00:21:50.240 It was by Chief Justice Samuel Chase, and it held that if you want to disqualify someone for insurrection or rebellion under the 13th Amendment, Section 3 of the 14th Amendment, Congress has to pass a federal criminal statute for insurrection or rebellion under Section 5 of the 14th Amendment, which Congress did in 1870.

00:22:16.140 If you want to disqualify Trump for insurrection or rebellion, you have to have a federal prosecutor like Jack Smith charge him for insurrection or rebellion under this criminal statute.

00:22:29.820 The judge has to convict, and that conviction must be upheld on appeal.
00:22:33.400 That's the only way you can disqualify.
