00:08:41.520 but up in D.C., we've got Stephen K. Bannon facing off against the regime, closing arguments expected
00:08:48.320 to come today. Mike Davis, walk us through what's going on the last couple of days of the trial.
00:08:53.760 And where does where does Steve Bannon find himself right now? Well, Steve Bannon had a major
00:09:00.000 legal error happen in his trial where the judge said that he could not present evidence that
00:09:07.040 President Trump asserted executive privilege in this case. President Trump absolutely asserted
00:09:12.320 executive privilege as confirmed by a letter on July 9th, 2022, saying that Stephen K. Bannon cannot
00:09:20.240 cooperate with the January 6th commission because of executive privilege. We've had executive privilege
00:09:24.960 going back to George Washington. What it does is it protects presidential advice between a president
00:09:33.200 and his advisers. And the Supreme Court has held that that applies to former presidents. Former
00:09:41.360 presidents can maintain executive privilege after they leave office. And the Office of Legal Counsel,
00:09:47.760 OLC, the General Counsel for the Executive Branch at the Department of Justice, has an opinion from
00:09:55.120 2007 that outside advisors to the president are protected by executive privilege, meaning the fact
00:10:01.120 that Steve Bannon was a former White House staffer does not mean that he does not enjoy executive
00:10:06.880 privilege. So the fact that this judge did not allow Steve Bannon to put on this defense is a
00:10:13.200 reversible error. It's a legal error. It destroyed Steve Bannon's case. Steve Bannon has no defense
00:10:19.520 now because the judge erred, legally erred, majorly legally erred by stripping this Steve Bannon's
00:10:27.760 ability to put forward this evidence of executive privilege. Well, Mike, what's so confusing to I
00:10:34.160 think the jury and a lot of people watching this is that the letter, though, that was written by President
00:10:39.520 Trump that was delivered to Steve Bannon about executive privilege also was introduced in the
00:10:45.760 trial. And yet the judge came around and we had Viva Fry on. He's doing the podcast over for Post
00:10:50.160 Millennial. And he said that the judge was a lot. He allowed the letter to be introduced, but he said
00:10:55.840 do not worry about the underlying truth of the matter itself. What is going on here with this judge?
00:11:02.320 This judge, I think the judge may realize that he screwed up royally by not allowing Steve Bannon to put
00:11:08.880 forward this evidence that President Trump asserted executive privilege in this case.
00:11:13.440 The government needed this evidence. And so the judge let the government backdoor this evidence
00:11:19.760 at the last minute through this hearsay letter. But the judge did not allow Steve Bannon to
00:11:26.640 call the appropriate witnesses and call the appropriate evidence to put forward the fact that
00:11:32.560 President Trump asserted executive privilege. I think where the judge may have gotten confused is
00:11:37.840 he may have gotten confused whether there is a valid claim of executive privilege as a matter of law
00:11:44.000 versus as a matter of fact whether executive privilege was asserted by former President Trump
00:11:50.960 making it impossible for Steve Bannon to cooperate with the January 6th committee.
00:11:56.240 Well, and this is exactly what what Viva was talking about yesterday, because there's a difference here
00:12:03.360 between whether or not, right, whether or not Steve Bannon, his analysis of the law is not actually
00:12:11.040 what's at question here, because it was his lawyers that went to him that gave him this. This was the
00:12:15.680 advice of counsel, acting on advice of counsel. And so the idea being, though, there is no mens rea.
00:12:21.360 There's no criminal intent on the behalf of Stephen K. Bannon regarding this situation.
00:12:26.720 And so the question, of course, becomes if he had no criminal intent, then how can they say that a
00:12:31.440 crime was committed? That's the entire point. They could have brought in President Trump himself
00:12:36.400 to go on the stand and say, yes, I invoked executive privilege, but they didn't allow any of that.
00:12:41.200 Yeah, I mean, here's the issue. This is where the January 6th commission working hand in glove with
00:12:47.360 the Biden Justice Department made a legal mistake here and violated Steve Bannon's constitutional rights,
00:12:54.240 that they should have resolved this through civil litigation. If there's a dispute between President
00:12:59.600 Trump and President Biden about whether there's a valid assertion of executive privilege as a matter
00:13:05.200 of law, whether it's because they're saying that former President Trump can't assert executive
00:13:10.000 privilege. Well, the Supreme Court's already said that he can back in 1973 in the Nixon case.
