00:00:05.620 Court has denied, denied Donald Trump's bid to stay his criminal sentence. He is scheduled to
00:00:12.940 be sentenced tomorrow to no jail time, but as of tomorrow, he will officially be sentenced for the
00:00:20.260 34-count felony conviction in New York. The Supreme Court asked and answered. They have said
00:00:29.340 no to Donald Trump's bid to stay his sentencing. Judge Mershon Mika has already told us that he is
00:00:37.680 leaning, inclined to an unconditional discharge, meaning a sentence of no sentence. That's
00:00:44.060 unusual and highly unusual. And all my years as a federal prosecutor, I've never seen anything
00:00:48.740 like it. Almost always there's a term of incarceration or at least supervised release,
00:00:55.420 probation, community service, a fine, restitution. Something attaches to the conviction. And here,
00:01:02.560 Judge Mershon has said there will be no sentence. But what that means, too, and this is important,
00:01:09.900 is that the underlying criminal case is over. The judgment is final. Mr. Trump, of course,
00:01:16.520 has the right to appeal to a higher court in New York state. But the sentencing proceeding puts an end
00:01:22.700 to the underlying case. It makes Mr. Trump a felon before he assumes office for the second time.
00:01:30.840 I am looking to see whether or not he has anything to say. Many defendants do. Some don't. I don't
00:01:36.480 imagine that he will be apologetic. But felon almost in name only, Chuck, are there any tangible
00:01:42.240 consequences? Because when and if we do hear from Donald Trump, he's going to say this is political
00:01:47.580 persecution. It's a witch hunt. He's not going to take ownership of it. Right. So are there any practical
00:01:51.560 consequences, Stephanie? For the layman like me? No. So he wins? Well, he's still convicted. And
00:01:59.520 perhaps you draw some sustenance from that. I do. A jury of his peers found him guilty by proof beyond

