00:00:00.000 This morning the Supreme Court has delivered a monumental victory for the Constitution, the separation of powers and the rule of law in striking down the excessive use of nationwide injunctions to interfere with the normal functioning of the executive branch. The Supreme Court has stopped the presidency itself. That's what they've done. And really it's been it's been an amazing period of time this last hour.
00:00:29.000 There are people elated all over the country. I've seen such such happiness and spirit. Sometimes you don't see that. But this case is very important. I was elected on a historic mandate. But in recent months, we've seen a handful of radical left judges effectively try to overrule the rightful powers of the president to stop the American people from getting the policies that they voted for in record numbers.
00:00:54.100 It was a grave threat to democracy, frankly. And instead of merely ruling on the immediate cases before them, these judges have attempted to dictate the law for the entire nation.
00:01:06.100 In practice, this meant that if any one of the nearly 700 federal judges disagreed with the policy of a duly elected president of the United States, he or she could block that policy from going into effect or at least delay it for many years, tie it up in the court system.
00:01:24.180 This was a colossal abuse of power, which never occurred in American history prior to recent decades.
00:01:31.180 And we've been hit with more nationwide injunctions than were issued in the entire 20th century together. Think of it more than the entire 20th century. Me.
00:01:41.780 I'm grateful to the Supreme Court for stepping in and solving this very, very big and complex problem. And they've made it very simple.
00:01:51.780 I want to thank Justice Barrett, who wrote the opinion brilliantly, as well as Chief Justice Roberts and Justices Alito, Gorsuch, Kavanaugh and Thomas. Great people.
00:02:03.780 Americans are finally getting what they voted for. No longer will we have rogue judges striking down President Trump's policies across the entire nation. No longer.
00:02:16.780 Today, in the 6-3 opinion, Justice Barrett correctly holds that the district court lacks authority to enter nationwide or universal injunctions.
00:02:26.780 These lawless injunctions gave relief to everyone in the world instead of the parties before the court. As the Supreme Court held today, they turned district courts into the imperial judiciary.
00:02:41.780 Active liberal justices, judges have used these injunctions to block virtually all of President Trump's policies. To put this in perspective,
00:02:52.780 there are 94 federal judicial districts. Five of those districts throughout this country held 35 of the nationwide injunctions. Think about that.
00:03:06.780 94 districts and 35 out of the 40 opinions with nationwide injunctions came from five liberal districts in this country. No longer.
00:03:18.780 Thanks to this decision. We can now promptly file to proceed with numerous policies that have been wrongly enjoined on a nationwide basis.
00:03:27.780 And some of the cases we're talking about would be ending birthright citizenship, which now comes to the fore.
00:03:35.780 That was meant for the babies of slaves. It wasn't meant for people trying to scam the system and come into the country on a vacation.
00:03:42.780 This was in fact, it was the same date, the exact same date, the end of the Civil War.
00:03:47.780 It was meant for the babies of slaves and it's so clean and so obvious.
00:03:51.780 But this lets us go there and finally win that case because hundreds of thousands of people are pouring into our country under birthright citizenship.
00:03:59.780 And it wasn't meant for that reason. It was meant for the babies of slaves.
00:04:04.780 So thanks to this decision, we can now promptly file to proceed with these numerous policies and those that have been wrongly enjoined on a nationwide basis,
00:04:14.780 including birthright citizenship, ending sanctuary city funding, suspending refugee resettlement, freezing unnecessary funding, stopping federal taxpayers from paying for transgender surgeries and numerous other priorities of the American people.
00:04:31.780 If you have an undocumented baby, would that baby then be an enforcement priority?
00:04:37.780 The violent criminals in our country are the priority. Now, let me put it in perspective.
00:04:43.780 Today marked the 2,711th arrest in our country of TDA members, just TDA.
00:04:52.780 Everyone in this room agrees they are one of the most violent criminal organizations in the world.
00:04:58.780 And the Biden administration let them walk into our country, walk into our country for the last four years.
00:05:05.780 2,711th of them today have been arrested in our country.
00:05:10.780 That is the priority of Donald Trump. That is the priority of this country, of Homeland Security, of all of our lawyers, of FBI.
00:05:17.780 That's the priority. That will be discussed in October when the Supreme Court hopefully rules in our favor and we're very confident of that.
00:05:25.780 But you should all feel safer now that President Trump can deport all of these, all of these gangs and not one district court judge can think they're an emperor over this administration,
00:05:37.780 his executive powers and why the people of the United States elected him.
00:05:40.780 I want to go back to what Andrew was saying about the silver linings. I don't think there are silver linings here.
00:05:45.780 And I want to be very clear with the viewers at home. This is a really grave situation.
00:05:50.780 This court has effectively taken the restraints off of this administration.
00:05:56.780 We don't have a Congress that is stepping in to rein in this administration.
00:06:01.780 All we've had are lower court judges who are looking at the lawlessness of this administration saying, not on my watch, imposing these nationwide injunctions to stop the damage in its tracks.
00:06:13.780 And this court has now said that limited tool, that limited judicial remedy goes too far.
00:06:18.780 And instead, what individual litigants are going to have to do is go to every district in this country to litigate, to stop the administration in its track or somehow find at a time when the administration has made the availability of lawyers scarce,
00:06:34.780 find a lawyer who is willing to take on the challenge of mounting a class action to go and challenge this administration.
00:06:42.780 This court has made it absolutely impossible to try and stop the worst of what the administration is doing.
00:06:51.780 So there really aren't silver linings.
00:06:53.780 Yes, there are some litigants now who have amended their complaints and filed class actions.
00:06:58.780 But the idea that we are going to do this for everything is really just unfathomable.
00:07:03.780 It's not just birthright citizenship that is at stake.
00:07:06.780 These nationwide injunctions have been used across the board to stop this administration from firing federal workers,
00:07:14.780 to stop this administration from rescinding funding from research institutions and universities.
00:07:20.780 All of that ends now.
00:07:22.780 The gloves are off.
00:07:23.780 There are no restraints, no checks on this administration.
00:07:27.780 We are entering a very dangerous moment.
00:07:30.780 This is the primal scream of a dying regime.
00:07:37.780 Pray for our enemies.
00:07:39.780 Because we're going medieval on these people.

