00:09:03.580Meta says it plans to appeal after a New Mexico jury found it liable for failing to protect
00:09:09.340children from sexual predators and misleading users about the dangers of its platforms.
00:09:15.400The jury ordered the tech giant to pay $375 million in damages.
00:09:21.300New Mexico's attorney general, who filed the suit, called it a historic victory, saying, quote,
00:09:25.900Meta executives knew their products harmed children, disregarded warnings from their own employees, and lied to the public about what they knew.
00:09:34.240CNN tech reporter Claire Duffy joining me now.
00:09:36.380Now, this is breathtakingly big because this is this the first time that Metta has been sort of put in a position where the jury's telling you are accountable for this.
00:09:48.460Yeah, Sarah, it's huge. I mean, for years we have heard these concerns from parents, from lawmakers, from advocates about the risks to children on Metta's platforms.
00:09:56.380And this is the first time that we're seeing a jury hold the company accountable for that.
00:10:00.660And this decision came after less than a day of jury deliberations following this seven week trial.
00:10:06.380The jury finding Metta liable on all counts in this lawsuit for violating New Mexico consumer protection law,
00:10:12.580including for willfully engaging in deceptive and unconscionable trade practices.
00:10:17.880And as you said, putting children at risk.
00:10:19.460They have ordered Metta to pay $375 million in damages.
00:10:23.840And this is just the first phase of this trial.
00:10:25.560In the next phase, this case will be presented directly to the judge,
00:10:29.560and we could see Metta ordered to pay additional financial damages and also to make changes to its platforms.
00:10:34.940And I think this really gives you a sense of where sort of the American public, where a jury is standing on this company, on this issue right now.
00:10:42.740Take a listen to what one of the jurors said following this decision yesterday.
00:10:47.320Social media has really become an as meta as a company itself and what it has come to represent and should be trying to represent better and in just protecting teens and people that are going to be on those platforms.
00:11:00.700It ultimately swung that way because the majority of the 12 people agreed that there was willful violation.
00:11:10.680So Metta does plan to appeal this decision, and I'll read to you what a spokesperson told me yesterday following the decision.
00:11:16.840They said, quote, we respectfully disagree with the verdict and will appeal.
00:11:20.620We work hard to keep people safe on our platforms and are clear about the challenges of identifying and removing bad actors or harmful content.
00:11:27.540But again, Sarah, I think this is such a significant moment in terms of setting a precedent that other states might end up following.

00:12:57.180the responsibility of parents to deal with these issues. If your child is being groomed online,
00:13:02.760or if they are descending into AI psychosis, if they've become best friends with an AI chatbot,
00:13:09.100If they are talking to the chatbot about committing suicide and the chatbot is responding, yes, you should.
00:13:15.740This, according to David Sachs, is the responsibility of parents to deal with and not the tech companies.
00:13:22.220The tech companies should. They are directed by the framework.
00:13:25.840They should provide tools for this problem.
00:13:29.180But, of course, we have yet another instance of an industry seeking to regulate itself, an industry, in this case, big tech, which has created the problem.
00:13:39.100And now they are claiming that they will provide the proper tools to fix the problem.
00:13:43.660And I would say, Steve, that even if I think that it's good to provide parents with these tools, I think it's good to provide parents with the information they need to guide their kids through an insane online world.
00:13:54.400But the reality is most parents are not going to be able to use these tools.

00:14:05.460So I think it's a minimal ask that when you have a platform like Meta, which allowed predators by the millions to exploit children, then the platform itself should bear the brunt of the liability.

00:32:53.680That what was happening was that the Biden administration was pressuring social media to take down content that they didn't like, content they would call malinformation or misinformation or disinformation, which is just, you know, bogus lines that they came up with.
00:33:13.220And they can't do that anymore. The government can't do that.
00:33:16.340And so it's a huge win. I'd love to share one or two paragraphs from the decision.
00:33:28.960And one is the parties agree that modern technology does not alter the government's obligation to abide by the strictures of the First Amendment.
00:33:37.100So that means just because it's on the Internet, the government still can't alter First Amendment rights.
00:33:45.100So that's huge. The other thing is the government cannot take actions formal or informal directly or indirectly to threaten social media companies with some form of punishment unless they delete, remove, suppress or reduce content containing protected free speech.
00:34:01.040So they shouldn't be doing that anymore. You know, what's amazing, too, is what we found out during this investigation was that nearly every department in the U.S. government has their own has their own censorship group that's working with inside that department.
00:34:19.760But, you know, Health and Human Services and the Pentagon and all of these places had these groups inside their organizations that would flag content and send it off to Facebook and have them take it down.
00:34:37.380So they can't do that anymore. And they never should have been able to do that. It seems pretty simple, doesn't it?
