The Supreme Court has stopped the presidency itself. That's what they've done. And really it's been it's been an amazing period of time this last hour.
00:00:29.000There are people elated all over the country. I've seen such such happiness and spirit. Sometimes you don't see that. But this case is very important. I was elected on a historic mandate. But in recent months, we've seen a handful of radical left judges effectively try to overrule the rightful powers of the president to stop the American people from getting the policies that they voted for in record numbers.
00:00:54.100It was a grave threat to democracy, frankly. And instead of merely ruling on the immediate cases before them, these judges have attempted to dictate the law for the entire nation.
00:01:06.100In practice, this meant that if any one of the nearly 700 federal judges disagreed with the policy of a duly elected president of the United States, he or she could block that policy from going into effect or at least delay it for many years, tie it up in the court system.
00:01:24.180This was a colossal abuse of power, which never occurred in American history prior to recent decades.
00:01:31.180And we've been hit with more nationwide injunctions than were issued in the entire 20th century together. Think of it more than the entire 20th century. Me.
00:01:41.780I'm grateful to the Supreme Court for stepping in and solving this very, very big and complex problem. And they've made it very simple.
00:01:51.780I want to thank Justice Barrett, who wrote the opinion brilliantly, as well as Chief Justice Roberts and Justices Alito, Gorsuch, Kavanaugh and Thomas. Great people.
00:02:03.780Americans are finally getting what they voted for. No longer will we have rogue judges striking down President Trump's policies across the entire nation. No longer.
00:02:16.780Today, in the 6-3 opinion, Justice Barrett correctly holds that the district court lacks authority to enter nationwide or universal injunctions.
00:02:26.780These lawless injunctions gave relief to everyone in the world instead of the parties before the court. As the Supreme Court held today, they turned district courts into the imperial judiciary.
00:02:41.780Active liberal justices, judges have used these injunctions to block virtually all of President Trump's policies. To put this in perspective,
00:02:52.780there are 94 federal judicial districts. Five of those districts throughout this country held 35 of the nationwide injunctions. Think about that.
00:03:06.78094 districts and 35 out of the 40 opinions with nationwide injunctions came from five liberal districts in this country. No longer.
00:03:18.780Thanks to this decision. We can now promptly file to proceed with numerous policies that have been wrongly enjoined on a nationwide basis.
00:03:27.780And some of the cases we're talking about would be ending birthright citizenship, which now comes to the fore.
00:03:35.780That was meant for the babies of slaves. It wasn't meant for people trying to scam the system and come into the country on a vacation.
00:03:42.780This was in fact, it was the same date, the exact same date, the end of the Civil War.
00:03:47.780It was meant for the babies of slaves and it's so clean and so obvious.
00:03:51.780But this lets us go there and finally win that case because hundreds of thousands of people are pouring into our country under birthright citizenship.
00:03:59.780And it wasn't meant for that reason. It was meant for the babies of slaves.
00:04:04.780So thanks to this decision, we can now promptly file to proceed with these numerous policies and those that have been wrongly enjoined on a nationwide basis,
00:04:14.780including birthright citizenship, ending sanctuary city funding, suspending refugee resettlement, freezing unnecessary funding, stopping federal taxpayers from paying for transgender surgeries and numerous other priorities of the American people.
00:04:31.780If you have an undocumented baby, would that baby then be an enforcement priority?
00:04:37.780The violent criminals in our country are the priority. Now, let me put it in perspective.
00:04:43.780Today marked the 2,711th arrest in our country of TDA members, just TDA.
00:04:52.780Everyone in this room agrees they are one of the most violent criminal organizations in the world.
00:04:58.780And the Biden administration let them walk into our country, walk into our country for the last four years.
00:05:05.7802,711th of them today have been arrested in our country.
00:05:10.780That is the priority of Donald Trump. That is the priority of this country, of Homeland Security, of all of our lawyers, of FBI.

00:05:25.780But you should all feel safer now that President Trump can deport all of these, all of these gangs and not one district court judge can think they're an emperor over this administration,

00:05:40.780I want to go back to what Andrew was saying about the silver linings. I don't think there are silver linings here.
00:05:45.780And I want to be very clear with the viewers at home. This is a really grave situation.
00:05:50.780This court has effectively taken the restraints off of this administration.
00:05:56.780We don't have a Congress that is stepping in to rein in this administration.
00:06:01.780All we've had are lower court judges who are looking at the lawlessness of this administration saying, not on my watch, imposing these nationwide injunctions to stop the damage in its tracks.
00:06:13.780And this court has now said that limited tool, that limited judicial remedy goes too far.
00:06:18.780And instead, what individual litigants are going to have to do is go to every district in this country to litigate, to stop the administration in its track or somehow find at a time when the administration has made the availability of lawyers scarce,
00:06:34.780find a lawyer who is willing to take on the challenge of mounting a class action to go and challenge this administration.
00:06:42.780This court has made it absolutely impossible to try and stop the worst of what the administration is doing.
00:06:51.780So there really aren't silver linings.
00:06:53.780Yes, there are some litigants now who have amended their complaints and filed class actions.
00:06:58.780But the idea that we are going to do this for everything is really just unfathomable.
00:07:03.780It's not just birthright citizenship that is at stake.
00:07:06.780These nationwide injunctions have been used across the board to stop this administration from firing federal workers,
00:07:14.780to stop this administration from rescinding funding from research institutions and universities.
00:14:54.780Also, President Trump, the peacemaker all afternoon in the White House.

