00:04:29.000 And President Trump was helping him out.

00:04:33.000 Was that legal until they changed it to transfer that to a PAC that's basically there to oppose President Trump?
00:04:40.000 To take MAGA money under the pretense of help me for governor, hold it.

00:04:45.000 And then transfer it later to a PAC that would then go against President Trump?

00:04:50.000 Prior to the rules being changed in the Florida political handbook, Steve, it was not legal to transfer those funds from the state entity.
00:04:58.000 And, of course, that was the Friends of Ron DeSantis PAC was a state PAC.
00:05:02.000 And then they, of course, changed their name to the Empowered Parents PAC to take his name off it to hide what they were doing, of course.
00:05:08.000 But now I guess you could say it's legal because he had his hand-selected Secretary of State, who he appointed last May, change the rules.
00:05:17.000 So I guess it pays to be governor, right, when you get to appoint the Secretary of State and you get to have the Speaker of the House get everybody wound up in the Florida legislature to support Resign to Run.
00:05:32.000 And when you get to make threats to the lobbyists and have them told that if they don't support your presidential campaign with donations that they're not going to get any of their legislative measures through.
00:05:45.000 So that's all documented.
00:05:47.000 That's all fact.
00:05:48.000 You can go back and you can see these are all reports that have been published and put out throughout this election season.
00:05:54.000 I like to say that the way Florida operates and the way Governor Ron DeSantis operates, it's like mafiosa tactics, right, his way or the highway.

00:06:03.000 And, look, all the money in the world, all the support from Rupert Murdoch in the world and all the rule bending in the world is not going to make Ron DeSantis the nominee.
00:06:11.000 He's extremely unlikable and he continues to crash in the polls every single day.
00:06:16.000 And it's only a matter of time before he and his wife come to that realization like the rest of us have, Steve.
00:06:22.000 I said on John Furrier yesterday, the smart thing for him to do politically is to drop out now, take all the heat, go back to Florida, be as great a governor as you possibly could be, and review this in years to come.

00:08:11.000 When we talk about Moonshot, I take it it's Biden's cover.

00:08:19.000 But what he's really doing is driving transhumanism with an all of government approach.

