00:00:12.440 earlier, 2024. You're watching the Senate floor. It's kind of confusing what's going
00:00:17.360 on right now, but I'll give you the best information we have. Earlier today, we're
00:00:21.180 going to do a cold open here in a minute. We had a historic win. We defeated the entire
00:00:25.840 package, both the invasion authorization bill coupled with the bailout, $60 billion bailout
00:00:36.440 of Ukraine as a combined package, went down to defeat. They needed 60 votes. They only
00:00:43.020 got 48. We got 50, including Chuck Schumer voted against it. He did that technically so they
00:00:50.040 could bring it back just with the foreign aid package alone. So that was earlier today.
00:00:54.520 You should know that Mitch McConnell voted against it. In fact, Mitch McConnell very
00:00:59.400 dramatically came in as the 41st vote, which is technically what kills it. Because once
00:01:05.340 you get 41, obviously you can't get to 60. It's over. That was quite dramatic early in
00:01:11.040 the day. Massive, massive win for this audience. You guys have delivered again another win in
00:01:16.600 just the last couple of days. Defeated that entire bill. Now here's what's going on. They
00:01:20.600 then went to have a, basically to put to the floor, whether they just do the foreign age
00:01:27.100 package, the national security package of Ukraine, Israel, and Taiwan, totally clean, no offsets,
00:01:34.380 nothing on the border. Steve Daines, in fact, had a, they had meetings beforehand and Daines,
00:01:40.380 who's the head of the NRSC, said, look, you would be giving the Democrats a huge win here
00:01:47.820 if you foisted upon the people I'm trying to get to run for the Senate, the fact that you passed the
00:01:54.360 Ukraine funding bill and had nothing to do with the border security. We are, we are bound by honor
00:01:58.680 and by national security to take care of this, of the board, of the border, to have the border shut
00:02:04.760 down before we prove anything for Ukraine. We've made that commitment. So here's what they're doing
00:02:09.120 right now in the Senate. Schumer has put forward just a clean authorization package for those.
00:02:15.980 You got to get to 60 so that you can begin the process of debate and amendments and all that.
00:02:20.940 The first time they did it, and this is George Kaplan from C-SPAN, who is the reporter there,
00:02:28.300 he tweeted out the first vote went 58, 40, 58, 41. So they didn't get there. And that's all the
00:02:36.680 senators that are still around, right? I think there's one senator missing, maybe Loomis, one senator
00:02:43.220 missing. So they have failed on their attempt, at least right now, to even get the foreign aid package
00:02:53.020 to a bigger debate and amendments and all that. Now, what I hear they're negotiating, but it's still
00:02:58.840 open. So it hadn't been closed. And there's some technical reasons they could have a revote.
00:03:02.160 Here's what you should, I think, know. And I think this is basically correct. If you remember
00:03:08.680 today, I talked about the CR, that that's really the next event that's coming, the real event,
00:03:15.140 the extension of the CR on March 1st, and that what Johnson should be doing now, because you're not
00:03:20.520 going to be able to shut the government down, but you're not going to be attached all of HR2. It's too
00:03:24.980 big. It's too overwhelming. What you have to do to get the border shut is give two or three things.
00:03:29.620 We had Peter Navarro on to talk to him about that. Two or three things that are needed now
00:03:33.660 to secure the border. One of those being what are called the third-party countries to make sure in
00:03:39.980 the asylum law, you've got to go to the first free country. Even if you're a political asylum,
00:03:45.860 you just can't come directly to the United States. So there's all types of technical things.
00:03:49.500 Peter laid that out. What they're doing, how this is analogous to the Senate,
00:03:52.600 basically, is they're behind closed doors. We're now arguing, arguing what amendments can we put
00:04:01.360 on here about border security that can give us enough of a fig leaf for the war room posse and
00:04:08.840 others that we can say, hey, we passed Ukraine, but we included two or three things that the House
00:04:15.900 will have to approve and Biden will have to approve, right? Obviously, it's a gimmick.
