Bannon's War Room - Episode 3748： Disrupting The Grift On Cap Hill

00:00:00.000 thing that we do have to underline here just so so viewers can can follow what's going on behind

00:00:05.980 the scenes is is the Biden campaign and many Democratic officials do believe that Barack

00:00:14.540 Obama is is quietly working behind the scenes to orchestrate this. Reasonable Americans will

00:00:23.760 and do believe that justices Thomas and Alito are prone and subject to corruption.

00:00:30.000 That the institution failing to punish them is broken and that consequently their impeachment

00:00:36.260 is a constitutional imperative and our congressional duty corruption without consequence

00:00:44.200 infects all it touches. And that is why this body Congress has a constitutional and moral obligation

00:00:56.040 to hold these justices accountable. Moments ago Congresswoman Alexandria Ocasio-Cortez of New York

00:01:04.220 took to the floor to make the case why she introduced articles of impeachment against 0.99

00:01:08.840 Supreme Court Justices Samuel Alito and Clarence Thomas. The resolution against Thomas says he

00:01:13.880 engaged in high crimes and misdemeanors by failing to report multiple gifts of luxury vacations and

00:01:18.980 travel. Impeachment articles against Alito focus on his refusal to recuse from cases related to

00:01:24.300 January 6th despite his indicating sympathy with efforts to overturn the 2020 election

00:01:28.520 by allowing symbols of support for those efforts to be flown outside his residency.

00:01:32.980 So at the heart of all this right the heart of what we're talking about and we're talking about

00:01:36.720 this story and the coverage of it is is not a scandal. There is no wrongdoing.

00:01:42.220 The heart of it is the fact that an old man has gotten older and he's gotten older in ways that

00:01:51.320 are not necessarily predictable because aging isn't after having the most stressful job in the world for

00:01:57.480 three years and it is very clearly taken a toll on him. We can all see that. And now in the next four

00:02:03.700 months he has to do the only thing that may be harder than being president more stressful and more

00:02:07.980 demanding which is to be president while also running for re-election. Those are both full-time

00:02:12.800 jobs. Beyond the incredible media feeding frenzy that that feels like a scandal is the one very

00:02:20.480 obvious question which is at 81 having been the president now with all that stress is president

00:02:28.320 biden capable of enduring the unbelievably taxing task of running the country and being a candidate

00:02:38.520 who can persuade unpersuaded american voters in order to defeat donald trump. I think that in a sense this

00:02:45.000 is long overdue because what democrats have served up for a year now is inaction on the corruption

00:02:51.500 scandals that have rocked the supreme court uh some angry letters uh some public appearances but this is

00:02:57.940 a leap forward in terms of seeking accountability and i think what aoc is trying to remind us here

00:03:04.460 um is that federal judges serve for life with good behavior and that congress is well within its rights

00:03:12.620 to decide that a judge or justice has failed to live up to that standard of good behavior and that when

00:03:18.120 it does congress is really left with no choice but to begin impeachment you know we've heard for now more

00:03:23.380 than a year from republicans well congress can't impose ethical rules congress can't impose an

00:03:28.600 enforceable code of judicial conduct well if that's true and i'm not conceding it but if that's true then

00:03:34.120 that only leaves the impeachment and removal power for congress and that is why aoc is using it right

00:03:39.940 this is the primal scream of a dying regime pray for our enemies because we're going to medieval on

00:03:51.640 these people here's not got a free shot all these networks lying about the people the people have had

00:03:58.360 a belly full of it i know you don't like hearing that i know you try to do everything in the world

00:04:02.300 to stop that but you're not going to stop it it's going to happen and where do people like that go

00:04:06.320 to share the big line mega media i wish in my soul i wish that any of these people had a conscience

00:04:14.480 ask yourself what is my task and what is my purpose if that answer is to save my country

00:04:21.800 this country will be saved war room here's your host stephen k band

00:04:28.580 thursday 11th of july anno domini 2024 harnwell here at the helm filling in for steve bannon who is

00:04:45.180 in one of joe biden's federal prisons up until the november um november the first keeping him out

00:04:53.200 of uh of influence for this general election campaign that's what the democrats need to do

00:04:59.880 folks that's not news for you um i've got cash patel who's going to be co-hosting um with me this

00:05:06.720 morning former chief of staff to the acting secretary of defense but we're going to go to mark payletta

00:05:12.200 start off now uh to analyze and break down this initiative on behalf of the democrats to impeach

00:05:19.700 two justices samuel elita and clarence thomas now my background folks i'll just just give a 30

00:05:25.600 seconds here my background in politics as i worked in the house of commons at 25 to 20 years ago and

00:05:33.080 and then um i worked for the same mp who was then elected to the european parliament and as his chief

00:05:38.880 of staff in brussels i had a couple of insights there in the legislative environment and i'm going to

00:05:46.460 share them with you now before we cut to mark and before we speak to cash um these are these are

00:05:52.940 some of the uh the insights i had working in a in a political environment there is no idea so crazy

00:06:00.760 that you won't see it mainstreamed from the peripheries and then implemented bear that in mind

00:06:10.160 as we're talking about aoc now there is no idea so crazy so delusional so you know unreal so surreal so

00:06:18.700 absurd that you won't see it in real time real time being dragged in from the peripheries to the

00:06:24.520 mainstream and then implemented um the center-right response in this case in the american context the gop

00:06:33.820 the center-right response will be performative they'll go through the motions um of opposing

00:06:41.020 these resolutions they'll be weak their hearts won't be in it because look fundamentally these

00:06:46.620 guys are in politics for the grift the revolving door right they want to do a bit of time in congress

00:06:52.160 and they'll go out do a bit of lobbying on k street perhaps they'll go over to the chamber of

00:06:56.480 commerce then they'll go back into congress it's all like a continuous thing right and for them donald trump

