Bannon's War Room - Episode 3718： Biden Will Not Be On The Ticket

00:00:00.000 right now because i'm about to tell you the truth and f you if you can't handle the truth

00:00:05.560 this version of biden intellectually analytically is the best biden ever not a close second and

00:00:17.100 i've known him for years the brzezinski's have known him for 50 years if it weren't the truth

00:00:22.400 i wouldn't say it i'm trying to provide housing for black americans and dealing with the 0.87

00:00:28.640 segregation that exists among these corporate these corporate operations that collude

00:00:34.920 to keep people out of their houses covet excuse me with um dealing with everything we have to do with

00:00:42.020 uh look if we finally beat medicare thank you move until we get the total ban on the the the total

00:00:54.040 initiative relative to what we're going to do with more border patrol and more asylum officers

00:00:59.960 president trump i really don't know what he said at the end of that sentence i don't think he knows

00:01:04.600 what he said either look yeah i think one thing republicans and all americans should think about

00:01:09.840 what we saw tonight is if you're a partisan republican this is not a time for glee there's

00:01:16.380 no gloating tonight what we learned in 90 minutes on television is that the president of the united

00:01:21.860 states at least appeared somewhat unwell and i know we're out here analyzing the politics of it and

00:01:28.440 the machinations of all of it but he did not look good he did not sound good he did not acquit himself

00:01:34.680 well politically or as the leader of the most important country on the face of the planet we have

00:01:41.560 seven months to go in his term we have a shorter period left in this election i do think he walked

00:01:47.340 into this thing tonight up to about right here in the quicksand and now he's up to here and i don't

00:01:54.060 know how you get out of it when it's this high and your job approval is 38 percent and you already as

00:02:00.460 abby pointed out correctly earlier having trouble with your own base and now they're in a total panic

00:02:05.020 but how do you get out of this morass with so little time to go and they did it let me let me just

00:02:10.960 take the other side of this kamala harris debate it is a fair question to ask right now what is going

00:02:17.380 on inside the white house every day is she currently making more decisions in the white house than we 1.00

00:02:23.580 know who is making decisions in the white house right now we're talking about this in terms of can

00:02:27.880 joe biden win an election and serve for four years i want to know i want to know what's happening on a

00:02:32.800 day-to-day basis to me she is the big story tonight because her position in this administration in

00:02:37.900 this campaign has become magnified by a thousand right i expect that you're going to see not just

00:02:42.460 the vice president out more you're going to see gretchen whitmore out more you're going to see

00:02:45.420 gavin newsom and they're going to be campaigning for biden but they're also showing the chops that

00:02:49.360 they have because there is a non-zero chance after the performance tonight that a change has to be

00:02:54.300 made if the president were to step aside and there is a bench dems actually have a very strong

00:02:58.740 bench but not the strongest person at the top of the tech guys this conversation about harris i mean

00:03:03.720 listen first of all this was not a good interview she couldn't answer a simple question about

00:03:08.060 what's joe biden like on a day-to-day basis because the honest answer is not acceptable that's number one

00:03:13.600 number two listen to what you're saying the the sitting president of the united states is so out of

00:03:21.980 it and infirm that you're now turning to the vice president united states to carry your ticket and

00:03:27.480 your party when they are currently in office supposedly running the country yeah this is

00:03:33.160 this is a scandal the white house press secretary this last few days have been telling us oh the

00:03:39.420 videos you've seen of joe biden aren't real they're fakes the u.s government right now has a president and

00:03:44.880 none of us are quite sure what goes on on a day-to-day basis and you're putting all your hopes and dreams

00:03:49.640 into the vp okay that is not that is not true this is the primal scream of a dying regime

00:03:59.260 pray for our enemies because we're going medieval on these people

00:04:04.320 you're just not got a free shot all these networks lying about the people the people have had a belly

00:04:10.940 full of it i know you don't like hearing that i know you try to do everything in the world to stop

00:04:14.860 that but you're not going to stop it it's going to happen and where do people like that go to share

00:04:19.200 the big line mega media i wish in my soul i wish that any of these people had a conscience ask

00:04:27.700 yourself what is my task and what is my purpose if that answer is to save my country this country

00:04:35.340 will be saved war room here's your host stephen k bann

00:04:40.700 it's friday 28 june in the year of our lord 2024 110 years ago today in sarajevo uh serbian

00:04:52.800 nationalists executed a uh the uh heir to the throne of uh austria hungary and uh what 30 days later

00:05:02.700 and nobody realized how big a deal this was at the time 30 days later you start one of the greatest

00:05:07.760 slaughters of mankind's history world war one last night this is not about politics this is not about

00:05:14.480 the 2024 campaign scott jennings right there you saw on cnn and scott jennings is a mcconnell guy

00:05:20.180 one of the mcconnell communications guys scott jennings and steve bannon would not agree on the

00:05:25.260 day of the week or the time of the day in that day of the week he is the only person last night

00:05:32.220 on national television that nailed exactly what the situation is president trump

00:05:39.320 against all political advice for the good of the country agreed to do that debate and essentially

00:05:47.480 gave biden and his crew a free option which you never give a game a free option

