00:00:00.000 Well, first let me say that President Trump has appointed an ambassador nominee for NATO,
00:00:04.940 which clearly indicates his role to engage in that.
00:00:09.200 Second is the law is what it is.
00:00:11.180 Obviously, as you've mentioned, I was a co-sponsor of the law,
00:00:13.780 and so it's tough to say I'm not in support of a law that I hope to pass,
00:00:16.600 and that I think it's an important role for Congress to play,
00:00:18.580 because, frankly, it's not just about the withdrawal piece of it,
00:00:21.360 it's the contributions you make towards the power of the purse still resides with the Congress.
00:00:25.780 Now, maybe, as if confirmed, moving towards the executive branch,
00:00:30.720 I'll forget that lesson a little bit.
00:00:33.680 I hope not, but ultimately I still recognize and understand that the power of the purse is with Congress,
00:00:38.280 and it's an incredibly important power.
00:00:40.760 Let me point on NATO one thing, and I think there's a misunderstanding about it.
00:00:44.020 The NATO alliance is a very important alliance.
00:00:46.160 I believe that.
00:00:47.100 I believe alliances can be, and it's been very useful.
00:00:49.280 Without the NATO alliance, there is no end to the Cold War.
00:00:51.900 In fact, without the NATO alliance, it's quite possible that much of what today, at the time,
00:00:57.120 today we know as Europe would have fallen victim to aggression.
00:01:03.080 But what's important for the United States is not just to have defense allies.
00:01:06.260 It's to have capable defense allies, allies who are capable of defending their region.
00:01:11.220 And I think there is a question to be asked.
00:01:13.000 I'm not stating a public policy position.
00:01:15.040 I'm stating a question to be asked, and that is,
00:01:17.140 should the role of the United States and NATO in the 21st century be the primary defense role
00:01:22.100 or as a backstop to aggression,
00:01:24.520 with countries in the region assuming more of that responsibility by contributing more?
00:01:28.620 Now, look, in fairness, and I think the further east you move in Europe,
00:01:31.720 the more money you see spent on the military as a percentage of GDP.
00:01:35.000 But I think there's been broad acknowledgement across Europe and across multiple administrations,
00:01:40.960 both Republican and Democrat, that our NATO partners, these are rich, advanced economies,
00:01:45.420 need to contribute more to their own defense and ultimately to the NATO partnership as well.
00:01:50.680 And that's a demand that's been made by multiple presidents across the years.
00:01:54.420 And the fact that that is true has been revealed by what's happened with Ukraine.
00:01:59.980 Look at the ramp-up in defense spending and the industrial capacity of multiple countries in Europe
00:02:04.460 as a result of an armed conflict.
00:02:06.460 Imagine if that capacity had been there before,
00:02:08.980 it quite possibly might have had a deterrent effect as well.
00:02:11.820 So I think it's important that we have alliances,
00:02:14.000 but we have to have alliances with strong and capable partners
00:02:16.660 and not those who sort of have viewed the U.S. and the NATO defense agreement
00:02:22.440 as an excuse to spend less on defense and more on some domestic needs.
00:02:26.120 We have domestic needs too.
00:02:27.220 These advanced and rich countries in Western Europe have enormous safety nets programs that they fund.
00:02:33.640 We have domestic needs as well, but they've been able to divert or grow those programs
00:02:38.300 because they don't have to spend as much on defense as we do as a percentage of our overall economy.
00:02:42.840 And that dynamic needs to change.
00:02:44.360 And I expect that President Trump will continue to forcefully make that point.
00:02:47.440 And as you know, this committee and the Senate NATO Observer Group,
00:02:52.780 which I co-chair, has made that point repeatedly,
00:02:55.500 and we are now up to 23 of the 32 NATO nations who are meeting their 2 percent of GDP,
00:03:01.180 and we have a number of them who are going beyond that, and it's appropriate.
00:03:05.640 We're going to shift back to Justice and Pam Bondi, Amy Klobuchar's question.
00:03:11.040 Let's go to it.
00:03:12.380 It will be my job, if confirmed, as Attorney General, to make those decisions.
00:03:18.200 Politics will not play a part.
00:03:21.140 I've demonstrated that my entire career as a prosecutor, as Attorney General,
00:03:26.240 and I will continue to do that if you confirm me as the 87th Attorney General of the United States of America.
00:03:33.140 And in an earlier question, some of my colleagues talked about China and the risk,
00:03:39.480 yet you have a nominee from this incoming administration, Kash Patel,
00:03:45.040 the pick to head the FBI of serious concerns about him,
00:03:48.480 has referred to the FBI's intel division,
00:03:51.160 which is responsible for protecting us from foreign adversaries like China.
00:03:56.660 As, quote, the biggest problem the FBI has had,
00:04:00.360 and he said that he wants to, quote, break that component out of the FBI.
00:04:05.120 Do you agree?
00:04:06.560 I have not seen those comments from Mr. Patel.
00:04:09.800 I would review them, but we have to do everything we can to protect our country.
00:04:14.960 Again, Mr. Patel would fall under me and the Department of Justice,