00:13:15.600 Or if they're saying that a former presidential advisor that you can't have executive privilege
00:13:21.200 with an outside advisor, well, the Office of Legal Counsel has already determined that you can. But
00:13:26.160 those are issues that should have been resolved in civil litigation in the court instead of going right
00:13:31.760 to criminal contempt. These highly unusual, unprecedented actually, criminal contempt charges against
00:13:39.600 presidential advisor Stephen K. Bannon over executive privilege. This just shows that the
00:13:46.640 the January 6th commission is partisan and out of control. And usually the Justice Department
00:13:53.040 has a check on that, but the Biden Justice Department is working hand in glove.
00:13:57.600 Now, Mike, we're down to one minute. We know closing arguments are today. Do you expect a verdict
00:14:02.160 today? Final thoughts. Do you expect a verdict today? The trial for Stephen K. Bannon?
00:14:06.240 Yeah, I expect the jury to find Bannon guilty because he was not able to put up a defense.
00:14:10.800 The issue is, is this is going to go up to the D.C. Circuit, which is stacked by Obama liberals.
00:14:15.200 And so then it will have to be resolved by the Supreme Court if the Supreme Court decides to take this
00:14:19.920 case and correct an egregious legal error that affects every president going forward.
00:14:25.520 Right. Every single potential president now focused on this. Is executive privilege allowed in this

00:18:13.280 update? Good morning, Jack. Morning, Kevin. So the situation as of yesterday, remember when,
00:18:20.940 when we were broadcasting right outside the official presidential residence was that, um, the
00:18:27.520 speakers of both the lower house and the upper house of the Italian parliament, you can just actually
00:18:32.580 see the, the, the lower house, the Italian equivalent of the house of representatives just
00:18:37.160 over, just over where my finger is there. That's it there. Um, both speakers went over to, to the
00:18:42.180 president. There was basically no conversation, Jack, about trying to get a new government scratched
00:18:48.600 out to last through until the projected, uh, general election in spring of next year. So yesterday
00:18:56.400 evening, last night, president Sergio Mattarella, uh, signed the official decree dissolving parliament
00:19:03.140 and calling fresh elections for September the 25th. So now instead of taking off a long summer, which
00:19:10.340 Italians just love doing, the whole political establishment is now going to be in maximum
00:19:15.320 fighting gear right through the summer, all the way through to the end of September. And we're going, I'm going to
00:19:21.760 give now for the war room three things that I, uh, three factors that I think are going to be quite
00:19:26.800 important over the next couple of months. The first is the inter-party wrangling. There's a coalition
00:19:32.440 system here, uh, thanks to the appalling, uh, constitute Italian constitution. So you never really get
00:19:39.200 a strong, stable government, but they're just packed together parties. I think that this actual, uh,
00:19:46.380 parliamentary mandate, which was dissolved yesterday had three governments in four years and that's
00:19:51.200 par for the course. And there've been 67, in fact, governments since the, the, the end of the
00:19:56.900 second world war, 70 or so years. So there's going to be the wrangling between the parties, both before
00:20:03.040 the elections and then after the elections. That's going to be instrumental to decide what the color of
00:20:09.060 the new government is going to be like. In addition to that, the, the, the sword of Damocles hanging over
00:20:15.600 that discussion is something called the, the PNRR, which is the 750 billion euro bailout from the
00:20:25.980 European union. Obviously it's European taxpayers' money that's paid over to Brussels. Brussels then
00:20:30.820 hands it back out. The largest recipients of this PNRR fund is actually Italy. Um, and they're going to
00:20:38.260 get, uh, 191 billion euros. Um, Italy's already had the first tranche of 20 billion. Um, so there's
00:20:46.500 a lot more to get. The question is, and this is the, the, the, the glue, if you like, that kept the
00:20:51.740 Draghi government held together is will the Italian government and having elections in the end of
00:20:58.480 September has already thrown into jeopardy the, the autumnal budget debate. Will this shock to the
00:21:06.020 Italian political system to put the PNRR now in doubt, which is very much needed? It's, it's,
00:21:13.380 Italy's bankrupt, uh, basically. So if this money comes through, it'll be able to call forwards a
00:21:19.560 little bit longer. That is really the big question on everyone's minds. And it's going to, as I say,
00:21:24.200 color the elections going forward. The third factor, Jack, I would outline, um, very briefly is the
00:21:30.800 situation now with Giorgia Meloni, who is the leader of Fratelli d'Italia, the brothers of Italy,
00:21:38.400 which according to the polls is now the leading political party. Now, Giorgia Meloni was, um,
00:21:47.240 unusually for a center white political party, the most vociferous, one of the most vociferous
00:21:53.640 voices inside the coalition governments behind Mario Draghi's position with regards to Ukraine.