00:07:02.100 is um not an agent of chaos he's an agent of disruption he's a disruption to their strategic

00:07:09.840 paths of grifting of institutional grifting that's what the gop wants to do it wants to be able to do

00:07:17.120 that to do that in peace donald trump and maga this great maga audience on the woman you're the you're

00:07:24.900 you're you're the you're disrupting their plans to do that um without distraction okay so the gop

00:07:32.800 response it would just be performative right as it was for example with steve bannon i overheard a

00:07:39.140 conversation with it with a with a republican congressman last week i won't meet one of the good

00:07:46.340 guys i won't mention his name and he was sort of saying oh yeah you know i keep thinking about how bad

00:07:51.600 it is how terrible it is for steve bannon to be in prison and i keep saying to myself i wonder

00:07:56.340 if we couldn't have done more and i felt like saying guys you didn't do anything you did absolutely

00:08:03.160 nothing if you'd have really wanted to stop steve bannon from going to prison you'd have passed a

00:08:08.180 resolution when you still had a majority of 20 saying that the j6 inquiry was invalidly constituted

00:08:15.560 and by effect it's subpoenas invalid and then you would have given had something

00:08:20.600 to steve bannon's lawyers to go to the supreme court and say this is a material um indication of

00:08:29.500 how this conviction is unsound right those subpoenas were invalid right the gop response will be

00:08:36.600 performative and on the back of it they'll send out emails and they'll do fundraising that's how they'll

00:08:42.060 counter this maneuver by aoc right this is this is absolutely fundamental to the security of your

00:08:47.960 republic what democrats are doing now the left third point the left has to have its way always when it's

00:08:55.800 in power and the left has to have its way always when it's not in power that is a golden rule in all

00:09:02.540 legislatures around the world um oh and the fourth thing which we'll come back later and and this is

00:09:10.260 my experience having just come out totally vindicated totally absolved after four years

00:09:15.880 five years of criminal inquiries here in italy um i repeat totally absolved there's no such thing as

00:09:24.360 despite whatever anyone says there's no such thing as an objective meaning in in the law you might you

00:09:30.980 might think because i thought in innocence having worked in on in a number of legislatures i thought yes

00:09:35.860 what parliamentarians do they write the law and then the judges implement it there is no such thing

00:09:41.860 as an objective meaning to the law that law finds its meaning when it when a case arrives before a judge

00:09:48.640 and the judge has to has to say what it means that's when a judge that's when a law actually has a meaning

00:09:54.020 we'll come on to that later right mark pay a letter um good morning to you um can you break down for us

00:10:02.580 like because we saw the war room but we had war room impeachment they followed breath by breath

00:10:07.880 blow by blow play by play here on this transmission the impeachment of donald trump in what way to start

00:10:16.840 off because this is going to be a big thing now this is it's not just like like five minutes on on on a

00:10:22.780 podcast we're going to be hitting this day after day after day because the democrats have you know have

00:10:27.500 taken initiative and they've moved the needle here they brought an impeachment against donald trump

00:10:32.380 too and now they're bringing bringing impeachments against supreme court justices this is the new

00:10:38.340 normal can you play out for us for the war room posse here how does the an impeachment of a supreme

00:10:47.220 court justice work is it the same way as a as an impeachment process for a sitting president president

00:10:53.280 which from memory you might correct me here it was simple majority in the house of representatives

00:10:59.240 and a two-thirds majority in the senate for conviction does there's an impeachment process

00:11:03.960 for um um and i guess this is unprecedented i guess there hasn't ever been uh i don't know perhaps you

00:11:10.520 could tell me here uh whether there has actually ever been an impeachment either successful or simple

00:11:15.500 process for a supreme court associate justice or chief justice good morning to you and can you help

00:11:22.640 now sort of explain to us exactly what's gonna what's going to go ahead now moving forward

00:11:27.460 sure she um this is the the the the dying lashing out of this regime the progressive regime i really do

00:11:37.240 think that they've been exposed uh the american people are on to them we need to fight hard and defend

00:11:43.000 this but yeah aoc has has introduced these uh two articles of impeachment against justice thomas

00:11:49.800 and justice alito when you read through them ben they're an absolute joke filled with lies filled

00:11:55.200 with ridiculousness right and just they're just crappy pieces of work and there's no basis for them 0.86

00:12:00.440 but but even in you know justice alito is being impeached because he literally you know allowed his

00:12:06.860 wife to fly two flags they don't even have the uh you know they don't even name the appeal to heaven flag 0.96

00:12:13.260 they say it's a flag associated with with uh you know insurrection um these things are jokes

00:12:18.780 we need to beat them down hard in terms of these resolutions uh these and these articles of

00:12:23.960 impeachment but they're going nowhere right it's in the house of representatives uh no one believes

00:12:29.880 them as we're as we're seeing the democrats say things that they don't believe in right they say aoc

00:12:34.940 says joe biden's fine sharp as attack uh you know and he's not everyone knows that we've known that

00:12:41.180 we've talked about that for years uh it was on full display uh at the debate and before then

00:12:46.620 but they are on the run that's why these that's why these articles were of impeachment were introduced

00:12:52.280 because they need to deflect they need to get away from joe biden is incompetent and his mental acuity

00:12:58.900 is gone uh the the articles you want to make a point mark mark sorry let me just so you're so

00:13:05.040 basically that's a really important point here this is substantially a distraction operation isn't it

00:13:11.420 to distract as is the fallout if you can call it over project um 2025 this is the mainstream media

00:13:19.120 finding non-stories to go with in order to distract people's attention away from the fact

00:13:25.680 that joe biden is no longer mentally competent is that right so yeah so ben remember uh and i've been in

00:13:32.780 this town um we haven't met but i've been here since uh 1983 went to law school been in a number of

00:13:38.440 administrations uh you know bill clinton bombed a country because he was being impeached right