00:05:18.060 Will you commit to defend the law against the lawsuits from Big Pharma?
00:05:23.620 Senator, I was involved in Big Pharma cases when I was Attorney General of the state of Florida,

00:05:35.820 That would also, same question, with the Supreme Court is going to be hearing a challenge to the Affordable Care Act's
00:05:42.420 coverage of preventative services, and despite the fact that you twice joined suits to have the entire Affordable Care Act

00:05:54.480 Yeah, I believe this is very different.
00:05:56.680 It's a very isolated, it's different.
00:05:59.160 It's not the entire Affordable Care Act, but I will, it's pending litigation, of course, within the department.

00:06:12.880 providers, and facilities that provide reproductive health services.
00:06:17.420 Will you commit to continuing to enforce the FACE Act to address violence and threats

00:07:09.880 By the same token, I think it's important that the Ukrainians have leverage,
00:07:13.360 but they also will have to make concessions to reach this agreement.

00:07:18.520 Conflicts of this nature that have historical underpinnings to it are going to require a lot of hard diplomacy and tough work.

00:09:43.300 President Biden started this with a disaster withdrawal from Afghanistan, that projected weakness.

00:10:32.500 while delaying tough sanctions on the Russian oil and gas industry,
00:10:36.400 which, as you know, is the lifeblood of the Russian war machine.

00:10:43.660 Instead of enforcing sanctions on Iran,
00:10:46.440 Biden naively tried to resurrect the Iran nuclear deal,
00:10:49.060 enabling the regime to generate $100 billion in oil revenue.
00:10:54.920 And I want to point out that during the Trump administration, because of sanctions,
00:10:59.380 Iran's foreign reserves fell from $122 billion to less than $14 billion.
00:11:05.540 That hampered their ability to be able to fund terrorist groups like Hamas and Hezbollah and the Houthis.
00:11:11.420 What the Biden administration has done is allowed the Iranian regime to enrich enough weapons-grade uranium
00:11:19.280 to be a week or two away from having a nuclear weapon.
00:11:25.420 And since October 7th, President Biden has not supported Israel in the way he's needed.
00:11:32.060 And because of the previous mentioned money that he's allowed the Iranians to have
00:11:36.400 that has funded the terrorist groups like Hamas and Hezbollah,
00:11:40.520 our allies, like Israel, have been attacked.
00:11:43.360 And we've been attacked directly.
00:11:46.080 Thankfully, Israel's had the courage to stand up to these terrorists
00:11:49.540 and take matters into its own hands.
00:11:51.580 And it's led to the decimation of Hamas and Hezbollah.

00:13:18.220 ranging from Catholics attempting to practice their faith,
00:13:22.320 to parents showing up to school board meetings,
00:13:25.800 to people showing up to engage in peaceful protesting outside of abortion clinics.
00:13:31.240 As Attorney General,
00:13:32.540 how will you prevent the weaponization of the Department of Justice against Americans?
00:13:37.300 And, Senator, you just gave the classic example of what's been happening regarding the weaponization.
00:13:44.920 Going after parents at a school board meeting has got to stop.
00:13:49.320 For practicing your religion,
00:13:52.100 sending informants in to Catholic churches must stop.

00:17:01.380 And for years, no one talked about it, which, by the way, not just has a human rights component to it,
00:17:06.140 it allows them to use slave labor to produce goods at the expense of the rest of the world.
00:17:11.900 Talk about not just a horrific humanitarian crisis, but an unfair trade practice as well.
00:17:16.800 We've allowed them to get away with things.
00:17:18.160 And frankly, the Chinese did what any country in the world would do given these opportunities.
00:17:22.380 They took advantage of it, and so I think now we're dealing with the ramifications of it.
00:17:27.180 I agree 100% what you said, but I remind you, and I remind everyone, I guess I want to make this point,
00:17:32.060 that much of what we need to do to confront China is here at home.
00:17:35.600 It's not just abroad, it's also here at home.
00:17:37.620 We have to rebuild our domestic industrial capacity,
00:17:40.280 and we have to make sure that the United States is not reliant on any single other nation

00:17:46.320 And with four seconds left, how are you going to explain that to your average American,
00:17:51.300 that we need this all-size society approach, and to your point exactly,
00:17:54.580 that it needs to begin here at home,

00:18:01.660 If we stay on the road we're on right now, in less than 10 years,
00:18:06.100 virtually everything that matters to us in life will depend on whether China will allow us to have it or not.

00:18:18.220 They have come to dominate the critical mineral industry supplies throughout the world.