00:08:54.780 But overall, this was a very good term.
00:08:59.780 President Trump's biggest and most consequential accomplishment of his first term was the
00:09:04.780 transformation of the Supreme Court to the first constitutionalist majority in 90 years.
00:09:11.780 And we're seeing that today.
00:09:12.780 We saw that early in the term when the Supreme Court ruled six to three that states can regulate
00:09:19.780 trans surgeries on minors.
00:09:23.780 We saw it today when the Supreme Court held six to three that these nationwide injunctions
00:09:31.780 by these activist judges are not lawful.
00:09:36.780 They likely violate Article three of the Constitution.
00:09:40.780 We we see this today in a six to three ruling that parents can opt out for their kids when
00:09:46.780 their kids are being indoctrinated with with LGBT, you know, anti-religious nonsense in
00:09:54.780 these schools where they're brainwashing these kids.
00:09:56.780 We saw it with another six to three ruling where the Supreme Court held that states can have
00:10:03.780 age verification to make sure that people who are going on to these porn sites are actually
00:10:08.780 18 years old.
00:10:10.780 It's it's very confusing to me with these left wing judges, these three Democrat left wing
00:10:15.780 judges, Sotomayor Kagan and Ketanji Brown Jackson.
00:10:21.780 I just I don't quite understand what they stand for because they pretend there is a constitutional
00:10:30.780 right to murder kids up until the moment of birth.
00:10:34.780 They pretend there's a constitutional right to mutilate these kids with trans pills and
00:10:41.780 trans surgeries.

