00:04:50.000 The federal government filed papers yesterday responding to the Fulton County motion to get the documents back.
00:04:58.000 And in a word, they it's a devastating response.
00:05:03.000 When we were on here talking about this before, I thought that the county would have a very hard time carrying their burden.
00:05:11.000 After reading the government's brief, their motion to get these documents back is just dead like six different ways.
00:05:20.000 So the government's brief is very good.
00:05:23.000 It has a very strong lineup of DOJ lawyers, starting with the number three lawyer in the department and working down to the trial council.
00:05:33.000 So they've got the assistant attorney general for the criminal division.
00:05:37.000 They have a few people above him in the hierarchy, which there's not that many above an assistant attorney general.
00:05:43.000 But they're on here.
00:05:44.000 And it is a very, very strong brief.

00:05:48.000 Well, there may not even be there may not even be a hearing.
00:05:51.000 They've asked for the judge to cancel the hearing.

00:06:01.000 And they actually asked the judge to say, there's no need to have anything else.

00:06:08.000 Well, they start by saying that they cite the Trump v. U.S. case in the Eleventh Circuit where the court rejected Donald Trump's attempt to limit the investigation by the Biden DOJ into the Mar-a-Lago documents that they seized.
00:06:29.000 And that was swept away by the Eleventh Circuit.
00:06:32.000 And they quote that case over and over in this brief as the court is not going to interfere in ongoing criminal investigation.
00:06:40.000 They're just not going to do it.
00:06:41.000 And so then they start with, you guys don't have standing.
00:06:46.000 You know, these documents are in the custody of the clerk.
00:06:49.000 The clerk's not in this case.
00:06:51.000 That's all there is to it.

00:06:53.000 Then they point out that counties don't have Fourth Amendment rights under the Constitution.
00:06:59.000 So they've got no right to get these back because they're not – it's not their stuff, and they don't have Fourth Amendment rights anyway.
00:07:06.000 And then they get into responding to the merits of the motion, and one of the criteria, legal criteria for such a motion, is that there be what the courts call callous disregard for the constitutional rights of the party from whom they were taken.
00:07:25.000 Well, this party is not the right party, so they don't have any constitutional rights that are implicated.
00:07:30.000 If they were the right party, they wouldn't have any constitutional rights under the Fourth Amendment anyway because that protects individuals, not governments.
00:07:38.000 And three, there was no callous disregard because they went to the magistrate twice, and the magistrate said the application for the warrant was proper and issued the warrant.
00:07:50.000 So they're dead like three or four or five different ways, and so I don't know what the judge is going to do.
00:07:57.000 I mean I spend all day trying to figure out what judges are going to do, but I don't see this one getting anywhere.
00:08:03.000 Well, do you think the judge has got enough courage now that this thing has not just national attention but global attention given the stakes here about getting to the bottom of the 2020 election and what it means going forward?
00:08:17.000 Do you think there's any chance that they cannot have this hearing?
00:08:20.000 Wouldn't that create another political firestorm that these judges are just not about to take on?
00:08:26.000 Well, so the judge has made difficult decisions in other cases, so he's certainly up to the task.
00:08:36.000 And the grounds for not having a hearing are strong.
00:08:41.000 It's clear and obvious that what the county is trying to do is run a fishing expedition.
00:08:48.000 They want to put the agent on the stand and ask them all about the investigation, all about things that are not in the affidavit, all about things that are not publicly known.
00:08:57.000 That's not what these hearings are for, and that's an improper use, and I don't see the judge allowing that to occur.
00:09:05.000 You know, if they have a hearing, the government has asked for it to just be legal argument and not evidence.
00:09:12.000 But we'll know, I think, early next week whether the judge is going to grant the government's motion to cancel the hearing or limit it to legal argument.
00:09:23.000 So we'll know that early next week, I expect.
00:09:26.000 But it's a very strong filing by the government, very well argued, very robust legal arguments.

00:10:53.000 The Wall Street Journal last night published an editorial that essentially reviewed what's going on right now in Wisconsin.
00:10:59.000 Well, there's looking back at elections in Georgia and what have you in Wisconsin.
00:11:03.000 The tact was quite different.
00:11:05.000 It was to come after the lawyers.
00:11:07.000 That's me.
00:11:08.000 And literally file an 11 count criminal felony complaint against me for using alternate electors.
00:11:20.000 They had a bizarre theories.
00:11:22.000 I won't go into that, but the theories were clearly wrong.
00:11:26.000 So we filed a series of motions, my excellent attorneys, and what happened was a private citizen, a former judge provided off the record.
00:11:43.000 That is ex parte, we had no idea this had happened.
00:11:46.000 He wrote an opinion denying the motion to dismiss, gave it to the sitting judge, undisclosed to us, secretly.
00:11:57.000 And then that opinion became the opinion of the court.
00:12:01.000 The court admitted, the court, when I say that, I mean the trial court judge, Judge Highland, admitted he haven't even read the briefs when he received a complete opinion from the son of that now private person former judge.
00:12:18.000 We had forensic linguist.
00:12:19.000 We had forensic linguists look at this because this order controls the entire case.
00:12:28.000 And the forensic linguists work for the FBI, among others.
00:12:32.000 And they said, unequivocally, unequivocally, the opinion was not written by the judge sitting on the case, but was in fact written by a private citizen who has very clear ways of speaking.
00:12:47.000 And that affidavit would be enough literally in a federal criminal proceeding against people.
00:12:53.000 Ron Johnson was so upset about this, after he had seen this, he wrote a letter to the Department of Justice in November, early December, asking them to begin a federal civil rights and criminal investigation into the conduct of the judges of Dane County Circuit Court.
00:13:12.000 Mind you, we went to the judge privately.
00:13:17.000 We tried not to make this public initially because we said, look, if we're wrong, tell us we're wrong.
00:13:23.000 No one has told us we're wrong.
00:13:25.000 Eventually, the judge simply said, I'm not going to hold a hearing on this.
00:13:30.000 Bind you over.
00:13:32.000 So in other words, all we asked for was an evidentiary hearing where we could put on linguists, experts, as well as other facts about the case,
00:13:41.000 to demonstrate the judge didn't write the opinion and put those facts on in front of a different judge.
00:13:46.000 A hundred percent of the lawyers listening to your program this morning and a hundred percent of the judges would say, of course,
00:13:53.000 when you have that kind of evidence, you must hold a separate hearing in front of a different judge to determine if there's been judicial impropriety.

00:14:03.000 And that's what the Wall Street Journal piece is about, because that case is now on appeal to the state Supreme Court.

00:14:13.000 So this has enormous implications.