00:18:26.440 Even those who want to see more electric cars, no matter where you make them,
00:18:29.400 those batteries are almost entirely dependent on the ability of the Chinese,
00:18:33.300 and the willingness of the Chinese Communist Party to produce it and export it to you.
00:18:37.360 So if we don't change course, we are going to live in a world
00:18:40.140 where much of what matters to us on a daily basis, from our security to our health,
00:18:44.440 will be dependent on whether the Chinese allow us to have it or not.
00:18:48.220 That's an unacceptable outcome.

00:19:00.620 And I've enjoyed working with you on the Congressional Executive Commission on China,
00:19:04.320 which engages in many issues related to their treatment of folks from the Tibetans to the Uyghurs,
00:19:12.040 to their position regarding Hong Kong and Taiwan.
00:19:17.100 But let's talk about Taiwan.
00:19:18.520 I had the chance to go to Taiwan in 20, well, the year 2000.
00:19:22.180 It was the second presidential election there,
00:19:24.020 and it was the first one where people were becoming convinced
00:19:25.900 that they actually might be able to hold a democracy.
00:19:28.900 I believe they've earned the right to have a voice in international affairs,
00:19:33.400 and I also believe that they are at great risk right now
00:19:37.300 with mainland China Xi's plan to be aggressive militarily towards them,
00:19:42.920 as my colleague, Senator Ricketts, just noted.
00:19:47.080 Will you support your role as Secretary of State?
00:19:50.480 Taiwan's right to have a voice in international affairs,
00:19:53.700 participate in international forums.
00:19:55.340 And will you support the porcupine strategy,
00:19:59.460 providing that we will supply them with defense articles
00:20:05.060 and defense services in such quantity as may be necessary
00:20:09.220 to enable Taiwan to maintain a sufficient self-defense capability?
00:20:12.980 By the way, that phrase is from the 1979 Taiwan Relations Act.
00:20:16.500 It's in our current law.
00:20:18.540 Yeah, let me just point out that on the Taiwan Relations Act,
00:20:21.340 and I believe that the year 2016 I was the lead Republican sponsor
00:20:24.860 in reauthorizing and reinvigorating it.
00:20:27.040 I think that the multiple or consecutive presidential administrations
00:20:32.960 of both parties have made clear
00:20:34.340 that the policy of the United States towards Taiwan is encapsulated
00:20:37.600 not just in the Taiwan Relations Act but in the six assurances
00:20:40.200 that multiple administrations, including the Trump administration
00:20:43.200 and now the Biden administration, have made clear our policies.
00:20:46.120 With regards to your second point about international forums,
00:20:49.200 ASEAN is a great example of one in which that's being tested.
00:20:54.560 Last year at their conference,
00:20:57.260 the Chinese were able to prevent participation
00:21:02.520 by any mention of Taiwan in the memorandum.
00:21:07.340 And then this year they're working very hard
00:21:08.640 to make sure that no one associated with Taiwan
00:21:10.380 is anywhere near it.
00:21:11.640 So this is just one more example of how they're being excluded.
00:21:13.960 I would also point to the Western Hemisphere.
00:21:15.820 I know that sounds like half a world away,
00:21:17.580 but you understand this issue.
00:21:18.720 The majority of nations on Earth that continue to recognize
00:21:21.480 and have relations with Taiwan,
00:21:22.720 the vast bulk of them, or the plurality,
00:21:24.820 are within the Western Hemisphere.
00:21:26.380 They've undertaken a very aggressive action
00:21:28.180 in just the last seven, eight years
00:21:29.840 to get these countries to flip.
00:21:31.640 They got Panama to flip,
00:21:33.180 then they got Panama to convince the Dominican Republic to flip.
00:21:36.040 They've targeted multiple other nations,
00:21:37.860 and Nicaragua most recently to flip.
00:21:40.100 So I think that's an important thing for us to keep in mind
00:21:43.060 and make a priority.
00:21:44.180 And I also think it's important to recognize allies in the region
00:21:47.640 like Paraguay that have not flipped
00:21:49.040 and others who have stayed strong in that regard.
00:21:51.720 On the porcupine strategy,
00:21:53.280 because I know it may sound weird to people
00:21:54.700 or if anyone's watching this,
00:21:57.100 I know what the ratings are,
00:21:58.360 but hopefully not high.
00:21:59.880 But let me just say that on the porcupine strategy,
00:22:03.300 what it really means is
00:22:04.480 you want to make the cost of invading Taiwan
00:22:07.540 higher than the benefit.
00:22:09.740 We want to discourage that
00:22:11.240 by the Chinese believing that,
00:22:14.080 yes, could they ultimately win an invasion of Taiwan,
00:22:16.380 but the price would be too high to pay.
00:22:18.340 It's basically deterrence.
00:22:20.180 And I think that's critical,