00:03:54.260 now, and he's giving them the old what for about how this has destroyed the legal system,
00:03:59.820 the judiciary. This is a show trial. It's a sham. It's a kangaroo court. Prosecutors are jumping in
00:04:06.520 as President Trump speaks. Say President Trump, I think, before the prosecutor said, have President
00:04:10.100 Trump have destroyed the system. So we have a lot to go through. Mike Davis joins us. Julie Kelly's
00:04:15.340 going to be in on a moment. Mike Davis, you were seeing this in real time. There are no microphones
00:04:20.740 or cameras in the court. This is a New York State Superior Court, I guess it is. And so we're getting
00:04:25.880 all this from texts or from tweets people are putting out in real time. What's your sense?
00:04:30.820 Today is one Mershon. The Supreme Court last night, shockingly, and this is what happens. You know,
00:04:36.600 Coney Barrett was supposed to be the pick, and all the Right to Life people loved her. And she's
00:04:42.000 been a total and complete, unmitigated disaster, except for that one topic. I'll be blunt. She's not
00:04:47.560 exactly, she's not exactly Felix Frankfurter in the mental area. And she just had one bad
00:04:54.560 ruling, five to four last night, Roberts and Coney Barrett deciding against the President.
00:05:02.280 Mike Davis, put in perspective for us what happened last night at the Supreme Court and
00:05:06.300 what's going on today in this courtroom.
00:05:07.800 Yeah, so when you import the third world, you become the third world. And we have this corrupt,
00:05:19.100 partisan, dangerous, third world, trash, Marxist judge in Manhattan, Juan Mershon, who donated to
00:05:29.280 Trump's political opponents, whose adult daughter, Lauren Mershon, got paid by the Kamala campaign,
00:05:37.780 whose adult daughter, Lauren Mershon, is raising money off of this unprecedented, bogus criminal
00:05:45.200 prosecution of a former and future president. There are so many reversible errors in this case.
00:05:53.260 The most glaring right now is that this Mershon ignored the Supreme Court's June presidential
00:06:01.260 immunity decision when the judge refused to declare a mistrial after he allowed in testimony from two
00:06:10.380 top White House aides against President Trump, which is a violation of presidential immunity,
00:06:17.660 right? And so, again, so many reversible errors didn't tell President Trump what the crime was,
00:06:23.700 made up a bogus crime based upon a bogus legal theory. A Soros-funded Manhattan DA, Alvin Bragg,
00:06:31.040 who campaigned on getting Trump, brought this case after Matthew Colangelo got deployed from the Biden
00:06:37.880 Justice Department, the number three official in the Biden Justice Department, a senior political
00:06:43.020 operative to bring this bogus case. The prior Manhattan DA, a Democrat, Cy Vance, refused to bring
00:06:49.520 this case. The Federal Election Commission refused to bring this case. Bragg himself refused to bring
00:06:56.280 this case. And then Colangelo got deployed because Bragg is George Soros's puppet. And then we have this
00:07:03.860 sentencing today. And wait, this is 34 felony counts, they say. He's 34 felony convictions. It's
00:07:11.380 so serious and it's so solemn. Well, so why isn't Mershon putting President Trump in prison today? And we know the
00:07:19.180 answer. The answer is, is even Mershon knows this is lawfare. It's election interference. It's bogus. And this is
00:07:27.740 all about giving President Trump a political black eye 10 days before he's supposed to get sworn in as the
00:07:36.800 President of the United States. And what's so dangerous about this Supreme Court precedent that was set last night,
00:07:44.560 Steve, is this. Okay, the Supreme Court is saying that a partisan, corrupt, dangerous local prosecutor and judge
00:07:56.200 has the ability, they can put a president-elect in prison 10 days before his inauguration. Because
00:08:05.480 remember, Mershon said he's, he said he's probably not going to put President Trump in prison and put
00:08:12.380 conditions on him. But he left that open. So the Supreme Court is saying that that's okay,
00:08:18.280 apparently, because you have three partisan hacks on the Supreme Court, along with a law professor with
00:08:27.100 her head up her ass, and a chief justice, who is a very bad politician.
00:08:36.380 Mike, hang on for one second, we're going to work through this. Joe Hoff's actually going to join us a
00:08:40.600 little later to walk through these ridiculous, bogus charges. Julie Kelly, a stunning, you know,
00:08:46.100 you were on the five o'clock show, and I said, hey, it's getting pretty late in the day. You know,
00:08:50.780 what's going to happen here? And it kind of played out like we thought. I was stunned. Coney Barrett and
00:08:56.680 Roberts, both a disgrace, sided with the radicals about President Trump. Your thoughts, ma'am?
00:09:03.460 Well, I mean, I share everyone's outrage, especially at Amy Coney Barrett. But I think
00:09:09.380 it's to recall that although she was with the majority in the July immunity ruling, she wrote
00:09:16.180 a separate opinion. And she sort of disagreed with Justice Roberts, Chief Justice Roberts and the
00:09:24.100 majority, that counted these outer perimeter acts in the presidency should not be immune from
00:09:30.600 prosecution. So yes, she voted with the majority, but she still had to throw her two cents in.
00:09:35.980 She also, more egregiously, I think, was in the majority with Elena Kagan and Sonia Sotomayor in
00:09:44.740 the Fisher decision, upholding how the DOJ weaponized and abused that post-Enron statute against the
00:09:53.220 president and more than 300 J6ers. She's an absolute disgrace, and people are infuriated because
00:10:00.420 they fought so hard for her. But also, Chief Justice Roberts issued a report last, I think
00:10:08.020 it was right after the first of the year, talking about disinformation being such a threat to the
00:10:14.400 courts, how the courts are above reproach, that people criticizing judges are out of line. I mean,
00:10:22.080 this was this whole missive talking about really denouncing public criticism of judges. This would
00:10:29.000 have been a perfect opportunity for him to send a message to other judges, even though Mershon is not
00:10:34.800 a federal judge. Look, we can't have this kind of partisanship because this is what is destroying the
00:10:41.840 credibility of the judiciary right now. Instead, he endorses what Mershon is doing, not only trying
00:10:49.520 to officially make President Trump a convicted felon today, also allowing him to rant from the bench,
00:10:57.620 which he will presumably will do, because that's what he just did in his order that he issued on
00:11:03.420 January 3rd. But this is, this matter is still pending before the New York appellate court. And
00:11:11.880 Mike could probably speak to this better than I can. Usually when there's an appeal pending related to
00:11:17.720 immunity, the proceedings are suspended. That's exactly what happened in the Washington J6 case.
00:11:23.360 So he's appealing this conviction based on presidential immunity, which of course,
00:11:30.680 that order came down after he was convicted in May of 2024. This relates to conduct when he was
00:11:37.320 president the first time. So there's a very good chance that this conviction will be overturned anyway.
00:11:44.140 What a mess the Supreme Court just made, to Mike's point. And at a time when the Supreme Court,
00:11:51.840 Democrats and the left, of course, are going after the court, and their credibility in the eyes of
00:11:57.280 Democrats is diminishing, this certainly does not help bolster our support of this court, especially
00:12:03.700 the chief justice, by that stomp that they pulled last night.
00:12:07.360 Mike, let's, let's, let's take that head on. I mean, here's the problem you have and you brought
00:12:15.860 it up and she reinforced it. You can have these out of control source backed. I mean, you got Alvin
00:12:21.040 Bragg, Tish James, you have these out of control people. That's going to happen. This is going to
00:12:25.200 happen. And we're trying to protect the system here. Of course, Trump, they see as an existential
00:12:30.320 threat to their system. And he is. But then you have a guy like Marchand. I don't really know if we
00:12:35.140 got Marchand's. There's questions about even, you know, how is even a U.S. citizen? There's all
00:12:40.040 kind of questions about all of this. It's the Supreme Court that's supposed to step in here and
00:12:45.160 say, hey, pencils down. I mean, to me, the most outrageous thing is Roberts once again, because
00:12:52.400 he's so weak. But Coney Barrett's just, I mean, hey, I think she ought to think about an early
00:12:57.800 retirement. I mean that. And give President Trump a opportunity. If she, if she had any, any class,
00:13:05.140 she would immediately step down after President Trump took the oath of office on the 20th. I
00:13:10.100 mean this. I'm going to be all over this. And Coney Barrett, as a matter of honor, personal
00:13:14.680 honor, should step down from the Supreme Court and allow President Trump's, one of his first
00:13:19.360 acts is to start putting a replacement for her in the Supreme Court. This is outrageous.

