00:02:48.000 And so fast forward and they got it out there because the Chief Justice John Roberts and
00:02:52.000 Justice Amy Coney Barrett were too scared to do their jobs, as we were talking about.

00:02:59.000 Okay, Professor Barrett, good work.
00:03:01.000 Because here we are two weeks later and we have these activist judges, particularly in
00:03:07.000 D.C., but all over the country, sabotaging the president of the United States.

00:03:15.000 And again, before it was personnel matters that are bad, but not a national security crisis.
00:03:22.000 Now these judges have created a national security crisis.
00:03:26.000 When this D.C. Obama judge, Jeb Bosberg, people say he's the moderate one.
00:03:33.000 So I guess he's only 95% Marxist instead of 100% Marxist, so he's moderate in D.C., right?
00:03:40.000 And so he runs into his chambers on Saturday during the middle of a national security operation,
00:03:48.000 a secret national security operation that President Trump is handling in conjunction
00:03:54.000 with the Salvadorian president, where they are trying to secretly get out of our country
00:03:59.000 the most vicious terrorist in the Western Hemisphere, Trendy Aragua gangs, along with MS-13 gang members.
00:04:09.000 And during the middle of this national security operation, this Judge Bosberg runs to his chambers
00:04:15.000 and holds a hearing, right, which publicly exposes the fact that this national security operation,
00:04:21.000 this military intel and law enforcement operation is ongoing, putting American lives in grave danger
00:04:28.000 along with the lives of our allies.
00:04:30.000 And so he exposes this operation through his court proceeding.
00:04:35.000 He says the hearing was closed.
00:04:37.000 Well, it's not in a SCIF, right?
00:04:39.000 This hearing will leak out, and it did leak out, right?
00:04:43.000 And so then, not only did this judge create a very dangerous situation for American military
00:04:53.000 intel, law enforcement officials, along with our allies.
00:04:57.000 He actually ordered the planes, the president, to turn around the planes full of these designated
00:05:06.000 foreign terrorists.
00:05:08.000 Judge Bosberg said that the president had to turn around the planes.
00:05:12.000 Now, the president, of course, wouldn't ignore a court's order, blah, blah, blah.
00:05:17.000 But the order was not followed, and the planes safely landed in El Salvador.
00:05:23.000 And we saw the video of the handoff from American officials to Salvadorian officials, where there
00:05:30.000 was an intense security operation, well-planned, to hand these dangerous, the most vicious terrorists
00:05:38.000 in the Western Hemisphere off from American officials to Salvadorian officials to go to
00:05:44.000 this Salvadorian prison waiting for them.
00:05:46.000 And Judge Bosberg tried to disrupt this.
00:05:50.000 He tried to sabotage this national security operation, which is 100% unlawful and absolutely
00:05:59.000 dangerous and unacceptable.
00:06:00.000 And that is why the Article III project, I've never done this.
00:06:05.000 I have called for the president and his administration to ignore this lawless, dangerous order because
00:06:12.000 it puts American lives in danger, along with our allies.
00:06:15.000 I'm also calling for the House of Representatives to impeach Judge Jeb Bosberg for his sabotage
00:06:23.000 of a national security operation, putting American lives in danger, along with our allies.
00:06:28.000 And Senator Chuck Grassley, the chairman of the Judiciary Committee, my former boss, is also very
00:06:35.000 esteemed about this.
00:06:36.000 He's ordering oversight of these judges and their illegal temporary restraining orders.
00:06:43.000 So there's a backlash coming.
00:06:44.000 And I want to say this to the chief justice and his wing woman, Amy Coney Barrett, you have
00:06:50.000 failed to do your jobs.
00:06:51.000 You failed to do your jobs by stopping Judge Ali's lawless TRO that ordered the president
00:06:58.000 to send out foreign aid over his national security objection and review.
00:07:03.000 And this is the natural and probable consequence of the chief justice and Amy Coney Barrett's mindlessness

00:07:12.000 Two weeks ago when they let Judge Ali say, oh, it's a T. We judge Ali put TRO temporary

00:07:29.000 And it's now we are at the brink with the federal judiciary because we have a circumstance
00:07:35.000 where a judge's order is not being followed.
00:07:38.000 And when a judge's order is not followed, what is he going to do?
00:07:41.000 Is he going to order his law clerks to go arrest the president of the United States?
00:07:46.000 Is he going to go order his law clerks to interfere with this operation?

