00:00:23.760 and do believe that justices Thomas and Alito are prone and subject to corruption.
00:00:30.000 That the institution failing to punish them is broken and that consequently their impeachment
00:00:36.260 is a constitutional imperative and our congressional duty corruption without consequence
00:00:44.200 infects all it touches. And that is why this body Congress has a constitutional and moral obligation
00:00:56.040 to hold these justices accountable. Moments ago Congresswoman Alexandria Ocasio-Cortez of New York
00:01:04.220 took to the floor to make the case why she introduced articles of impeachment against
00:01:08.840 Supreme Court Justices Samuel Alito and Clarence Thomas. The resolution against Thomas says he
00:01:13.880 engaged in high crimes and misdemeanors by failing to report multiple gifts of luxury vacations and
00:01:18.980 travel. Impeachment articles against Alito focus on his refusal to recuse from cases related to
00:01:24.300 January 6th despite his indicating sympathy with efforts to overturn the 2020 election
00:01:28.520 by allowing symbols of support for those efforts to be flown outside his residency.
00:01:32.980 So at the heart of all this right the heart of what we're talking about and we're talking about
00:01:36.720 this story and the coverage of it is is not a scandal. There is no wrongdoing.
00:01:42.220 The heart of it is the fact that an old man has gotten older and he's gotten older in ways that
00:01:51.320 are not necessarily predictable because aging isn't after having the most stressful job in the world for
00:01:57.480 three years and it is very clearly taken a toll on him. We can all see that. And now in the next four
00:02:03.700 months he has to do the only thing that may be harder than being president more stressful and more
00:02:07.980 demanding which is to be president while also running for re-election. Those are both full-time
00:02:12.800 jobs. Beyond the incredible media feeding frenzy that that feels like a scandal is the one very
00:02:20.480 obvious question which is at 81 having been the president now with all that stress is president
00:02:28.320 biden capable of enduring the unbelievably taxing task of running the country and being a candidate
00:02:38.520 who can persuade unpersuaded american voters in order to defeat donald trump. I think that in a sense this
00:02:45.000 is long overdue because what democrats have served up for a year now is inaction on the corruption
00:02:51.500 scandals that have rocked the supreme court uh some angry letters uh some public appearances but this is
00:02:57.940 a leap forward in terms of seeking accountability and i think what aoc is trying to remind us here
00:03:04.460 um is that federal judges serve for life with good behavior and that congress is well within its rights
00:03:12.620 to decide that a judge or justice has failed to live up to that standard of good behavior and that when
00:03:18.120 it does congress is really left with no choice but to begin impeachment you know we've heard for now more
00:03:23.380 than a year from republicans well congress can't impose ethical rules congress can't impose an
00:03:28.600 enforceable code of judicial conduct well if that's true and i'm not conceding it but if that's true then
00:03:34.120 that only leaves the impeachment and removal power for congress and that is why aoc is using it right

00:05:52.940 some of the uh the insights i had working in a in a political environment there is no idea so crazy
00:06:00.760 that you won't see it mainstreamed from the peripheries and then implemented bear that in mind

00:07:56.340 if we couldn't have done more and i felt like saying guys you didn't do anything you did absolutely
00:08:03.160 nothing if you'd have really wanted to stop steve bannon from going to prison you'd have passed a
00:08:08.180 resolution when you still had a majority of 20 saying that the j6 inquiry was invalidly constituted
00:08:15.560 and by effect it's subpoenas invalid and then you would have given had something
00:08:20.600 to steve bannon's lawyers to go to the supreme court and say this is a material um indication of
00:08:29.500 how this conviction is unsound right those subpoenas were invalid right the gop response will be
00:08:36.600 performative and on the back of it they'll send out emails and they'll do fundraising that's how they'll
00:08:42.060 counter this maneuver by aoc right this is this is absolutely fundamental to the security of your
00:08:47.960 republic what democrats are doing now the left third point the left has to have its way always when it's

00:14:22.760 right in 1991 with a democrat senate was 57 democrats and what do they do they pull out the lies of