00:19:06.580 $40,000 in October 2024. Tammy Baldwin, again in October, another $148,000 check to Lauren Mershon's
00:19:17.520 firm. Fight Lake Hellpack, which is Gretchen Whitmer's firm. Don't know what she's buying.
00:19:23.960 She was not up for re-election. $187,000 September of 2024. The list goes on. But Steve, I'm going to
00:19:33.420 be totaling this up as of May of 2024, when President Trump was convicted, how much money
00:19:41.140 Lauren Mershon has raced in as her father does her dirty work in the Democratic Party so she can
00:19:48.980 enrich herself and presumably her family. She's like a mini Hunter Biden.

00:20:38.020 before he becomes the president of the United States. I really think the Chief Justice and
00:20:44.760 Justice Amy Coney Barrett thought they were being cute and political here, and all they've done is
00:20:52.060 created a disaster. They've created a lot of anger in America. You're seeing the outrage right now online,
00:21:00.120 and the Chief Justice thinks it's his job to protect the legitimacy of the Supreme Court,
00:21:05.940 and I think he caused a lot of damage to the Supreme Court's legitimacy by his cute political
00:21:12.820 little ruling. I would say to Justice Amy Coney Barrett, it's time for you to get your head out of your ass.

00:22:03.840 I know, smartest lawyer, non-lawyer I know is Julie Kelly. She said that when you assert immunity,
00:22:10.360 the case has to stop, right? And that includes, obviously, criminal sentencing. If you are immune
00:22:16.920 from criminal prosecution, you can't be criminally sentenced, unless it's Amy Coney Barrett and she's
00:22:25.820 at home knitting or whatever the hell she does late at night. She can't get her head out of her ass
00:22:30.440 and understand that criminal sentencing is the worst part of criminal prosecution. So if you're immune
00:22:36.920 from criminal prosecution, you're obviously immune from criminal sentencing. But we put a
00:22:43.540 15-part test that some wackadoodle like Justice Kennedy would be proud of last night that, oh,
00:22:50.720 it's okay because we're all trashed Marxist judge. We import it from the Cali cartel in Columbia.