00:04:21.620 It's optics. But that's how obsessed they are. This fetish, as J.D. Vance called it,
00:04:29.060 Senator J.D. Vance called it today earlier, this fetish about getting money to Ukraine,
00:04:33.220 which is in the middle of a military coup right now, they're just obsessed with. So right now,
00:04:38.580 currently, they've had this second vote on foreign, on the foreign aid package alone,
00:04:44.460 what C-SPAN is telling us, it was 58-41, which doesn't get them there. That means the whole thing's
00:04:50.800 kind of dead. Now, they have not called this vote. And the reason is, is that we hear the behind
00:04:56.100 closed doors arguing about amendments that could be put on going forward, particularly on the Ukraine
00:05:03.340 side, that would be two or three things that would give the people like the Mitch McConnells of the
00:05:09.060 world cover to be able to vote for something. Eight senators voted for it. People like Jerry
00:05:17.740 Moran, obviously Romney. Romney was one of the few people who voted for it this morning. I mean,
00:05:21.840 he's been awful. He's going to just rub your nose in his awfulness. Okay, here's what I want to do now.
00:05:26.800 That's the quick update. What we're going to do is open the show. We got some stuff to show from the

00:05:37.060 the hero of Nevada, the Cash Patel joins us. Cash got none of the above to win yesterday as he came
00:05:45.840 on the show and worked for weeks and weeks and weeks, was talking about that. In the gun deck
00:05:50.800 primary, Nikki Haley actually lost to nobody last night, courtesy of Cash Patel and his hard work.

00:06:01.040 and open the show now. I think this would be another example of just the move toward total
00:06:05.520 chaos from the Republican Party that started, a brand new Republican Party that started with
00:06:11.180 the Tea Party. Can you explain what's been happening? Yeah, I mean, the strictures and the
00:06:16.160 kind of traditional fault lines, Katie, in the Republican Party have just changed so much in
00:06:20.760 the last 14 years. The traditional Republican Party, the strong on foreign policy, global leader
00:06:28.900 type party that Mitch McConnell tried to lead for the last 15 years is dead. And we've shifted into a
00:06:36.100 new sphere that of a Republican Party that doesn't want to support allies and across the world, whether
00:06:44.080 it be Ukraine or in the House of Representatives, suggesting that we offset our cut spending to allow
00:06:50.100 us to give more money to Israel. It's really something that I've never seen. And then you add into this mix
00:06:55.040 a new speaker of the House and Mike Johnson, who has no real background that would lend him, give him the
00:07:02.300 skills to be speaker of the House. Take two bills to the floor, two serious bills, Katie. These are just
00:07:08.080 mess. I mean, they are messaging bills in some respect, but these are serious topics. Aid to Israel, impeaching
00:07:13.420 Alejandro Mayorkas, a cabinet secretary. And having those fail in prime time is just unlike anything I've ever
00:07:22.860 seen. And by the way, Mike Johnson took those to the floor knowing they would fail. He purposely decided
00:07:29.320 that he would go forward with these votes knowing that it would fail. And it just, it defies everything
00:07:34.960 that we know about politics, which is we want winning to be the outcome, not losing. It used to be that
00:07:40.260 Mitch McConnell was kind of the titular head of the Republican Party, even during the Trump years.
00:07:44.840 He still had a lot of sway, especially of Republicans in the Senate. It seems like McConnell no longer has
00:07:51.620 that sway. And the party is now fully under the control of a man who's still running for office,
00:07:57.620 who might get disqualified from the ballot. The Supreme Court is hearing a case to disqualify him
00:08:02.280 from the ballot tomorrow. They're hearing oral arguments. Donald Trump seems to be in command
00:08:07.520 of this party, even though Donald Trump is not necessarily in command of his own candidacy.
00:08:12.580 It's, it's, it's Donald Trump, but it's really Donald Trump inspired members of Congress.