00:05:51.460 he did this for the nation because the nation needed to see exactly what the commander in chief

00:06:01.720 currently although as you know on this show illegitimate but current commander in chief

00:06:06.280 with the nuclear codes in control of all the combatant commanders throughout the world

00:06:10.900 is actually like and what scott jennings said right there is absolutely correct we have

00:06:18.860 a national security crisis right now that is going to lead to a constitutional crisis about the 25th

00:06:27.300 amendment very shortly the sit the the discussions not about politics and and who's going to run

00:06:34.340 against trump joe biden is not going as i've said before joe biden is not going to be on the ticket

00:06:39.640 come the the democratic convention right now they know you see the chatter we're have to grass on a night

00:06:47.020 they would lose the presidency by 10 to 15 points we would pick up 56 57 maybe 58 senate seats

00:06:54.780 right now the hill last night quoting democratic operatives i mean the hardest nuts out there

00:07:00.980 you could lose 20 house seats the democrats lose 20 you would have a generational wipeout that would

00:07:06.020 take them decades to come back from they will not allow that to happen politically but what we saw last

00:07:11.400 night is what exactly is going on in the white house and how the media if you can pull that uh my getter

00:07:20.700 uh go to getter and and pull up but and i think i sent it to you guys the new york times today the five

00:07:25.800 lead columnist the heavies of the heavies tom friedman frank bruni nicholas kristoff all with all with

00:07:35.300 all with uh all with uh articles saying this is terrible biden's got to go you're telling me tom

00:07:41.980 friedman didn't know this you're telling me frank bruni with his connections didn't know us you told me

00:07:46.040 when you came to msnbc last night and it looked like awake or sitting shiva are you telling me

00:07:53.360 that they haven't known what's exactly going on when the white house uh when the white house the zen

00:07:58.300 master jean pierre tells oh no these are all doctored videos they don't know exactly going on

00:08:02.960 number one this is politics aside what president trump did last night was for the nation he put that

00:08:10.240 no politician no strategist would ever have done this for the politics of it because obviously

00:08:16.540 you're giving them the option to change it out and they will change it out he did it for the nation he

00:08:21.600 did it to come front and center and see exactly with with no intermediary exactly what the situation is

00:08:30.800 with the so-called commander-in-chief the issue before us right now is quite simple it's not about

00:08:37.020 who's going to win in november because currently if you go on trump's going to win by 10 or 15 points

00:08:43.100 it'll be 400 electoral votes and a blowout in the senate and a wipeout in the house the question for 0.87

00:08:48.060 the citizens of this country is quite simple how and with whom do you get to january how do you get

00:08:56.640 to donald j trump hand on the king james bible at high noon on the 20th of january 2025 how do you do that

00:09:03.980 tell me how you do that would any where would you like to be last night and this morning would you

00:09:09.680 like to be in jerusalem or taipei or kiev or would you rather be in moscow tehran and beijing

00:09:16.200 i hope that the seventh fleet commander has put the seventh fleet on high alert

00:09:22.580 because right now the enemies the people that hate this nation the most the people that hate our allies

00:09:31.420 the most the people that hate the countries that are affiliated with the most are sitting there and

00:09:36.380 seeing exactly what you saw scott jennings is absolutely right and the way he batted back

00:09:41.900 van jones and and david axrod the fix was in as soon as it was over they were talking about you know

00:09:48.400 more in sorrow than in anger and we got to do this the new york times the fix was in over at msmc

00:09:54.440 and here's what they did and this is how praetorian guards roll gavin newsom gave a master class last

00:10:01.460 night and having somebody's back who you know you're going to be asked to replace this is what

00:10:05.920 the praetorian guards did remember the praetorian guard would always go to those generals first

00:10:10.680 that appeared and seemed the most loyal so you wouldn't have a huge bloodbath in a transition

00:10:17.520 the praetorian guard reached out to gavin newsom you had uh you had pastor senator warnock

00:10:26.400 the axios did i tell you yesterday this nothing happens randomly there's no random occurrences in

00:10:33.920 the imperial capital here hill what when when axios and mike allen put out a story yesterday morning

00:10:42.320 about michelle obama and she detests the she attests the bidens and she's not partisan oh so

00:10:50.180 you could like come in not partisan and unite the country there's two tracks going on here two tracks

00:10:55.440 one is about the country that's a national security crisis at this very moment that is going to lead to

00:11:04.500 a constitutional crisis about the 25th amendment there's also a political issue and the political

00:11:11.000 issue is because the democrats put themselves above the nation and certainly they're going to trade

00:11:16.200 him out and they're going to do that after they extract maximum pain from trump president trump's

00:11:22.360 upcoming a prison sentence that the out of control moscow show trial judge is going to give him on july

00:11:29.760 11th and they're going to trade it out politics so there's two tracks going on we obviously have to

00:11:35.280 extract the most pain politically and doing this transition why why because they're going to have

00:11:42.480 two phases of that a messiah searching for the messiah and then they're going to have the honeymoon 1.00

00:11:48.180 you saw it last night trump's a liar everything he says a lie trump wouldn't ask crazy a liar he's a 1.00

