Bannon's lawyers argue that the government overstepped the bounds of executive privilege in this case, and argue that only Congress can decide whether or not executive privilege is valid. But the government argues that the question is a matter for the courts to decide.
00:00:00.000You have new reporting on how the second term that Donald Trump's preparing for could even be worse.
00:00:08.320Joe, what I have today is the first two part series I've been working on for months,
00:00:12.700which shows that there is much more detailed work and planning going on for a second term Trump administration than has been previously reported.
00:00:21.880Obviously, Trump himself remains obsessed with the 2020 election, as you've outlined, calling officials trying to overturn it.
00:00:29.220But what he's done quietly is he's empowered some of his key trusted former advisers and senior officials in his administration.
00:00:37.340And he's funded his wide money to their groups. What they're doing is quite vast.
00:00:42.560I lay down the piece. It can't easily be summarized on TV, but it's got multiple elements that the core of it is they're already building databases of names,
00:00:52.140potential personnel who they're vetting as being loyal to Donald Trump and committed to his America first ideology.
00:00:59.880They've got hundreds of names already, multiple databases, and they're working in loose coordination with each other.
00:01:07.200There's also a whole other dimension which is based around a legal strategy, which most of your viewers probably haven't heard about.
00:01:15.460It's called Schedule F. This was a plan that Trump Trump's team developed during his administration in complete secrecy.
00:01:24.940They issued it as an executive order 13 days before the election.
00:01:28.900It got media coverage at the time, but was buried in the crazy chaos after the election.
00:01:36.620It allows a president to reassign tens of thousands of federal career civil servants in a new category that they're calling Schedule F.
00:01:48.660And what that allows them to do is it removes all their employment protections.
00:01:52.460It allows a president to fire them and replace them with loyalists.
00:01:55.720So if you think about that, what the preparations that are going on right now, Biden rescinded that order immediately.
00:02:02.840But Trump's going to put it back in straight away if he gets back in.
00:02:05.980And this is why they're building such a huge labor force is because they're not intending just to replace the 4,000 political appointees that are normally replaced every administration.
00:02:16.120They're looking at more beyond that career civil servants who typically continue from one administration to the other.
00:02:23.120OK, David Schoen is going to talk here in a second about exactly what the jury heard.
00:02:27.840They came to their conclusion, right, about what was put on in the in that courtroom.
00:02:32.400David Schoen is going to talk to you about our appeals process.
00:02:34.400But listen, in the closing argument, the prosecutor missed one very important phrase, right?
00:02:42.380I stand with Trump and the Constitution, and I will never back off that ever.
00:02:47.360This didn't seem like a misdemeanor from hell, Mr. Bannon.
00:02:56.500Have you ever, in another case, seen a judge six times say in the case that he thinks the standard for willfulness is wrong?
00:03:06.500He said it doesn't comport with modern jurisprudence.
00:03:09.400He said it doesn't comport with the standard, the traditional definition.
00:03:13.560But he said he feels his hands were bound by the by a 1961 decision.
00:03:18.960You will see this case reversed on appeal.
00:03:20.760You will see all of these resources, three federal prosecutors, four FBI agents from misdemeanor being wasted.
00:03:29.580You cannot find another crime in which misdemeanor or felony in which a person is convicted without believing or knowing or having reason to believe he or she did anything wrong.
00:03:42.500That's the standard that was applied in this case.
00:03:44.440The government said from the start, the standard they were urging on the court was, was Bannon subpoenaed and did Bannon show up?
00:03:53.000They won the case maybe in closing today.
00:03:55.880They lost their appeal in closing today.
00:03:58.600The overreaching by the government in this case has been extraordinary on every level.
00:04:03.260But shame on this office of the United States Attorney's Office and the Department of Justice for how far it went in this case.
00:04:10.720They put forward an argument today that completely tears asunder constitutional principle of separation of powers.
00:04:17.940They argued to the jury today that when a person gets a subpoena and executive privilege is invoked, it's for Congress to decide whether the executive privilege is valid and how broad it is.
00:05:04.060It's not for Congress to decide that it's not valid.
00:05:06.660Secondly, from the willfulness standard that the judge felt compelled to apply in this case, in which he said he's inclined to think is wrong, again, all they had to prove was that he didn't show up.
00:05:19.960That can't be the standard in a case, especially in a case that holds the potential for a jail sentence.