00:13:44.120 that was the classic wag the dog movie uh you know distraction so this is what the democrats do

00:13:50.240 they're tried and true thing they they my view is they you are right they want to destroy their

00:13:55.420 adversaries pulverize them you know zero you know a tolerance for dissent right and they go after

00:14:03.060 people they target them they've been targeting justice thomas and just by way of background for you

00:14:07.280 i worked on justice thomas's confirmation in 1991 i was a white house lawyer and worked you know side

00:14:12.440 by side when those attacks came on him and how they went after him they had lost the battle of ideas on

00:14:17.800 justice thomas right he was coasting to victory right he would have gotten more than 60 votes

00:14:22.760 right in 1991 with a democrat senate was 57 democrats and what do they do they pull out the lies of

00:14:29.060 anita hill right that's what they did this is what they do impeachment i was a lawyer at omb

00:14:34.540 during the trump administration that signed the legal memo uh holding the funds for ukraine which

00:14:39.700 the president was impeached on i do it again in a second president acted absolutely proper but that's

00:14:44.600 what they do so they've debased impeachment that's what they've done they just made a political act

00:14:50.580 right that has no meaning this is going nowhere but we need to use it expose how awful they are

00:14:56.260 stand by man we'll be back two minutes after the break the elites are getting desperate they now want

00:15:02.420 to use the technology behind bitcoin for their own orwellian purposes their gold to dominate our

00:15:08.100 economy by forcing everyone to use central bank digital currencies which they control imagine your

00:15:15.060 every purchase being called into question your every move tracked like you live in a communist country 0.57

00:15:21.160 this is not the america we want but it is the america they want to create fortunately

00:16:15.640 welcome back folks here with mark pay letter from the center for renewing america and mark here's one

00:16:25.540 of the articles okay in if you folks if you've just joined us we're talking here about aoc's

00:16:30.420 resolution which she introduced into the house um yesterday calling for the um articles of

00:16:37.900 impeachment for justices associate justices currents thomas and samuel elita here's one of the the the

00:16:46.100 charges if you will refusal to recuse from matters involving his spouse's financial interest in cases

00:16:55.700 before the court now now he's denied that right but however however it's not true and here's he's he's

00:17:04.380 not here's the point right fundamentally with with my third uh my third case that i mentioned in in

00:17:12.480 the introduction democrats want to get their way when they're in power and they want to get their

00:17:17.300 way when they're out of power right what they want is basically what has to be now one example of that

00:17:24.420 principle is that is the miss uh not the misapplication the disequal the the the partial application

00:17:32.600 of principles now even if this were true right and and clarence thomas says it's not true even if this

00:17:40.460 was true where were the articles of impeachment on judge juan mershan right whose daughter now that is

00:17:47.240 not open to question because the fact that he his daughter was fundraising for democrats on the basis um

00:17:54.660 right of of of of mershan's conviction of of donald trump that is not in dispute that is that is

00:18:02.040 objectively uh uh appreciated by all sides no articles of impeachment there right and there's

00:18:10.820 a straight up conflict of interest there right so look this is what i've focused so the law says a

00:18:17.080 judge a judge and the supreme court abides by the lower court uh laws uh the the the the federal law

00:18:23.700 on recusals which is you need to recuse if your spouse is a party a lawyer uh you're going to be a

00:18:29.580 witness or uh will have a substantial interest will be substantially affected by the outcome

00:18:35.320 jenny thomas has nothing like that the so one of them was her financial she's never done anything 0.94

00:18:40.780 in the legal lane she's been a political activist uh her her entire professional career there was no 0.99

00:18:46.560 reason for justice uh thomas to recuse i point you to and i've written a lot about this there was a

00:18:51.600 liberal judge as you talk about the partial application a liberal judge judge stephen reinhart who

00:18:56.740 had the same sex marriage case uh in back in like 2011 2012 it's a celebrated case his wife was ahead

00:19:03.160 of the aclu southern california chapter and she filed two briefs in the court below right that went up to

00:19:09.180 judge reinhart and he didn't recuse and he said my wife's you you know my my views are my views my

00:19:14.300 wife's to use of her own there's no reason for me to recuse and that the left machinery the legal ethics 1.00

00:19:20.400 expert stephen gillers they filed a brief in the supreme court saying this is outrageous that you

00:19:24.900 think that just a judge reinhart needs to recuse his wife had literally entered the case right

00:19:29.980 in the court below and went up to him she was very vocal on the legal issues in that case

00:19:35.080 so with jenny thomas there's nothing even close to that another one justice ginsburg's husband was

00:19:41.440 at a law firm that repeatedly appeared before the supreme court and she never recused once

00:19:46.840 from a single case in fact ruled in favor of marty ginsburg law firm's clients so you see this you

00:19:54.780 know you saw justice ginsburg literally you know attack right try and stop donald trump from becoming

00:20:01.160 president during the 26 campaign and everyone celebrated her right and she never recused from

00:20:06.920 a case involving donald trump so that is just a complete ridiculous argument there's nothing there

00:20:13.480 it's both consistent with the law that justice thomas didn't need to recuse and the double standards

00:20:18.800 that the democrats show are just outrageous the second one is that they claim justice thomas didn't

00:20:24.200 recuse because of his wife's involvement in the january 6th full disclosure i was jenny thomas's

00:20:29.880 lawyer during those proceedings before the january 6th committee she went in for an interview

00:20:34.420 right they went after her they had no reason and no basis to go after her

00:20:38.680 she interviewed for four four hours produced you know she produced whatever relevant document she 0.98

00:20:44.560 you know they asked for and guess what uh she wasn't named in the january 6th uh committee's 0.99

00:20:51.240 final report which was 845 pages the this articles of impeachment says she's directing donald trump

00:20:57.200 she's advising donald trump she's going into the legal strategy you know she's she's uh she's urging trump