00:19:57.780 But today, a 6-3 ruling by the Supreme Court in a case called Mahmood v. Taylor, the Beckett Fund brought this case in defense of parents' fundamental religious rights to direct the upbringing of their children.
00:20:08.780 And, Steve, I want to give you a big thank you to start off because the first time I ever came on your show, you said, Tiffany, explain what fundamental parental rights are.
00:20:16.780 I want to make sure everyone understands that.
00:20:18.780 And during COVID, to be honest with you, I think a lot of parents didn't realize, in fact, that the government was trying to, you know, have this overreach of their rights.
00:20:25.780 So President Trump at the podium today answering questions about the Supreme Court cases.
00:20:30.780 And he said that he couldn't believe that parents had been in this position in the first place, but he was very happy to be a part of making sure that we were returning the fundamental rights of parents where they belong.
00:20:40.780 What was the basic case about? What was this? You guys chose to take this one and take it all the way.
00:20:48.780 What was this one about and why are of everything that happened today, you know, Trump's autocratic power and everything?
00:20:55.780 This one, you stuck the landing because they're in they're big mad about this one.
00:21:01.780 What is this case that was so important? What were the kind of the details and why are they so big mad about it?
00:21:08.780 They're really mad about it because they wanted to use America's public schools to indoctrinate children into gender ideology.
00:21:14.780 This idea that somehow your biological sex might be incongruent with your gender identity.
00:21:19.780 Let's be clear. There are two sexes, zero genders and infinite personalities.
00:21:24.780 There's no right way to be a boy or a girl.
00:21:26.780 But in this school, they were reading books to students as part of this pride storybook collection.
00:21:31.780 Things like pride puppy books where there were drag queens in it talking about wearing leather and all kinds of things.
00:21:39.780 Justice Alito in his in his ruling today and his argument said, listen, you know, this is inappropriate content.
00:21:47.780 Parents have a religious right to direct the upbringing of their children.
00:21:51.780 And so the school had stopped allowing parents to opt out of this curriculum.
00:21:58.780 And it was pretty crazy to see Justice Kavanaugh in the oral arguments had said, wow, kind of hard to realize this is the hill you're going to die on.
00:22:07.780 And so the school said no more opt outs. Your kids have to go through this state.
00:22:11.780 They want to do this on purpose. They want to indoctrinate your children.
00:22:15.780 They don't want you to be able to pull them out of this instruction that they know goes against your family values.
00:22:20.780 Why? Because they want the destruction of the family.
00:22:23.780 They want to drive a wedge between the parent and the child. So the left is very mad.
00:22:27.780 Public schools have been a huge battleground in the middle of this cultural revolution that they have put us in.
00:22:33.780 And we are taking this cultural institution back. So no doubt that they are spitting mad over there because this is just the start of the winning that American parents are going to do.
00:22:43.780 Remember, this case was was ruled on religious rights of parents.
00:22:47.780 But I believe that you're going to see other cases coming before the Supreme Court in the future that are going to really jig down deep on the fundamental right of parents to direct the upbringing of their kids.

00:23:02.780 And this has been a big fight for you. Your thoughts.
00:23:04.780 Well, Steve, I agree with Mike Davis at Article three.
00:23:08.780 The American. This is a great term at the Supreme Court.
00:23:11.780 The American family is three and oh this term.
00:23:14.780 And what I mean by that is with the Scrimetti decision that came out last week, our children in the 27 states that we've gotten mutilate gender mutilation bands passed are now going to be protected and not struck down by some stupid ruling that would have been struck down by the way just shortly before President Trump was elected.
00:23:32.780 But then with the Mahmoud case that came out today, parents right to fundament of the fundamental right to direct the upbringing and education, their children is protected.
00:23:39.780 But Steve, the even bigger victory, I think, than all of these combined is the first time in I don't know how long the Supreme Court has ruled against the porn industry.
00:23:51.780 The Free Speech Coalition versus Paxton decision came out this morning as well.
00:23:56.780 And it ruled that states have the right to pass age verification to protect children online from porn.
00:24:02.780 See, to put this in perspective, we had the ACLU versus Reno in 1997 struck down the Communications Decency Act.
00:24:10.780 Every Supreme Court decision that's come out regarding pornography has expanded the porn industry.
00:24:17.780 This is the first time that parents have had a huge victory at the Supreme Court when it comes to porn.
00:24:22.780 But we're not just one victory.
00:24:24.780 This is 3-0.
00:24:25.780 I mean, every single term before this, it was 0-2, 0-5, 0-3.
00:24:29.780 We are now winning at the Supreme Court level, and it doesn't happen without Donald Trump, and it doesn't happen without Morgan.
00:24:35.780 It doesn't happen without the War Room Posse.
00:24:37.780 Give me that perspective again because it seemed like that the First Amendment and the freedom of speech, and it's interesting how the porn industry came about this as a First Amendment right, right?
00:24:51.780 Is this the first time that's kind of been countered that your right of free speech is kind of limited by at least the access to young people of what they can see?
00:25:00.780 Because they tried to hide behind a First Amendment argument, didn't they?

00:25:46.780 And it cannot protect obscenity because these things have a crowding out effect.

00:30:46.780 And instead, what individual litigants are going to have to do is go to every district in this country to litigate, to stop the administration in its track or somehow find at a time when the administration has made the availability of lawyers scarce.
00:31:02.780 Find a lawyer who is willing to take on the challenge of mounting a class action to go and challenge this administration.
00:31:10.780 This court has made it absolutely impossible to try and stop the worst of what the administration is doing.
00:31:18.780 So there really aren't silver linings.
00:31:20.780 Yes, there are some litigants now who have amended their complaints and filed class actions.
00:31:25.780 But the idea that we are going to do this for everything is really just unfathomable.
00:31:30.780 It's not just birthright citizenship that is at stake.
00:31:34.780 These nationwide injunctions have been used across the board to stop this administration from firing federal workers,
00:31:41.780 to stop this administration from rescinding funding from research institutions and universities.
00:31:47.780 All of that ends now.
00:31:49.780 The gloves are off.
00:31:50.780 There are no restraints, no checks on this administration.
00:31:55.780 We are entering a very dangerous moment.