00:23:03.280 Julie Kelly, any update on the whole Jack Smith fiasco on the, so here's what they're trying to

00:23:26.400 kind of planned out how to follow the action because at high noon, it's going to be action,

00:23:44.900 to see that all the time now in the New York Times and MSNBC to try to put that in people's minds.
00:23:50.680 But also this Jack Smith, they are trying to do backflow. So they've already been ordered to stand
00:23:54.780 down to get out the report, another bias, hack thing. And Jack Smith's going to be under
00:23:59.400 investigation. Esmarchand's going to be under investigation. Bragg's going to be under
00:24:03.260 investigation. This is all going to, this all falls under the vast criminal conspiracy to stop
00:24:08.860 Trump, of which the American people rendered a verdict and said, hey, we want Trump. So now we're
00:24:14.240 going to go on the offense here, but they're going to try to do everything possible to put as many
00:24:18.900 markers out there. Give me an update on the Jack Smith fiasco.
00:24:22.140 So despite a court docket in Florida that has more than 700 entries, despite wall-to-wall
00:24:30.880 coverage of the J-6 case proceeding in Washington, despite an 845-page report issued by the January
00:24:40.280 6th Select Committee, and just non-stop coverage of President Trump January 6th now for four years,
00:24:47.280 Jack Smith has authored a report, which special counsels can do at the conclusion of their work
00:24:55.260 and submit it to the Attorney General. Apparently he has written a report, two volumes, volume one
00:25:01.760 dealing with the J-6 case that has been dismissed, and the volume two, the classified documents case
00:25:08.680 in Florida, which also has been dropped against the President, but not his two co-defendants. Well,
00:25:13.900 the two co-defendants in that case filed an immediate of seeking an injunction from Jack Smith releasing
00:25:21.980 that report because there's still ongoing litigation there. Judge Cannon issued an immediate order
00:25:27.780 preventing Jack Smith and the Department of Justice from sharing that draft report, which was given to
00:25:34.740 Merrick Garland on Tuesday, sharing that report outside of the department. Well, Jack Smith and DOJ went crazy
00:25:41.620 and went to the appellate court, of course, asking them to reverse Judge Cannon and asking them not to
00:25:49.720 permit them to release this report. Last night, the 11th Circuit appellate court did deny the
00:25:57.740 co-defendants, so basically Trump sighed, denied their motion seeking to prevent the release of this report.
00:26:07.060 However, Judge Cannon's order still is in effect for three more days. Well, what happens today?
00:26:12.900 Yeah, but my point is, hang on, hang on, hang on, but hang on, hang on. It's, Judge Cannon's got it in
00:26:19.140 there, but Sunday night, and that's how you drive the news cycle, you, Sunday night at midnight, it goes
00:26:26.180 away. So at, what, 12.01 in the morning AM, they can release it to the news media to make it put it on the
00:26:33.860 front page of the New York Times and have it lead CNN and MSNBC. Unless something else happens, that will, I mean,
00:26:40.940 they'll give it to Jamie Raskin, but Jamie Raskin is going to get, take the biggest things and give it right to the
00:26:45.400 New York Times. So this, what you're telling me, unless I'm, I don't understand this, is that Monday morning, people
00:26:52.200 should be looking for this. On Friday, to drive the news cycle over the weekend, it's going to, he's a
00:26:57.100 convicted felon, right? And now, on Monday, they're going to come back with, oh, he should be, he should
00:27:02.300 have been convicted on all this stuff because he's an insurrectionist. That, I mean, that's, that's their

00:45:40.060 And then the prosecution goes on a tear against Donald Trump, saying that he caused irreparable
00:45:46.300 damage to the criminal justice system, to paraphrase, and that Trump entered into, you know, false
00:45:53.900 attacks, that this was a sham and a witch hunt, and engaged in dangerous rhetoric and threatened
00:46:01.520 to retaliate.
00:46:02.600 And again, they're saying the criminal justice system was put, and the court was put, in harm's
00:46:08.820 way here.
00:46:10.380 But then they called for the unconditional discharge, the most vital solution to ensure
00:46:15.660 finality and allow defendants to pursue the presidency.
00:46:19.560 The public interest would not be served by imprisonment.
00:46:22.840 And then Blanche responded, and of course he disagreed with that assessment, saying many
00:46:26.980 legal experts say this case never should have been brought forth.
00:46:30.300 And the American people agreed by the results of the election.
00:46:34.540 But Mershon bent on giving Trump that scarlet letter, F for felon, right?
00:46:40.240 He wound up saying, in the end, you know, this was the toughest decision I ever had to make.
00:46:45.620 And the sentencing part is always the toughest part.
00:46:48.580 And Trump got up.
00:46:49.760 Trump was allowed to respond via video from Florida.
00:46:53.320 And he said, this is a terrible experience and a setback for New Yorkers.