00:16:30.420 resolution which she introduced into the house um yesterday calling for the um articles of
00:16:37.900 impeachment for justices associate justices currents thomas and samuel elita here's one of the the the
00:16:46.100 charges if you will refusal to recuse from matters involving his spouse's financial interest in cases
00:16:55.700 before the court now now he's denied that right but however however it's not true and here's he's he's
00:17:04.380 not here's the point right fundamentally with with my third uh my third case that i mentioned in in
00:17:12.480 the introduction democrats want to get their way when they're in power and they want to get their
00:17:17.300 way when they're out of power right what they want is basically what has to be now one example of that
00:17:24.420 principle is that is the miss uh not the misapplication the disequal the the the partial application
00:17:32.600 of principles now even if this were true right and and clarence thomas says it's not true even if this
00:17:40.460 was true where were the articles of impeachment on judge juan mershan right whose daughter now that is
00:17:47.240 not open to question because the fact that he his daughter was fundraising for democrats on the basis um
00:17:54.660 right of of of of mershan's conviction of of donald trump that is not in dispute that is that is
00:18:02.040 objectively uh uh appreciated by all sides no articles of impeachment there right and there's
00:18:10.820 a straight up conflict of interest there right so look this is what i've focused so the law says a
00:18:17.080 judge a judge and the supreme court abides by the lower court uh laws uh the the the the federal law
00:18:23.700 on recusals which is you need to recuse if your spouse is a party a lawyer uh you're going to be a
00:18:29.580 witness or uh will have a substantial interest will be substantially affected by the outcome
00:18:35.320 jenny thomas has nothing like that the so one of them was her financial she's never done anything
00:18:40.780 in the legal lane she's been a political activist uh her her entire professional career there was no
00:18:46.560 reason for justice uh thomas to recuse i point you to and i've written a lot about this there was a
00:18:51.600 liberal judge as you talk about the partial application a liberal judge judge stephen reinhart who
00:18:56.740 had the same sex marriage case uh in back in like 2011 2012 it's a celebrated case his wife was ahead
00:19:03.160 of the aclu southern california chapter and she filed two briefs in the court below right that went up to
00:19:09.180 judge reinhart and he didn't recuse and he said my wife's you you know my my views are my views my
00:19:14.300 wife's to use of her own there's no reason for me to recuse and that the left machinery the legal ethics
00:19:20.400 expert stephen gillers they filed a brief in the supreme court saying this is outrageous that you
00:19:24.900 think that just a judge reinhart needs to recuse his wife had literally entered the case right
00:19:29.980 in the court below and went up to him she was very vocal on the legal issues in that case
00:19:35.080 so with jenny thomas there's nothing even close to that another one justice ginsburg's husband was
00:19:41.440 at a law firm that repeatedly appeared before the supreme court and she never recused once
00:19:46.840 from a single case in fact ruled in favor of marty ginsburg law firm's clients so you see this you
00:19:54.780 know you saw justice ginsburg literally you know attack right try and stop donald trump from becoming
00:20:01.160 president during the 26 campaign and everyone celebrated her right and she never recused from
00:20:06.920 a case involving donald trump so that is just a complete ridiculous argument there's nothing there
00:20:13.480 it's both consistent with the law that justice thomas didn't need to recuse and the double standards
00:20:18.800 that the democrats show are just outrageous the second one is that they claim justice thomas didn't
00:20:24.200 recuse because of his wife's involvement in the january 6th full disclosure i was jenny thomas's
00:20:29.880 lawyer during those proceedings before the january 6th committee she went in for an interview
00:20:34.420 right they went after her they had no reason and no basis to go after her
00:20:38.680 she interviewed for four four hours produced you know she produced whatever relevant document she
00:20:44.560 you know they asked for and guess what uh she wasn't named in the january 6th uh committee's
00:20:51.240 final report which was 845 pages the this articles of impeachment says she's directing donald trump
00:20:57.200 she's advising donald trump she's going into the legal strategy you know she's she's uh she's urging trump
00:21:03.080 uh on on on on on his on his legal strategy and and the lawyers jenny thomas was texting with her friend
00:21:08.440 mark meadows that is not advising uh you know you know the president on his legal strategy she was so
00:21:14.160 uninvolved that the january 6th democrat appointed right and completely democrat appointed committee
00:21:20.260 uh didn't mention her once in any hearings or in the final report so she's absolutely had minimal
00:21:26.120 involvement in the january 6th uh you know issues and and again those are sort of you know she went
00:21:33.640 to the she went to the rally has nothing to do with the legal issues okay there's no reasonable basis
00:21:38.720 for justice thomas to have to recuse from the from uh those issues like presidential immunity and the like
00:21:44.840 uh gifts they claim he didn't disclose gifts it is very clear okay and i've written on this a lot
00:21:51.200 uh um 2012 the judicial conference had allegations that justice thomas was violating the law for not
00:21:59.340 disclosing his trips with his friend harlan crowe both on his plane and and his boat okay he has a he
00:22:05.100 has a friend who's wealthy okay he hangs out with him he goes on vacation with him the the judicial
00:22:10.300 conference said he had done nothing wrong in 2012 he had complied with all the the the requirements
00:22:16.220 of disclosing trips so all this entire section on you know not disclosing gifts is just a complete
00:22:23.020 lie okay the judicial conference which is the body that runs ethics administers the ethics for the
00:22:29.620 judiciary had taken up this issue in 2012 and ruled that justice thomas was in full compliance so
00:22:35.740 right down the line okay on every single um harlan crowe bought his boyhood home to make it a museum
00:22:44.520 okay his mother lives in that home okay as part of the negotiation because she's still living there and
00:22:51.100 he wanted to own this home uh and make sure it wasn't torn down or or whatever um he gave her a
00:22:57.520 right to live in it for the rest of her life okay um that was part of the negotiation in this articles
00:23:03.080 of impeachment they say he's giving her free rent it wasn't free rent it was a you know a hand uh an
00:23:08.240 arm's length transaction uh to preserve the boyhood home of what i consider our greatest living american
00:23:14.360 and our greatest supreme court justice not a bad thing to do it's a great thing to do yet this has
00:23:19.000 turned into a crime uh for these articles of impeachment so and then you have aoc right you're
00:23:24.800 talking about this partial stand remember the stories on her going to the met gala and she gets a dress and
00:23:30.840 her makeup and all of this stuff and she stiffs all of these workers she doesn't pay them right uh and
00:23:36.840 and then there's finally i think a new york times or some sort of story about it and she finally pays
00:23:41.120 and lies about how there was miscommunication no she was stiffing working class americans because
00:23:46.780 she thought she's entitled right the the we're the ruling class uh give me my my stuff for free
00:23:53.400 uh and then i'm going to impeach justice thomas for complying with the law it's ridiculous
00:23:58.020 okay mark um i do want to come back on the on the technical procedures uh on how uh an impeachment
00:24:07.220 against a sitting supreme court associate justice would enroll what the anatomy of this um would be
00:24:15.080 right it would have to pass yeah oh go ahead go please please go ahead yeah it would have to pass

00:24:49.720 the person who's being impeached it'll never get out of the house this is just a stunt this is a publicity
00:24:55.220 stunt by by by aoc but we do need to fight back hard then i agree with you and expose it for what it is