00:08:17.140 It's not, we don't have a traditional pool of, you know, ride or die defense hawks who are going to
00:08:24.000 support a muscular foreign policy and, and, and military presence for the United States across
00:08:30.060 the globe. We don't have that anymore. So we have people like Mike Lee and JD Vance and, and people
00:08:36.460 of that nature who are inherently skeptical of more money going to countries like Ukraine. And they are
00:08:43.120 the loudest voices in the Republican conference right now and add into the mix, a presidential
00:08:48.120 election, some senators who want to be vice president, some members of the house Republican
00:08:52.900 leadership who want to be vice president. And you do have a Republican party that continues to be
00:08:57.620 under the spell of Donald Trump. I think that's accurate. I think Chuck is doing a great job of
00:09:02.620 putting everybody. Isn't that also Donald Trump behind the scenes? Oh, absolutely. It's all about
00:09:06.980 Donald Trump. It's all about Donald Trump. It's about immigration, all the rest. The president
00:09:12.020 has cooperated in terms as, as we have, I, you know, as we see what's in the immigration bill,
00:09:18.700 it's not a bill than any was written, but it's compromise. It's negotiation and it solves the
00:09:25.120 problem. For a long time, the president has had this in his proposals. Now they have some more
00:09:32.400 things they wanted. The president agreed. And now they didn't take yes for an answer.
00:09:38.960 Mitch McConnell didn't take yes for an answer. In the beginning of the day yesterday, it was
00:09:43.140 promising. Toward the end of the day, he said, it's changed. And that's because of Donald Trump.
00:09:49.040 You're a former intelligence chair. I mean, you have foreign policy credentials going back,
00:09:54.380 you know, being the hang of eight forever. And you're going to the Munich Security Conference.
00:09:59.460 If Congress does not pass Ukraine aid, how do American lawmakers representing our government
00:10:07.080 hold our, hold your heads up in Germany next week when NATO came through with, with billions,
00:10:13.840 but we have weapons that they don't have that Ukraine needs, the attackums and the air defenses.
00:10:20.160 And Ukraine is without ammo, we're told, in the trenches. And Vladimir Putin has more people,
00:10:29.540 more men that can go into the fight because the casualties don't seem to bother him.
00:10:34.540 What's heartbreaking about this is that we've all praised the courage of the Ukrainian people
00:10:40.560 fighting for their democracy and in fighting for theirs, fighting for democracy writ large.
00:10:45.940 We have overwhelming votes. We had over 300. The last vote we took in the House for a for the
00:10:54.060 military assistance for Ukraine, the EU funding over 50 billion dollars, a huge amount of money,
00:11:01.660 much more than well. It's a lot of money. That's largely for the economy functioning of government
00:11:11.680 and the rest. The military assistance is what they need. And that's what our funding is.
00:11:18.640 So it is a total embarrassment, but that's the least of it. It's a tragedy
00:11:24.480 that we are not supporting Ukraine. Now, I I'm not giving up on it. I do think that when they
00:11:32.480 the speaker was asked, they had his press comments what he would do if the Senate sent over the Ukraine
00:11:37.860 package without immigration. And he didn't. He was noncommittal on it. So I'm hoping that
00:11:46.960 so many of the Republicans support a to Ukraine. So many of them do in the House of Representatives.
00:11:53.660 Now, they do have a Putin pro Putin caucus. They're not officially a caucus, but the advocates for
00:12:02.380 who benefits from this, Vladimir Putin, who benefits Vladimir Putin, Donald Trump. It's connected.

00:13:58.380 got up there and gave some big sob story. Somebody called him up and said, I'm going to break you.
