00:00:13.600 to real people whose names we know, whose stories we know. The president of the United States
00:00:20.480 is disappearing people to an El Salvadoran prison for terrorists. A prison known by its initials
00:00:28.300 he caught. A prison built for disappearance. A prison where there is no education or remediation
00:00:36.680 or recreation. Because it is a prison that does not intend to release its inhabitants back out
00:00:43.900 into the world. It is a prison where the only way out, in the words of El Salvador's justice minister,
00:00:51.840 is in a coffin. Sure, president. First and foremost, he was illegally in our country.
00:00:57.960 He had been illegally in our country. And in 2019, two courts, an immigration court and an
00:01:05.060 appellate immigration court, ruled that he was a member of MS-13 and he was illegally in our
00:01:11.540 country. Right now, it was a paperwork. It was additional paperwork that needed to be done.
00:01:17.980 That's up to El Salvador if they want to return him. That's not up to us. The Supreme Court ruled,
00:01:24.080 president, that if, as El Salvador wants to return him, this is international matters, foreign affairs,
00:01:30.640 if they wanted to return him, we would facilitate it. Meaning, provide a plane.
00:01:36.420 Yesterday in the Oval Office, administration officials made it very clear that El Salvador
00:01:41.260 is responsible for Mr. Obrigo Garcia. Yet El Salvador's president said, we are, we're not going to do
00:01:46.600 anything with him. So my question is, who is responsible for this man and where he's going to end up?
00:01:51.640 Well, no. First of all, President Bukele said that he is not going to smuggle a foreign terrorist back
00:01:57.980 into the United States of America, as many in this room in the Democrat Party seemingly want him to do.
00:02:04.740 Obrigo Garcia was a foreign terrorist. He is an MS-13 gang member. He was engaged in human trafficking.
00:02:12.300 He illegally came into our country. And so deporting him back to El Salvador was always going to be the
00:02:19.680 end result. There is never going to be a world in which this is an individual who's going to live a
00:02:24.740 peaceful life in Maryland because he is a foreign terrorist and a MS-13 gang member. Not only have
00:02:30.500 we confirmed that, President Bukele yesterday in the Oval Office confirmed that as well.
00:02:35.640 So he went back to his home country where he will face consequences for his gang affiliation and his
00:02:41.880 engagement in human trafficking. I'm not sure what is so difficult about this for everyone in the media
00:02:46.880 to understand. And it's appalling, truly appalling, that there has been so much time covering this
00:02:53.840 alleged human trafficker and this gang member, MS-13 gang member. It's truly striking to me.
00:03:03.020 As Pam mentioned, there's an illegal alien from El Salvador. So with respect to you,
00:03:10.400 he's a citizen of El Salvador. So it's very arrogant even for American media to suggest
00:03:16.280 that we would even tell El Salvador how to handle their own citizens as a starting point.
00:03:20.980 As two immigration courts found that he was a member of MS-13, when President Trump declared
00:03:26.060 MS-13 to be a foreign terrorist organization, that meant that he was no longer eligible under federal
00:03:32.480 law, which I'm sure you know, you're very familiar with the INA, that he was no longer eligible for
00:03:36.780 any form of immigration relief in the United States. So he had a deportation order that was
00:03:42.200 valid, which meant that under our law, he's not even allowed to be present in the United States
00:03:46.860 and had to be returned because of the foreign terrorist designation. This issue was then by a district
00:03:54.000 court judge, completely inverted, and a district court judge tried to tell the administration that they had to
00:04:00.300 kidnap a citizen of El Salvador and fly him back here. That issue was raised to the Supreme Court. And the
00:04:06.100 Supreme Court said the district court order was unlawful and its main components reversed 9-0 unanimously, stating
00:04:13.900 clearly that neither Secretary of State nor the president could be compelled by anybody to forcibly
00:04:20.200 retrieve a citizen of El Salvador from El Salvador, who again is a member of MS-13, which is, I'm sure you
00:04:27.380 understand, rapes little girls, murders women, murders children, is engaged in the most barbaric activities
00:04:33.140 in the world. And I can promise you, if he was your neighbor, you would move right away. And from their
00:04:36.840 perspective, maybe they're right. Because here's a scary thing that I think sits at least partially
00:04:41.800 beneath their calculus. Politically, they cannot let Abrego Garcia out, nor any of the other people
00:04:48.000 they sent to Seacott without due process. Because what if he was released? What if he returned to
00:04:53.320 the United States? What if he could tell his own story? What if, as seems quite likely, he's been
00:04:59.700 brutalized and tortured by Trump's Salvadoran henchmen? Well, he can't be allowed to tell the American
00:05:06.580 people that. To the Trump administration, Abrego Garcia is not a mistake. He's a liability and he's a test. A test of their
00:05:15.920 power to do this to anyone. A test of whether the loophole they believe they have found. A loophole where if they
00:05:22.040 could just get you on a plane, then they can hustle you beyond our laws and leave you in the grips of the kind of
00:05:27.980 gulags they wish that they had here. Does that include potentially U.S. citizens fully naturalized
00:05:33.440 degree? They're not ashamed of this. They're not denying their desire to do it to more people.
00:05:38.780 Yeah, that includes them. Why do you think there's a special category of person? They're as bad as
00:05:43.800 anybody that comes in. We have bad ones too. And I'm all for it. Because we can do things with the
00:05:52.060 president for less money and have great security. We are not even a hundred days into this
00:05:58.860 administration. And we are already faced with this level of horror. And I can feel the desire to look
00:06:05.420 away from it, even in me. What all this demands is too inconvenient, too disruptive. But Trump has said
00:06:14.300 it all plainly and publicly. He intends to send those he hates to foreign prisons beyond the reach of U.S.
00:06:20.000 law. He does not care. He will not even seek to discover if those he is sending into these foreign
00:06:25.820 hells are guilty of what he claims. Because this is not about their guilt. It is about his power.
00:06:32.120 This is how dictatorships work. Trump has always been clear about who he is and the kind of power
00:06:38.780 he wants. And now he's using that power. And everyone around him is defending his right to wield that power.
00:06:46.140 The foreign policy of the United States is conducted by the president of the United States, not by a court.
00:06:51.360 And no court in the United States has a right to conduct the foreign policy of the United States.

