00:02:23.880 into a thing and some republican legislatures in north carolina have kind of taken this now up
00:02:28.800 explain what this is is it a fringe theory or is it embedded in the constitution then i want to talk
00:02:34.520 about what happened yesterday it's the elections clause in the united states constitution that says
00:02:41.760 that state legislatures decide the time place and manner for federal elections unless they're that
00:02:50.040 that decision is overridden by congress so it it means that state legislatures make that substantive
00:02:56.120 decision on redistricting the rules for federal elections and that can't be overturned by state
00:03:03.860 supreme courts oftentimes democrat elected state supreme courts or commissions appointed by politicians
00:03:11.200 in the states that you can't strip the power away from the legislatures unless congress does it itself
00:03:17.220 and so that's what this case comes down to and why did the founders hang on hang on why did the
00:03:23.600 framers and the founders put that into the constitution what was their thinking why did
00:03:27.880 they think that was important sir because they wanted to have power as close to the people as possible
00:03:33.700 and your state legislative seats are as close as you're going to get under our constitutional republic
00:03:40.100 that is i mean those are your state representatives they wanted to make sure that states had a say they
00:03:46.000 wanted a limited federal government the federal government was only supposed to have specific
00:03:50.680 enumerated and separated powers because the founders very much feared a powerful federal government so
00:03:57.940 it's uh so another check on that is to make sure that the election rules and redistricting redistricting
00:04:04.340 is handled by state legislatures and when it comes down to in north carolina the republican state
00:04:10.720 legislature did the redistricting and it was favorable to republicans so the democrat appointees on the north
00:04:18.260 carolina supreme court purported to override them and said that you're it wasn't even racial
00:04:23.480 gerrymandering that they said that the state legislature did they said it was political
00:04:28.000 gerrymandering and that's democrats speak for we didn't like the way the republican legislature
00:04:33.300 redrew the the house races we're going to lose house seats and so therefore we're going to come up with
00:04:37.940 this bogus theory called political gerrymandering to have it struck down by their state supreme courts that's
00:04:44.140 what this case is about right now with the supreme court of the supreme court's going to decide whether
00:04:49.360 uh that the north carolina supreme court had the power to do what it did
00:04:53.260 and when you look at this court i mean you look at the questions and you look at the gorsuch
00:04:59.780 alito and thomas have a certain uh view of the world you would say a certain angle of attack as
00:05:05.560 as we would say in in the military uh but i was and look as you know and that's why i reach out to
00:05:11.560 you because that's my line of country but kavanaugh particularly kavanaugh and and amy comey barrett but
00:05:17.260 particularly robert yesterday just in his questioning back and forth walk me through this
00:05:22.680 well there's the there i think there's a three three three camp there's the three liberals who will
00:05:28.880 just go with the liberal result every time the democrat result every time and they're they're
00:05:32.900 only principled as winning uh there are the three constitutionalists thomas alito gorsuch who
00:05:39.320 understand that their modest but critical role as a justice is to see what the law says the plain
00:05:44.640 text of the law and what did that law mean to the public when when it was enacted so you look at the
00:05:50.380 plain text of state legislature uh under the constitution what did that mean and what did that
00:05:55.680 mean to the american people textualism originalism i think with roberts and and to a lesser
00:06:02.560 extent kavanaugh and barrett i think that they're a little bit skittish and they're a little bit more
00:06:07.740 concerned about the political implications of the rulings and frankly that's not a judge's job their
00:06:14.700 job that's why they have lifetime tenure that's why they have pay protection their job is to figure out
00:06:20.440 what the law is apply the law and let the politics work itself out that's not their job as a judge to
00:06:26.080 figure out the politics that's the politician's job but i think that they're uh with with the three
00:06:32.220 constitutionalists i don't think they really care what the consequences are that's not their job but
00:06:37.340 i think the that roberts and again to a lesser extent kavanaugh and to an even lesser extent
00:06:41.720 barrett there's a little bit more of an incrementalism to what they do

00:21:41.200 it's a very very slim chance that the court would accept their appeal and stay the december 21 date
00:21:48.960 however in congress one of the uh pieces of negotiate that they're negotiating over is
00:21:58.560 uh a clause that would maintain title 42 uh so we'll have to see what happens with that there are a
00:22:05.740 couple of um there are a couple of possibilities that it might not go away on december 21 but i'm
00:22:12.200 being told that you know 95 percent in the congress is this is this on is this on the omnis bill or the
00:22:19.200 continued resolution they're going to attach this to one of the spending bills so it has to take
00:22:22.920 effect where where would you see this where would you see this actually attached to uh this i i can't
