00:04:05.080 Well, Steve, I have two stories, two scandals out of Pennsylvania.
00:04:09.640 The first one is Governor Josh Shapiro has just announced that after five years of failure and $13 million,
00:04:17.740 they are not going to be able to go through with a software update and new voter machines
00:04:23.860 that will correct a lot of the errors that led to chaos in Pennsylvania in 2020.
00:04:29.000 The vendor apparently isn't delivering on time, so nothing will be done for 2024.
00:04:35.720 And if there are any problems created in 2024, we're not going to learn about it for another two, three or four years.
00:04:41.800 But that's only the tip of the iceberg.
00:04:45.800 Pennsylvania is in the middle of a giant scandal that is 20 years in the making.
00:04:50.980 20 years ago, Pennsylvania developed a system that by non-citizens, we're talking about legal residents and green card holders.

00:05:01.860 They can legally get a driver's license.
00:05:04.220 They would go into DMV, present their paperwork that they were eligible for a driver's license.
00:05:08.520 Then they would go to a computer screen, and it would ask them questions about the road and accidents and all of that.
00:05:15.200 And then a box would come up saying, do you want to register to vote?
00:05:20.060 Now, it didn't say that you can't register to vote if you're not a citizen.
00:05:24.260 It just said, do you want to register to vote?
00:05:25.940 So a lot of people said, well, if they ask me, the answer is I can register to vote.

00:05:29.300 It was discovered by accident by a citizen journalist who noticed a box on the floor of an office building in the election division in Pennsylvania that said non-citizen voting files and started asking questions and filing FOIA requests.

00:05:45.240 We learned that for 20 years, between 10,000 and 100,000 people who were non-citizens were registered to vote.
00:05:52.320 In a sample of those voters done by the Philadelphia Election Office, the Philadelphia Election Office, not exactly a MAGA headquarters, they found 41 percent of them had actually voted at least one election.
00:06:04.140 Now, the Public Interest Legal Foundation has filed suit to try to get the whole story out and to try to stop it.
00:06:11.140 It was a scandal seven years ago.
00:06:13.420 The secretary of state had to resign in disgrace, but they refused to turn over the records of all of this,
00:06:19.300 both to the Public Interest Legal Foundation and to the state legislature, which was controlled by Republicans and was holding hearings.

00:25:28.900 You just mentioned that my law firm, Shere Jaffe, filed an amicus brief today that essentially says that Jack Smith is not a constitutional officer, is not a valid legal appointment under the Constitution, that to be a – only Congress can make the office of special counsel.

00:25:52.040 This comes out of that whole mess that was the independent counsel, which was an abomination, right?
00:25:57.960 And what you saw there, right, was that it was lawfare and criminalizing policy differences that the Democrats started with the independent counsel act, I think, in 1978, went after lots of Republicans.
00:26:08.620 The minute it bit the Democrats, right, with Bill Clinton, they dropped it.

00:26:14.560 What came in its place was the Office of Special Counsel, which was only regulations by Janet Reno, a horrible, right, attorney general under Bill Clinton.

00:26:43.660 If you had appointed a U.S. attorney, a presidentially appointed, Senate-confirmed appointee to do this, like they've done in the past with other special counsels, that would be legally sufficient.
00:26:56.040 But here, I think this amicus brief that's filed by Ed Meese, my law firm is representing Ed Meese, and Steve Calabrese, who is a founder of the Federal Society, making that argument.