00:14:02.480 And he was whining up there for hours. Just an embarrassment to the people in Oklahoma,
00:14:08.720 the great folks out there. But it was defeated. It was crushed. Mitch McConnell and all his men

00:20:42.720 followers so certainly have a voice. What is this beef they've got with Trump having a point of view in
00:20:47.980 this, sir? Because Trump's right, and they can't have that. They can't have that being printed on
00:20:53.800 the New York Times and across the headlines at CNN and the fake news. Anything that Trump does that
00:20:59.300 delivers this country a win, they will try to remove that win with fake news and disinformation
00:21:04.820 campaigns. They just cannot have Donald Trump succeed. And you're right. Donald Trump is the
00:21:09.420 leader of this movement, but America has spoken behind him. America is the one that shut down
00:21:14.760 this bill that masqueraded as a border security bill. America spoke and said, we want to take
00:21:20.800 care of us and our border and our neighborhoods first. And then if we have leftover, we'll give

00:21:35.500 mainstream media has just ticked off that they continue to be defeated by Donald Trump's movement,

00:22:37.460 want to do it now in this election cycle, because a war cycle for the economic side of things will
00:22:43.800 prop up the economy just because of the amount of money that's flooded into it. And that narrative,
00:22:48.120 they need to say, look at what Joe Biden's doing to our economy. So we just seize not only the
00:22:52.720 lobbyist industry, but the defense industrial titans that have run Washington, D.C., were just delivered
00:22:57.980 to blow. They're not going away, Steve. They do a lot of great work. Don't get me wrong. But they do
00:23:01.860 a lot of work that cuts against the interests of the American people. And they've been running that
00:23:06.020 town for years. Listen, Secretary of Defense Lloyd Austin was on the board of Raytheon making
00:23:11.560 bazillions of dollars. Since he became the SECDEF, Raytheon has gotten $3 billion in government
00:23:18.200 contracts. That's pretty much all you need to know. Not bad work. Let's play the clip from this
00:23:25.480 morning on on Birdbrain about about what happened in Nevada. We have a nonstarter in Nevada. Majority
00:23:35.300 of Republican primary voters last night checked the box for none of these candidates over Nikki Haley
00:23:41.460 by more than two to one. Former President Trump is not on that ballot. So onward, we roll to the next
00:23:47.600 phase. OK, Cash, this is it's so amazing what you did. Tell what you had. You explained it, how you
00:23:56.860 broke it down for the president and his team, what was happening in Nevada and how you helped with the

00:24:35.400 guys are racking up, whether it's defeating the border bill, whether it's changing leadership at the
00:24:39.400 speaker or the RNC, and now the Nevada. Remember, Nikki Haley and the mainstream media had gone out
00:24:45.140 here and printed the headlines that she was going to win the primary. Not only did we stop the mail-in
00:24:51.600 ballot con job that is the Nevada primary, we actually got people to shove it down their own
00:24:58.800 throats and vote none of the above. She literally lost to no one. And that's how many votes we got out
00:25:05.680 there. Look at that. 43,000 people rolled out against Nikki Haley. And now we're going to roll
00:25:11.460 into our caucus on Thursday, February tomorrow with President Trump here. And we're going to deliver
00:25:16.240 a huge win for him there and give him all the GOP delegates here in the state of Nevada, the key to
00:25:21.040 the West. It's a monster win. They thought it could not be done. And it would not have been possible
00:25:26.380 without the likes of Seagal Chata and Michael McDonald and the Trump senior campaign officials

00:34:18.040 why are they obsessed by this ruling? It's like, it's, it's, they've had so much bad news and reality
00:34:23.080 on the polling and Trump's winning everywhere. And now Trump's winning in the house and Senate.
00:34:26.580 They, they have to hang on to this because it's a weird obsession they have with this ruling.
00:34:32.440 Well, it's really all they have. I have a piece up on my sub stack that I posted over the weekend
00:34:37.580 that talks about the Andrew Weissmans of the world, the legal experts, the MSNBC and CNN
00:34:43.740 analysts and hosts who were really starting to bully the appellate court last week into issuing
00:34:51.860 their decision. Even though oral arguments had been held on January 9th, Steve, it's usually three,
00:34:57.340 four, five months between oral arguments and the appellate court publishing their decision.
00:35:02.580 So they were starting to bully these judges, especially that Bush 41 judge, Karen Henderson,
00:35:08.520 who they believed was holding this up into finally posting their decision. Why? Because the March 4th
00:35:16.580 trial date, as you know, Judge Chudkin officially vacated that last week. All of the pretrial calendars,
00:35:21.840 has been on hold awaiting this immunity decision. Steve, these people thought they were going to be
00:35:27.100 in Washington. That's where I am right now. Right now, for weeks and months, covering this historic
00:35:33.680 trial in Washington, D.C., covering every hearing, talking about every motion that was posted,
00:35:39.540 discussing the jury selection process, the heated banter between Judge Chudkin and Trump's legal team.
