00:03:26.640 This is my attorney, Brad Miller, my husband, Mike Ward, because Mike and I were both arraigned today.

00:03:36.820 We were arraigned today for what we believe is an unconstitutional attempt at criminalizing speech, criminalizing being a Republican,
00:03:47.780 and criminalizing the questioning of our elections and the things that happened in the Arizona election in 2020 and 2022.

00:04:02.480 Kelly, I guess the grand jury both out there at the last second, I mean, this thing's been around for years, at the last second,
00:04:10.860 it looked like, at least to us, more lawfare.
00:04:13.060 Where they indicted both the people who were the electors, which seems like, you know, the president and his campaign team had every right to have that in case this,
00:04:24.980 in case uncertifiable things happen or state legislatures felt they were uncertifiable, Arizona being the one in play.
00:04:32.860 But also people associated with it, some of the lawyers and other officials associated with it.
00:04:38.660 So when you say it's about free speech, just what do you mean by that?
00:04:41.340 Yeah, so what they've essentially done is they've created a new crime, and that's the crime of questioning an election.
00:04:50.060 So in most states, and Arizona included, crimes are set out in statute, and there are defined elements of what a particular crime is.
00:04:57.780 It took the attorney general months and months and months and thousands and thousands of pages to convince a grand jury that a crime, in fact, had occurred.
00:05:06.040 But what we intend to show, and this is our first day, because today was the arraignment, our first time to answer and say,
00:05:12.540 no, my clients are not guilty of any particular crime because no crime was defined.
00:05:20.680 Okay, I want to go back through that just for a second, Brad.
00:05:24.140 You're saying that the questioning of an election is not a crime, and it took the attorney general,
00:05:29.400 who people should remember is only up, what, 208 votes in an election where there's, I believe, 8,000 or 9,000 uncounted ballots in one of the precincts over there in Arizona.
00:05:44.300 So, you know, people question her legitimacy every day.
00:05:48.420 We do it on the show every day, or every day we talk about Arizona, which is about every day.
00:05:52.180 You're saying she's made a crime of questioning an election, and it took thousands of pages of research and writing for her to convince this grand jury.
00:06:05.260 What were in those pages, and how did she convince a grand jury to actually indict Arizona citizens, sir?
00:06:12.900 So what she's done is she's claimed the passions of those particular individuals.
00:06:17.920 Now, today is an important day for our rule of law and our democratic republic,
00:06:25.740 in that it's the first time that we finally get access and start getting access to those documents,
00:06:30.760 and, in fact, what actually occurred in the grand jury.
00:06:33.800 What we think is disconcerting is that the attorney general has gone all over the media talking about how many crimes occurred
00:06:41.620 and what these particular electors did, what they did what was wrong.
00:06:46.120 But she has not produced any of the documents that back any of her claims.
00:06:51.760 And here's the other important thing that I really want to bring up that's very important in this,
00:06:56.520 is that they've alleged that my clients have committed some sort of conspiracy.
00:07:00.720 What I would like to know, in terms of full transparency for the Minister of Justice in Arizona,
00:07:06.320 what I would like to know is this.
00:07:07.820 Has the attorney general spoken to the attorney generals or anybody in Michigan, in Georgia, in New York,
00:07:14.900 to draft this particular indictment, to get ideas about this indictment,
00:07:19.480 or to have a conspiracy against the individuals who are supporting Trump in the 2020 election?
00:07:25.820 That's really what I want to know, and I hope to get through discovery.
00:07:28.980 Your discovery process could take a long time.
00:07:34.680 One of the things we've been arguing for legislative purposes to make sure this can't happen again
00:07:39.840 is that the House of Representatives that has judiciary, has oversight here,
00:07:45.040 should be conducting hearings and subpoenaing the AG in Arizona, the AG in Michigan, the AG in Georgia.
00:07:52.760 To get to that answer today, don't we need to know that answer?
00:07:56.940 Was there some conspiracy?
00:07:58.420 Because it appears, since there's no coincidences, it appears that that happened.
00:08:04.580 And what strikes me, it seems like the Arizona case, at least the way she propels it, is the simplest.
00:08:10.320 Why did she wait all the way until you're 100 days away from a primary in Arizona?
00:08:15.280 Because we believe, like, unfortunately, what's happened over the past few years
00:08:21.320 is that Democrats do what they're accusing their opponents of doing.
00:08:25.600 They're actually stifling speech.
00:08:27.720 They want to stamp out and have no questions about the electoral process,
00:08:32.900 even though in 2000 there were many questions.
00:08:35.720 In 2008 there were many questions.
00:08:37.600 In 2016 there were many questions.
00:08:40.180 I remember all the news media going down to Georgia,
00:08:42.600 questioning the gubernatorial election with Stacey Abrams.
00:08:46.780 And, of course, in none of those cases did criminal charges occur.
00:08:51.060 I think that we should support and we should defend people's ability to question the electoral process
00:08:58.980 and question and bring account people for election integrity issues.
00:09:06.640 Do you think that this was brought at this time by the AG this late in the process,
00:09:10.940 given that most of these facts, I think, and I'm not saying there's a crime,
00:09:15.460 but most of just the facts have been known for years and years and years
00:09:18.940 to basically suppress people questioning the 2024 election, sir?
00:09:25.360 Yeah, and that's definitely one of the issues that we're going to bring up.
00:09:28.360 One of the advantages we have in Arizona is we have a statute on the books that talks about
00:09:35.060 bringing a prosecution for a political purpose.
00:09:37.660 It's called an anti-slap legislation.
00:09:41.100 And so we plan on bringing an anti-slap legislation,
00:09:45.360 that legislation against our attorney general.
00:09:48.420 And what this does is this, is it flips the burden of proof on its head.
00:09:53.020 So if we present a prima facie case that there was some sort of political nature to this prosecution,
00:10:01.080 then it now becomes the attorney general's duty and their job and their burden to prove that it was not.
00:10:06.700 That's what we intend to do.
00:10:08.360 I don't know if Attorney General Mays will be able to take the witness stand,
00:10:13.280 but we would encourage her to take the witness stand.
00:10:15.640 If this is totally above board and full of transparency,
00:10:19.420 then she should be willing to face questions and face questions in the public with cameras there,
00:10:25.380 just like there were today, from attorneys like me,
00:10:29.120 so that we can question her about the political nature of this prosecution.