00:07:55.000 You went out of your way when this first started and you and I talked and other people talk.
00:08:00.000 We knew that they were going to come and use lawfare and use these courts against President
00:08:05.000 Trump's plan that the American people voted for.

00:08:09.000 You came on here and first said, hey, I want to warn everybody in the administration.
00:08:13.000 If you start getting these orders, you've got to comply because that's going to rattle Amy Coney Barrett

00:08:23.000 Now you've done a huge flip on that.
00:08:26.000 I just want to make sure everybody understands.
00:08:28.000 You were adamant that even if some of these were egregious, you had to comply with them
00:08:32.000 because it would hurt us as we went up the chain of command, the judicial chain of command.
00:08:37.000 Now you're saying that this one is so egregious and it delves into national security
00:08:42.000 where no judge should be sticking around and actually the operations of national security
00:08:47.000 that you're actually recommending to the president that he not comply with it.
00:08:52.000 I just want to make sure the audience has your thinking, sir.
00:08:56.000 There's not a flip flop here.
00:08:57.000 This is a rare exception.
00:08:59.000 The most rare exception where you cannot, as the president of the United States, follow this.

00:09:07.000 You can still comply with a lawless order and take it up on appeal.
00:09:11.000 This is a lawless order that is a grave danger to our national security.
00:09:16.000 And that's where the president has a constitutional duty as the commander in chief under Article 2
00:09:21.000 to ignore this lawless and extremely dangerous order.

00:09:28.000 You're putting American lives in jeopardy.
00:09:30.000 This judge could have got Americans and our allies very easily killed by turning around those planes.
00:09:38.000 Look, they had a whole military operation in El Salvador waiting awaiting these terrorists.
00:09:44.000 They didn't have that same thing in America if you turned around these planes, right?

00:09:50.000 And then if you turn around these planes, did this judge know how much fuel was in these planes?

00:09:59.000 Because he got his ego bruised and because he's such a rabid Trump-hating partisan, his judgment is clouded.

00:10:57.000 You also want the House in the budget process to cut, I think it's $12 billion to run the federal judiciary.

00:11:10.000 And so that $2 billion that the Chief Justice and Justice Amy Coney Barrett let Judge Ali send to his terrorist buddies and to transgender mice, the House needs to cut that directly out of the judiciary's budget.

00:11:23.000 If they can piss away $2 billion in foreign aid, then we can take that out of, that's 20% of the federal judiciary's budget.

00:11:40.000 And also, I'm going to get to impeachment in a second, but you're also saying you want legislation, much like they had legislation at the beginning of the Republic, to actually reorganize.

00:12:50.000 And in D.C., I would say this.

00:13:10.000 So they don't have a lot of cases on their hands.
00:13:12.000 And so these district court judges in D.C. are bored.
00:13:15.000 And now they're sabotaging the presidency, his Article 2 power, because they're bored and they can't.
00:13:20.000 So what I would do is I would strip their jurisdiction.
00:13:23.000 I would instead of the D.C. Superior Court that handles D.C. street crimes, there are like 10 or 11 vacancies on that thing that are that need to be filled.
00:13:32.000 And it's a bunch of, you know, radical activists on the D.C. bar who fills those judges.
00:13:37.000 Get rid of the D.C. Superior Court.
00:13:39.000 It's unconstitutional anyway.
00:13:41.000 And they're not doing a good job as as evidenced by the D.C. street crime over the last four years.
00:13:45.000 And then have the D.C. district court judges handle that docket, take that jurisdiction of D.C. street crimes from the D.C. Superior Court.