00:35:45.900 And they're sitting there twiddling their thumbs or something spinning because what they anticipated
00:35:51.960 was going to be happening at the start of this year has all been put on hold with this immunity
00:35:56.980 issue. So now they're back in the swoon of possibly there will be this criminal trial of Donald Trump
00:36:04.080 in Washington soon, pending what the Supreme Court decides to do and Donald Trump decides to do
00:36:10.080 really next. His decision, his step will determine where this goes.
00:36:15.500 But hang on. But let's talk about that decision. I thought normally appellate courts would come back
00:36:21.040 and give decisions, rulings, and then people could either decide to go en banc or go to the Supreme Court.
00:36:26.500 But you had the option of going to the entire panel and maybe getting some dissenting opinions if you lost
00:36:31.260 that you could use later. This ruling was kind of strange because they're so obsessed with getting
00:36:36.600 going. They actually ruled out the en banc process by saying if you don't file with the Supreme Court
00:36:42.380 in seven days, the stay comes off and the trial goes ahead as previously scheduled. Am I right in that
00:36:48.880 interpretation? That's exactly right. So this was unusual, and I know Mike Davis talked about this as
00:36:54.580 well, that they basically gave Trump an ultimatum. Either you go directly to the Supreme Court, you ask for
00:37:00.760 an emergency stay of this appellate ruling, which would put this ruling on hold, basically. You go to
00:37:07.280 the Supreme Court before February 13th, and you start the process there. Because if you go back to
00:37:14.020 the D.C. appellate and ask for this en banc review, which means the entire court, not just three judges,
00:37:19.960 would review it. If you do that, the hold on the pretrial calendar will be lifted, and Judge Chutkin can move
00:37:27.100 forward now with a possible trial date and go back and fulfill all of the things that have been on hold
00:37:33.980 since December. So really, he has no choice but to go to the Supreme Court. That's where everyone
00:37:41.540 thinks that this is going to be ultimately resolved. And so if he goes to the D.C. appellate,
00:37:47.620 asks for this full court review, then Judge Chutkin can right away get started with the pretrial
00:37:54.120 calendar that's been on hold really since the beginning of December. So Trump really doesn't
00:37:59.260 have an option, I think. So what will he file before February 13th? It's really the 12th, but he has to
00:38:06.500 Well, hold on, hold on, hold on. I heard, hang on, hang on. I'm hearing his lawyers. Can his lawyers go
00:38:11.520 and challenge this? Can't they go to the, can't they go to the, can't they, can't they challenge this
00:38:17.160 with the appellate? Because it's so extraordinary that you can't go en banc, you're penalized, this whole
00:38:22.080 goes. This is election interference. It's obvious by the ruling, they're obsessed, obsessed with
00:38:28.340 getting Trump into this federal courthouse in, in Washington, D.C. with a rigged jury. And he can't
00:38:34.860 get a fair trial. It's impossible. They realize the only way they can potentially beat him, although
00:38:38.580 the polls show only 2%, and it wouldn't be that he'd win by five, even if he was found guilty of this
00:38:45.080 bogus charge. I mean, how can, how can this ruling stand? Doesn't Trump have any alternatives to question
00:38:51.240 this? Well, his only challenge to this in the D.C. circuit, the appellate court, would be to ask for
00:38:57.360 this en banc review. So that is the way to challenge the panel, the traditional way of challenging a
00:39:04.540 panel's ruling. They want this kicked out of the D.C. circuit, though. And it really doesn't make any
00:39:09.780 sense because we've seen this over and over, especially with J6 cases and Trump-related cases.
00:39:14.860 This just happened in the Twitter appeal, that the D.C. circuit routinely denies requests for
00:39:21.480 en banc, I'm saying in probably the wrong way, review. And plus, it's a fully, as Mike Davis said,
00:39:29.300 Obama-appointed stacked court. So there's really no point except to prolong the process.