00:32:46.780 But what has been raised on both the left and the right, and we're already seeing court filings.

00:32:53.780 So while the court overturned the use of universal preliminary injunctions, meaning a nationwide ban based on one lawsuit before one district court judge on this issue, birthright citizenship executive order, what the court did open the door for was the designation of class action lawsuits.
00:33:15.780 Now, this is what we've talked about in the Alien Enemies Act and for states.
00:33:21.780 And we saw several blue states who were involved in this preliminary injunction litigation claiming that they could be a harmed party if we take away birthright citizenship for children born to illegal immigrants and women who are here on a temporary lawful basis.
00:33:38.780 So they did open the door for these class action lawsuits, and we're already seeing filings today in New Hampshire by Norm Eisen, the ACLU and NAACP, and then a continuation in the Maryland case, which was the case that was really brought before the Supreme Court on these preliminary injunctions.
00:34:00.780 So I know it's confusing to people.
00:34:02.780 I have a piece of it, my sub stack declassified with Julie Kelly.
00:34:06.780 I'm going to have a lot more over the weekend trying to deconstruct it.
00:34:09.780 But the idea that this is now, you know, closed litigation, that the president won in the birthright citizenship litigation is going away and that that executive order is going to go into effect.

00:34:23.780 There's going to actually be a lot more lawsuits than the three preliminary injunctions that we saw resulting in the Supreme Court ruling today.
00:34:30.780 This is what I want to get you on here and give.
00:34:34.780 Look, it's a day of celebration.
00:34:35.780 It's a day that, hey, we got this done.
00:34:37.780 But how quickly they were they were ready to go.
00:34:41.780 They went in and filed these lawsuits virtually that the press release was not the tweet was not out for the Supreme Court.
00:34:49.780 And Norm Eisen and these guys have raised a ton of money, have all these law firms.
00:34:53.780 This is and this is the important thing about President Trump and the law firms.
00:34:56.780 You see Scad and ARPS hundred million dollars.
00:34:59.780 That means they're not putting it into these back in these NGOs and given free legal.
00:35:02.780 So now it's harder for them to raise money.
00:35:04.780 They got to raise hard dollars.
00:35:05.780 So this this war with the judiciary and this judicial uprising, this insurrection, it ain't over because these people understand.
00:35:14.780 I think the one thing they understand is that this is the best ground they can fight President Trump and administration on politically.
00:35:21.780 They're very weak.
00:35:22.780 You know, they're organized has been very weak.
00:35:24.780 New York City, the New York City mayor race aside.
00:35:27.780 We'll get to that in the next hour.
00:35:29.780 But this is where this is the hill they will die on.

00:35:33.780 They're going to fight this one tooth and nail.
00:35:34.780 You can see today with the big, long, sad faces initially.
00:35:37.780 But they're coming back and they're going to hit us with everything they got.

00:35:41.780 They absolutely are.

00:35:43.780 Now, here's the little upside, Steve, that War Room Posse will be very fascinated.
00:35:48.780 This is almost a bombshell revelation out of this litigation.
00:35:52.780 The left radical activist leftists, especially the ACLU, have finally found a right that unborn babies are entitled to.
00:36:02.780 They don't have a right to live, but they do have a right to become a U.S. citizen if they are born on U.S. soil to a mother who is here illegally.