00:19:13.000 I mean, Wisconsin was part of the blue wall that Donald Trump was able to pierce back in 2016 there.
00:19:18.000 The Supreme Court in Wisconsin has dramatically overstepped in previous years when it comes to election law, when it comes to law and order, when it comes to illegal immigration there.
00:19:27.000 So, it's an extraordinarily important election.
00:19:30.000 And a lot of these swing states, the control of the court ultimately comes down to one seat.
00:19:34.000 So, it is to the case in the state of Wisconsin there.
00:19:37.000 You know, not every state has these judicial elections.
00:19:40.000 I mean, the way that the judiciary works is a state-by-state basis there.
00:19:43.000 So, when you live in a state, if you are a grassroots activist, if you are someone who cares, frankly, just about your state, about the country, about all the issues.
00:19:49.000 And you actually live in a state where you have the opportunity to vote to actually elect Supreme Court justice, you better get off your rear end and do it.
00:19:56.000 Because, frankly, not every American actually has an opportunity.
00:19:58.000 I mean, whether it's the Missouri plan, advice consent, a lot of people just don't have the opportunity.
00:20:02.000 So, you better take advantage of it if you live in Wisconsin, I say.
00:20:05.000 Josh, you're part of the posse over working with the viceroy, Mike Davis.

00:20:26.000 Do you think this constitutional crisis that we're hurtling towards requires the kind of remedies that we are talking about in Article 3 is talking about, sir?
00:20:35.000 Steve, ever since I was a first year law student, I have been yelling from the top of my lungs about presidents and the Congress in particular and reigning in lawless judges.
00:20:47.000 I have been of the opinion literally since I first read the Constitution cover to cover that judicial impeachment is one of the most underutilized tools in American history.
00:20:55.000 I mean, when is the last time that we have actually had a concerted effort and a successful effort at that to try to actually impeach a federal judge?
00:21:02.000 We've seen no shortage of opportunities to do exactly that here in this second Trump administration, whether it's Judge Bozberg, who I've been calling Judge Bozo.
00:21:09.000 It's kind of juvenile, but it's also kind of funny.
00:21:11.000 Whether it's Judge Bozo in D.C., whether it's Judge McConnell in Rhode Island or any number of other examples here, there are ample opportunities.
00:21:17.000 Judge Amir Ali, the guy who's on the USAID case, also in Washington, D.C. there.
00:21:21.000 At some point, you have to throw a shot across the bow here.
00:21:24.000 Steve, I mean, one or two times ago when I was on with you here to talk to the War Room Posse,
00:21:29.000 we were talking about the threat of what I call the judicial insurrection in general.
00:21:33.000 And you have to nip this thing in the bud because if you let this fester, if you let this start to spread like a great conflagration, and arguably we actually are already there.
00:21:43.000 But if you let it spread and spread and just keep on spreading there, eventually they're going to devour you.
00:21:48.000 I mean, it's kind of like the old video game Pac-Man.
00:21:50.000 As Pac-Man starts eating up and eating up with little resistance there, he's going to just dominate.
00:21:54.000 So you have to meet force with force.
00:21:56.000 It's like James Madison said in Federalist No. 51, ambition must be made to counteract ambition.
00:22:01.000 That's the entire premise, the entire hinge on which our entire separation of powers construct actually goes here.
00:22:06.000 And what that means is that Congress has a ton of tools at its disposal, including but not limited to judicial impeachment, that they really ought to do.
00:22:14.000 It's time also, I think, to get crafty when it comes to jurisdiction stripping legislation.
00:22:19.000 Let's try to strip some of these federal judges of certain types of jurisdiction.
00:22:23.000 You can basically strip them of any category of cases that you want to hear if you want to make sure that a case goes to state or local court, not federal court.
00:22:30.000 Congress has plenary authority to legislate in that particular area here.
00:22:34.000 But, yes, we at Article III Project mean business.
00:22:36.000 I mean, we are not messing around here because, frankly, Donald Trump cannot mess around.
00:22:40.000 Because if you let this fester against you, this could devour the entirety, the entirety of the MAGA 2.0 agenda, I fear.
00:22:46.000 You were the first, even before Davis, because Mike came in at a tactical level.
00:22:54.000 You said, hey, this whole – you're going to see a judicial insurrection across the board.
00:22:58.000 Is there a theory of the case here?