00:08:26.000 Walk me through your Moonshot construct because it's quite important for the situation we find ourselves in today, sir.
00:08:33.000 Well, as you have up on screen, Steve, there, that's Law 360, which is a very, you know, so-called mainstream legal source saying that there's no way that if Trump says the special counsel regulations are unlawful that he could win, that that's a moonshot.
00:08:49.000 And nothing could be further from the truth, especially given the Supreme Court and its current composition.
00:08:56.000 So let me do a little bit of, I guess, war room law school here and talk about the various legal defects in the special counsel regulations.
00:09:03.000 And it's Jack Smith, right?
00:09:04.000 He serves under those regulations.
00:09:06.000 I think those regulations are, to use the technical term, ultra vires.
00:09:10.000 They're beyond the power of the federal government and beyond the power of the attorney general to adopt.
00:09:16.000 And, you know, the first set of reasons is because it's unconstitutional.
00:09:20.000 So we have a take care clause that gives the president the power to enforce the law, right?
00:09:25.000 So what do these special counsel regulations do?
00:09:28.000 They take that power and they give it to someone, namely a special counsel whom the AG appoints, not the president.
00:09:35.000 And then that person makes prosecutorial decisions and investigative decisions.
00:09:41.000 That is entirely contrary to the take care clause.
00:09:45.000 It's also contrary to the removal power, because if you look at the special counsel regulation 28 CFR 600.7D,
00:09:54.000 it provides that the special counsel can only be removed for good cause.
00:09:59.000 So that means that basically it's an attempt to tie the president's hands and not be able to direct the attorney general to get rid of someone.
00:10:07.000 It also is something that violates the appointments clause because the president's not appointing that person.
00:10:14.000 And you need to understand that, look, all the U.S. attorneys are appointed by the president, with some exceptions if there's a vacancy.
00:10:20.000 But the special counsel is not just any old U.S. attorney who has a limited geographic span and can apply criminal laws to conduct inside that span.
00:10:32.000 The special counsel is a super U.S. attorney, a kind of Shazam who has all the powers of the Greek gods rolled into one.
00:10:39.000 He has all the powers of any U.S. attorney fused into him.
00:10:43.000 And yet he is not appointed by the president.
00:10:45.000 All of that is flatly unconstitutional.
00:10:48.000 The regulations also, and now let me shift from the constitutional reasons into the administrative law reasons.
00:10:54.000 These regulations were adopted in 1999 by Janet Reno.
00:10:58.000 They were written by this guy, Neil Katyal, who's always on MSNBC bloviating about various lines of attack against Trump.
00:11:06.000 He's like one of the most radical lawyers I've ever seen, you know, floating around in mainstream sources.
00:11:12.000 He wrote these regulations and they were adopted so fast after the expiration of the special counsel statute because it was an emergency.
00:11:21.000 Well, what was the emergency, Steve?
00:11:23.000 It doesn't, you know, even facially comport with the idea of something that doesn't need to go through Administrative Procedure Act notice and comment.
00:11:32.000 Because the emergency was the expiration of the independent counsel statute that, you know, folks like Fisk and Ken Starr served under.
00:11:41.000 Well, that's not an emergency, Steve.
00:11:43.000 We had a republic for 194 years before the independent counsel statute was adopted in 1983.
00:11:49.000 But hang on, but hang on, but hang on.
00:11:51.000 Fisk tenure ran out and they still wanted to continue to investigate the Clintons.
00:11:56.000 Is that basically, and so they came up with the Caccio work for Janet Reno at Justice at the time.
00:12:02.000 So they came up with this because there was pressure in the House and the Senate to continue to investigate because it would look too bad for the clock to run out on the Clintons.
00:12:11.000 They'd run the clock out on Fisk.
00:12:13.000 Is that what the quote unquote crisis was at the time?
00:12:16.000 Well, I think all of that's part of it, but I think they wanted to continue this unconstitutional regime, Steve, because it's exactly part of what I described in my paper.
00:12:26.000 The DOJ is not independent.
00:12:28.000 This, those regulations, the special counsel regulations are like their second best, right?
00:12:33.000 Their first best was to have the independent counsel statute.
00:12:36.000 And then they could claim, well, that person, Congress set them up as independent.
00:12:39.000 And the Supreme Court said it was okay for Congress to pass that statute.
00:12:43.000 The regulations, once the statute sunset, the regulations were, you know, the best they could do to kind of continue to hold on to this fiction that DOJ or parts of DOJ are independent.
00:12:53.000 And it's entirely anathema to the Constitution, Steve.
00:12:56.000 It needs to be struck down.
00:12:57.000 And it's so unconstitutional, in fact, I'd like to see the House take steps to defund the special counsel saying, look, we have an oath clause obligation to the Constitution.
00:13:07.000 These regulations are unconstitutional.
00:13:09.000 We're not going to fund their use to try to pick the president in 2024.
00:13:14.000 It's ridiculous.
00:13:15.000 So what does the left say about these regulations?
00:13:19.000 Why do they say it's a moonshot?
00:13:21.000 Their main reason is they say that because the regulations were adopted without notice and comment, therefore the regulations can be set aside at any time by Merrick Garland.
00:13:32.000 And, you know, so therefore they don't really restrict the power of the president.
00:13:37.000 But there's a big problem with that, Steve.
00:13:39.000 Chief Justice Roberts, writing for the court, wrote this decision about the DACA program, which also was not based in any regulation at all, let alone one that didn't go through notice and comment like this regulation.
00:13:50.000 So that program was even worse.
00:13:53.000 And yet Chief Justice Roberts said that there needed to be a process to pull down DACA and that the Trump administration didn't go through it.
00:14:01.000 Well, if that logic applies, then these regulations do constrain the power of the president, and therefore they're unconstitutional.
00:14:09.000 And therefore everything Jack Smith has done or will do under those regulations is unconstitutional.
00:14:16.000 And the prosecution against President Trump should be dismissed.

00:17:46.000 Steve, the independent counsel statute expired on June 30th, 1999, and the regulations were in place as direct to final rules by July 9th, 1999.

00:17:59.000 Look, I think the reason why in the in the Trump Justice Department, right, is that you have people like, you know, Bill Barr and sadly, Jeff Sessions, who I have, you know, respect for in terms of, you know, what he'd done for the Congress and for the American people in the Senate.
00:18:14.000 But look, they believe this idea that DOJ should be independent.
00:18:17.000 And it's totally wrong.
00:18:18.000 The independent counsel statute was boldly challenged by Ted Olson, who was then the assistant attorney general for the Office of Legal Counsel.
00:18:29.000 Later in Bush 43, he became the solicitor general.
00:18:32.000 And, you know, he got Justice Scalia's vote that that statute was unconstitutional.
00:18:36.000 These regulations are not only unconstitutional, they also violate the Administrative Procedure Act.
00:18:41.000 And the challenge needs to be brought.
00:18:44.000 And look, I think I'm 100 percent right.
00:18:46.000 And I also think many conservative judges and justices would agree with me about that.
00:18:50.000 But let's say I'm wrong.
00:18:51.000 President Trump needs to test those regulations, because if all the way through the Supreme Court those regulations are upheld as constitutional, you know that if he returns to office in 2025, he's going to use those regulations.
00:19:05.000 And so I think that that the courts will look at it that way.
00:19:09.000 Right. And they'll say to themselves, like, you know, these are very serious constitutional legal problems.
00:19:13.000 And then the entire Jack Smith, you know, witch hunt evaporates on all its multiple fronts.

00:21:50.000 Democratic leaders have pledged to oppose the bill, writing a statement.
