00:28:36.000We want to know, I'm hearing that it might have been blunted and a lot of that work and a lot of the thanks as to what you guys have done at Heritage.
00:28:48.000So about a couple of weeks ago, Senator Tillis and Senator Sinema announced they had reached a framework agreement on a massive amnesty deal.
00:28:57.000They never even got around to rolling out the tax because this thing got slaughtered from all sides.
00:29:01.000We were happy at Heritage to play a big role in it.
00:29:04.000Basically what they wanted to do was they announced amnesty for about $2 million.
00:29:09.000If you kind of read into their framework, it would have gone up to $10 million.
00:29:12.000So this is the biggest amnesty in American history by far.
00:29:15.000And then they were purporting to have some small border security fixes.
00:29:18.000But what in reality they actually aimed to do was set up massive illegal alien welcoming centers at the border.
00:29:24.000So basically it would work in the future like this.
00:29:26.000An illegal alien would come to the border, immediately be processed in one of these massive facilities and then be dispersed around the country.
00:29:32.000So they thought this was a border security fix, wasn't anything close, wasn't a serious effort.
00:29:36.000Credit to a lot of the outside groups.
00:29:38.000Our partners at Federation for American Immigration Reform, FAIR, Numbers USA, America First Policy Institute, et cetera.
00:29:45.000Everybody smelled this as being an absolute fraud all over it.
00:29:49.000The grassroots lit up the phone lines and it never got out of the gate.
00:29:53.000Tillis couldn't get one other Republican even say something nice about it.
00:29:56.000So much credit for people holding the line.
00:29:59.000By the way, that's all those phone calls and this is what makes it happen.

00:30:24.000Right. So the comparison I use right now is the border is a terminally ill patient on life support by getting rid of Title 42.

00:30:38.000It's going to be a disaster there. I'm getting intelligence reports that some facilities in Mexico are who've been holding tens and tens of thousands of people due to Title 42.
00:30:48.000Are just going to release them and surge them to the border. We're going to see a wave unlike anything we've seen.
00:30:52.000And keep in mind, we've been living month after month with record numbers we've never seen before.
00:30:56.000So we're going to just this crisis is going to absolutely explode right over over Christmas.
00:31:02.000And what can congressional leaders do? Well, it's pretty obvious, right?
00:31:05.000You don't fund this stuff. You hold the administration accountable, but they're doing the exact opposite here in the swamp.
00:31:10.000There's a big omnibus bill that they're trying to pass that would give the Department of Homeland Security billions of dollars to continue implementing these things.
00:31:17.000Why are they doing such a thing? It would take away the ability of next Congress, the incoming folks that were elected to actually assert some leverage through funding.
00:31:26.000The only reason this is happening is because Senator Shelby, who's the Republican appropriations chair, has enough pork in there that he can retire on his nice little sendoff gift to himself to get some more buildings named after him in Alabama.
00:31:38.000It does no good for the American people.
00:31:41.000By the way, when you did this thing, when you did this study with with the NGOs, I think 35 and had the cell phones, you see how they're going all the way through the country.
00:31:50.000So this is every town's a border town. All those NGOs essentially are primarily funded through the U.S. government through this omnibus bill. Is that correct, sir?
00:32:02.000Correct. I think the number 720 billion last I checked.
00:32:05.000They want to give this money to FEMA to then grant out to these NGOs.
00:32:09.000That is a lot of money. I mean, you could solve this border crisis for 50 cents of kinkos if you just printed the executive orders and change the policy.
00:32:17.000This is a policy made crisis. It doesn't take money to fix.
00:32:20.000It takes keeping Title 42, remain in Mexico, actually turning back on ice because they shut down ice.
00:32:27.000So illegal aliens know if they get into the interior, they're not getting removed.