00:11:53.120 liar he's a liar that's the best president trump was so magnificent particularly for the first hour 1.00

00:11:58.260 until the until the until the moderators let it devolve into something else he was powerful he was 0.99

00:12:04.320 concise he was statesman like they don't care about that do you think they're honestly after what you saw

00:12:12.740 last night in the jeopardy they put this nation do you think for a second that they're just going to

00:12:18.020 sit there and turn the country over to us do you think that people that would do that he had 16 senior

00:12:23.960 people in his administration and people that he's close to at camp tabord for a week are you telling

00:12:29.100 me they can't see that scott jennings asked the question what is going on in the white house who

00:12:35.260 knew about this in the media who have been his praetorian guard the media who has covered this up

00:12:40.900 that we started the show with joe bian this was from a couple weeks ago i think the best i've ever seen

00:12:46.420 the smartest i've ever seen bro i'm going to hang that around you every day because this nation is in a

00:12:53.300 crisis at this very moment and why are we in a crisis this very moment because you have an

00:12:59.060 individual that clearly is not does not have all his faculties it was it was humiliating for this

00:13:06.460 nation it was embarrassing for biden but but most importantly it is about quite simply they have put

00:13:15.300 their own political uh benefits ahead of the country donald john trump did something yesterday

00:13:23.180 that is a profile in courage he put the nation first he did something that no political group

00:13:29.980 would ever agree to he agreed to their rules he agreed to when it would happen he agreed to everything

00:13:36.300 he didn't push back he agreed to all of it why did he agree to all of it because he understood

00:13:42.940 that the only way for the nation to see what the reality is is to see it what do we say here all the

00:13:50.900 time see what you see see what you see and last night you have a cabal of media and political

00:14:01.760 operatives in this radical biden regime that have put the nation in jeopardy let me repeat that they 1.00

00:14:09.720 have put the nation in jeopardy i don't care about who he's getting changed out with i don't care about 0.71

00:14:15.180 the meetings they're having is michelle obama or gavin newsom or gretchen richmond i don't care about

00:14:19.560 it what we care about is what's going on in that white house today who's actually in charge and who

00:14:25.600 knew about it and i want to start with those columnists tom friedman you brag about how dialed

00:14:29.980 in you are o'donnell at msmc how dialed in you are frank bruny how dialed in you are okay if you're

00:14:36.540 dialed in you've known this and you've known this for a while and you have lied you've looked to the

00:14:41.100 american people and you've lied we have a national security crisis that's going to lead to a 0.93

00:14:45.880 constitutional crisis on the 25th amendment we're going to take a short commercial break we're going

00:14:51.260 to return in the warm in just a moment can your savings weather an economic storm think about

00:15:02.960 what you've put away for the future inflation can render cash worthless real estate can crash like in

00:15:10.680 2008 economies built on a mountain of debt can fall like a house of cards there are very few

00:15:17.080 physical assets you can invest in that can stand the test of time gold has withstood this as a

00:15:24.000 valued form of money for millennia i actually think for 8 000 years of man's recorded history

00:15:30.160 it's why people are flocking to it now why birch gold is busier than ever through a little known tax

00:15:36.060 loophole birch gold lets you convert a retirement account into a tax sheltered ira in physical gold

00:15:43.180 and the best part it doesn't cost you a penny out of pocket let me repeat that it doesn't cost you a

00:15:49.060 penny out of pocket to learn more about this to immerse yourself in information text bannon b-a-n-n-o-n

00:15:55.180 to 989898 and claim your free info kit on gold let me ask you this again can your ira or 401k

00:16:05.160 weather an economic storm because a storm's coming if it can't call the people i trust that's birch gold

00:16:12.180 text bannon to 989898 secure your savings today birch gold group republicans and all americans

00:16:21.060 should think about what we saw tonight is if you're a partisan republican this is not a time for glee

00:16:27.680 there's no gloating tonight what we learned in 90 minutes on television is that the president of the

00:16:33.540 united states at least appeared somewhat unwell and i know we're out here analyzing the politics

00:16:39.840 of it and the machinations of all of it but he did not look good he did not sound good he did not

00:16:45.940 acquit himself well politically or as the leader of the most important country on the face of the planet

00:16:52.360 we have seven months to go in his term we have a shorter period left in this election i do think he

00:16:58.960 walked into this thing tonight up to about right here in the quicksand and now he's up to here

00:17:04.520 and i don't know how you get out of it when it's this high and your job approval is 38 percent

00:17:22.060 did it let me let me just take the other side of this kamala harris debate

00:18:56.820 none of us are quite sure what goes on on a day-to-day basis and you're putting all your hopes and dreams

00:19:01.580 into the vp okay that is not that is not true this is the this is all this is the only thing that

00:19:08.600 should be focused on there should only be the focus on this on this this is the thing itself

00:19:14.180 because it

00:19:16.700 not symbolizes it it encaptures encapsulates encapsulates everything about these people

00:19:26.480 and now on the world stage you can't hide it look at zelinski's comments you can't hide it

00:19:32.440 infirmed sick scandal last night scott jennings was the emperor scott jennings of all msnbc and

00:19:42.900 and fox and all of it was the only guy that sat right there and said stop stop about the politics