00:05:51.400The Justice Department decisions, as we've said in the past, their official position has been in the past, that former and current executive branch employees, when they're served with a subpoena and executive privileges invoked, cannot be compelled to appear.
00:06:05.080And in any event that this statute cannot be applied against them.
00:06:08.440There are issues for appeal in this case that are astounding.
00:07:52.360By the way, I want to thank the jury, D.C. working class and middle class people.
00:07:56.900They took the entire week off for a misdemeanor that I think they were in the court for maybe a day, day and a half max or five days.
00:08:03.680I want to thank them and respect their decision, given the evidence and the information they were presented in the room.
00:08:11.600It's a misdemeanor, and it was very restricted.
00:08:13.520This is why there was so much convoluted in and out, and the judge did a great job.
00:08:17.640I'm not questioning the judge did a great job of trying to balance everything.
00:08:20.100But today in the closing argument, I will mention or opine that I think it was the U.S. attorney popped up, I don't know, six, eight times, and during my attorneys, after not putting on a defense, the closing argument was kind of like, hey, you get to interact, you know, you get to bond with the jury.
00:08:37.200She's like cutting him off every 30 seconds.
00:08:39.040I am going to be on Tucker tonight at 8 o'clock.
00:08:41.760I think at the top of the show, we'll get to more of it.
00:08:57.180One of the most important things, and I really wanted to get this out, Jonathan Swan, who's one of the smartest young men in this town and a reporter, this is what the fight is about.
00:09:06.160What happened in the federal courthouse today, and look, I respect the process.
00:09:38.840So all the guys you see, Shifty Shift is going to be stripped of all his committee assignments.
00:09:42.280People have already made the committee of that.
00:09:43.420But Fang Fang Swalwell is going to be investigated deeply about his betrayal of us with the Chinese, you know, being honeypotted by a Chinese intelligence asset, Fang Fang.
00:10:26.240And I've been putting articles up on Getter of how it's had a massive impact across the entire environmental area, energy area, even deeper.
00:10:33.240However, I said when this happened that the EPA versus in the West Virginia case, I believe for what we're trying to accomplish is even bigger than Roe v. Wade, as big as that is.
00:10:56.880Now, today, you saw with all these different think tanks, you see so many of these characters on here.
00:11:01.540Russ's vote, Peter Navarro's name, Cortez is very involved, is the actual action plan.
00:11:08.220Remember, I gave that speech to Jeff Shapiro's group a couple of months ago over the Capitol Hill Club, and they went nuts.
00:11:14.760I said, we're building the shock troops.
00:11:16.760That's the 4,000 political appointees needed for Trump's second term.
00:11:22.420There is a deep plan right now for Trump's second term.
00:11:26.160When in November, start to basically stop the Biden administration dead in their tracks, do the massive investigations of the FBI, the Justice Department, Fauci, Hunter Biden's laptop, all of it.
00:11:38.480And really start the second term then with stripping these guys and focus and investigations.
00:11:45.360While we build a massive landslide, and remember the Senate, the cycle is so great for the Senate, build a massive landslide in 24.
00:11:54.740But in 24, correct the mistakes that we had in personnel, as Cortez and Navarro know, that we didn't have the bodies available, not ready to what they call landing teams, beachhead teams, inside teams.
00:12:09.560Those 4,000 are going to be already selected.
00:12:13.580Not just that, with what they call Schedule F, there's a whole new concept of how to start to clear out.
00:12:18.540But draining the swamp is a cute term.
00:13:14.960The tip of that spear, and I'm going to have an article about this out next week.
00:13:19.700The tip of that spear is this America First Policy Institute, which has become basically a dumping ground and haven for a lot of the failed people from the first administration,
00:13:31.280the rhinos, the disloyalists who let Trump down.
00:13:34.320Steve, you may well remember when the RNC came in and took over on November 9th, the Trump war room, what they wound up doing.
00:13:45.780But I worked a lot in the days leading up to the inauguration with the personnel people.
00:13:53.060And we had resumes coming out of our ears of Trump people.
00:13:57.220And those things got put in the trash can by the Reince Priebus crowd.
00:14:02.340And we're going to have to be really vigilant.
00:14:05.480So Jonathan Swan needs to take a second look at who's putting who into what under the name of Trump,
00:14:12.680because there's going to be a lot of posers there, Steve.
00:14:15.120Cortez, Cortez, I knew we'd be pushing this out.
00:14:18.960And Navarro really wants to go the bloodletting right away.