00:21:03.080 uh on on on on on his on his legal strategy and and the lawyers jenny thomas was texting with her friend

00:21:08.440 mark meadows that is not advising uh you know you know the president on his legal strategy she was so

00:21:14.160 uninvolved that the january 6th democrat appointed right and completely democrat appointed committee

00:21:20.260 uh didn't mention her once in any hearings or in the final report so she's absolutely had minimal

00:21:26.120 involvement in the january 6th uh you know issues and and again those are sort of you know she went 1.00

00:21:33.640 to the she went to the rally has nothing to do with the legal issues okay there's no reasonable basis

00:21:38.720 for justice thomas to have to recuse from the from uh those issues like presidential immunity and the like

00:21:44.840 uh gifts they claim he didn't disclose gifts it is very clear okay and i've written on this a lot

00:21:51.200 uh um 2012 the judicial conference had allegations that justice thomas was violating the law for not

00:21:59.340 disclosing his trips with his friend harlan crowe both on his plane and and his boat okay he has a he

00:22:05.100 has a friend who's wealthy okay he hangs out with him he goes on vacation with him the the judicial

00:22:10.300 conference said he had done nothing wrong in 2012 he had complied with all the the the requirements

00:22:16.220 of disclosing trips so all this entire section on you know not disclosing gifts is just a complete

00:22:23.020 lie okay the judicial conference which is the body that runs ethics administers the ethics for the

00:22:29.620 judiciary had taken up this issue in 2012 and ruled that justice thomas was in full compliance so

00:22:35.740 right down the line okay on every single um harlan crowe bought his boyhood home to make it a museum

00:22:44.520 okay his mother lives in that home okay as part of the negotiation because she's still living there and

00:22:51.100 he wanted to own this home uh and make sure it wasn't torn down or or whatever um he gave her a

00:22:57.520 right to live in it for the rest of her life okay um that was part of the negotiation in this articles

00:23:03.080 of impeachment they say he's giving her free rent it wasn't free rent it was a you know a hand uh an

00:23:08.240 arm's length transaction uh to preserve the boyhood home of what i consider our greatest living american

00:23:14.360 and our greatest supreme court justice not a bad thing to do it's a great thing to do yet this has

00:23:19.000 turned into a crime uh for these articles of impeachment so and then you have aoc right you're

00:23:24.800 talking about this partial stand remember the stories on her going to the met gala and she gets a dress and

00:23:30.840 her makeup and all of this stuff and she stiffs all of these workers she doesn't pay them right uh and 1.00

00:23:36.840 and then there's finally i think a new york times or some sort of story about it and she finally pays 0.97

00:23:41.120 and lies about how there was miscommunication no she was stiffing working class americans because

00:23:46.780 she thought she's entitled right the the we're the ruling class uh give me my my stuff for free 0.95

00:23:53.400 uh and then i'm going to impeach justice thomas for complying with the law it's ridiculous

00:23:58.020 okay mark um i do want to come back on the on the technical procedures uh on how uh an impeachment

00:24:07.220 against a sitting supreme court associate justice would enroll what the anatomy of this um would be

00:24:15.080 right it would have to pass yeah oh go ahead go please please go ahead yeah it would have to pass

00:24:20.840 the house of representatives right uh so that will never happen um and and if it were to pass as we saw

00:24:27.360 with uh bill clinton right um or or even uh president trump uh it goes over to the senate uh and and and they

00:24:34.700 have a trial where they would have they would you know presumably invite the justice that you or his

00:24:39.020 lawyers to make his case um but it's never going to get that far but just to answer kind of run it

00:24:43.580 through it would need to be i think it's two-thirds uh majority of the senators voting to convict um

00:24:49.720 the person who's being impeached it'll never get out of the house this is just a stunt this is a publicity

00:24:55.220 stunt by by by aoc but we do need to fight back hard then i agree with you and expose it for what it is

00:25:03.080 which is they are trying to destroy the supreme court right for for many many years decades the

00:25:08.960 left has controlled the supreme court with president trump's appointments right and justice thomas of

00:25:14.100 back in 91 is the beginning of this this this great supreme court alito roberts uh in 05 um you know

00:25:21.660 that it is now an originalist court the left has never had to deal with that in in modern times they

00:25:26.880 had this reliable ally who was going to implement their left-wing agenda right always and so

00:25:32.580 uh once trump made these three appointments and the court turns to an originalist court

00:25:36.900 you know not perfect but but the best court in 80 years the court now wants to destroy it and burn it

00:25:42.460 down and intimidate justices which triggered these assassination attempts so they are now on 24 7

00:25:48.480 you know protection mark i want to come back to that point um but first let's bring in cash

00:25:56.600 patel cash good morning to you hey good morning guys so you're you're you're following this um

00:26:03.260 what's your first reading when you heard that aoc uh had had tabled the these um these resolutions

00:26:11.140 of impeachment uh i thought it was one of those uh headlines from the uh daily the honeybee or whatever

00:26:18.680 that west coast outfit is that constantly puts on uh yeah there you go babylon b um but i guess

00:26:25.040 it's the reality as mark was uh you know outlining it's just uh i guess it's not a surprise because

00:26:31.280 their knee-jerk reaction is to come in over the top and utilize the media to say this is normal we do

00:26:37.920 this all the time why wouldn't we do this so if it's the norm might i propose that we take aoc's articles

00:26:44.560 of impeachment and instead of the names of thomas and scalia we insert the names of every single

00:26:51.740 federal judge that has applied the two-tier system of justice at the behest of merrick garland and

00:26:57.340 president joe biden both criminally and civilly let's just do that how about the house republicans

00:27:02.460 since they're not seem to be moving the machinery on impeaching garland and ray and holding them in

00:27:07.500 contempt let's see if we can use their own game board against them and let's see what the media's

00:27:13.100 reaction is um are you telling me that there isn't an actual federal judge out there who based on aoc's