00:06:56.520 Mr. President, you wanted people to know that there was consequences if you break our laws and harm our people
00:07:01.800 and endanger families. And this is a clear consequence for the worst of the worst that we have somewhere to put them.

00:18:42.520 Tech companies, Meta is not exclusive to this, but tech companies have been throwing money
00:18:46.680 around town to influence the coverage of them and also to think tanks who then launder their
00:18:53.280 business propositions as policy proposals, which then go to policymakers on the Hill.
00:18:58.280 So there is this cycle of information warfare, to use your term, that's going on.
00:19:04.680 But I think the second reason is that he's one of them.
00:19:08.640 He is an elite in D.C.
00:19:10.280 And how dare these institutions of government come for them?
00:19:13.780 They are only supposed to go after political opposition for Democrats.
00:19:17.420 That's their job.
00:19:18.700 They go after businesses that nobody cares about.
00:19:21.680 How dare you come after these masters of the universe, which Zuckerberg has positioned

00:19:52.740 And it's actually, I've been told, prompted laughter in the courtroom because it's so

00:19:57.160 He's presented with his own words being that, oh, I want to neutralize a competitor when

00:20:03.120 And he'll say, yeah, maybe I said that or I don't recall.
00:20:06.460 And so he's not actually being the fierce witness that Politico wants to portray him as.
00:20:11.440 But again, they're on the hook for doing so because they're being paid by Mark Zuckerberg.
00:20:16.160 Just for the audience, what the first part of the trial, is it unusual to call a guy like
00:20:23.500 him as the first witness?
00:20:25.140 Was this a radical strategy of the government, of the FTC to actually call?
00:20:30.140 Isn't it traditional you build up and then he's the he's the grand finale?
00:20:34.740 Or do you normally bring somebody like that in this early?

00:20:39.940 And it's not just with Mark Zuckerberg.

00:20:49.860 They're trying to overwhelm the court a little bit here with star power.
00:20:54.580 And I think they're trying to get their best arguments out there and then for the government
00:20:58.540 to put them out and then rebuke them.
00:20:59.960 So it is a little bit of a strategy, I think, on Facebook's part.
00:21:02.680 And remember, too, the lead lawyer for Facebook actually used to be the boss of the judge,
00:21:08.740 of Judge Jeb Boesburg.
00:21:09.740 So this is all an intentional strategy to, you know, grease the skids, influence, peddle
00:21:15.860 the influence game in Washington.
00:21:17.680 You know, Facebook was in the White House three times meeting with Trump.
00:21:21.140 Again, as we talked about, they donated his inauguration fund.
00:21:23.780 All of this is because for years, Facebook has been able to buy its way out of enforcement.
00:21:28.600 And you're seeing them use every trick in the book to try to do that again.
00:21:31.540 If the overall strategy of the FTC and the Justice Department and everybody that's, you
00:21:38.460 know, the neo-Brandeisians that want to start to take apart these oligarchs, and it's to
00:21:43.420 disaggregate, start by disaggregating meta and show that you can do that because you've
00:21:48.400 got the penalty phases of Google on two different types, right?
00:21:51.580 I think on search and then the advertising engine, one in Northern Virginia Federal Court
00:21:55.280 and the other in D.C., of which Omid and the team over the justice are just been on fire

00:22:07.560 has Zuckerberg, I know he's contradicting himself, but is the government actually making its
00:22:14.200 case, you think, that can drive through the rest of this trial and convince folks that

00:22:26.040 You know, I think, as we've discussed, they're benefited by the fact that they have Zuckerberg's

00:22:32.080 Zuckerberg's words in email saying, I want to neutralize a competitor.

00:22:38.160 All of these things indicating that he didn't buy Instagram in order to help it innovate
00:22:44.080 and help it thrive.
00:22:45.040 He bought it because it was a competitor and he wanted to neutralize it.

00:22:49.820 Our antitrust laws, again, protect the marketplace.
00:22:53.300 They protect the marketplace from predators like Meta seeking to hoover up any competitive
00:22:59.180 threat and suck it into themselves to create these giant market borgs.
00:23:03.940 And that's what Facebook has and Meta have become.
00:23:06.640 And so I think the government is really trying to demonstrate that.
00:23:09.560 Now, I think we're going to get, you know, when we get out of the star power phase of
00:23:12.580 this trial, we're going to focus very much on these wonky definitions around what is

00:23:17.400 Who does Facebook actually compete with?
00:23:19.420 And that's where I think FTC is really going to have to show its mettle.
00:23:22.180 Because if Meta is allowed to claim it, it competes against a host of these competitors,
00:23:27.500 its market share is actually very small, the government will have a harder case to make.