00:39:36.020 So what these judges did, because if you do ask for en banc, then the judges all have to confer,
00:39:41.380 and then they issue a ruling that would prolong this whole process. So what these judges did is
00:39:47.940 cut off that option, that relief that would add time to Donald Trump trying to get this resolved,
00:39:54.780 and by the same token, delaying the trial in Washington. So the judges cut that off and said,
00:40:01.440 if you go there, we're going to start the pretrial schedule back to Judge Chutkin. But if you go to the
00:40:07.060 Supreme Court by the 13th of February, end of the 12th of February, and you apply for a stay of this
00:40:16.620 ruling, emergency stay, then it could potentially be on hold indefinitely. So that is what I assume
00:40:24.560 Donald Trump's lawyers will do. They will file this application for an emergency stay to this appellate
00:40:29.420 ruling. You need five justices to agree to a stay. Will they get five, or will they not, and just
00:40:39.120 deny the emergency stay? And then everything sort of starts again, while Trump then goes back to the
00:40:45.980 Supreme Court, files a petition for a writ of cert, that that will technically then ask the court to
00:40:53.160 reverse this appellate ruling. What about, we've had updates and also the Mar-a-Lago situation,
00:41:01.220 which has kind of gotten off the front burner. What's going on there? Right. So things aren't
00:41:06.260 going as well for Jack Smith in Southern Florida in Judge Cannon's courtroom as they have been for
00:41:11.860 Judge Chutkin, who really is nothing more than a rubber stamp for DOJ and has been. Judge Cannon,
00:41:17.700 on the same day that the appellate court ruling came down, she issued a pretty stern scolding of
00:41:24.480 Jack Smith for his attempts to continue to keep information under seal and redacted. So Donald
00:41:31.880 Trump's lawyers went to her last month and said, we want to file this motion, discovery motion. A lot
00:41:40.720 of it is redacted per the protective order, but we want to unseal this. And we want Jack Smith to come
00:41:45.540 back and explain why he wants all of this information related to the investigation kept
00:41:51.200 under seal. Jack Smith went back to Judge Cannon, said, we want all of this, you know, it's national
00:41:57.020 security, it's personal identifying information, it's relates to an ongoing investigation. Gave all
00:42:02.980 the normal excuses. Well, Judge Cannon yesterday said, no, Jack Smith, I've looked at all of this
00:42:09.840 in my courtroom privately. Here are a few things that can be kept under seal. All of this other
00:42:17.220 information, though, is going to be made public. And what she said repeatedly is, there is an interest
00:42:24.400 in transparency and the public's right to know about what's happening in criminal trials.
00:42:29.740 She is not going to circumvent that because the defendant is Donald Trump. And so we could next week
00:42:36.100 start seeing some of this information that Jack Smith has wanted to keep under seal, including
00:42:40.660 Steve, what the Trump's defense team uncovered, which was a separate additional FBI investigation
00:42:48.680 into Donald Trump that has a name, not Crossfire Hurricane, who knows what they came up with this
00:42:54.000 time. Another FBI investigation into Donald Trump that Jack Smith is trying to conceal. And Judge Cannon,
00:43:01.440 in her order, said, no, it's an ongoing investigation. There's no reason, basically,
00:43:05.920 she said, to keep this redacted, except to protect those involved. So we could know next week about the
00:43:13.940 existence of yet another FBI investigation into Donald Trump by Joe Biden's Department of Justice.

00:47:05.960 run that down for us, but this is the types of things that are starting to explode all over this
00:47:10.900 lawfare battlefield, ma'am? Yeah, I'm just looking at the logs right now going through it, and I'm sure

00:47:39.720 unsurprisingly, I mean, you can't get a decent judge except for Judge Canada, a few exceptions,
00:47:46.100 the judge in that case, he asked for those letters. He looked at them in his ex parte, in his courtroom by
00:47:55.020 himself or with others, and now he's placed those letters under seal. So no one can get that, including
00:48:01.300 the defendants such as Jeffrey Clark. So we know correspondence exists. We already know from some
00:48:08.180 White House, from the White House visitor log that Nathan Wade was there. So this is, would be pretty
00:48:16.260 interesting, shocking really, that Fannie Willis went to the White House and met directly with anyone
00:48:22.240 there, including the president, certainly his general counsel. That also would be quite interesting.
00:48:27.900 And remember when Fannie Willis was asked at her press conference if she had been in contact with Jack
00:48:33.640 Smith and she refused to answer. We do know, too, from some of these court filings by Trump's lawyers