00:27:19.740 guidelines actually committed the alleged crimes that she's talking about or the alleged violations

00:27:24.700 of the canons of ethics i think i don't know mark could probably name 50 off the top of his head

00:27:30.300 um maybe let's start with some of the jan 6 folks what do you think yeah so so again banning and cash

00:27:37.020 you're putting it right on the head in terms of what the left does uh i identified that um justice

00:27:42.940 jackson had failed to disclose her husband's consulting income right for malpractice cases for

00:27:48.780 10 years right and uh russ vote and the center for renewing america filed an ethics complaint against her

00:27:55.100 with the judicial conference it's gone nowhere right but for 10 years she's not

00:27:59.820 disclosed her husband's consulting income okay on her forms we'll be back

00:28:04.540 i want to warn you of a huge change that could be coming to our money in our bank accounts first

00:28:17.740 think back to 9 11 shortly after the government pushed through the patriot act this gave the

00:28:22.380 government power to spy on innocent americans by monitoring our phone and email and tracking our

00:28:28.060 movement across the internet now jim rickards editor of the independent financial newsletter strategic

00:28:34.220 intelligence and new york times best-selling author is warning about a coming event that could elevate

00:28:40.140 this governmental surveillance to a terrifying new level in fact some of the guests i've had on

00:28:45.500 the war room believe that the government will soon expand their powers to track our every move if we say

00:28:51.900 the wrong things on social media donate to the wrong causes buy firearms or even vote maga the government

00:28:58.620 may be able to shut us out of our bank accounts i can't say for sure if this will happen but it's an

00:29:05.180 interesting and dire warning fortunately jim rickards an american patriot and friend of mine has made it his

00:29:11.180 mission to educate us on what he believes is coming and how to protect yourself from the possibility of

00:29:18.300 programmable money watch jim's warning video now before it's censored like i've been in the past go to

00:29:25.740 rickardswarroom.com that's rickardswarroom.com now to see the video here's your host stephen k bann

00:29:40.540 hey welcome back to war room everybody good to be with the panel mark if uh do we still have you can

00:29:45.260 you give us a memory of what the house leadership and republican response should be and where everybody

00:29:51.500 can find you and uh read all the things you're doing sure thanks cash uh look they need to just

00:29:57.100 expose this isn't going anywhere right and and so but they knew to they they do need to expose and and

00:30:03.260 sort of focus on the fact that aoc is weaponizing the articles of impeachment against two justices

00:30:08.860 that they don't agree with it it's not a coincidence right that the supreme court ended the term on july

00:30:14.060 1st and these things were filed this week it wasn't a coincidence that senator white house

00:30:19.260 file a criminal referral with the department of justice on uh with and asking merrick garland

00:30:24.140 to prosecute justice thomas it's all because of their opinions it's all because they hate them

00:30:29.500 and particularly thomas because he's a black conservative and the left it you know it he 0.52

00:30:33.900 triggers their racism okay that's what's going on with with justice thomas in in a word so uh they

00:30:40.140 need to they need to again it's not going to go anywhere but they need to focus on it highlight it

00:30:44.780 show how the left wants to tear down the supreme court make this an issue for the election

00:30:48.780 okay president trump won 2016 in my view because of the supreme court lots of things but the

00:30:54.540 supreme court and how he was going to appoint conservatives and he did that and you know and

00:30:59.580 fulfilled his his promise and it's made it the greatest court in in in modern times um you could

00:31:05.580 reach me at at mark paoletta on x and i have a website mark paola.com all my articles i have a lot

00:31:13.100 of articles op-eds defending the court and all these and pushing back on these attacks with receipts

00:31:18.620 statutes examples the hypocrisy of the left i urge the posse to go check it out it'll educate you

00:31:25.180 and you will be well armed and then of course i'm at the center for renewing america a fantastic

00:31:29.340 organization run by russ vote uh who i work with it at omb in the trump white house and um and and and

00:31:35.420 go to their website for more information great thanks so much go ahead mark before you before you

00:31:42.140 jump by and we'll be talking about most folks a little later on in the show as well um you know who agrees

00:31:47.500 with you on your analysis on this axios here's the article that they they put out today on uh aoc

00:31:54.060 unveiling the articles of impeachment right at the top of the article second line it says this why it

00:32:00.700 matters it's a long shot element of a broader legislative push by house democrats to reign in

00:32:08.780 the court after a spate of decisions in june that incensed liberals it's right there in your face this is

00:32:16.780 exactly what this is it is this is the democrats trying to reign in the supreme court because it's

00:32:22.780 produced decisions that don't that aren't pleasing to democrats and it's up front in your face and

00:32:28.860 they're not they're not even trying to hide it so i thought you'd be interested mark to hear that axios

00:32:33.900 agreeing with you 100 on your analysis last thing here guys look the the the the the new supreme court

00:32:41.580 is just kind of just a game changer in america right thank god for donald trump's three appointments

00:32:47.340 what you saw was schumer standing on the steps of the supreme court physically threatening

00:32:51.500 corsage and kavanaugh on an abortion vote right that led to the assassination attempt in my view

00:32:56.620 in 2022 right you had the dobbs opinion right and and that was the assassination attempt in 23

00:33:03.420 was the affirmative action case right that struck down race-based affirmative action and they went

00:33:08.140 after justice thomas every single spring now they will ramp up these attacks in the supreme court

00:33:13.420 and this is just the next step right criminal referrals and impeachment this is 24 you know

00:33:19.340 welcome to the new welcome to the new world but here's the thing the left is on the run right

00:33:24.140 this supreme court is the greatest supreme court in modern times and it's going to protect our liberties

00:33:29.340 and the constitution and this is what the left's response is to try and destroy it

00:33:33.580 try and make their lives miserable that's why they have 24 7 protection right because the left has

