00:00:58.200 The judge here says that she will not accept or reject the plea agreement.

00:01:05.660 Basically, excuse me, what she is asking for is to determine whether or not it's appropriate for her to consider something in the diversion program.

00:01:27.720 Weigh in on what has taken place so far today with the breakdown of this plea deal.
00:01:33.420 Now, Hunter Biden pleading not guilty and having to revisit an agreement between both parties.
00:01:38.780 Well, it was clear from the outset that Hunter Biden's attorneys and the prosecutors were on a completely different page about what this agreement meant.

00:01:52.280 And as a former prosecutor, I'll put this on the prosecutors, the Delaware U.S. attorney's office, that they would go to court.
00:01:58.640 And usually these hearings are smooth sailing.
00:02:01.580 Now, the judge is not a potted plant.
00:02:03.540 A judge does not rubber stamp a plea.
00:02:05.740 It is her job to make sure that the plea comports with the law and the facts and that the defendant is pleading knowingly, voluntarily, and intelligently.
00:02:15.520 And was during that questioning, a simple question, you know, does this plea cover all other crimes?
00:02:21.080 The defense says yes.
00:02:22.600 The prosecution says no.
00:02:24.740 How that happened, meaning they didn't know this before they went to court, is shocking.
00:02:28.980 It was always curious to me when a plea agreement was announced, I guess it was a month ago, the defense attorney said the investigation is over.
00:02:38.440 The United States attorney, I believe, issued a press release and said the investigation is still ongoing.
00:02:43.800 And I thought, well, there's clearly just a misunderstanding and that will be cleared up by the time it happens.
00:02:49.340 And clearly it wasn't.
00:02:50.560 So the judge really did her job and drilled down.
00:02:54.720 It was clear there was no meeting of the minds on both sides.

00:02:59.780 When I've seen plea deals fall apart, it's usually the defendant suddenly decides, I don't want to plea.

00:03:11.060 And that it would be on such a high profile case in such a public setting that this would happen is, quite frankly, shocking.