00:10:41.260 is how they are attempting to make sure that Project 65 is going after all the attorneys.

00:11:41.480 And that's the important piece, is that the remedy to issues regarding election integrity is not the stifling of speech.

00:11:52.740 You know, I've received many, many questions over the past few days regarding my clients,
00:11:57.860 talking about they committed some sort of wrong because they filed lawsuits or questioned the election.

00:12:03.320 I think that's a sign of a healthy democratic republic because people are feel free to question their government,
00:12:11.240 to hold government officials accountable.
00:12:14.060 Unfortunately, what this type of prosecution does is it stifles that type of debate.
00:12:19.400 And that is absolutely incorrect in America today.
00:12:23.120 And that's why I believe that we need good people to stand up and fight.

00:20:28.460 And it just didn't—I mean, it didn't pass the smell test for me, but like you say, Rolling Stone picked it up.

00:20:38.900 Rick Wilson, of course, the Lincoln Project guys, all of them, they're all tweeting it out.
00:20:42.700 And it only took less than an hour, I think, for us to debunk it, and we had the first debunking article out there about it, that what had transpired was that the Ukrainian Pravda website, which ironically is, in effect, state media in Ukraine,
00:21:01.060 was peddling some information that came out of another organization, a Ukrainian organization, an NGO, which appears to be kind of an information war entity on behalf of the Ukrainian government.
00:21:14.060 So what happened here is the great defenders of democracy, right, the great media class that is supposed to protect us from all of these foreign meddling and so forth,
00:21:25.480 were actually peddling foreign disinformation about not just obviously any old U.S. citizen, but in fact probably one of the most impactful U.S. citizens of our generation, Tucker Carlson.
00:21:37.240 Now, it would be fine if that information stopped there, and you could just put it down to kind of, oh, you know, maybe some journalist got spoofed by this Pravda report, bad enough as that is, by the way, but I don't think that is what's happening here.
00:21:50.860 When you look at the history of the so-called reporter in London, by the way, working for Newsweek, you will find a long history of peddling the Ukrainian state line on all manner of positions,
00:22:03.440 as it pertains to the war, pre-war, and all of that.
00:22:07.380 So with my tinfoil hat firmly off, I would hazard to say that there is a massive operation now out of the Ukrainian government to dupe American reporters,
00:22:20.240 to dupe, not that they need much duping, by the way, to dupe the American public, and what is the likely end result here?

00:22:27.300 They're going to try, and they are trying actively to change the results of the election.
00:22:32.480 This was designed to try and limit the impact of the things that Tucker Carlson says between now and November the 5th.

00:23:04.920 Can you walk us through some of the highlights, ma'am?
00:23:06.800 So, again, this is related to more unsealed, unredacted motions that Judge Cannon has ordered to be publicly docketed.
00:23:16.840 And these are two motions.
00:23:19.340 Donald Trump's motion to suppress the evidence collected during the Mar-a-Lago raid, primarily based on it was unlawful.
00:23:26.600 The affidavit was incorrect and misleading.
00:23:29.740 And, of course, it was executed improperly.
00:23:33.580 And part of this disclosure today, as I'm reading through this, Steve, and I really had to read it a few times to believe it,
00:23:41.680 is that in the FBI operations plan, they give guidance on how to, on the use of deadly forks at Mar-a-Lago.
00:23:51.640 This is part of this 20-page whatever plan that the FBI and law enforcement put together.
00:23:56.840 In addition to that, they discuss how these agents, they had about 30 agents, 25 from Miami, four from Washington's field office, who were armed.
00:24:08.280 They had weapons.
00:24:09.480 They had ammo.
00:24:10.700 They had handcuffs.
00:24:12.460 And they talked about what would happen if Donald Trump showed up at Mar-a-Lago during this raid.
00:24:17.740 And what, first off, they had authorization for deadly force.
00:24:26.700 Then they go through, they have all the accoutrements.
00:24:30.600 What did they say was going to happen?
00:24:32.560 They weren't going to handcuff, they weren't going to handcuff Trump, were they?

00:24:37.320 I mean, they were obviously prepared, and they talked about this in this document, for contingencies and what agents could do or how they would handle if the former president showed up and how they would engage with Donald Trump and the Secret Service.
00:24:53.600 Then there was a little caveat in there about giving really vague instructions if there was some sort of resistance by Secret Service agents to this raid.