00:33:40.620 has triggered lunatics to want to go take go after the justices mark thanks very much god bless catch you

00:33:47.580 tomorrow thanks this is going to be a developing story this is going to dominate i think the conversation

00:33:54.620 for the next few months cash let me ask you a question here what do you think because there are

00:33:59.420 different schools of opinion as to what an incoming trump administration should do here should it try to

00:34:05.900 de-escalate the doj um and try and sort of tone down the tenor of debate or should instead the trump

00:34:14.540 administration use the weaponized doj to do to democrats exactly what democrats have been doing to

00:34:20.860 republicans which which side do you come down on this it's simple we just follow the constitution

00:34:29.260 they're the ones that project how we are the ones that are rigging and scamming the rule of law and

00:34:35.340 justice in the courts and in reality we are the ones that have caught them utilizing a weaponized

00:34:41.580 system of justice and intelligence and defense whether it's russia russia russia whether it's 51 intel

00:34:47.420 letter whether it's the bogus jancic's insurrection narrative whether it's the national guard issue and

00:34:53.260 whether we're talking about impeachments the classified documents case joe biden hunter biden's laptop

00:34:58.300 what have you all they have done is told us we were wrong about every single one of those things

00:35:03.900 and we were right because we put the truth out and all we have done is wanted the american people

00:35:08.700 to receive the truth so that that's what they use on voting day to elect our leadership in washington

00:35:14.700 and around the country and since we've been proven right each and every time for telling the truth

00:35:19.900 they hate us and so i think look as a former doj national security division prosecutor guy there is no

00:35:25.580 vengeance there's simply the constitution and we cannot allow the left to preemptively issue headlines

00:35:32.940 as if we are the ones distorting justice if you in the left or anywhere broke the law and you happen

00:35:39.980 to be in a leadership position in government so be it you must be held accountable whether it's criminally

00:35:44.860 or civilly and whoever you worked with to do so we are not going to raise bogus investigations

00:35:51.500 for political headline grabs like the left is doing like the aocs of the world are doing and saying hey

00:35:56.940 we have to um you know impeach these people we don't have anything left to do but um yeah i mean i

00:36:02.380 can i mean the two-tier system of justice is something i can rant on forever but i think we've got hammer on

00:36:06.460 deck uh and let's put him in the hot seat great listen i'm going to hand over to you now cash because

00:36:13.500 you're going to co-host the rest of this segment with josh hammer josh good morning to you uh i don't you know

00:36:19.900 this is good now this is an interesting thing here because which one of us is really in studio and which

00:36:25.260 one of us is using the green screen that's that that's going to set up some debate uh on the getter

00:36:31.260 live chat oh i'll give a shout out to to the to the getter live chat rumble live chat um telegram

00:36:37.980 live chat and the rav live chat before i hand over to cash love you guys you look fantastic uh

00:36:45.500 that interaction on the live chat cash josh i'll hand over to you guys now and i'll catch you um

00:36:51.500 the posse a little later on today for the evening show um tonight thanks very much god bless

00:36:59.820 camera good to be with you man um i think you look better in studio than anyone i've ever seen before

00:37:05.020 don't tell that to i said that to bannon um uh but what do you think where does this so look we've got

00:37:10.380 i think everything we've been talking about on the show today leads to the one confluence point

00:37:17.340 that is joe biden so what are they going to do with it like what is the outcome here are they

00:37:23.340 really going to take him out how are they going to do that are they going to keep him in is george

00:37:27.180 clooney going to run for president yeah cash i don't buy it i mean i i have been a skeptic of this for

00:37:33.900 over a year now i mean this conversation has been going on for a very long time it obviously accelerated in

00:37:39.340 the aftermath of joe biden pooping his pants in front of the whole world in the cnn presidential

00:37:43.580 debate there but this conversation has been going on slightly more in the background for a very long

00:37:48.140 time and i have said again since the beginning that he's not going going anywhere literally as

00:37:54.140 long as he has a pulse obviously if he stops breathing and his heart stops pumping then we

00:37:58.460 have a different conversation there but i have a few reasons for this one is joe biden has been

00:38:03.420 here in washington dc for literally a half century he first got here in 1974 he has run for

00:38:08.780 president three times the first time was before i was even born in 1988 he has wanted this office

00:38:15.260 for essentially his whole life and good luck trying to convince not just him but his lady macbeth wife

00:38:21.420 so-called dr jill good luck convincing them at this point to just give up the reins of power

00:38:27.180 now that they have it so that's point number one i i mean i i just don't see the actual convincing

00:38:32.700 working and point number two which is kind of a direct corollary to that is

00:38:36.780 every time that you have now a new democratic backbencher whether it's some random congressman

00:38:41.580 or senator welch from vermont who just comes out and says he's got to go i i think lady macbeth and

00:38:46.940 uncle joe just dig in their heels even further because they still feel peaked they still feel

00:38:52.220 aggrieved by what happened in 2016 that it's kind of a not very well-kept secret that the obama and

00:38:58.060 biden camps don't really like each other very much because biden felt like he should have been the

00:39:02.620 anointed successor to joe biden and then obama chose hillary clinton and we all know what happened

00:39:07.100 there when donald trump won that election heard around the world in 2016 so you kind of add all

00:39:11.500 this psychology combined there and then i think there's there's two other factors that i guess i

00:39:15.580 should probably just also briefly mention so i had on my own show the josh hammer show last week

00:39:19.740 trey trainer who's a sitting fec commissioner on the federal election commission and we kind of got

00:39:24.060 into the nitty-gritty of the actual federal campaign finance law democrats have a huge huge

00:39:29.180 huge problem on their hands if they actually try to change horses midstream like that that's the

00:39:33.020 basic takeaway from my conversation with commissioner trainer we are in unchartered waters of unchartered

00:39:38.220 waters when it comes to what happens to the 200 plus million dollars currently sitting in biden harris