00:20:48.780What was this one about and why are of everything that happened today, you know, Trump's autocratic power and everything?
00:20:55.780This one, you stuck the landing because they're in they're big mad about this one.
00:21:01.780What is this case that was so important? What were the kind of the details and why are they so big mad about it?
00:21:08.780They're really mad about it because they wanted to use America's public schools to indoctrinate children into gender ideology.
00:21:14.780This idea that somehow your biological sex might be incongruent with your gender identity.
00:21:19.780Let's be clear. There are two sexes, zero genders and infinite personalities.
00:21:24.780There's no right way to be a boy or a girl.
00:21:26.780But in this school, they were reading books to students as part of this pride storybook collection.
00:21:31.780Things like pride puppy books where there were drag queens in it talking about wearing leather and all kinds of things.
00:21:39.780Justice Alito in his in his ruling today and his argument said, listen, you know, this is inappropriate content.
00:21:47.780Parents have a religious right to direct the upbringing of their children.
00:21:51.780And so the school had stopped allowing parents to opt out of this curriculum.
00:21:58.780And it was pretty crazy to see Justice Kavanaugh in the oral arguments had said, wow, kind of hard to realize this is the hill you're going to die on.
00:22:07.780And so the school said no more opt outs. Your kids have to go through this state.
00:22:11.780They want to do this on purpose. They want to indoctrinate your children.
00:22:15.780They don't want you to be able to pull them out of this instruction that they know goes against your family values.
00:22:20.780Why? Because they want the destruction of the family.
00:22:23.780They want to drive a wedge between the parent and the child. So the left is very mad.
00:22:27.780Public schools have been a huge battleground in the middle of this cultural revolution that they have put us in.
00:22:33.780And we are taking this cultural institution back. So no doubt that they are spitting mad over there because this is just the start of the winning that American parents are going to do.
00:22:43.780Remember, this case was was ruled on religious rights of parents.
00:22:47.780But I believe that you're going to see other cases coming before the Supreme Court in the future that are going to really jig down deep on the fundamental right of parents to direct the upbringing of their kids.

00:23:08.780The American. This is a great term at the Supreme Court.
00:23:11.780The American family is three and oh this term.
00:23:14.780And what I mean by that is with the Scrimetti decision that came out last week, our children in the 27 states that we've gotten mutilate gender mutilation bands passed are now going to be protected and not struck down by some stupid ruling that would have been struck down by the way just shortly before President Trump was elected.
00:23:32.780But then with the Mahmoud case that came out today, parents right to fundament of the fundamental right to direct the upbringing and education, their children is protected.
00:23:39.780But Steve, the even bigger victory, I think, than all of these combined is the first time in I don't know how long the Supreme Court has ruled against the porn industry.
00:23:51.780The Free Speech Coalition versus Paxton decision came out this morning as well.
00:23:56.780And it ruled that states have the right to pass age verification to protect children online from porn.
00:24:02.780See, to put this in perspective, we had the ACLU versus Reno in 1997 struck down the Communications Decency Act.
00:24:10.780Every Supreme Court decision that's come out regarding pornography has expanded the porn industry.
00:24:17.780This is the first time that parents have had a huge victory at the Supreme Court when it comes to porn.
00:24:25.780I mean, every single term before this, it was 0-2, 0-5, 0-3.
00:24:29.780We are now winning at the Supreme Court level, and it doesn't happen without Donald Trump, and it doesn't happen without Morgan.
00:24:35.780It doesn't happen without the War Room Posse.
00:24:37.780Give me that perspective again because it seemed like that the First Amendment and the freedom of speech, and it's interesting how the porn industry came about this as a First Amendment right, right?
00:24:51.780Is this the first time that's kind of been countered that your right of free speech is kind of limited by at least the access to young people of what they can see?
00:25:00.780Because they tried to hide behind a First Amendment argument, didn't they?
00:25:05.780Yeah, they did try to hide behind a First Amendment argument, the porn industry, that is.
00:25:09.780So, Steve, there's this really weird blip in American legal history.
00:25:14.780For the vast majority of our existence as a country, the First Amendment has never protected three things, libel, seditious libel, or obscenity.
00:25:24.780And essentially, over the last, you know, over the 20th century, the Supreme Court weakened obscenity statues, and they basically gave pornographers and porn users a right to access it.
00:25:38.780It's totally crazy. But the reality is, is that the First Amendment cannot protect lies.
00:25:43.780It cannot protect deliberate lies in at least any way.
00:25:46.780And it cannot protect obscenity because these things have a crowding out effect.
00:25:50.780That's the nature of lies. That's the nature of distortions and obscenity is that it will end up crowding out all the speech that's actually meant to be protected.
00:25:59.780And by the way, Steve, I just want to say this is the porn industry.
00:26:02.780This is the porn industry. It's a hundred billion dollar industry.
00:26:05.780They have the access to the best lawyers in the world.

