00:09:19.420 it will happen um but even if it doesn't happen i'm perfectly fine going forward with this case in
00:09:25.260 washington dc because it's so bad it is so poorly pled um quite honestly i think the victory would be
00:09:32.340 sweeter in dc so i'm fine with it where it is let's talk about the forechar when you say it's so
00:09:38.440 poorly pled back that up with some some some evidence they got these four charges they're
00:09:43.200 charging with insurrection they charge it with sedition or seditious conspiracy now the ones that
00:09:48.620 these guys have been running around they look like they and i'm not a lawyer you are uh they
00:09:53.400 looks like they just kind of slapped together a pricey of the j6 uh committee which was an absolute
00:09:59.400 disaster and didn't sway the public whatsoever tell me about this indictment why do you say it was
00:10:06.540 it's it's very weak and and he could win in dc and you want to do it there for a number of reasons
00:10:12.040 one they have to prove beyond a reasonable doubt that donald trump believes that this election was
00:10:17.000 free and fair and that he lost the election but that he created this whole pretext of this this fake
00:10:22.460 story of a rigged election for the purpose of overthrowing the united states government um i think
00:10:28.360 that's a tall order i don't think they can do it they will also have to prove because part of the
00:10:31.740 defense will be no the election was rigged and stolen they now have to prove beyond a reasonable
00:10:36.720 doubt that it wasn't and the way that they pled it is just completely insufficient for example they
00:10:41.580 mention georgia and the video of the ballots being wheeled out after they kicked all the republican
00:10:47.180 observers out of the room and they start counting these secret ballots and they say in the indictment

00:10:56.940 well that's insufficient that just brad raffensperger saying you know everything here is fine doesn't
00:11:03.500 make it so and quite frankly we can see from the video it's not fine even if we assume that the
00:11:08.700 ballots are legitimate ballots that should have been counted they kicked all of the republican
00:11:13.500 observers out and did it in secret and georgia law requires both sides to have observers there so
00:11:19.020 even if the ballots were totally sufficient the manner in which they counted them was not and that for
00:11:24.540 that reason donald trump is perfectly fine uh for believing that there was a problem with it because
00:11:29.660 there was and you can go through everything that they cite you know reporters can kind of get away
00:11:35.260 with saying oh this has been debunked or oh this isn't true because they don't really have anybody
00:11:40.220 going you know challenging their assertions but when you're a federal prosecutor trying to prosecute a
00:11:46.060 president of the united states and you say you know the state farm arena video has been debunked
00:11:52.540 well no no it hasn't let's let's get into that let's subpoena brad raffensperger let's subpoena
00:11:57.500 state farm arena let's subpoena everything that happened to georgia because you want to say that
00:12:01.980 it's debunked but we've never seen the ballots let's see the ballots you know we're not just going to take
00:12:05.980 your word for it and uh i i think they will be surprised at the level of detail with which their
00:12:12.380 indictment is just flat out wrong okay why why did they not all the talk and all j6 and you know i think j6
00:12:20.300 tried to make a criminal referral maybe did about president trump they talked about insurrection
00:12:24.700 and seditious conspiracy and all this stuff why did they the charges themselves seem kind of bizarre

00:12:44.380 why why if jackson these guys have got the receipts why didn't they charge trump with what they always

00:13:00.380 want us digging into what actually happened on january 6th because of course if they indict donald trump
00:13:05.740 with inciting an insurrection in the capital violence we're going to say okay well how many federal
00:13:09.340 officers did you have their show us all your emails how many uh intelligence agencies were working with
00:13:14.620 non-government groups non-government actors that were involved in inciting this insurrection and
00:13:19.420 why don't you why don't we air all of the footage for everybody and why were the capital police
00:13:23.420 instructed to stand down you know i you and i both served uh in the military we know standard operating
00:13:29.180 procedures for the escalation of force i've trained troops in combat on the escalation of uh force
00:13:34.380 procedures and they were not followed on january 6th why weren't they followed why did the cap police
00:13:39.260 capital police stand down and not use the you know the proper protocol to control this crowd because
00:13:45.420 they had plenty of resources to do it why didn't they and they don't want us asking those really
00:13:50.380 inconvenient questions and so uh quite honestly i think that's why they didn't charge it
00:13:57.180 uh talk about this what they did charge him with particularly the government procedure the
00:14:00.860 government proceedings isn't that didn't they have to kind of concoct that in the first place
00:14:05.180 with the trial some of the j6 defendant yeah they did that'll be an interesting uh you know the the
00:14:11.500 trial attorneys are going to have an interesting um time with that i'm sure there will be motions
00:14:15.660 filed on that that's a that's a statute that was designed for government proceedings for destruction of
00:14:21.180 documents uh for i'm sorry i say government um business uh when businesses are trying to you know
00:14:25.900 prevent the government from detecting fraud it was never intended for physical violence or
00:14:30.700 for any type of uh you know physical activity other than destroying records or preventing uh you
00:14:37.260 know tapes and and records of business proceedings this had nothing to do with violence um so they
00:14:45.100 really did try to shoehorn that statute into this january 6th scenario that the statute was never ever
00:14:53.100 even closely intended for that now they've gotten away with prosecuting other january 6th defendants
00:14:58.540 for that but the other defendants were not the president of the united states and the likely
00:15:03.020 future president of the united states so i think uh the courts are going to have to look closer at that
00:15:08.060 and quite honestly jack smith is treading on thin ice with that because if it's thrown out for donald
00:15:12.860 trump it's going to be thrown out for i believe some 300 other defendants who have already been convicted
00:15:17.980 under it so um i i really think that this is going to be really interesting i know people have a lot of
00:15:23.180 concerns about the the venue and say oh no are they going to you know shove this down our throats i
00:15:28.700 don't know that they're going to be able to it's so poorly pled and it's on such thin ice and quite
00:15:33.660 frankly we're going to be going through a lot of discovery i know cash patel has been talking with
00:15:36.780 you about um his excitement about the subpoena now finally gaining subpoena power and i'm excited
00:15:42.140 about that too let's look into it because i've got a lot of questions about what happened in 2020 that
00:15:46.460 we haven't been able to get access to because no federal court has been willing to give us subpoena
00:15:51.500 power to actually look into the various procedures in these states in 2020 let's do it let's look
00:15:57.180 into it let's see what they've got when in uh we're going to double back on that in a second just
00:16:03.660 given the scale of this and they've already kind of tried to rush it you know jack smith you know

00:16:19.980 just given the defense and what trump want to look into about all the steel in pennsylvania

00:17:11.180 worried about it either way i i do think a normal trial schedule will push this past the election

00:18:13.420 yeah the trial itself could take eight months you know maybe even a year a year is a really long time

00:38:07.680 That's why they've been targeting this to try to do two horrible things.
00:38:11.300 They want to enshrine abortion into the very state constitution without minors even having to tell their parents.

00:38:31.480 So what our side did is we have a special election prior to November, which is our best chance to stop crazy changes like anyone could want to do if the threshold of the constitution is so small to make a change, which it currently is right now.