00:14:21.980This is, is that the Sicilian blood in you, Navarro?
00:14:34.900Yeah, take a few days off at the beach and you lose your mojo.
00:14:38.600I think, I think, I think I'm going back and watch some of the committee tapes and just check out, maybe check a few checkbox, a few names.
00:14:45.220Okay, Cortez, Navarro, we got a packed show.
00:14:48.420The Army of the Awakened here in the war room.
00:15:01.740When your nation's supposed authority on economic policy completely misses the flashing red lights of impending inflation.
00:15:10.620Now, Treasury Secretary Janet Yellen has finally admitted, quote,
00:15:14.260There's been an unanticipated and large shocks to the economy that have boosted energy and food prices and supply bottlenecks that affected our economy badly that I didn't, at the time, fully understand.
00:15:28.980You know who understands the real threat of inflation?
00:15:31.920People who invested in gold and silver with Birch Gold Group.
00:15:36.280They're protecting their savings from a highly turbulent economy by diversifying their 401k or IRA into gold, physical gold.
00:15:47.160It's not too late for you to take action now.
00:15:49.060Text Bannon, B-A-N-N-O-N, to 989898 and get a free info kit on diversifying and protecting your savings with precious metals.
00:16:00.460With an A-plus rating from the Better Business Bureau, countless five-star reviews, and thousands of satisfied customers, text Bannon, B-A-N-N-O-N, to 989898 and get the real help from Birch Gold today.
00:16:14.500Again, text Bannon to 989898 to claim your free, no-obligation information kit on protecting your savings with gold.
00:16:23.780It's Hispanic Americans flee in droves from the radicalism of Joe Biden.
00:16:30.280Let's look at the numbers in a chalk talk powered by Getter.
00:16:33.200This latest poll from Quinnipiac got a lot of attention, only 19% approval among Hispanics for Joe Biden, by far the lowest of any demographic group.
00:16:43.120But that number is even worse if it's viewed in historical context, because when Joe Biden took office,
00:16:49.140he had enormous goodwill from the Latino community in America, a plus 39% approved disapproved ratio from plus 39 to minus 51 for a net move of minus 90%.
00:17:02.720As it turns out, an open border, out-of-control inflation, and soaring street crime, they don't form the recipe for winning support from bad hombres.
00:17:12.240Okay, Cortez, I got Cortez, and I've got Navarro, also reminding you of MyPillow.com, promo code WARROOM.
00:17:22.320I think I'm tracking down Mike Lindell. Mike Lindell is going to be on tomorrow, tomorrow's show.
00:17:27.780We've got so much going on. Lindell is also going to be at CPAC. We're going to talk about that tomorrow.
00:17:32.200Also in Wisconsin, breaking news, the head of the committee up in Wisconsin says she now wants to decertify the Biden electors, Robin Voss.
00:17:42.420We don't care about Robin Voss. We're going to decertify these electors.
00:17:45.420Before I get into the economy and the polling and the Hispanics, I got Navarro and Cortez, the touchdown twins here, the best.
00:17:52.420First, Cortez, you've got some – Jonathan Swan is correct directionally, and people want to understand this is a seminal article.
00:18:03.200This is a seminal article because – and the only thing – you've got the courts with the deconstruction of the administrative state, and now you've got an actual operating plan of the 4,000.
00:18:14.700Remember, the 4,000 political appointees, and Navarro can tell you because he was there right next to me, we didn't have 4,000, right?
00:18:20.920We didn't have 1,000. We had 1,500, and 1,000 of those has got to be Senate-confirmed, and we've got some, let's say, folks in there that maybe are not top of the agenda.
00:18:28.940And you can see a lot of those folks just cut the committee on and see this testimony.
00:18:33.600Hey, just look at it with your own eyes.
00:18:35.860Cortez, give me your assessment of that first, of what Navarro is saying and what has to happen here.
00:18:40.460And it's all in the early stages, but at least there's an operating plan, Steve Cortez.
00:18:46.220Right. Well, listen, first of all, regarding the good Dr. Navarro, wow, shots fired, okay?
00:24:52.440It's the first time, other than the spring lockdowns in 2020, Steve, this is the first time that composite PMI has been below 50 since 2009.
00:25:26.880It's not narrative and spin from the Federal Reserve or from Janet Yellen, who should have resigned yesterday.
00:25:32.340It's not people telling us it's transitory.