00:39:43.260 campaign coffers a lot of people in the commentariat are saying okay maybe if you swap in kamala then

00:39:48.380 the money stays there it's actually not even clear because those donors cash they donate specifically to

00:39:53.580 the biden harris campaign not to harris whitmer harris newsom whatever so there's some serious

00:39:59.340 serious legal obstacles there as well and then the final point that i'll make here which again i've

00:40:03.580 been saying all along recall that this is a political party this is a party that literally

00:40:08.540 chose katanji brown jackson for the u.s supreme court two and a half years ago when stephen bryer retired

00:40:14.140 literally because she was a black woman they didn't care about the fact that two percent of lawyers 1.00

00:40:19.500 across the country happened to be black women they didn't care that they limited themselves to two 1.00

00:40:23.900 percent of the national lawyer pool because their intersectionality their identity politics that is 0.83

00:40:28.940 their modern day pagan god so good luck at this point trying to shunt aside the first vice president

00:40:36.220 of color i guess would be the correct nomenclature these days it's just it's just not going to happen so

00:40:41.660 i i think that this is kind of a a grand display of ultimately incompetence and ultimately just impotence

00:40:48.220 from democratic media elites who are shouting into the ether trying to make this happen but

00:40:52.860 because of all these nuts and bolts factors i just don't see it happen no hammer thanks for setting

00:40:57.180 me up and the audience is going to think we had like hours and hours to prepare on this but we

00:41:00.780 literally are just meeting right now i'm going to rant for about 30 seconds to bring you right back

00:41:04.860 on the kamala harris issue i have to rant for a little bit i find it as an indian american wildly

00:41:10.860 offensive that kamala harris who is half indian and raised by her indian mother is always referred to as 0.57

00:41:16.460 black or african american when her father is from jamaica if you told that guy he's an african american

00:41:21.900 he'd probably punch you and so your point about race politics identity politics or whatever you 0.85

00:41:27.100 want to call it and the mainstream media comes in roaring behind them to say we would love to have a 0.94

00:41:32.060 first black woman as president what about her actual heritage i mean they don't even care what it 1.00

00:41:37.180 is they just want to use whatever sells the best and so um you know that's me on my indian american

00:41:42.220 soapbox i'm sure the fcc is going to come in here and shut down war room in a hot minute 0.99

00:41:45.740 but while we still have you hammer we'll hold you through the break we've got about 90 seconds

00:41:49.500 you outlined a a perfect landscape and i didn't even think of the financials honestly that's really

00:41:55.180 brilliant most people aren't even thinking about the hundreds of millions of dollars

00:41:58.380 that is poured into biden harris what happens to that where do you see going in about 90 seconds

00:42:04.140 we'll hold you over but where where do you what do you think is going to become of this in the next 30

00:42:09.180 days in the lead up to their democratic convention so i think that biden's not going anywhere cash

00:42:15.260 and the more that he doubles down i mean his letter to congress on monday was pretty clear i

00:42:20.060 mean he wasn't really not mincing any words there i guess the best that he can given the

00:42:23.500 fact that he can't coherently finish a sentence in the english language but he was really not mincing

00:42:28.140 any words and if they just ride this out for another week look the rnc trump are going to get 1.00

00:42:33.420 all the headlines next week so that will be a week where biden's relatively speaking out of the

00:42:37.180 spotlight again so if they could just ride this out for another week i think he basically survives

00:42:42.140 at this point maybe the only thing that would convince him maybe is if literally all the democrat

00:42:48.220 leaders in congress so schumer jeffries all them if they just do like an intervention of sorts in

00:42:53.660 the oval office maybe maybe maybe but i don't see it happening because again the logistical hurdles

00:42:59.180 are so high there are serious logistical legal hurdles preventing this from happening and the 0.97

00:43:04.700 more that these quotes get out there the stupid george clooney op-ed that this that you're just 0.90

00:43:08.940 feeding rnc and trump attack ads on the airwaves in october so i think eventually that the media 0.98

00:43:14.380 and these democratic backbenchers will shut up and basically get in line so i'm gonna hold we

00:43:18.300 got 10 seconds i'm gonna hold you over but when we come back i want to talk about the irony of the

00:43:22.780 25th amendment and whether or not these democratic leaderships that you just uh outlined will use them

00:43:27.580 we'll be right back y'all 10 years patriot mobile has been americans only conservative christian

00:45:04.060 all right we are back here in the war room i got hammer i'm coming to you live from the sun coming up out

00:45:08.780 here in las vegas nevada for all you east coast heathens out there there is a great american country to the

00:45:13.980 west of the mississippi um i don't know why they allowed me to co-host war room it's probably the

00:45:18.780 worst idea that media has ever had but we're gonna see how this goes hammer we were talking about the

00:45:23.900 25th amendment and the irony of the democrats saying oh you got to take out donald trump with the 25th

00:45:31.980 amendment he's incapacitated he doesn't have the ability to govern um explain to us your thoughts on 0.99

00:45:38.780 will the dems because we know they have no boundaries and they're the biggest hypocrites

00:45:43.820 will they actually use the threat of the 25th privately and how would that work against joe biden

00:45:50.460 so the short answer is no they're not going to use it it's a fun talking point the 25th amendment

00:45:55.020 comes up every so often i mean let's step back and like actually walk through just briefly the

00:46:00.060 history and the context of the 25th amendment so this was ratified in 1967 in the aftermath of

00:46:05.900 the jfk assassination and they basically did it because it was all the chaos lbj getting sworn in

00:46:11.260 and they were just trying to solidify essentially how succession works when a president is incapacitated

00:46:18.300 is literally comatose or god forbid if the president dies you know it was never meant to be an excuse

00:46:25.100 for a palace coup or an excuse for just some sort of internal power struggle between the president and