00:19:50.360 stop about this election stop about the democratic convention stop about all your who's going to take

00:19:56.340 place we have a crisis here and now we've had a crisis that has not has not been this bad since

00:20:04.120 wilson had a stroke and had his wife kind of run the deal we need to get immediately an answer

00:20:13.300 exactly what is going on in this white house and this regime this administration we need to know

00:20:20.480 immediately immediately and we cannot back off this for the good of the nation this is where the country

00:20:27.200 comes first because we're going to hurdle quite quickly into a constitutional crisis

00:20:33.920 can you imagine if they called the combatant commanders if you call pacific fleet in right now

00:20:39.120 if you call the chairman the joint chiefs and in the service heads about what the reality would be do

00:20:44.880 you understand what the message traffic out from the pentagon to the combatant commanders last night

00:20:49.260 look at zelinski's look at zelinski's comment would you like to be in jerusalem would you like to be in

00:20:54.400 taipei would you like to be in kiev and see that that is a crisis to the heart of our country and

00:21:04.320 then the second part is who knew about this you know joe but joe scarborough he's the best we've ever 0.99

00:21:10.320 had i've known him for 30 years you're nothing but you're you're disgusting and revolting he sat 0.99

00:21:15.280 there this morning like it was awake you were so shocked in shock about what happened and now you're 1.00

00:21:21.600 coming up with everything you think you are revolting and you're part of the problem in the

00:21:26.800 new york times all those columnists tom friedman you're part of the problem frank bruni you're part

00:21:31.600 of the problem msnbc you're part of the problem you know why because you're all dialed in you all know

00:21:36.080 what's going on you are the problem and this has to be resolved how do we get to january 20th

00:21:45.520 death what happens to the nation that's the reality for this country

00:21:54.640 this other track is all their machinations about the search for first of all we're going to go for

00:22:00.960 the search you know joe biden heroically for the country's gonna step aside you have to then you're

00:22:06.080 gonna have the search for the messiah that's going to save you from uh the new hitler right and from 0.94

00:22:14.720 maga from these right-wing uh xenophobic misogynist racist homophobic followers of president trump 0.71

00:22:25.280 and then when the search for the messiah or the team team messiah ends then it's going to be a 0.97

00:22:30.640 honeymoon like you've never seen before look at just a vitriol on president trump a magnificent

00:22:36.800 performance look at the vitriol on president trump last night that's nothing compared to what's coming

00:22:40.720 oh by the way with the prison sentence handed up now by mershon delayed until after the election

00:22:48.960 it's as clear it's as sure as the turning of the earth it's as sure as a turning of the earth

00:22:58.640 perfect we'll get to mike davis in a second we got the chevron deference overruled it huge thing on the

00:23:02.640 ministry of state i want to bring in one man saw this and i am so proud that i got the opportunity

00:23:10.400 to work with him at breitbart years ago and that he came on the show last week and it's not steve

00:23:14.640 bannon saying he nailed it i said he nailed it at the time it's morning joe let's play the clip

00:23:20.160 from morning joe and i want to bring in charlie spearing from the daily mail let's go and play it

00:23:24.240 what do we do now uh this is we need to figure out how that works and there's a story the other day

00:23:32.320 and uh in the totally non-credible in many respects uh daily mail i think a couple weeks ago on monday

00:23:39.920 that said that uh that the clintons the obamas uh schumer and pelosi we're going to watch this debate

00:23:46.160 and if did not go well for joe biden they were going to go and try to have the talk with him about

00:23:49.600 about stepping back um i may go laughed at that it was not a credible report you look at the daily

00:23:55.760 mail the british tabloid whatever i had about six good sources after that who said that's not totally

00:24:03.200 false and uh the interesting part of that was the schumer and pelosi piece because no one thinks joe

00:24:08.640 biden would listen to the obamas the clintons on the subject but because he cares so much about

00:24:13.920 democrats in the house and senate there was some discussion about whether nancy pelosi and chuck 0.99

00:24:18.560 schumer privately we're at least taking soundings on this question i don't know what will happen

00:24:23.200 now going forward but i will say these are the kinds of conversations that people are having now

00:24:27.280 in the democratic party as we speak what to do because the level of panic is for me in my time

00:24:33.600 covering politics i've never seen a level of panic about this uh on the scale

00:24:39.120 so that's john hallman uh on the morning joe show i noticed john and you're not on the list

00:24:45.120 to be investigated because you haven't worked hard enough but you're amazing talent

00:24:49.280 but i charlie spearing coming here for a second is your story i don't remember john hallman coming

00:24:54.400 out at the time i i failed to miss this on his twitter feed i don't remember him coming out the

00:24:59.120 time and maybe he did and we should search but i don't remember and we follow heim hallman i don't

00:25:03.360 remember him coming out with his six credible sources and saying yeah charlie spearing at the daily

00:25:09.280 mail after he trashed the daily mail being not credible i have six good credible sources that say

00:25:15.280 spearing is right i think i missed that so tell us about the story we had you on here for a week ago

00:25:20.960 and why now is everybody saying that's exactly what's going to go on yeah steve thanks for having