00:36:14.780 So that is what is fascinating in these documents.
00:36:16.780 And I was posting a little bit of that on X and will continue to do so.
00:36:21.780 So now we're going to see this in multiple states, multiple jurisdictions.
00:36:25.780 All this really means is now these judges are going to confer class wide status, just like we saw Jeb Bosberg do in the Alien Enemies Act and other judges have done that as well.
00:36:36.780 They will then let the class wide lawsuit move forward.
00:36:40.780 Then they can issue a preliminary injunction in their district based on that class.
00:36:47.780 So this really tends to create a hydra of more judicial and legal wrangling with the administration.
00:36:55.780 But, Steve, the end result is that this birthright citizenship question, the executive order, will eventually make it back to the Supreme Court.
00:37:04.780 Again, the Supreme Court did not rule on that executive order today.
00:37:09.780 They only ruled on the use of these universal preliminary injunctions.
00:37:13.780 Very important to underscore that.
00:37:15.780 But that question eventually will get to the highest court and they are going to have to determine whether the 14th Amendment and the Citizenship Clause really did mean that babies born here on American soil to anyone, including those who cross the border illegally, as soon as early as last year, Steve.
00:37:37.780 The Norm Eisen lawsuit specifically talks about a plaintiff named Barbara who crossed the border illegally from Honduras in 2024.
00:37:46.780 This is one of Joe Biden's illegals.
00:37:48.780 She already had three children.
00:37:50.780 I'm assuming she brought them with her.
00:37:52.780 Her husband is also here illegally and she's pregnant due in October of 2025.
00:38:00.780 So this is the essence of the anchor baby system that we've seen for decades that has been ignored by both Republicans and Democrats, not by President Trump.
00:38:11.780 And so this is just one of the plaintiffs that the ACLU has plucked to use in this in these lawsuits.
00:38:18.780 How can the Supreme Court ultimately decide that this woman who came across the border in 2024 illegally seeking asylum from Honduras is married to another illegal and has a baby that that baby is then a U.S. citizen?
00:38:33.780 And of course, that means the entire family has some basis to stay here.
00:38:40.780 Insane.
00:38:41.780 One of the things they were cheerleading about today is that, oh, is this not automatic?
00:38:46.780 Do you have to go back and now argue in front of everyone of these judges to drop the injunction across the nation?
00:38:52.780 Is that another slowdown tactic?
00:38:54.780 Because to delay is to deny.
00:38:56.780 So and this is what I say about President Trump and trying to sell the war and negotiate these things.
00:39:00.780 He gets briefed every day on where these cases are.
00:39:03.780 And the cases are, I think, at 200.
00:39:05.780 Now does Bondi because they don't have a huge staff.
00:39:08.780 They remember most people in the Justice Department are still deep state or administrative state.
00:39:13.780 We have very few actual bodies over there.
00:39:16.780 And you can tell on the legal side we're struggling to put teams together.
00:39:20.780 Do they have to go back now to each of these district courts and have another argument on how just to drop that injunction there?
00:39:26.780 Not the nationwide injunctions that these three courts have imposed.
00:39:31.780 No.
00:39:32.780 Now, what will be interesting with the other nationwide preliminary injunctions that have been imposed, and I believe that were over 30 of those, that they will now use the Supreme Court to go and vacate those nationwide preliminary injunctions.
00:39:47.780 But the president and the DOJ won't really have to go back to these three judges on the birthright citizenship preliminary nationwide preliminary injunction case.
00:39:58.780 The litigants are, the plaintiffs, the ACLU and the immigrants groups are already doing that.
00:40:04.780 So what they're going back with, Steve, is they're asking for emergency motions.
00:40:07.780 And this is what we're seeing today.
00:40:09.780 We're going to see it all weekend into next week.
00:40:11.780 Is emergency motions to confer this class-wide status that would potentially cover anyone.
00:40:17.780 These pregnant illegals within this jurisdiction would cover all of them.
00:40:22.780 Then ask for a preliminary injunction, first a temporary restraining order, then a preliminary injunction that would halt the implementation of the birthright citizenship executive order.
00:40:34.780 So I'm hoping that I'm explaining this clearly enough and accurately.
00:40:40.780 I really think everyone, even close court observers, are sort of struggling with what the consequences of this opinion is going to be.
00:40:49.780 But we're already seeing, you know, these lawsuits being filed.
00:40:52.780 And I'm sure these same judges are going to come back and rubber stamp whatever Norm Eisen and the ACLU and all these immigrants rights groups want.
00:41:00.780 Because, as we've also talked about, Steve, these lower court judges, these Democrat activists who are judges on the bench, do not care if they are reprimanded by the Supreme Court.
00:41:12.780 They consider it a badge of honor.

00:41:16.780 We saw that most recently with Judge Brian Murphy in Boston on a case there of illegals, criminal illegals who were deported to a third country.

00:41:29.780 And he continued to insist that he still had the authority to impose his first orders about that.
00:41:34.780 We've talked about Judge Tanya Chuck and I was in her courtroom in September of last year after the Supreme Court roundly rebuked her hasty presidential immunity decision, claiming that President Trump had no immunity from prosecution based on his acts while he was in office.
00:41:53.780 And, Steve, she walked into that courtroom.
00:41:56.780 We've talked about this.
00:41:57.780 Like, she had just won the Miss America pageant.
00:41:59.780 She thought she was the victor there because they, these Democrat activist judges, view the Supreme Court as illegitimate.
00:42:07.780 So they will now take these lawsuits.
00:42:09.780 They will get the rubber stamp out again.
00:42:11.780 They will move forward.