00:23:46.000 If you go back and look from 2017 to 2021, by my count, it's between 65 and 70 of these so-called nationwide injunctions that the lower court federal judges issued against the Trump administration.

00:24:03.000 And so right here out of the gate, starting just a couple days after Donald Trump is sworn in on January 20th, they're trying the same thing all over again.

00:33:54.000 That's the Klaus Schwab globalism, the homogenizing imperative, the John Lennon imagine let's eradicate all differences between human beings, the very things that make us human in the first place there.

00:34:11.000 And I think if we're talking about defending the West, I mean, we were just talking about the law.

00:34:33.000 And, Steve, in the book, in some of the earlier chapters, I painstakingly detail how everything from the English common law to the American founding to so much that we take for granted in our day-to-day lives when it comes to morals, ethics, our rule of law, constitution, all of the above, was really predicated on biblical values and, in many ways, Hebrew Bible values.

00:34:55.000 You shall proclaim liberty throughout the land and all the inhabitants thereof.

00:35:03.000 Abraham Lincoln famously spoke of Americans as a, quote, almost chosen people.
00:35:07.000 And the book is really a call for Jews and Christians alike to basically fall in love with that which made our civilization great again.
00:35:14.000 Now, the other thing that I want to do to answer your question, and this is kind of taking on not just the children of Israel but the state of Israel component here.
00:35:21.000 Steve, I have a whole chapter in the book, and you and I have talked about this privately.
00:35:26.000 I have a whole chapter in this book making the MAGA America first case for US-Israel relations.
00:35:31.000 Frankly, it's not a very difficult chapter to write because it's literally just Donald Trump's presidency.
00:35:36.000 I basically explain what Donald Trump's mentality was on all of these issues there, ultimately culminating in the Abraham Accords, this transformative peace deal between Israel and the UAE, Bahrain, Morocco, and Sudan.
00:35:48.000 Steve, I am a hard-headed foreign policy realist.
00:35:51.000 I've been criticizing neoconservatives for longer than most people have even known what the word neoconservative means here.
00:35:56.000 I am a realist who looks at every single geopolitical conflict around the world and says what is in the American national interest.
00:36:02.000 What that means is that as a realist, I recognize, as I believe you do as well, that China and the Chinese Communist Party is bar none, period, full stop, end of story, America's preeminent threat this century.
00:36:13.000 The relevant question, then, is what can America do to best safeguard its interest in this very volatile part of the world, the Middle East, when it comes to everything from the radical jihad, the Muslim Brotherhood, the Persians, as you artfully call them, to oil and natural gas, and the Red Sea shipping, all that.
00:36:30.000 How can you best secure your interests while the United States then strategically redeploys assets to the Indo-Pacific, which I do believe we have to do?
00:36:38.000 The answer, again, can be found in the Trump diplomacy from the first time, in this Abraham Accords-style statesmanship that basically says you embolden our allies in the region to patrol your own neck of the woods in a way that redounds to both of our interests.

00:36:53.220 He and J.D. Vance are trying to encourage the European allies to take care of their own backyard.

00:37:21.140 But in that regard, if we get sucked into another Middle East war, and this means any type of military intervention either by air or land in Persia about this obviously grievous faults of Democrats about this nuclear situation, don't you believe in working with Russia, some sort of rapprochement, we have to get to a diplomatic settlement there?
