00:00:17.520 Well, I've tried to educate myself on this because it's clear that this is not a section of the 14th Amendment,
00:00:24.820 Section 3, that a lot of us paid a lot of attention to in the past.

00:00:31.640 But there's a very strong argument.
00:00:34.680 And remember, this argument did not come from liberals.
00:00:37.320 It didn't come from people who already are against Trump at all.
00:00:43.260 They came from conservative originalists, as they like to call themselves, law professors, lawyers,
00:00:51.380 who basically said, if you read Section 3 of the 14th Amendment,
00:00:55.800 it's pretty clear that he should not be permitted to run for president.
00:00:59.800 I think the argument is very strongly on their side.
00:01:02.960 Now, what's the remedy?
00:01:04.320 Is the remedy for the Supreme Court to say, no, he can't be on the ballot?
00:01:08.480 Or is the remedy for the court to say, this very well can apply constitutionally,
00:01:14.660 but it's up to the states to make the determination.
00:01:17.700 Because remember, states in our federalist system actually run elections.
00:01:22.460 And I think that might be where the court ends up.
00:01:27.960 Maybe they could get to the point of saying, no, no, Section 3 doesn't apply, or you have

00:01:32.960 They could come up with some out for Trump.
00:01:35.480 But if they want to be true to their so-called originalist interpretation,
00:01:40.760 then I think they have to find that Section 3 applies to people who foment and participate in insurrections.

00:03:30.920 Yes, so we had the Colorado Supreme Court for Democrat activists on the Colorado Supreme Court unconstitutionally, illegally take President Trump off the Colorado Republican primary ballots based upon a bogus reading of the 14th Amendment.
00:03:50.000 We enacted the 14th Amendment after the Civil War, the 13th, 14th, and 15th Amendments to outlaw slavery, guarantee equal protection, and due process to the freed slaves, and to guarantee voting rights to the freed male slaves.
00:04:05.120 And as part of the post-Civil War Reconstruction effort, we were seeing these Confederates who engaged in insurrection or rebellion winning elective office, like to the House of Representatives, and undermining the post-Civil War Reconstruction effort.
00:04:19.300 So they included Section 3 of the 14th Amendment to disqualify those who engaged in insurrection or rebellion against the United States.
00:04:29.000 And there's a case from over 150 years ago by then Chief Justice Salmon Chase that in order to disqualify an officeholder under Section 3 of the 14th Amendment, Congress must pass a federal criminal statute on insurrection or rebellion.
00:04:49.300 With a disqualification provision, which Congress did more than 150 years ago.
00:04:55.000 And so Democrats are trying to dust off this provision from 155 years ago to say that January 6th was somehow an insurrection,
00:05:04.760 even though it was a lawful protest permitted by the National Park Service that devolved into a riot.
00:05:11.620 And how many insurrectionists go into a nation's capital, get to the Senate floor unarmed, walk through velvet ropes, follow police direction, and don't burn down the damn place, right?
00:05:23.460 So the Democrats are trying to use this Section 3 of the 14th Amendment to just take Trump off the ballot.
00:05:30.640 And the Supreme Court, this should be a 9-0 case because it's such an easy case.
00:05:36.920 But we have three partisan Democrat appointees on the Supreme Court.
00:05:41.540 So it might be a 6-3 case, but there's no question that President Trump is going to prevail here because there's a 155-year-old precedent on this very matter.

00:08:59.260 That's what's actually happening. The Democrats are actually waging an insurrection in court by trying to remove Donald J. Trump off the ballot and take away the freedom, the First Amendment rights of Americans to vote for him and elect him as president of the United States.

00:50:28.720 And then you had this goofball main Secretary of State, Shetta Bellows, unelected, non-lawyer.

00:51:22.600 So it was a circuit opinion, but it's the controlling opinion on point that if you want to disqualify under Section 3,
00:51:29.520 Congress has to pass a federal criminal statute for insurrection and rebellion, and Congress did that.
00:51:33.920 If you want to get rid of an office holder, you have to – look, the qualifications for president are laid out in the Constitution.
00:51:43.900 There's only one way to disqualify under the Constitution for insurrection or rebellion, and you have to do that through the federal criminal process.
00:51:50.980 You have to have a federal grand jury indict, a federal jury, find guilt with evidence beyond a reasonable doubt unanimously.