00:25:26.960 me back on to talk about this story when i talked to democrats earlier and this was over the course of

00:25:31.680 a month last month and for many days afterwards was talking about what would it take to replace

00:25:38.080 joe biden is there some is there some way that democrats are reassuring themselves and trying to

00:25:43.360 get it out there they all expected joe biden to actually do well in this debate they kind of thought

00:25:49.360 that yeah you know that they wouldn't have to pull the ripcord and they wouldn't have to deploy this

00:25:53.760 plan if it actually took place right now they wake up the next morning and they're already seeing the

00:25:58.800 signs out there of key democratic operatives sending the message through their operatives through their

00:26:05.360 media you know their media people this is a crisis and we've got to fix it

00:26:12.880 when you say crisis they know now you're absolutely convinced after what you saw last night that uh that

00:26:18.960 this still stands it has to be schumer pelosi clinton and obama that have to go and make the move on joe

00:26:24.160 biden to really jill biden absolutely look it's very interesting people connected to obama are already

00:26:31.040 reading from the same script all morning they were very silent for several hours after the debate but

00:26:36.640 now they're all on this and speaking from the same tune joe we love joe biden joe biden did a good job

00:26:43.280 he was a great president but it's time for us to start having these conversations about joe going and i

00:26:50.240 think john highland is right i don't think the biden campaign respects the clintons i don't think they

00:26:55.760 respect the obamas they are extremely stubborn they were routinely counted out encouraged to leave 0.88

00:27:02.720 urged to step down and they have a chip on their shoulder they are not about to listen to the obamas

00:27:07.760 and the clintons about this because they've had way too much um aggressive work against them throughout

00:27:14.800 their entire political career and i think that if right now all eyes should be on nancy pelosi she's the

00:27:21.120 one who will be able to go to joe and tell him that it's time to stop step down she will be the

00:27:26.880 one to be able to have a close conversation with jill biden about the future going forward here and i

00:27:33.680 think everyone should be watching pelosi for any move charlie your uh social media where do people

00:27:40.160 follow you over the daily mail at charlie spearing on twitter on truth social and on instagram or every

00:27:47.600 day at the dailymail.com charlie thank you so much honored to have you on here okay we just had a

00:30:20.880 a monumental day at the supreme court already we're going to go there momentarily i would just want

00:30:33.760 to reiterate um that uh i i do recommend president trump what he did for the nation last night was a

00:30:39.600 profile in courage because as i said many times uh he was going to beat biden by five points or more

00:30:46.720 in a blowout come this november he knew he could beat biden he agreed to this early debate and

00:30:55.440 remember on all their rules and how much how much did i bitch and moan about these rules please tell me 1.00

00:31:02.080 audience a lot he agreed to all the rules he agreed to all of it let biden have whatever they want

00:31:09.200 because the nation has to see what they see that is a patriot he didn't have to do that he could

00:31:19.600 said look what he did what he did in the in the in the primary not debate him at all not to give biden

00:31:25.600 biden is actually president trump is going after the incumbent but the incumbent's illegitimate

00:31:32.720 and he's kind of the the the he's the upstart he's behind that's why they needed a debate president

00:31:38.000 trump didn't need a debate biden needed a debate and he gave it to him on their rules and in their

00:31:41.920 time and particularly before he's sentenced and before the convention and what i keep saying it

00:31:48.160 has to just be the democratic nominee whoever that is that's real debate you can't give them a free

00:31:53.200 option we're not in a we're not going to do an august exhibition game it was trump in his wisdom

00:32:00.240 and i tell you all this all the time when i have disagreements with him about things like this

00:32:03.440 99.99999 percent of the time he is correct he did this for the country that's a profile and

00:32:11.520 courage i think he needs to come to the sticks today before this great rally in the commonwealth of

00:32:15.440 virginia and i think he has to lay down exactly where we are this is not about politics this is

00:32:20.880 not about their whole effort you know charlie spearing about nancy pelosi and spearing nailed it

00:32:25.600 pelosi's the key it's it's like the movie in the godfather whoever comes to you at the funeral and

00:32:31.520 offers the meat that's the one it's pelosi it's not the clintons or the bidens he's been fighting

00:32:37.520 with those guys forever not just clintons or the obamas it's pelosi she's the key not schumer pelosi

00:32:45.520 but for the country it's what scott jenny said last night what is going on day to day in this white

00:32:51.680 house who is actually making decisions

00:32:53.760 this is a national security crisis immediately we have it impaired a very ill and he's ill we have a

00:33:03.280 very look at that last night that cadaver that's the commander-in-chief of the most powerful armed

00:33:09.040 forces in the history of mankind that what do you think they're feeling in kiev right now harnwell

00:33:15.760 will tell you they ain't feeling good how do you think they're feeling in jerusalem right now they

00:33:18.720 ain't feeling good how you think they're feeling in taipei which is probably in the worst situation

00:33:22.480 in beijing you're sitting there right now saying okay boys let's let's get it out let's think about

00:33:29.200 let's think this through if we go now that's what will lead to a constitutional crisis on the 25th

00:33:34.400 amendment mike davis joins me at the over at the supreme court mike i i want to get to the 25th