00:46:32.140 the vice president and more specifically so it's actually section four of the 25th amendment that

00:46:37.340 people are currently invoking here that's the section that provides that when the vice president

00:46:42.060 and a majority of the cabinet or i believe a two-thirds majority of congress but we really

00:46:47.580 typically focus on the vice president and majority cabinet if they combine to state solemnly and they

00:46:53.260 sign whatever that the president is incapable of discharging his duties then he is removed but again

00:46:59.900 cash i mean i don't have to tell you i mean this is kamala harris you know this is like

00:47:03.900 this is a transportation secretary pete buddhij alejandro mayorkas at dhs i mean more accurately

00:47:10.460 really not at dhs i don't know where he is in any given day because he's obviously horrible uh tony

00:47:15.260 blinken at state i could go on here i mean the notion that these people are going to agree a majority of

00:47:20.620 them to stage a coup against joe biden it's ludicrous it is good political theater you know it may or may 0.65

00:47:27.420 not be good for the country given the fact that he's a corpse that will keel over and die at any moment 0.79

00:47:32.620 but you know then you get kamala harris so i guess good luck pick your poison but it's not going to

00:47:36.940 happen and you're right you know to your point yeah go ahead sorry that roster call for me for

00:47:43.820 the first time just illustrated how difficult that would be when you actually went through the names

00:47:48.380 because i don't think people bothered to see who is going to move that kind of machinery but i think

00:47:53.580 there is an individual or individuals in the media that would love to see that kind of machinery

00:47:58.700 and i got i got queued up for you um something that i'd like you to comment on your best friend

00:48:03.260 joy reid had a another nuclear meltdown over religious affiliations and i'd love to get your

00:48:09.420 take on this we've talked about the embrace of religious fervor on the religious right i mean on

00:48:16.140 the american right and why it is dangerous the republican party in this era of donald trump has allowed a

00:48:22.140 small fringe white christian nationalist movement to control the way the party and much of this

00:48:27.740 country operates and so now proud christian nationalists are having their moment not just

00:48:33.420 creeping into the culture but seeking to revamp and define it charlie kirk professional troll and

00:48:38.700 founder of turning point usa embraces christian nationalism and says things like christians need

00:48:43.740 to view the election as a spiritual struggle to save western civil civilization and that trump is crucial

00:48:50.060 to restoring morality in america right the convicted felon sexual abuser equals morality it's the kind

00:48:57.020 of stuff that makes your brain hurt because it makes no sense then there's the interesting choice

00:49:02.860 by the new york times to platform a far-right christian extremist musings on why he doesn't vote which is

00:49:08.700 code for hey maybe you shouldn't vote matthew walther editor of a right-wing catholic literary journal

00:49:15.020 writes why does anyone vote i ask myself the answer cannot be that we believe that by doing so we

00:49:21.180 will influence the outcome and election no actually that's exactly why i vote and why everyone votes

00:49:26.780 as it turns out though the new york times has since made a correction after internet sleuths pointed out

00:49:32.220 that this op-ed writer did in the two most recent election cycles wait for it vote not voting of

00:49:38.700 course means choosing a devastating agenda for lgbtq people women and girls brown and black people

00:49:44.540 basically anyone who doesn't look like charlie kirk or matthew walter okay hammer there's only so much

00:49:50.620 a joy read i can take and since i don't support christian nationalism i guess that makes me a

00:49:56.060 communist or some sort or or maybe a racist or i don't even know what but i know you're in dc for

00:50:01.020 nat con and you're the perfect guy to comment on what she was blathering on about what's your take

00:50:07.340 yeah good old joyless joy read is my buddy from home call sir look i so i am here for nat con you

00:50:14.060 know cash my panel that i spoke on two days ago actually was titled separation of church and state

00:50:19.660 has failed and you know this panel was interesting because i'm jewish when my co-panelist was catholic

00:50:24.700 and there were two protestants on the panel and we all agree that so-called separation of church and

00:50:29.260 state which by the way is not actually there in the first amendment if you actually read the first

00:50:33.580 amendment it very simply says that congress shall make no law respecting and establishment of religion

00:50:38.380 it says nothing whatsoever about a so-called separation of church and state wall which comes

00:50:42.460 from this basically a tweet it comes from a 233 word letter that thomas jefferson wrote in 1802 it's

00:50:49.660 crazy but more generally speaking this debate over nationalism and christian nationalism look america

00:50:55.660 was founded as as a deeply religious country now it's true that they said congress shall make no

00:51:01.260 law respecting an official state religion but it was actually just a federalism provision clarence

00:51:06.300 thomas has said this over and over again he's totally right they did that so that the states

00:51:09.980 could actually establish their own churches and in fact they did that well into the ninth century in

00:51:14.620 fact that noted far-right fascist bastion of the commonwealth of massachusetts had an established

00:51:20.140 church of congregationalism all the way until 1833 i think connecticut might have gone even longer

00:51:24.940 there so the notion that religion in public life was anathema to the founders has no credibility

00:51:31.180 whatsoever the founding was deeply deeply inspired inspired excuse me by the bible by scripture

00:51:37.500 benjamin franklin famously wanted the great seal of the united states to be moses parting the red

00:51:42.940 sea for the israelites to cross from from pharaoh and the egyptian pursuers there any number of other

00:51:47.980 examples as well there look america cash and i say this as a jew america is a better place when it is a

00:51:54.620 more christian place america is a more powerful country when christians are emboldened to be more

00:51:59.660 publicly and visibly and politically active christians in the public square christians are

00:52:03.900 better jews are better all americans are better and the country is better as a whole i think you

00:52:08.220 can tie basically a direct line from declining church attendance in this country to so many of

00:52:14.140 the woke maladies that we are currently facing and the idea that you have to be a white man to say

00:52:19.980 this it's just it's just absolutely nuts i i don't buy it for a second cash okay we got 30 seconds