00:33:17.000Christina, breaking news out of Maricopa County.
00:33:20.000A lot of people got very excited when they first saw this.
00:33:23.000Walk us through exactly what the judge said today and how big a deal is this?
00:33:28.000Right. So in the complaint, Carrie Lake requested access to the ballots to be able to inspect them.
00:33:36.000That's actually part of the statute under which she sued the election contest.
00:33:40.000And according to the statute, she has a right to inspect a sampling of the ballots.
00:33:45.000It's not a lot. I want to say it's maybe 50.
00:33:47.000It's a very small number, but it's a sampling.
00:33:49.000And each side gets to appoint someone to go and inspect altogether.
00:33:53.000You know, it's all done in accordance with the statute.
00:33:55.000The judge granted that request today, which is good.
00:33:59.000But I would say it's basically just in line with the statute.
00:34:02.000So it's a good indication in the sense that he followed the law and did what the law requires.
00:34:07.000But it's not he didn't have to make an opinion or weigh the facts to make this decision.
00:34:13.000It was written in black letter law. He followed it. They get to inspect.
00:34:18.000And then on Monday, the 19th, they have a motion to dismiss the defendants.
00:34:23.000Maricopa County, Katie Hobbs and the remaining defendants want to file motions to or have filed motions to dismiss.
00:34:29.000Carrie Lake's team is responding to them tomorrow.
00:34:32.000And then those will be heard on Monday.
00:34:35.000And I know if that motion to dismiss gets granted, then the ballot inspection obviously becomes moot.
00:34:43.000So it's kind of a weird order in which these things are going.
00:34:48.000But because it's such a jammed timeline, the judge said, I know you and I talked about this, but the judge said, recognizing that defendants are confident in their position, the court nonetheless cannot put off all pretrial discovery on the expectation that the case will be dismissed.
00:35:04.000So he's basically saying, I know defendants are very confident.
00:35:07.000They think that this case is going to get dismissed, but I can't delay it just because you think you're going to win.
00:35:11.000So here's the here's the point, though, is that this is the first time even if you go to appeal, this is a big deal that you actually get to go.
00:35:20.000This is the first. Correct me if I'm wrong. You're the lawyer that's been on this.
00:35:23.000Right. And you wrote the book about it.
00:35:25.000You've been on the from the first time on, you know, November 4th, 2020, whether that was in Pennsylvania or Michigan or Arizona or Nevada.
00:35:35.340Is this the first time we've really gotten to an evidentiary stage that actually somebody is going to go in a court process?
00:35:42.800And I understand it's before the motion to dismiss is argued. Right.
00:35:47.120Right. But is this the first time that actually somebody is going to actually go look at evidence and put their hands on evidence?
00:35:52.880So actually, it actually happened in Michigan in 2020.
00:35:55.920Matt DiPerno's team was able to go and inspect some of the machines and inspect some of the process there.
00:36:00.860So to my knowledge, this is the second time that it has happened.
00:36:03.760There may have been some other smaller cases.
00:36:05.660If you remember Antrim County, Michigan, everybody got all spun up about it.
00:36:10.160That happened there. So we're at the Antrim County, Michigan phase right now where the plaintiff side is actually allowed to go look at some of this evidence.
00:36:17.900And then on Monday, we'll find out if that evidence gets to be presented in court where the public can assess it.
00:36:26.000So, you know, it's a little bit of a crunched timeline.
00:36:30.220But I will say the evidence in this case is so solid.
00:36:34.060I don't know how a court could dismiss it.
00:36:36.080We've got emails from the secretary of state slash Democrat candidate colluding with Twitter and the federal government to censor political speech election speech.
00:36:45.420You've got the Maricopa County recorder colluding with Twitter and the federal government to censor election speech, to manipulate the outcome of this election.
00:36:55.620You've got an expert witness saying that the machine, an expert who has certified these machines for the last nine years, saying that they're lawful to use and that they're in good working condition,
00:37:06.220saying that the error that occurred on Election Day, because we saw how many Republicans were disenfranchised because over half the machines broke on Election Day, that error was intentional.
00:37:16.240You have a whistleblower from Runbeck, the ballot company that says over 300 or excuse me, approximately 300,000 ballots were illegally asserted, inserted into the tally, not coming from drop boxes, not coming from polling locations,
00:37:29.240but just being brought in by employees, not within the lawful chain of custody.
00:37:33.740I mean, there's so much evidence in this case, I don't see how a court can dismiss it.
00:37:38.220So I think Kerry survives on Monday, but we'll see.
00:37:42.480Real quickly, what the judge allowed today, what will actually happen?
00:37:46.460Do you know technically what happens about these ballots, the inspection?
00:37:49.640How will that take place between now and Monday?
00:37:52.840So I don't know that the actual inspection will be completed by Monday.
00:37:56.160I think each side is going to have to nominate their person.
00:38:12.800And then whenever the court appoints it or whenever the parties can agree, I would expect early next week,
00:38:19.320they will go and get to see the sampling of the ballots and do their testing or whatever it is that they're doing.
00:38:24.780And then they can use that information in the trial because the trial date has been set for the 21st and 22nd.
00:38:30.940And they'll use it that time to present to the court.
00:38:35.760Just given the schedule here, because this will be both either side will appeal, right?
00:38:41.580And it'll appeal all the way up to the Arizona Supreme Court.
00:38:43.740But just given, I think, the inauguration day is Monday the 2nd, is there enough time here over the holidays actually to get this done?
00:38:53.420Is your belief they're going to have to delay the inauguration just to get to all this?
00:39:00.580I don't know what they'll do with the inauguration.
00:39:02.900I don't expect this to be wrapped up by the 2nd, but I know that there's case history in Arizona where someone was inaugurated and then the contest, the election contest, was successful and that governor was removed from office.
