00:03:24.380but also asking their states to pass voting rights acts, pass better maps, because until we reassert that democracy means all Americans,
00:03:33.940then what is happening in the South is starting here, but it won't stop here.
00:03:37.520Let's start with this, Ellie. What do you make of this decision?
00:03:39.700I mean, the judge was not complimentary of the raid, per se, of the search, per se, and the seizure, but still does not think that the ballots should be returned.
00:03:49.880Is there anything further Fulton County can do?
00:03:53.580There is, Kate. It's sort of a mixed bag for now.
00:03:56.000So anytime a party like Fulton County gets searched, you can challenge that search by bringing what we call a motion for return of property.
00:04:02.520But as you just pointed out, the bar there legally is very high.
00:04:06.680Fulton County would have had to have shown that there was a flagrant disregard for their
00:04:10.960constitutional or legal rights. The judge found that Fulton County did not make quite that
00:04:15.940dramatic a showing. However, the judge did conspicuously note that there were potentially
00:04:21.500some problems with this search. And the way this could play out is if and when there's ever a
00:04:26.620criminal charge based on this evidence seized, then the party that's charged gets to try again.
00:04:31.800The bar is actually a little lower there. There, if they can show whoever gets charged can show that there was some fault in this search and affidavit in the way the search was carried out.
00:04:42.060Then you can get the evidence, what we call suppressed, meaning it cannot be used against someone at trial.
00:04:46.780So Fulton County has failed at its first shot, but there could be another one down the line.
00:04:51.880It is really interesting. Can I also ask about Virginia, this FBI search of the personal office and business connected to a powerful Democratic Virginia lawmaker, Louise Lucas?
00:05:01.800source claims that it says that it had to do the search with a corruption probe that had been
00:05:07.200launched during the Biden administration. But recently it has been noted she was a powerful
00:05:13.020voice pushing for Virginia's successful redistricting effort, which helped Democrats
00:05:17.680and kind of went against President Trump. What do you make of this?
00:05:23.440So there are things we do and don't know here. We do know that anytime prosecutors
00:05:27.080get a search warrant like this. You have to establish probable cause and you have to show
00:05:31.800that it's likely you'll find some evidence of criminality. So I've been through this many a
00:05:35.520times. You have to write out a detailed affidavit as a prosecutor, walk it over to a federal judge
00:05:40.620who then reviews it. And if the judge finds, yes, there's probable cause, then you can do the
00:05:45.440search. We know that happened here, but probable cause is far less than proof beyond a reasonable
00:05:50.840doubt. It's not nothing. Judges don't rubber stamp these things, but it is a substantial finding
00:05:55.580by the judge. Now, with respect to the allegation that this was politically motivated,
00:06:00.340we don't know. We do know this DOJ certainly has a pattern of targeting people who have been
00:06:06.100politically adverse to the president, whether Jim Comey or Letitia James or Mark Kelly,
00:06:10.660Alyssa Slotkin, Jerome Powell, on down the line. And we do know that this individual who was
00:06:15.580searched was at the forefront of Virginia's recent effort to redistrict. So if it's the case that
00:06:21.160this fraud investigation goes back to the Biden administration, that undercuts any allegation
00:06:26.780that there was politics here. But this is part of what we don't yet know and will be potentially
00:06:32.460litigated down the line. The thing about where we are right now, and I can't stress this enough,
00:06:38.820is that Trump and Blanche and Patel, the entire administration from the White House up down,
00:06:43.780have forfeited any, any presumption of regular order or good faith. In fact, they have created
00:06:52.680a presumption contrary to that. You must assume as a rebuttable presumption that what they're
00:06:59.980doing is retaliation, that the cases they're bringing aren't warranted because they want
00:07:05.200the most powerful law enforcement agency in the U.S. government to work for them personally and
00:07:08.660one else and they've been very clear about that okay victory after victory it's thursday 7 may
00:07:15.140year of our lord 2026 i'm proud of this audience in the show for being at the forefront of these