00:25:34.200This is an economy that is absolutely falling off a cliff.
00:25:38.820And the data and numbers continue to back this.
00:25:41.100Now, that's purchasing managers, so that's at the company level.
00:25:43.720If we look at the consumer level, we know from the University of Michigan Consumer Sentiment Survey that consumer confidence in the United States, Steve, is at an all-time low for a survey that goes back to the 1950s.
00:25:55.880Think of all America has been through, all of the challenges that we have faced as a country since the 1950s, all that we faced in the 1970s with the first round of stagflation.
00:26:05.680We have another round, of course, now.
00:26:07.3809-11, the credit crisis, all the challenges America has faced.
00:26:10.940Consumer confidence has never been lower.
00:26:13.220But to connect this conversation, and that's the PMI report out today.
00:26:19.640Composite meaning combining manufacturing with services.
00:26:22.800Services are falling even faster than manufacturing.
00:26:25.200And that's particularly important for the U.S.
00:26:26.380But, Steve, to connect this economic situation and this predicament we're in, this quagmire, to the political discussion that we were just having, here's what's vitally important.
00:26:36.540When we win, and we're going to win in 2022 and 2024, we cannot have vipers within the tent anymore.
00:26:45.480And we certainly cannot have unelected bureaucrats in Washington, D.C. from the administrative state stymie the will of the American people.
00:26:53.500We cannot have that anymore in part because we simply can't financially afford it.
00:27:13.740Peter Navarro, I know you've got to bounce.
00:27:15.340Give us your social media, particularly how you get the new book.
00:27:18.260Real P. Navarro on Getter, the Twitter killer.
00:27:20.620Taking Back Trump's America is really important to read because the first half of that book deconstructs all the personnel mistakes we made during the first term.
00:27:31.560And by the way, Steve, Mitch McConnell had a lot to do with when we actually had good Trump people.
00:27:37.820We couldn't even get them through confirmed in the Senate.
00:27:41.140So Taking Back Trump's America on Amazon.
00:27:43.960And Steve, we'll see you at the beginning of the week.
00:28:17.440I got Richard Barris, Cortez, Schultz, Stern next in the war room.
00:28:24.020With the recent rulings from the Supreme Court, it's worth mentioning that these wins didn't happen on their own.
00:28:30.220It took the support of companies like Patriot Mobile, who have passionately fought on behalf of the unborn in your constitutional rights.
00:28:37.860Patriot Mobile is America's only Christian conservative mobile phone provider.
00:28:42.620They have been on the front lines fighting for your values.
00:28:46.500This is why Patriot Mobile is different from every other provider out there.
00:28:50.780Inflation has made it really hard on many Americans.
00:28:53.400Thankfully, Patriot Mobile has plans for almost any budget, and they offer the same nationwide coverage as all the major carriers.
00:29:00.740So you get the same great service, plus the knowledge that your money is going to a company fighting for the sanctity of life, religious freedom, and your Second Amendment.
00:30:29.120Steve Cortez, walk me through the collapse of the Hispanic community's support, not just for Democrats, but particularly the illegitimate Biden regime.
00:30:38.240And then we're bringing in Richard Barris.
00:30:39.740The president of the United States, Donald J. Trump, is en route to Arizona, where there's a massive rally tonight with Carrie Lake and Blake Masters, MAGA, America First, all of it.
00:30:49.380Tell me about the Hispanic community, the polling number, sir.
00:30:53.780And just quickly, before I address the issue of bad hombres, since you played CNN there, my former employer, by the way, a lot of people out there probably can't believe that.
00:31:00.940My former employer, CNN, they should send you a fruit basket because they're going to get to replay that show and actually get good ratings tonight only because you got convicted.
00:31:10.000But let me also say this, you know, having watched that show on Sunday night, the first time around, you know, they intend that to be a hit job.
00:31:16.940But that's the kind of hit job that I suspect Steve Bannon somehow actually paid for.
00:31:21.000I mean, because it made you look so gangster and so good.
00:31:24.020But listen, let me get to enough of CNN.
00:31:37.060Yeah, I think we had 30,000 people and that, you know, that was just Steve Cortez.
00:31:40.320I was in a hotel room opining after the show and, you know, and really taking apart all of their errors and omissions in their show, which is, you know, probably a decent percentage of what CNN itself had on that night.
00:31:51.440So I won't do it again tonight, but, you know, it was it was great.