00:22:01.060 Um, the other two center-right parties that are allied to her, which are Silvio Berlusconi's party,
00:22:08.980 um, and, um, Matteo Salvini's party, they, they took a far more hesitant approach, having strong
00:22:16.000 personal relations with Vladimir Putin. Giorgia Meloni, instead, she had a, she was very much behind
00:22:22.920 the, the Draghi position. This is also, therefore, another dynamic, as I, as I'd mentioned yesterday
00:22:28.740 and a few days before, with, with this government having fallen now, and it was the most vociferously
00:22:34.260 pro-Zelensky government in the European Union, with this government now falling, the question is,
00:22:40.680 which of the other European Union countries will now step forward and take that place? Bearing in mind
00:22:47.260 that what had happened in Sri Lanka a few weeks ago now happened here. These are both direct cause and
00:22:54.500 effect consequences of the, of the Ukraine war. A government in the European Union has now fallen
00:23:02.100 because of this issue, because of the catastrophically high prices and the cost of living crisis. And once
00:23:08.320 one government falls, and Mario Draghi was the epitome of the European Union establishment, having been
00:23:13.940 president of the European Central Bank, when a country, when a government like Italy falls with,
00:23:18.900 with that government, with all the establishment support behind it, other member states are asking
00:23:23.320 who's next. And I'll simply say that I think France and Germany are two countries that are going to be
00:23:28.780 extremely cautious about, um, about pursuing a radically pro-Ukraine position right now. And I'll just
00:23:37.740 close, Jack, with the, I have been able to confirm what I had suggested yesterday, that at the same
00:23:43.560 time, Mario Draghi was formally giving his resignation to the president of the Republic, Russia was
00:23:50.260 augmenting its gas supply by 71% to, uh, to Italy. So there's also this other dynamic, uh, in play to do
00:24:01.320 with the energy shortages. Well, so Ben, what you're saying is essentially, we're starting to see a
00:24:08.140 domino effect here. And that the countries that are most vulnerable in this situation, we now see
00:24:14.780 that Russia is able to use, and this is exactly what President Trump predicted, they are able to use their
00:24:20.920 control over these gas taps to get the governments that they want across Europe. This is also why you're
00:24:27.780 seeing European Central Bank. They just said they got to come out. They're raising rates. The IEA chief says
00:24:33.220 they're cutting gas 20% across Europe. They've got to contract because all they were doing is settling
00:24:39.840 down on these green policies. They're pushing the Green New Deal type policies. That's why we saw the
00:24:43.820 government in Netherlands facing the farmer uprising, the Dutch. Have they put themselves up? Ben, what is going on?
00:24:50.580 Are they going to continue to push this policy of continuing to exacerbate the situation in Ukraine?
00:24:58.220 To go toe to toe with the Russians? Because we just saw, by the way, U.S. Treasury just said that
00:25:02.700 they're going to start floating Russian bonds again. They just put that out today. So the question is,
00:25:07.440 where'd the sanctions go? What was that? What were the sanctions all about? If you're getting back
00:25:11.300 in with Russian bonds, now we're turning it around. They have no other choice at this point than to go
00:25:18.900 back. They're running over to Azerbaijan. They're running to Qatar. They're running all over the place.
00:25:23.400 You can't turn on a nuclear facility in a week. They have no choice. And Ben, I said this the other
00:25:31.440 day. I think Germany, Scholz, is going to get to the same point when he realizes that they don't have
00:25:36.640 a choice. But they do have two pipelines called Nord Stream 1 and Nord Stream 2 that are already
00:25:43.040 built. Yeah, yeah, Jack, look, you're absolutely right. I think with the fall of the government here
00:25:48.580 in Italy, in chancellors across the European continent, political leaders are just realizing
00:25:54.680 now that the show's getting real. And if, yeah, politicians are opportunists, sure, they'll put
00:26:01.640 their own people on the back burner and support other countries at the drop of a hat. But when it,
00:26:08.520 when the prospect of losing office just comes up and hits you in front of your nose, then that becomes,