00:08:39.240system are finally facing some form of accountability, whether it sticks, whether
00:08:43.340it creates a disincentive for future people to weaponize the government remains to be seen. But
00:08:48.620the evidence is getting out, and then skilled people are taking the evidence and bringing
00:08:52.740accountability actions. The SPLC indictment's a great example. That is a very solid, carefully
00:08:59.020research indictment. You got Joe DiGenova down in Florida. The guy is former U.S. attorney,
00:09:06.560former independent counsel, former special counsel. There's very few prosecutors in the
00:09:09.840world ever to have those three titles. He's now running the Florida conspiracy case. So
00:09:14.780you have sense now, I think for people who wanted accountability, there is a credible
00:09:19.620machinery built to do it. And it's not doing what those clips just said. This isn't retribution.
00:09:24.340it isn't uh going after people just because they oppose donald trump uh it's going after people
00:09:30.760because there is a significant evidence of criminality and it's gone unpunished for a long
00:09:35.320time oh no that particularly msmc the new york times you didn't hear a word from them in the
00:09:41.840four years we were in the wilderness except working and i believe you're going to see indictments
00:09:46.600on people in the media that are inextricably linked to this whether it's the uh wow the
00:10:30.180It's made enough of a case to keep those documents until it finishes its investigation.
00:10:35.340What's happening in Georgia, what's happening in Michigan, Wisconsin, and Arizona is an application of a law that hasn't been used in a while, but it's been on the books for a reason.
00:10:45.540if a state or an election official at the county or state or local level changes the rules beyond
00:10:52.460what the state legislature has uh set remember the legislatures are the supreme authority about
00:10:57.520how elections are conducted in each state if a bureaucrat a deep state electioner or just an
00:11:03.340election official you don't want to sign any bad motive to them uh does something that wasn't
00:11:08.900approved by the law they did it knowingly and willfully it becomes a federal felony offense
00:11:13.580in a federal election. And that is what's being looked at here. Did people in Georgia, did people
00:11:18.960in Arizona, Wisconsin, and Michigan change the rules as bureaucrats in ways that were not affirmed
00:11:24.660by the legislature? And if they did so knowing and willing, perhaps to give Democrats an advantage
00:11:31.020in the election, they could face prosecution. They could face a conspiracy case. And so that's
00:11:36.000a case that Cash Patel and the Justice Department are thinking. It's why the judge said it's okay
00:11:42.320for the FBI these documents. They have a lawful legal reason to look at them. Now, while that's
00:11:47.380going on, I think what the DNI is doing is really important. All right, we're getting a sense of
00:11:51.800what the case is for potential domestic meddling in our elections, that maybe people change the
00:11:57.640rules. Maybe they hijacked the process. They didn't follow the legislature's rules. But there
00:12:02.640is a growing body of evidence, compliments of DNI Gabbard and FBI Director Kash Patel and CIA
00:12:09.000director john ratcliffe that the government was aware of foreign intrusions in our elections
00:12:14.520starting in 2020 2022 2024 and that there was a effort to keep this information from the people
00:12:22.760in the government who most needed to know about it the president of the united states the congress
00:12:27.880which has a statutory right to be notified anytime there's been a foreign intrusion in our government
00:12:33.800the evidence that we unveiled this morning which are in class of unclassified documents that were

00:12:43.740group, looked at some records, have some bombshells. There's an allegation that a CIA
00:12:49.640analyst was asked to change CIA documents to hide foreign influence efforts in the 2020 election.
00:12:56.280There's an allegation that they massage President Trump's PDB in 2020 so they wouldn't have to tell
00:13:01.780him about potential foreign intrusions. There's an allegation that analytical products were
00:13:09.120hijacked and suppressed because they rightfully used evidence showing that China was trying to
00:13:16.100influence the election in a more aggressive way than had been acknowledged publicly,
00:13:19.360or that Venezuela had some capabilities in election machines that raised concern.
00:13:25.080That doesn't mean they were deployed, but knowing that there were vulnerabilities,
00:13:29.020knowing that there were exploits, knowing that there were mal-influence operations going on.
00:13:34.680You want your commander-in-chief, you want your Congress to know this, and it looks like the deep
00:13:38.860state, if these documents are an accurate reflection of what the classified evidence is,
00:13:43.280was trying to keep the commander-in-chief, the American public, and the Congress dark about
00:13:47.540real threats to our election. Instead, we were forced that a narrative is the most secure
00:13:52.280election in America. We now know that wasn't a true story. What we're beginning to see
00:13:57.300is an overt effort by intelligence officers to keep the people, the American people elected,

00:26:08.080Right now, the Virginia Supreme Court is dealing with two of the key issues about whether the legislature followed the law, and they're supposed to rule on that.
00:26:16.380But in the meantime, separately, the Tazewell County Circuit Court ruled right after the election was held.
00:26:23.720A guy by the name of Judge Rogers said, nope, the election doesn't count because it violated the 90-day statute.
00:26:30.420In other words, Virginia also has two other statutes, one that says that the language in the constitutional amendment has to be, quote, in plain English.
00:26:41.020Secondly, there's a 90-day provision that says from the time the legislature votes for the second time to the time that voters get presented,
00:26:49.720and that's the key word, presented with the opportunity to vote on this, there has to be 90
00:26:54.120days. There wasn't. It doesn't take, I never took math in college. You don't need to have
00:26:58.940the level of sophistication. There wasn't 90 days. Okay. And so what happened is the Tazewell
00:27:04.200Circuit Court Judge Rogers said, nope, that didn't qualify. I'm putting a stay on the election
00:27:10.260results. It didn't occur. It's not valid. The Virginia Supreme Court was petitioned by the
00:27:15.460Democrats to overturn that stay and say, nope, nope, nope, you got to let it go. And the court,
00:27:21.140the Virginia court, in a separate ruling said, nope, we're not going to interfere with that.
00:27:25.200They're letting that stand. So the ruling right now in Virginia is technically that that election
00:27:31.340does not count. And the court at the highest level is not doing anything to overturn that
00:27:37.240ruling from the Tazewell court. The deadline yesterday to certify the results that occurred
00:27:43.440in Virginia happened. It passed, meaning if the court was going to act, it was supposed to have
00:27:48.440acted by yesterday. This is a very positive sign for the Republicans. Your Twitter feed,
