:34:09.000 Absentee ballots that they can receive and still have them count in the election.
01:34:13.000 The state Supreme Court, the Pennsylvania Supreme Court, overrode the laws on the books and had that deadline extended.
01:34:23.000 The Republicans challenge this and they send it up to the Supreme Court.
01:34:27.000 The Supreme Court is split four to four.
01:34:30.000 The Republicans come back with another petition after Amy Barrett is confirmed, hoping that she'll swing it and it'll go five to four.
01:34:37.000 The Supreme Court refuses to make a decision on their petition.
01:34:42.000 If after the election the Supreme Court of the United States revisits the petition and they decide that it was unconstitutional for the Pennsylvania Supreme Court to override the laws on the books and extend the deadline, then the original deadline will stand and the votes that were received after the original deadline won't count.
01:35:02.000 This is a really big deal because if that decision is made after the election, then all the votes that come in, which probably favor Biden, will be scrapped.
01:35:12.000 So if All the votes are tallied up.
01:35:14.000 It turns out Biden wins Pennsylvania.
01:35:16.000 Well, that very well could mean that Trump doesn't win the election.
01:35:20.000 The maps that I'm looking at, the numbers that I'm looking at, Pennsylvania is almost a must.
01:35:25.000 It's either Pennsylvania or Michigan, but he's got to find a way to make the math work with one of those Midwestern states, maybe Wisconsin, maybe Minnesota.
01:35:33.000 But Pennsylvania is a critical one.
01:35:36.000 Now, let's say that Biden wins Pennsylvania, even after all the ballots are counted on the day of the election and all the mail in ballots.
01:35:43.000 The Supreme Court could come in then.
01:35:46.000 Weeks later, make a decision, void the ballots, it could flip the vote.
01:35:51.000 If it flips the vote in just Pennsylvania, that could flip the entire election.

01:35:58.000 So if it comes down to Trump, you know, 260, whatever the math works out to be, if he wins Arizona, Florida, North Carolina, and then Pennsylvania flips, he's got the election.

01:36:40.000 For example, in Wisconsin, I'm not going to read through all these reports, but basically, in Wisconsin, the Supreme Court ruled that all of the mail in ballots have to be received by 8 o'clock.
01:36:53.000 On election day, which is good.
01:36:55.000 In Michigan, the Court of Appeals in Michigan, not the Supreme Court, but the Court of Appeals, blocked a 14 day extension to receive ballots.
01:37:06.000 So it's good in Wisconsin.
01:37:07.000 It's good in Michigan.
01:37:08.000 Those laws favor us.
01:37:10.000 And in Minnesota, the Court of Appeals also ruled that the ballots need to be in on the day of the election.
01:37:20.000 So that means that in Minnesota, Wisconsin, and Michigan, we're getting favorable rulings, and these are all variously over the Course of the last three to four weeks.
01:37:28.000 But these three Midwestern states are solid.
01:37:32.000 It seems to be that they're tightening up the restrictions there, or they're disallowing, I guess, liberal officials from extending them.
01:37:39.000 In North Carolina, not so good.
01:37:41.000 In Pennsylvania, still remains to be seen.
01:37:44.000 But this is really important stuff because this is, I've been telling you, there's going to be a legal battle after the election.
01:37:51.000 This is what I mean by this.
01:37:53.000 You know, and it's crazy to me, people still don't have like a Functioning understanding of how the election actually is conducted.
01:38:02.000 In other words, people really do believe on some level that the election is national in nature and it comes down to, okay, well, everyone's going to vote and whoever has the most votes wins.
01:38:13.000 But that is not how it works, as we know.
01:38:17.000 And even they don't understand the electoral college.
01:38:19.000 They think that it's like it comes down to the popular vote in the states.
01:38:25.000 Even in the states, it is a relatively new phenomenon that.
01:38:31.000 It's completely tethered to a popular vote contest in a state that that's how the electors are decided.
01:38:38.000 In the first elections in the history of the United States, there were no popular votes, at least not in every state.
01:38:45.000 Some states had popular vote contests, but if I recall correctly, the very first elections, it was just electors going and deciding.
01:38:53.000 The state governments would choose a slate of electors, and the electors would then go and they would decide who would be the president, these electoral college votes.
01:39:04.000 Now, it's been modified over the years, like many other institutions in the US government.
01:39:10.000 And now it's like, well, there's a popular vote in each state, and whoever wants a popular vote then gets all the electors, and it's one to one.
01:39:17.000 That's not always how it used to work.
01:39:20.000 What I mean by this is to explain really how this is going to get difficult, you have to really kind of understand how this works.
01:39:27.000 Because let's say that the election happens, okay, and maybe Wisconsin goes for Biden, Michigan goes for Trump, Pennsylvania, it's very close.
01:39:37.000 There is a variety of outcomes where the Supreme Court could intervene and throw out votes.
01:39:42.000 It swings the vote in a state and the electors go a certain way.
01:39:45.000 There could be a scenario where there's massive voter fraud in a state like Wisconsin, where there's a Republican state legislature.
01:39:54.000 Now, let's say there's a really big dilemma.
01:39:57.000 There's a big contention between the Republicans and the Democrats, between the media and the White House about voter fraud.
01:40:05.000 And Republicans are accusing the Democrats of voter fraud.
01:40:07.000 They're saying this election.
01:40:10.000 Is basically invalid because there's massive fraud.
01:40:13.000 Maybe there's fraud even during the recount or the investigation.
01:40:17.000 Well, the Republican legislature in Wisconsin might just say, we will intervene and through a vote decide the slate of electors for the state of Wisconsin.
01:40:27.000 And even though there's no final determination on who won the popular vote in Wisconsin, we're just going to choose a slate of electors and send them to Capitol Hill and they'll vote for President Trump.
01:40:40.000 I mean, this could feasibly happen.
01:40:42.000 These are the legal machinations that will take place after the election about fraud, about deadlines, mail in ballots, all this stuff.

01:40:53.000 Now, I keep telling people that everyone should vote no matter what because if Trump blows away Joe Biden in a landslide, things like that become more difficult.
01:41:03.000 If Trump wins by a huge margin in one swing state that he needs, well, it's a lot difficult if Trump wins by 3% in Pennsylvania.
01:41:13.000 For there to be a fix, for there to be something outrageous like a state legislature picking their own slate of electors.
01:41:21.000 If there's a landslide in one direction or the other, overall, or in a given state that decides the vote, it diminishes the chances that it's going to turn into a giant circus like that.