00:33:15.780Now, this is what we've talked about in the Alien Enemies Act and for states.
00:33:21.780And we saw several blue states who were involved in this preliminary injunction litigation claiming that they could be a harmed party if we take away birthright citizenship for children born to illegal immigrants and women who are here on a temporary lawful basis.
00:33:38.780So they did open the door for these class action lawsuits, and we're already seeing filings today in New Hampshire by Norm Eisen, the ACLU and NAACP, and then a continuation in the Maryland case, which was the case that was really brought before the Supreme Court on these preliminary injunctions.
00:34:02.780I have a piece of it, my sub stack declassified with Julie Kelly.
00:34:06.780I'm going to have a lot more over the weekend trying to deconstruct it.
00:34:09.780But the idea that this is now, you know, closed litigation, that the president won in the birthright citizenship litigation is going away and that that executive order is going to go into effect.
00:34:23.780There's going to actually be a lot more lawsuits than the three preliminary injunctions that we saw resulting in the Supreme Court ruling today.
00:34:30.780This is what I want to get you on here and give.
00:35:43.780Now, here's the little upside, Steve, that War Room Posse will be very fascinated.
00:35:48.780This is almost a bombshell revelation out of this litigation.
00:35:52.780The left radical activist leftists, especially the ACLU, have finally found a right that unborn babies are entitled to.
00:36:02.780They don't have a right to live, but they do have a right to become a U.S. citizen if they are born on U.S. soil to a mother who is here illegally.
00:36:14.780So that is what is fascinating in these documents.
00:36:16.780And I was posting a little bit of that on X and will continue to do so.
00:36:21.780So now we're going to see this in multiple states, multiple jurisdictions.
00:36:25.780All this really means is now these judges are going to confer class wide status, just like we saw Jeb Bosberg do in the Alien Enemies Act and other judges have done that as well.
00:36:36.780They will then let the class wide lawsuit move forward.
00:36:40.780Then they can issue a preliminary injunction in their district based on that class.
00:36:47.780So this really tends to create a hydra of more judicial and legal wrangling with the administration.
00:36:55.780But, Steve, the end result is that this birthright citizenship question, the executive order, will eventually make it back to the Supreme Court.
00:37:04.780Again, the Supreme Court did not rule on that executive order today.
00:37:09.780They only ruled on the use of these universal preliminary injunctions.
00:37:15.780But that question eventually will get to the highest court and they are going to have to determine whether the 14th Amendment and the Citizenship Clause really did mean that babies born here on American soil to anyone, including those who cross the border illegally, as soon as early as last year, Steve.
00:37:37.780The Norm Eisen lawsuit specifically talks about a plaintiff named Barbara who crossed the border illegally from Honduras in 2024.
00:37:50.780I'm assuming she brought them with her.
00:37:52.780Her husband is also here illegally and she's pregnant due in October of 2025.
00:38:00.780So this is the essence of the anchor baby system that we've seen for decades that has been ignored by both Republicans and Democrats, not by President Trump.
00:38:11.780And so this is just one of the plaintiffs that the ACLU has plucked to use in this in these lawsuits.
00:38:18.780How can the Supreme Court ultimately decide that this woman who came across the border in 2024 illegally seeking asylum from Honduras is married to another illegal and has a baby that that baby is then a U.S. citizen?
00:38:33.780And of course, that means the entire family has some basis to stay here.
00:39:32.780Now, what will be interesting with the other nationwide preliminary injunctions that have been imposed, and I believe that were over 30 of those, that they will now use the Supreme Court to go and vacate those nationwide preliminary injunctions.
00:39:47.780But the president and the DOJ won't really have to go back to these three judges on the birthright citizenship preliminary nationwide preliminary injunction case.
00:39:58.780The litigants are, the plaintiffs, the ACLU and the immigrants groups are already doing that.
00:40:04.780So what they're going back with, Steve, is they're asking for emergency motions.
00:40:09.780We're going to see it all weekend into next week.
00:40:11.780Is emergency motions to confer this class-wide status that would potentially cover anyone.
00:40:17.780These pregnant illegals within this jurisdiction would cover all of them.
00:40:22.780Then ask for a preliminary injunction, first a temporary restraining order, then a preliminary injunction that would halt the implementation of the birthright citizenship executive order.
00:40:34.780So I'm hoping that I'm explaining this clearly enough and accurately.
00:40:40.780I really think everyone, even close court observers, are sort of struggling with what the consequences of this opinion is going to be.
00:40:49.780But we're already seeing, you know, these lawsuits being filed.
00:40:52.780And I'm sure these same judges are going to come back and rubber stamp whatever Norm Eisen and the ACLU and all these immigrants rights groups want.