00:33:39.840 amendment you're an expert on all this stuff and and the crisis we're in in the governance because all

00:33:44.480 i'm worried about is how you get to how this country holds it together in a world that's starting

00:33:49.520 on the on the 110th anniversary of uh of the assassination of the archduke in sarajevo

00:33:56.880 by serbian nationals that led to the greatest slaughter in mankind a war that didn't really 1.00

00:34:01.280 end until 1989 essentially the short and bloody 20th century from 1914 to 1989 mike but i gotta tell

00:34:10.400 you a monumental day we would be talking we were led with you at the steps all we'd be talking about

00:34:14.480 for two hours is the chevron deference can you walk me through what happened the supreme court

00:34:20.400 six to three reversed a 40 year old precedent uh the chevron case where courts for the last 40 years

00:34:29.680 have unconstitutionally deferred to executive branch agencies when those executive branch agencies

00:34:39.040 interpret their own power interpret statutes that give them power so of course these executive branch

00:34:45.920 agencies always interpret that they have more power and the courts are supposed to defer to that

00:34:51.760 interpretation so long as that interpretation is reasonable whatever the hell that means and so

00:34:57.760 you had you have congress uh giving too much legislative power to these executive branch agencies that are

00:35:05.520 unaccountable to the american people it's very hard to remove these people and then you have

00:35:10.080 judges giving away their judicial power by uh by deferring to these agencies on their interpretation of

00:35:17.440 their own statutes well that ended today in this six to three case of course the three liberal justices

00:35:24.640 dissented as we expected but this just shows you how important elections are uh and how consequent how

00:35:32.160 consequential president trump's first term was he transformed the left of center supreme court to

00:35:38.960 the clarence thomas supreme court with the appointments of justices gorsuch kavanaugh and barrett and this

00:35:45.600 means a lot for real americans and real america if you're on the receiving end of the epa as a farmer

00:35:54.000 in iowa where i'm from for example they could crush you and and uh what we need to do with this

00:36:00.720 court over the next 20 years has continued to roll back these uh these administrative agencies the

00:36:06.400 federal government and put them in their proper place as intended by our founders in the constitution

00:36:13.520 i want to address our brothers and sisters who are you know kind of from the ted cruz school or maybe

00:36:18.880 the limited government conservatives we've talked for decades about how you how you get control of

00:36:25.680 the leviathan on the spending and how its insertion in every part of american life and for years and

00:36:31.840 years and years people talked about it as more regulation as a as the the cancer metastasized and

00:36:38.240 that's why this is a seminal moment because there were individuals the don mcgans of the world the jeff

00:36:44.800 clarks of the world's the mark pay a lettuce of the world and a guy named neil gorsuch that had kind of

00:36:51.440 a vision of how you take on the leviathan that's why associate justice gorsuch was trump's first pick

00:36:59.840 mike just tell i want you to explain it in terms of

00:37:04.000 getting control of the leviathan and where this can lead we've talked about limiting government for

00:37:08.080 years and not only we have not limited it's only grown bigger and it's growing it's been growing

00:37:13.120 bigger it's accelerating at an accelerating rate that the gordian knot you had to cut

00:37:18.400 but this is what chevron deference was why does this start to why is this the railhead what i call

00:37:23.600 the mac daddy why is this the railhead of everything we want to do on deconstructing the administrative

00:37:29.040 state sir well i clerk for then judge gorsuch on the tenth circuit when he wrote a powerful opinion

00:37:38.240 on why chevron was wrongly decided at my why it must be reversed and you were on the selection committee

00:37:46.160 for justice gorsuch steve bannon and you saw that opinion you know how impactful it was i also clerked

00:37:52.960 for justice gorsuch to help him get set up on the supreme court this is critically important to him

00:37:58.960 because justice gorsuch understands like the founders understood the dangers of an all-powerful

00:38:07.520 executive branch the dangers of an all-powerful federal government and what the supreme court must do

00:38:14.720 is follow the loan agreement that is our u.s constitution we the people loan our federal

00:38:21.440 government specific enumerate it meaning spelled out and divided powers in exchange that government

00:38:29.440 is supposed to protect our liberties and this federal government over the last 90 years has violated

00:38:35.680 that loan agreement the switch in time that saved nine with the federal government has way too much power

00:38:40.400 that the founders never intended and then that power has been consolidated in the executive branch and

00:38:46.720 then those executive branch agencies have been insulated from accountability from the american people

00:38:52.800 through our elected members of congress and our judges and this chevron decision changes that and says

00:38:59.600 you guys do you guys do not get to decide your own power your statutes are interpreted by courts not the

00:39:07.200 tony fauci's of the world because the tony fauci's of the world are always going to interpret their

00:39:12.320 power to give them more power

00:39:17.520 you know this is also about process folks because we was oh you're so negative you just want to stop

00:39:21.680 things we had to stop hillary clinton and defeat her because of all the madness they wanted and you know

00:39:30.080 managed to climb by our elites but one of the most important things is merrick garland you ever heard his

00:39:34.720 name have we ever talked about merrick garland on the show have i ever mentioned merrick garland