00:31:54.620But listen to this bigger issue, of course, of Hispanics in America who are rallying to the patriotic populist movement and fleeing away from the increasingly radical Democratic Party that has made Hispanics in this country effectively into political orphans.
00:32:09.880The news lately has really been astounding.
00:32:12.420The Quinnipiac poll, as I pointed out in my chalk talk, Quinnipiac poll shows only 19 percent approval of Joe Biden among Hispanics, by far the lowest of any demographic in America.
00:32:23.060But I think it's even worse if you look at it in context, because Latinos gave Joe Biden the benefit of the doubt.
00:32:43.120Now, people like you and I, Steve, who are in this business, right, of political operatives, campaign people who who devour polling and study polling.
00:32:51.080We know that kind of implosion is almost impossible in a year and a half.
00:33:00.760And we need to talk about them and focus on them.
00:33:03.680The Democratic Party has become so radicalized and is such a secular humanist nihilist movement that it is no longer welcoming to anybody who has any sense of traditional beliefs.
00:33:15.320Certainly not anybody who is a church going or, you know, Christian Christianity believing adherent.
00:33:21.480They are simply totally unwelcome in the Democratic Party.
00:33:25.240And Hispanic community, largely Catholic and evangelical, simply doesn't fit there culturally.
00:33:30.040And then secondly, of course, the economic part.
00:33:32.320And I think this is especially important, Steve.
00:33:34.280Joe Biden has been misery for entrepreneurs in this country because small business is being particularly hammered by Biden's inflation.
00:33:41.440Hispanics are thankfully the most entrepreneurial demographic in America.
00:33:59.480And this is yet another reason, Steve, why as dark as things are right now in this country, and they are terrible, including what happened to you today in that courthouse in Washington, D.C.
00:34:07.480And I'm honored to be your friend and proud to fight alongside you for this country.
00:34:11.560But one of the reasons, despite the darkness, that I am so optimistic about the long term future of America, one of the main reasons is what is going on among Hispanics.
00:34:19.860This army of the awakened among the bad hombres.
00:34:22.600By the way, because they understand that the family is the cradle of liberty, African-Americans, Asians, and Hispanics.
00:34:31.560That's our building blocks right there.
00:44:19.660And that change starts with you and your wallet.
00:44:21.860That's why I'm proud to partner with Public SQ, the largest network of patriotic, freedom-loving businesses and consumers our nation has ever seen.
00:44:31.040Public SQ is the first app to connect freedom-loving Americans with their local community and the businesses that share their values.
00:44:38.320Whether you want to support a restaurant that only buys from local farms, a coffee shop that took a stand against COVID mandates, or a bank that could never cancel you for your political views, Public SQ is your guide.
00:44:51.700There's also interactive, sensor-free community groups where you can connect with other local members.
00:49:28.620Sir, you have more than 3,600 migrants that they have been right here waiting outside, camping out.
00:49:34.160And, you know, in human conditions, this is because of the Biden administration.
00:49:37.400And the consistent, you know, incentivization of open borders.
00:49:39.900Now, this massive group, a couple of days ago, they rushed the National Guard again to go all the way to the front gate to exercise and to demand that the Mexican authorities give them the humanitarian permit or the multiple migration form.
00:49:53.060And now, because of that, a day later, they blocked the streets, thankful to the National Guard that they cleared that.
00:49:59.540And now they are planning on a caravan that possibly is going to leave, not tomorrow, but possibly on Monday, sir.
00:50:05.760This is an inconsistency of the Mexican government, of these open border policies that the intelligence agency by Mexico, they just said that the more than 1,200 people are entering irregularly and undocumented on a daily day basis, sir, and it's going to exacerbate.
00:50:20.120And it's going to continue as it's a massive wave, caravan after caravan after caravan.
00:50:24.840This is just an inconsistency and a complete disaster and mockery by the Biden administration, sir.
00:50:30.500The seven families that own Mexico and Mexico say those seven billionaire families don't care about the Mexican people.
00:50:35.940Tell me real quickly, the Mexican people that are in the middle of this flow, what's happening to them, sir?
00:50:42.840Well, a community, sir, it was going to go one on one two days ago against the migrants that were picking up stones and sticks because the National Guard and the authorities of Mexico, they did not want it to listen to them.
00:50:52.840And they were going to go head on because they were blocking the streets.
00:50:55.320But later on, the National Guard cleared the whole scenario.
