00:11:19.980 count they languished in that dc gulag some of them for two years before they went on trial

00:12:57.980 the line prosecutors who brought it and the 18 federal judges in washington who put their stamp of
00:13:05.660 approval on this vindictive uh and wrongful prosecution
00:13:11.260 well we have to make we will make those judges and the doj officials we'll make them famous

00:13:22.300 the destruction of these families the destruction of these prisoners is not acceptable it doesn't

00:15:34.580 what is the reality with the prisoners that were under this uh in this alone or just had some other
00:15:40.480 misdemeanor are they being released right now well you have to file a motion with your judge uh asking
00:15:46.980 for release from prison some judges have already released a few j6ers so it's a little bit complicated
00:15:53.240 but let's say you were convicted or you took a plea deal for obstruction and the four common
00:15:58.180 misdemeanors well the obstruction charge really drives your sentence right so let's say you were
00:16:03.360 can you're sentenced to 30 41 50 months in prison on the obstruction but you also had prison time
00:16:11.920 assigned for the misdemeanors so these defendants have been going to the court already saying okay if
00:16:17.860 you drop if fisher overturns the obstruction count which they have uh based on the misinterpretation
00:16:24.920 of the statute uh okay well i was convicted of these other misdemeanors so now i should be out
00:16:31.160 of prison because i've already served 12 13 14 months so judges have released some of them but then
00:16:38.000 other judges have come back and said well okay but if you ask for resentencing and the obstruction
00:16:42.680 count is then dismissed by doj or i drop it or whatever happens and you still have convictions
00:16:48.100 on four misdemeanors now hear me out here two of the common misdemeanors punishable by up to 12
00:16:54.700 months in prison the other two up to six months what the judges have said now that usually runs
00:17:00.140 concurrently right so they're saying 12 months max for all of them you're going to serve 12 months
00:17:05.120 some judges have said if you come back and ask for resentencing the obstruction count goes away
00:17:10.960 you're already in jail we're going to now stack that sentencing meaning you're going to it's going
00:17:17.640 to be consecutive not concurrent so they will still try to keep these people in prison for three years
00:17:24.140 on misdemeanors parading in the capitol being on restricted grounds because mike pence was there as a
00:17:30.380 secret service protectee i mean there are judges who will triple quadruple down on this instead of
00:17:37.480 saying okay look we did this we tried we thought we were doing not the right thing they knew that
00:17:42.700 they were working hand-to-glove with the doj to turn these people into lifelong felons
00:17:46.400 so now you're going to still keep them in prison re-stacking their sentences when that's nothing that
00:17:54.340 the district court ever does the chief judge former chief judge barrel howell admitted that
00:17:58.340 she said we don't really do this stacking sentences but we might do it in this case
00:18:03.400 so they will never admit error they will never seek some sort of you know where they will tell
00:18:12.960 these j6ers you know we were wrong this was an error by the court no some of them are going to do
00:18:18.800 whatever they can we even see signals from the doj because this ruling today said that the to find
00:18:27.220 someone guilty of this 1512 c2 has to involve evidence impairment destroying a record mutilating
00:18:33.920 a document or shredding a document which was the origin where this originated in enron the doj has
00:18:40.480 signaled in jack smith that they will say the electoral college certificates that these j6ers never
00:18:47.580 touched they never saw they didn't try to steal them out of the hands of people who were carrying them
00:18:53.540 into the joint session of congress that day that those electoral college certificates represent a
00:19:01.280 record or document in an official proceeding and still try to make this count stick jack smith has
00:19:09.560 said the same in the j6 case against donald trump 1512 c2 half of the indictment two of the four
00:19:16.600 accounts in that indictment related to 1512 c2 that either the electoral college certificates or as he
00:19:22.500 mentions in his indictment the fake electoral certificates that happen every four years
00:19:28.060 somehow that represents tampering with evidence so this is how unbowed for the most part we know doj will
00:19:36.260 be the question is will the judges continue to go along with this charade this life destroying charade
00:19:42.800 simply to protect their own reputations their own turf and refuse to um uh recompense for for what
00:19:52.200 they've done in aid of the destruction of these people's lives

00:21:01.120 proceeding so after getting after getting slapped after getting slapped like this or even uh judge
00:21:07.360 brown jackson uh wrote a concurrent opinion she was part of the six to three on the good guy side
00:21:13.980 you think they'll still try to play i guess we'll have to watch msnb tonight and re melbourne because i'm
00:21:18.500 sure they already weissman's already you know thinking this through about what they're going to do but
00:21:23.020 you honestly you honestly think that they're going to still stick with this charge i i do i think
00:21:29.460 there's probably a really good chance that they will and i think katanji brown jackson even though
00:21:33.720 she did concur at the end of her concurrence she mentions these electoral college certificates as
00:21:40.660 potentially records that could meet this element in the 1512 c1 c2 statute so in a way she kind of set
00:21:50.660 up jack smith and maybe even the oj going to these judges saying well here she suggests that these
00:21:58.100 certificates could represent some sort of record or document so there's still a lot that could happen
00:22:06.120 here but when you're talking about your regular j6 defendant joseph fisher in this matter who entered
00:22:12.640 the capitol stayed there for four minutes after the joint session had long um recessed how are they
00:22:18.900 going to prove that he tampered with or impaired electoral college certificate or any kind of document
00:22:25.940 so but going back to special counsel jack smith after seeing him look the guy was overturned 8-0 in the
00:22:34.080 mcdonald conviction he was completely overturned there he doesn't care for he is just an apparatchik
00:22:41.800 a democratic party apparatchik he knows there's no consequences for him there's no consequences really
00:22:47.840 in court i mean that's why they're going after judge cannon she's the only one holding him and his team

00:24:04.520 this decision but others putting her imprimatur as the chief judge on using this 1512 c2
00:24:11.080 charge against january sixers other judges who have done it including those especially those steve who
00:24:18.580 kept americans in pretrial detention in the dc gulag on this count alone and that will be trump
00:24:25.900 judges it will be clinton judges obama judges amit mehta who applied a terror enhancement for the
00:24:34.080 obstruction conviction a terror enhancement to sentencing those judges at least a handful should