00:39:38.480 have i he was going to get a lifetime appointment to the supreme court instead of merrick garland

00:39:47.600 instead of that little worm instead of him we get neil gorsuch you stop it first you have to stop it

00:39:55.680 first then you pivot to what you're going to do this is monumental we finally now have the intellectual

00:40:03.120 firepower to actually go and to take apart and you wait to this afternoon this is they're going to

00:40:08.800 strip the government these guys the radicals are now inside the the anger against the court from the

00:40:14.800 smart people in this town are going to be just as big quite frankly behind the scenes as it will be for

00:40:20.720 the reversal of fisher and for limited immunity for president trump which are two other blockbusters

00:40:25.840 anything else today mike before we let you go any other drops today

00:40:29.440 there is there is a case out of oregon that my former boss neil gorsuch wrote it's a six to three

00:40:36.720 decision the ninth circuit held that a town that banned homeless camps on public property violated the

00:40:45.600 cruel and unusual punishment clause of the united states constitution so if you don't want homeless

00:40:52.320 people with their tents and their drugs and their trash and their other filth in your public parks

00:40:59.440 uh that according to to these liberal judges on the ninth circuit and three leftist judges on the

00:41:04.960 supreme court that would be unconstitutional for the for a city to end homeless camps in public parks

00:41:11.440 that is absolutely insane justice gorsuch obviously reversed that nonsense six to three but it just shows

00:41:18.080 you steve just like you said if trump didn't win this election you would have leftists locking us up

00:41:24.960 with our covid masks still and we we did we would just have to to defer to them at the cdc and say yeah

00:41:32.000 we have to wear covid masks the rest of our lives and schools have to be closed and remote learning and homeless

00:41:39.280 people can overrun public parks because these left-wing judges are insane and they just proved it today

00:41:45.600 with these three judges these three liberal hens on this homeless camping ban decision somehow

00:41:51.840 that's cruel and unusual punishment maybe we should put these homeless people in the parks 1.00

00:41:57.440 in these three liberal hens neighborhoods 0.92

00:42:02.240 mike davis uh what is article three your social media obviously monday because they've only given one

00:42:07.600 more day monday is a massive day at the supreme court i assume sir with both fisher and uh and uh

00:42:13.920 immunity i hate to say mike that i called it but i think i called it so monday monday's gonna be a

00:42:21.280 blockbuster day they will be far out of town before there's a release mike davis what's your social media

00:42:26.320 how do people get to article three to join the fight one last thing i would say that justin justice kagan

00:42:32.800 is the biggest loser of trump's transformation of the supreme court because she has to be pulling 1.00

00:42:37.840 her hair out right now with these dueling dumb dissents from justice jackson and justice sotomayor so 0.99

00:42:45.280 poor justice kagan that's cruel and unusual punishment but hang on no no no but but hang on 0.93

00:42:50.400 because she's very i gotta ask you then what is this judge justice alito who's such a gentleman

00:42:56.560 what was this thing that people sent me because i can't i can't understand it where he actually goes after

00:43:00.880 judge uh judge uh judge uh judge jackson i think that these uh i think these justice i think these

00:43:10.480 justices are getting fed up with these dumb emotive attacks from these left-wing justices these left-wing

00:43:18.560 justices can't win these cases they the left can't win elections and i would say after last night's 0.59

00:43:25.120 the disastrous debate for joe biden it could be a seven to two uh conservative supreme court in trump's

00:43:32.960 second term mike if you can hang on or maybe come over i want to talk to you about the 25th amendment

00:43:39.440 also so let me figure out give me give me article three again your social media twitter all of it so

00:43:43.680 people would follow you more than ever article three project dot org article number three project

00:44:10.560 here in suspension steve bannon was wrong they just put out fisher i said this is blockbuster let's see if it

00:45:52.080 to tell you i've got jeff clark has joined us we got a whole we got the whole team and we're going to

00:45:55.840 go to all of it mike davis stayed uh mike i guess i guess they heard me say it and robin's chief

00:46:02.080 judge roberts goes screw bannon here's what it is tell me about fisher it's it's a massive uh six

00:46:08.000 three but it's kind of the makeup of it is quite striking striking sir talk to me yes so you have

00:46:15.040 justice jackson writing a concurring opinion joining five conservative five conservatives to uh vacate

00:46:25.120 the sentences of these january 6 defendants and sent it sent it back to uh to uh based upon the court's

00:46:33.040 misinterpretation of this post enron sarbanes oxley obstruction of justice statute uh interestingly you

00:46:42.800 had justice barrett writing a dissenting opinion joined by kagan and sotomayor so i don't know where

00:46:50.320 justice barrett's head is on this one i have to read her dissenting opinion but this is a win for

00:46:56.240 the january 6th defendants as we've been predicting since the oral arguments and this is a big win

00:47:03.200 for the constitution because the biden justice department has this this yeah this is this is

00:47:11.440 i think the most important even here's why this is not about trump's charges they go away it's a joke

00:47:17.280 this is not even about the j6 guys and by the way what's happening to them is is insane okay some

00:47:22.560 of these people and the multi-year of using this felony for multi-year this gets to the heart of the

00:47:29.200 collusion of certain justice with the justice department and i think even the hill staffs just

00:47:34.080 like they removed nixon sir am i too far off based on that is that the beating heart of this problem

00:47:39.520 no you're exactly right the the biden justice department has politicized weaponized and

00:47:47.280 contorted this post enron obstruction of justice statute dealing with corporate fraud to go after

00:47:54.960 trump his top aides like you steve and peter navarro who's sitting in prison right now they want to send

00:48:00.480 you to prison his attorneys like jeff clark who's coming up and john eastman his supporters on january

00:48:05.840 six they're putting real americans in real america in prison for a very long time for a lawful protest

00:48:14.240 permitted by the national park service that got out of control and devolved into a riot and they're

00:48:19.760 trying to use this bs interpretation of this obstruction of justice statute to drop the hammer

00:48:27.120 on these trump supporters while they give amnesty to the much more deadly dangerous and destructive blm 0.97

00:48:34.640 antifa hamas abortion industry activists trans terrorists who are causing a hell of a lot more 0.93

00:48:41.360 damage i led the kavanaugh confirmation on the senate judiciary committee i was the senate staff 0.98

00:48:46.320 leader they disrupted those proceedings within seconds not a damn thing happens to them they 0.50

00:48:52.320 were trying to stop the peaceful transfer of power on the supreme court nothing happens right if you are

00:48:58.400 if you are a leftist if you are abortion industry activists if you are a hamas supporter you can get

00:49:03.920 away with whatever the hell you do but if you're a trump supporter they want to throw you in prison

00:49:08.480 for years and we cannot let the justice department use vague laws to go after their

00:49:14.480 political enemies and the supreme court put a stop to that today

00:49:20.400 mike davis once again article three your social media article three project dot org article number

00:49:26.960 three project dot or donate take action follow us on social media

00:49:34.160 brother thank you so much jeff clark let's go to first uh let's do uh uh j6 let's do fisher and then

00:49:40.160 we'll get to the chevron deference of which you're an expert tell me about fisher

00:49:44.480 sure so fisher's great steve it's a tremendous statutory interpretation

00:49:49.440 case and it was the obvious statutory interpretation all along it's a statute that's directed at obstruction

00:49:56.880 of justice that's even in the title it's all over the place it was only designed to be changed after

00:50:03.680 the enron debacle because of the so-called enron loophole and it's easily construed that addition to

00:50:11.440 the statute to mean that you're talking about forms of obstruction that are like the existing forms of

00:50:18.160 obstruction like tearing up a document like hiding a document uh etc or you know witness intimidation

00:50:26.640 of the like it's not designed for protests and so the supreme court says you know that that's not

00:50:32.560 what the statute is for and they apply you know i'll give your your audience two quick uh little latin

00:50:39.120 lessons it applies these two classic ancient canons of interpretation nos tutora socius and they use

00:50:46.160 dem generis and they mean that words are known by the company they keep and that uh if you have a list

00:50:52.720 of things the list you construe it uh to mean that everything on the list is of a like kind or character

00:50:59.840 that's what the latin means they apply those cannons they say that out rule outlaws what happened with

00:51:05.840 these january 6 prosecutions and you know that's that's the end of it they made short work of it steve

00:51:12.480 it's a big victory for justice for the j6ers but it's a great upholding of the rule of law because 0.86

00:51:18.800 the biden administration the garland justice department they weaponized this statute

00:51:24.800 they totally misinterpreted it they abused their prosecutorial discretion and the supreme court smacked

00:51:31.360 it down but that's that's the point the point the part of the matter is their abuse of this and

00:51:38.400 they're knowing abuse of the system they knowingly went and did this this is andrew weissman this is

00:51:44.400 why weissman john homan's not on the list weissman's on the list they knowingly knowingly went in and

00:51:50.640 used this and the the federal bench you got to ask some questions here got to be some short you

00:51:57.520 got to be some tough questions am i wrong in that jeff clark no you have to pursue this with maximum energy

00:52:05.120 in oversight to see how we got to this very twisted place look at we haven't talked about it before i

00:52:10.800 think in any of my appearances with you steve but you know i was a a law professor for uh you know a

00:52:16.960 decade while i was in private practice and while i was in the bush administration and i also guest

00:52:22.960 lecture from time to time on constitutional law including last year in in europe and this is the

00:52:28.480 kind of interpretation of this statute 18 usc 1512 c2 that if one of my law students came up with it

00:52:35.120 i would say like oh you know oh you're very clever you're trying to use the text of the statute but

00:52:40.800 come on you know remotely that's not what this statute is intended to do you're forgetting about

00:52:45.680 these two canons that i just described yeah you're forgetting about the fact that this was designed to

00:52:50.640 plug a specific loophole you're just trying to use the statute in a cynical and results oriented way

00:52:56.960 to go after people who you think you should be able to put on the hook even if it destroys their

00:53:02.640 families even if you're not using the statute against the same conduct by the left right we had

00:53:09.840 the whole summer of 2020 with the uh antifa blm summer of love did they get special treatment under

00:53:16.720 the statute that they see themselves sent to jail for long periods of time yeah no jeff jeff jeff
